I was looking around the immgration website and saw that I qualify for a fee waiver. My question is, has anyone used this before and does it have any impact on things later on, ie when they require proof of income for sponsorship. One of the ways to qualify is if one has used a federal assistance program in the last 6 months - which I have since I was hardly working the last few months. But I just got a GREAT job and will be above the needed income level to sponsor my SO when it comes to that time. I just wonder if they are going to look back and see that I had the fee waived and then either demand money from me or think that I am lying about my income when they evalute for sponsorship. If I apply for the fee waiver and am granted it, it means that the paperwork will be submitted a month earlier because I have to build up a savings right now and it will take a month before I will have enough to pay the fee.


I have seen several member talk about trying to use the fee wavier, never heard of anyone getting it. Last person I know of who asked at infopass about fee wavier was told that if they could not pay the fee how were they going to support their SO. If you were to apply they would be looking at your income as it is now as well as any income in the past.

That is because the 1-800 line is known as the miss-info line, they are not immigragtion officers thay are call center staff that can only answer basic question (and even then they get it wrong).

You should make an infopass appointment at your local office and request they contact the service center and ask for your EAD to be issued. You wont get it that day but they can find out if there is a problem.

Thanks all for the congrats. I have all the original docs from my parents and the Police report is coming by 3 day mail from the UK so it should be here next week.

I have the I-864 filled out and the 2008 tax transcript and a letter from my employer confirming my salary and position and dates of employment. Is there anything else I need?

The DS 230's are already completed and signed I just have to date them and photo copy everything.

I will try phoning the NVC on Monday and see if they have got the cases yet and issued a number.

Hi all

My Parents I-130's have been approved, kicking.gif kicking.gif kicking.gif kicking.gif I got the NOA2 in the mail today. How long does it normally take for the NVC to get the case and to issue a case number?

I am in shock that it was approved so fast, it only took 22 days from the day they got them.

Any help at this stage would be welcome.

What type of updates I keep calling to see if we are recieved by NVC yet.Sometimes I speak with I think a live person but they always have the same answer 2-4 weeks and up to 90 days .I am wondering if we are lost in the shuffle,so many others are passing us by which is good .we would just like to get in. At least another step.

For anyone entering the USA on a CR-1/IR-1 visa you will be a LPR on arrival. The officer will stamp your visa to activate the I-551 temp greencard. That stamp in your passport is as good as the Greencard you will get in the mail. You can use it for work and for international travel before you get the greencard in the mail.

All you will need is the passport with the CR-1/IR-1 visa that was stamped at POE and one other form of photo ID.

I did not bother with the snail mail copy as the officer at NVC told me they do not need it if you emailed and got the auto response email back.

Yes you look good to go. I did not include photocopies and never had any problems. I did write the Case numbers on small post-it tabs and stuck them on all the original Docs.

The petitioner should phone NVC and ask about the case. NVC are no longer sending out letters by snail mail they are doing everything by email. so get the petitioner to phone NVC and get the case number and give them email addresses for both the petitioner and the benificiary.

We waited 2 weeks after case complete for my parents to get a interview date, They seem to issue most interview dates during the first 2 weeks of each month, but it depends on your embassy as to how long you have to wait, some issue dates faster than others..

I file jointly with my husband. I just sponsored my parents to come to the US. I did not get my husbamd to complete the I-864A as my income is enough to cover our household size. I sent 3 years of Joint Tax Transcripts with my I-864.

My parents were not asked for a I-864A at their interview. NVC never asked for a I-864A when they reviewed the I-864 that I sent.

You only need to pay one AOS fee $70.00, when you log into the payment site you will see that both parents cases are linked so you only need to pay once.

You will need to pay $400.00 for each parent when it comes time to pay the IV bill. Each parent will have a barcode coversheet that you print off once the AOS bill and the IV are paid, you attach the barcode coversheet to each parents papers and mail them together in the same envelope.

once you have the case number for your Mothers case talk to the NVC operator to make sure the cases are linked. You will know if they are because when you go to the AOS fee payment site and go to pay you will see that it shows both your Fathers and Mothers cases and says that they are linked. Once you have paid the $70 and it is showing as paid in one account it will also show as paid in the other account. You will need to print out both Barcoded coversheets, one from Mom's case and one from Dad's case.

dont panic it can take NVC 2 weeks to input the information into the system, same thing happened to us. we got a email RFE say they had not got the DS230 when I knew it had been delivered. A few days later they told me that they has the DS230 and it was under final review.

I don't know exactly what that petition is, or if it has economic or political reasons to be put in front of us. What I know is that VSC should have planned beforehand and organized themselves not to have such a big delay and disparity between them and CSC that is completely unfair. It doesn't matter if they have several other types of petitions to work on, they could have redistributed their tasks or even transferred more people to CSC. There is always a way to be efficient when you plan or have good management of unpredictable situations (which I don't think was the case). CSC seems to be working pretty fine even with the VSC tranfers they have received... So, there is a way to make it work. They just have to put effort on it!

Ah! by the way, someone mentioned something similar to this "election thing" in another thread a few weeks ago, but the discussion brought up the fact that it takes more than 1 month to process that petition, so at this point, people wouldn't be ready to vote anyway! So, why should they bother processing them right now since the people will only be able to vote on the next years...


This is so funny reading your posts, if only you had been around a few years back when we first started our journey you would have seen that everyone wanted to have their cases sent to VSC as they were the fastest of them all, they were never behind and all applications for the 100's of visa types were handled in a timely fasion. now things are diffrent and everyone is demanding the VSC should work on their type of case and let others sit waiting.

Have a look around VJ and see how long people who filed for Removal of Conditions are having to wait, well over 1 year. Look at how long people are having to wait for all sorts of benefits at VSC. Some of us at the end of our visa journey have been dealing with this immigration stuff for well over 5 years, so please just stop to think about what you are saying, yes everyone want their part to be approved as soon as possible and finds it frustrating to have to wait, but that is how it works. Some get approved faster than others and there is nothing you or the Ombudsman can do about it.

So pull up a chair and take a seat, you are in for a long ride.

The scenario you describe would indeed allow you to simply adjust status. You may do so before or after your I-94 expires without penalty because you married a US Citizen. The sooner you do so, the sooner you'll be able to work.

Your visa expiration is of no consequence. The I-94 is what counts here.



Thanks both! I apparently am new to all the immigration "terminologies"! My I-94 expires in December. My visa allows me for multiple-entry and is good for 10 years. So I am safe as long as the postal stamp/ the day I mail the package is before my I-94 expiration date? You can apply whenever you want but if you want to remain in status then you should mail your application no later than the day before your I-94 expires and send it overnight to the lockbox address.

It would be better to file for AOS before your I-94 expires, also you should not leave the USA even with Advanced Parole, as you could be refused entry.

You have not given enough information to get the correct advice. You say you were ina long term relationship and your profile showes you filed for K1 so what was your intent when you entered the US on your B1/B2 visa? when did you enter? and when did you decide to get married?

The I-94 card is the white card she filled out on the flight, It should be stapled in her passport.
