QUOTE (eau_xplain @ Oct 5 2008, 12:32 AM) <{POST_SNAPBACK}>
Today we got prematurely excited when we saw a letter from USCIS. We thought it was the interview letter already. Well, it turns out it's a "Case File Review Notice/Interview Document Check List". It's like an RFE but instead of mailing the documents in, I'm instructed to take the documents to the interview. But no interview date sad.gif

Has anyone else who sent in their N400 in August received such a letter? It's on yellow paper.

Sorry you got excited for nothing, we have not heard anything yet! hoping for an interview letter this month. At least you know they have been working on your case.

Can I ask what documents they are looking for?

US Citizenship General DiscussionFrom when do we measure that three year time span before applying for citizenship?
QUOTE (Johnny Spangle @ Apr 8 2009, 10:30 AM) <{POST_SNAPBACK}>
Sorry if this question has been asked many times before, but I've scanned information on this site and the web and I cannot find a commonly occurring answer. My question is about from when we measure the three years that must elapse before applying for US citizenship.

First some background. My wife is a US citizen and we have been very happily married for 4 years (our fourth anniversary is this weekend!). I was granted Conditional Permanent Resident status (the 2 year kind) in November 2006, and actual Permanent Resident status (the 10 year kind) in November 2008.

I have read in many places that one can apply for citizenship after three years as a lawful permanent resident, if married to a US citizen. However, do I measure that three years from when I was granted Conditional Permanent Residency (Nov 2006) or when I was granted Permanent Residency (Nov 2008)?

My confusion rests on the usual absence of the word "conditional" from the term "lawful permanent resident" when the three year period is stated.

Thanks in advance.

You can file for Citizenship 90 days before the 3rd anniversary of your LPR status. So for you that would be 90 days before the date in Nov 2009.

Look at your Greencard and you will see a line that says "Resident from --/--/----" add 3 years to that date and then subtract 90 days.

Here is a link to a date calculator that is good for working out the 90 days date. http://www.timeandda...te/dateadd.html

Hope this helps

US Citizenship General DiscussionN-400: Question about former passports....
QUOTE (AntandD @ Apr 7 2009, 12:07 AM) <{POST_SNAPBACK}>
Hi Everyone,

I'm in the midst of preparing my N-400 application and have been reading posts here on VJ about the N-400 process too.

Anyways, one of the items that have been mentioned is "previous and current passports", as a document that they require for the N-400 process and interview, regardless of if they are expired or still valid.

I currently have the following passports in my names:
-Canadian (valid, from 2009-2014, in my married name)
-Canadian (expired, from 2004-2009, in my maiden name, with an visitor's visa to the USA which I later adjusted to a US green card immigrant status)

However, I sort-of have another passport, under my parent's name:
-Birth Country (expired, in my parent's name, but with a page notation and photo with my particlars as a minor child in it many years ago, with an immigrant visa to Canada). As far as I know, I don't have citizenship and/or any other legal ties to this birth country now, so I cannot get another passport from that birth country, nor do I want to or intend to either.

So my question is: Do I also have to include that past Birth Country passport for the N-400? If so, will I have to show them the original, or will a copy of it suffice? Or will submitting only my Canadian passports original and/or copy suffice for this N-400 process, since Canada is my current country of citizenship and that these are the only passports in my name and possession?

The reason why I ask this now is that I don't have that birth country passport in possession with me now, as it is not mine. Therefore, if such is needed for the N-400, I will have to ask to "borrow" it from my parents, which could take some time to do beforehand, and I will have to do that as soon as possible...

Any thoughts, ideas, suggestions, etc. will be greatly appreciated. Thanks in advance for your help.

Ant (Still waiting for I-751, Still waiting for Baby...)

You only need the passports that have been issued in your name. My wife was included on her mothers passport years ago but this was not required at the N-400 interview. The interviewing officer only looked at the entry/exit stamps in her current passport and her original entry stamp in the passport that was in her maiden name.

Just take what you have and you will be fine.

US Citizenship General DiscussionOptions prior to getting citizenship... but maybe leaving US
QUOTE (Paul @ Apr 9 2009, 04:27 PM) <{POST_SNAPBACK}>
Hi there

I came to the US in 2005 on a fiance visa, married my American wife and we applied for my green card which came through in August 2006. In the next few months I will be able to apply for citizenship... (if I've read everything correctly)

...but I have a question and if anyone has any thoughts please let me know... what would happen if we had to move back to the UK (where I am from) and stayed long-term- how would we be able to return to the US? Would we have to start the process all over again for me? Would I be able to work or would I have to file for a work permit? (We don't want to move back but the work situation here is worse for me than it would be in the UK- but we don't want to waste the time we've put into getting me citizenship so we can come and go as we please).

If anyone could point me to any information about this admittedly quite vague question, I would appreciate it!

If you left before becoming a US Citizen then you would have to start all over again if you wanted to return to live in the US. You are so close to being able to file for Citizenship you would be better to wait and go back to the UK after you are a citizen.

Is there a chance the State Dept could deny a passport application if you dont't update your citizenship status with SSA first? The passport application states that they verify SSNs against lists of people ineligible to get a passport.

My wife will be chanigng her name when she naturalizes. Will that pose any possible problems with SSA or State?

My wife has not updated her SSN yet and she has her new US passport. So no they will not deny you if you have not updated your status with SSA.

My wife applied for her passport on March 7th 2009 with normal processing, as of yet she has not got the passport or her certificate back. She is now wishing she had paid for the expidited service to get the certificate back as soon as possible.

She still has to update SSA once it does come back.

But with the N-400, the USCIS doesn't know a damn thing about you, so you start the entire process again.

When you go for your N-400 interview they know everything about you. They have your entire immigration file infront of them, with all the information you have supplied to USCIS over the years.

I got a temporary permanent resident (GREEN) card on December 31st 2007. It is only a two year card after which I thought I could get citizenship. Having read some information here and read other information online it looks like I can't apply for three years?

I am not being lazy - just worried that I have made a mistake somewhere - why would my card expire before I could get citizenship - is this normal?
Can someone show me a link to a normal timeline?

Thanks in advance,

Phily

You need to file to remove the conditions on the Greencard, that is why it is only valid for 2 years. see the guide for full details of what you need to do to remove conditions.

http://www.visajourn...p;page=751guide

Once you have been a LPR for 3 years and you meet all the other requirements you can file for Citizenship, BUT you must file to remove the conditions at the right time before you can do anything else.

Our attorney advised way back then that my wife file an I-864A since her daughter was also involved, my wife had no problem with that. The I-864 does expire at USC, but also with so many work hours, recall around a ten year period.

They really want to make sure if you come here legally, you are not a burden to any type of welfare agency, either public nor private. But we sure can't say the same thing about illegals coming here. This really hits home when you hear about families that kicked off of their health insurance policies when they have a kid with a precondition, just pray that doesn't happen to a kid you brought here. Also hits home when your governor claims next to education, his highest bill is for Medicaid, we know of a lot of kids born from 14 year old illegals that have kids on Medicaid. The laws are working against those that obey the laws of this land, that isn't right.

Please do not turn this thread into a lets bash the illegals I just posted my expirence yesterday at the SSA I did not intend for it to go downhill into lets blame illegals for the state of the USA.

Thanks to all who read my rant at the SSA.

Hmmm... Maybe it might be best to get a passport first before going to SSA or DMV...

My wife already has a passport and there is nothing to update at the DMV, she just has to check the Citizens box next time she renews her DL.

Having a Passport would not have stopped the guy asking for a Greencard.

US Citizenship General DiscussionGood Old SSA
My wife just went to our local SSA office to update her SSN status to that of Citizen. She took her certificate and a completed SS5 form. The guy looked at all the forms and input some info in the computer system asked wife for secondary ID, so she handed her State DL he looked at this and then asked her for her GREENCARD!!!!!! The wife explained she is now a Citizen and does not have a Greencard, The guy got a bit heated and insisted that she must have a greencard and if she did not have it she would have to come back another time with it before he could update her SS records.

My wife asked to speak to a Supervisor and the guy told her that a supervisor would not be able to help, at this point my wife got a bit anoyed and demanded to see the manager. A lady came over and said she was the manager and how could she help. My wife explained that she was updating her immigration status to a Citizen but the officer was demanding a GREENCARD. The Manager said she would need to check with someone else and went off to make a phonecall.

When she came back to the window she said that they could accept it application to update without a Greencard as long as my wife had anoth form of ID.

I can not belive that these people do not know the basics of their job. What a sad sad state our country is in.

As wife was walking away from the window the guy shouted that she would recieve her SSN in the mail within 6 weeks?????? #######!!!!!!

Oh well I guess things will never change.

Thank you so much for all the responses.
Will the passport signature need to match the signature on the Nat. Cert?
Thanks again!

Since the middle name says if applicable, I would be tempted to leave it blank or type in some ----- .

When we filed for the passport, used the same name as in the certificate, so requested that my wife sign that the same way. LOL, she gets stubborn about that, don't know why, but has developed a very unique artistic signature, just said, save that for everything else. But her full signature is on our marriage certificate, judge told her to sign it that way, she didn't argue with the judge. rofl.gif

My USA Passport lists my middle name but I did not sign it with my middle name, just my usual everyday signature, same with my marriage certificate, just my usual signature. so I dont think it makes that much of a diffrence. nobody has every questioned the way I have my passport signed and why would it need to match your citizen certificate you wont have your certificate with you when you travel.

US Citizenship General DiscussionSignature on Naturalization Certificate
My wife had a private oath ceramony so she was able to have a 1 to 1 discustion with the USCIS officer that had to attend the oath ceramony, The officer told her that she had to sign the certificate "Susan Jane Doe" not her usual signature of "Susan Doe". The Photographs she had to sign on the day of her interview were just with her usual signature "Susan Doe".

US Citizenship General DiscussionAdditional documents or not?
We sent 3 years of tax transcripts and our latest mortgage statement. that was all.

We did take additional stuff with us for the interview including our e-tickets from our trip to the UK for Christmas and that was all the officer asked to see.

NO RFE's

US Citizenship General DiscussionWhat constitutes Government issued photo identification?
She is going to need that State ID once she has become a Citizen as she will no longer have a greencard to show as ID and she will not be able to carry around her certificate. She could carry her US Passport once she has it but a State ID will be so much easier.

Good luck at the interview.

Europe & Eurasia (except the UK and Russia)POE Dublin to Chicago
QUOTE (KoPoda @ Jun 13 2009, 12:49 AM) <{POST_SNAPBACK}>
So my husband had his papers taken at the Dublin POE. Does this mean that in his AOS paper work we have to put Dublin as the port of entry?? Or do we put Chicago the airport he arrived in?? Technically Dublin Immigration was US soil so that is what we should put down but I just don't know. Any help??!

Yes put Dublin down as his POE. I went through Dublin years ago and my Parents will be coming through Dublin in Aug when they move here for good.

Can you give some details of his experience at Dublin that I can pass on to my parents.

My Green card has on the top Lastname<< Firstname<<Initial at the bottom it has, Lastname<< Firstname<< Middlename, My SSN card shows Firstname Middlename Lastname.

This has not caused any issues at all.

It would be very unlikely that you could get him a work visa unless you can prove that there is nobody else in the USA that is qualified to do the job. a family based visa would be your most likely route and your wife would need to be a citizen to file for him. the wait time for a sibling is many many years. so itsa not going to happen any time soon. you are looking at 20 + years.

i agree with you to have my parents send the paper work to me.
do you remmeber the instructions od sending the paper work when you receive the ds230'package?
since I am moving ahead of time, I kinda guessing the instructions would ask to send to NVC.

QUOTE (lindal24 @ Oct 19 2009, 01:45 PM) <{POST_SNAPBACK}>
In my case, I filled out the DS-230, emailed it to my husband, had him print it out and sign it, and since my brother was there at the time, had my husband send the signed, completed form back with my brother when he came back to the states. When I got a hold of it, I sent it off with tracking/confirmation. I don't know about submitting it directly to HCMC consulate--maybe someone who has experience can answer this...

...I heard about signing on behalf of spouse, but I don't know about parents--I didn't sign anything on behalf of my husband though in fOear that it would be denied or something.

...I'd recommend to just have your parents sign it and send it to you to be on the safe side...they've waited this long already, what's another couple of weeks?! But find out if submitting to the HCMC Consulate is an option...

The paperwork that is needed for the DS230 MUST be submitted to NVC it is not optional. You will find more information and others who are filing for parents HERE

Africa: Sub-SaharanFee Waiver
QUOTE (WhidbeyGirl @ Dec 14 2008, 11:22 PM) <{POST_SNAPBACK}>
I was looking around the immgration website and saw that I qualify for a fee waiver. My question is, has anyone used this before and does it have any impact on things later on, ie when they require proof of income for sponsorship. One of the ways to qualify is if one has used a federal assistance program in the last 6 months - which I have since I was hardly working the last few months. But I just got a GREAT job and will be above the needed income level to sponsor my SO when it comes to that time. I just wonder if they are going to look back and see that I had the fee waived and then either demand money from me or think that I am lying about my income when they evalute for sponsorship. If I apply for the fee waiver and am granted it, it means that the paperwork will be submitted a month earlier because I have to build up a savings right now and it will take a month before I will have enough to pay the fee.

I have seen several member talk about trying to use the fee wavier, never heard of anyone getting it. Last person I know of who asked at infopass about fee wavier was told that if they could not pay the fee how were they going to support their SO. If you were to apply they would be looking at your income as it is now as well as any income in the past.
