I just had a look at the proccessing dates for Boston office and the site says updated Oct 19th 2008 But when you scroll down to read the application numbers and the dates it says " Proccessing Dates for Boston as of Aug 31st 2008, so they are out of date already..

1. What is with this CONDITIONAL permanent residency a.k.a. green card I keep reading about. It seems like this should have been awarded her once we were married and the folks at the American Consulate in Milan didn't mention it. What do I need to do to get this for her AND is it possible they'll back date it?

OR was I supposed to know about this entire CONDITIONAL permanent residency and have applied for it immediately after the marriage took place (it was performed here in Italy). BLAH!

2. While reading "A Guide to Naturalization" I'm seeing two different things. One is that my wife must remain in the United States for 18 months of the 3 years for which she will be granted a "green card." I am also seeing that at least in some cases it is possible that the foreign spouse can leave the country for up to 364 days and return. In addition to that it says that those 364 days can be credited towards my wifes continuous physical presence going towards satisfying her permanent residency requirement of 18 months within the 3 years. This would be optimal if possilble because my wife works for the Italian state and we'd prefer to actually move to the U.S. in another year and a half at the earliest. In this case we could come over for a month, leave for 364 days and then return and already have 1 year and 1 month credited to her continuous physical presence in the U.S. I'm sure it's not possible, because it seems they want to make this so complicated especially when I compare it to my requirements for acquiring Italian citizenship. Please tell me it is possible! unsure.gif

She can not become a citizen until she has been a perminent resident in the USA for 3 years. Tou will need to apply for a spousal visa to bring her to the USA this could be a K3 visa or a CR1 visa, you can read about the diffrent visa's here on VJ, look for the Tab at the top of the page that says GUIDES. Once she has been approved for whatever visa anc come to the USA, If she entered on a CR1 visa she will get her Greencard withing a few weeks. If she entered on a K3 the she will need to apply to Adjust her status that will take about 5 - 12 month to be approved and then she will get her Greencard. She has to apply to remove the conditions for her greencard (as you have been married for less than 2 years) where you have to prove that you are still married and the marriage is real. once that has been approved she will be able to apply for citizenship about 12 months later as long as all the conditions are met.

So its not just a case of applying for her to be a citizen. Sadly being married to a USC does not give her the right to move to the US or become a citizen until she has been approved for a visa and has moved to the USA and then removed the conditions on the greencard due to being married for under 2 years.

If you have a pending I-751, it would be a good idea to call USCIS and confirm address change.

We had an incident where my son sold an old motorcycle to a college classmate for 50 bucks, the kid never registered the cycle, son just signed over the title. Two years later, he gets a fine from Madison, they found the bike abandoned and hit my kid for a 800 buck fine. He gave the police the name of the kid, but that wasn't good enough for them, they wanted his current address, took us a couple of days to find that. That taught us never to sign over a title that just about everybody does, but to back it up with a notarized bill of sale with full name and current address. The DMV does not warn this, and the police couldn't find anybody if that person was right under there nose. We either had to find him or pay the fine, we found him.

USCIS is that way also, ha can't even find a file on their desk at times. As typical with USCIS forms, they never come out in plain language and state exactly what a form is for. I-865 is such a form, but we all had to sign an I-864 to bring our spouses here, but this form infers that you may have sponsored someone that does not live with you. So as the sponsor, have to tell them exactly where you are.

I am no legal expert on this, but seems that if your spouse is living with you, the AR-11 should be sufficient for an address change, it appears that the I-865 is just to inform the USCIS where you live if you sponsored a person with an I-864 that doesn't live with you, others may want to comment on this. Was told by our attorney to keep a copy of the AR-11 handy in case we move, but he never mentioned the I-865, but I suppose if you are separated or divorced and your spouse is not yet a USC or meets the other conditions for I-864 dependency, you would have to file an I-865 so they can come and get you if your former spouse seeks state or federal aid.

Seems like just about everyone takes the I-751 seriously except the USCIS, still have bad feelings on that event, letting that one year extension expire because of their excessively long uncalled for delays making you panic for an infopass appointment and the like just so you can keep your job. And in many states including ours, keep your driver's license. If you forget to file, you can be deported, if you do file precisely 90 days in advance, get that stupid extension notice that means carrying two pieces of paper with you and you can't lose either one.

Still very bitter about this which is one reason we instantly applied for USC at the very earliest date, and they sure in the hell don't remind you to renew your ten year card, like you have a calendar that goes out that far. I posted my wife's I-751 filing date on our refrigerator door, got tired of looking at it. But after that is was following through, they don't tell you #######, but awfully damn quick to cash your check. Not a damn reason in the world they cannot issue that ten year card that use to be a lifetime card within the 90 days they ask for.


thank you very much for the clarification...my hubby and i are living together so i think ar11 is fine it shows the confirmation number in it..we decided if we didnt hear anything by february 08, 90 days before my extension expire I will file for n-400...i hope anyone here tried this kind of arrangement and become a citizen without a problem, please tell me if it is possible




No you are not fine. Your sponsor must notify USCIS that they have moved. Your husband need to complete the I-865 it is a legal requirment it does not matter if they are living with you or not. The instructions clearly state it should be completed by the sponsor within 30 days of changing address.

To be able to file under the 3 year rule she would have to be still married to the USC and still living with the USC, as she is now divorced she can not apply for citizenship until she has been a LPR for 5 years and meets all the other conditions of citizenship.

Update your address when you go for your interview, just take a AR11 with you and the interviewing officer will be able to update your address on the system.

It would be an IR1 and yes if you meet the conditions you can file from London. Last time I checked it was about 8 months to a year for IR1

If you move back to the UK and give up your residency here in the US then you would have to start all over again with a spousal visa if you wanted to come back to live in the US.

If you were to apply for Citizenship you would have to be living in the US while it was being processed and that can take up to 12 -14 months depending on where you are, but once you had citizenship you could move to the UK and then return without having to file anything. Just remember that you would need to file a US tax return no matter where you were living.

I went to infopass appointment yesterday at Boston office as I had noticed people getting interviews that filed a month after me. I was told that they will not schedule an interview before the 3rd anniversary of LPR so as my 3rd anniversary was only on Nov 9th I have to wait for interview, but they were able to tell me that everything is cleared and all ready for interview and it should be in Jan.

All you can do is take the photocopies of your passport to your interview and explain what happened to your passport. Did you report the loss to the police? if so did you get a crime number or report, you could take that to your interview as well.

You can apply for Citizenship 90 days before the 3rd anniversary of your LPR and that is what we did. We sent the application on Aug 11th 2008 and the 3rd anniversary of the LPR was on Nov 9th 2008.

I do know that some offices will conduct the interview before the 3rd anniversary but make you wait for the oath ceremony until after the 3rd anniversary but the officer told us yesterday that in Boston the will not schedule your appointment until after the 3rd anniversary.

We hope to hear in the next few weeks about an appointment. The officer did say it would be in January.

Yes you will not be allowed to enter on a EU passport unless you have a valid visa and as a US Citizen you can not get a visa to enter the US you need your US passport. Dual Passport holders MUST use their US passport to enter the USA.

You do not have to file for Citizenship as soon as you are eligible. You can file at any time after you become eligible. Check the USCIS website for the current fee.

Had the interview today and here is the report:

We arrived at 8:10am for the interview booked at 8:30am, We had to hand in the interview letter at window 1 and then take a seat. The wife was called along with 4 other about 10 minutes later and asked to follow the officer, we were taken to a smaller waiting area and asked to take a seat. 5 minutes later the same officer called the 1st person and they were only in the room for 10 minutes then my wife was called.

The officer was David Voo and he explained that he was going to give the Citizenship test and then she would be interviewed my another officer. I was allowed to be with her the whole time.

Officer Voo asked to see her Greencard and then checked her details on the file he had in front of him. He asked is she has studied the old or the new test and she told him the old one, he explaned that he would be asking question that applied to both the old and the new test. He then started the test. She was asked the following questions:

1. How many stars are on the US flag?

2. What is the minimum voting age in the US?

3. What happened on 09/11/2001?

4. Who was the first President of the USA?

5. How many stripes on the US flag?

6. Who is the President of the USA today?

She was then asked to read the sentance "A US Citizen has to be 18 years old to vote"

She then had to write "US Citizen's can vote"

My wife could not belive how easy the test was, she had spend hours going over all the hard to remember one just incase! Officer Voo then said Congratulations you have passed the Citizenship test. He handed her a slip of paper and told us to go to room 160 and wait to be called for the interview.

We waited 15 minutes before we were called by Officer Davoy, We went to room 15 and after my wife raised her right hand and swore to tell the truth we were asked to sid down. Officer Davoy was very friendly and put her at ease very quickly. He looked through her folder and then asked all the Yes/No questions, He then asked if we had been out of the US since she had filed the N-400, my wife explaned we had taken a trip to England at Christmas time and that she had brought our flight Itinery for him to see. Officer Davoy looked this over and made a note of the dates then handed it back to my wife.

He asked if we were still married and living together and we replied YES, my wife said she had brought lots of evidence to show him like joint utility bills, joint insurance details, joint bank accounts and our tax transcripts for the last 3 years and also a full copy of this years taxes that we filled just yesterday. Much to my wifes disapointment he said he did not need to see any of it. He then explained that they have just digitized my wifes immigration records and he needed to call them up on his PC and just check a few things. Well he had problems logging into the PC and ended up having to call their tech support to get instructions on how to access the file, so that held things up for about 10 minutes but it was ok. He checked her security checks and her entry/exit information (we could clearly see the information on the screen, it showed her exit and entry dates at each POE for every entry she has ever made to the USA going back to 1992!!) He then started to check off thinds in red ink and then put a big "APPROVED" stamp on her file.

He explained that we needed to go back to the waiting room and we would be called to sign her photos and pick up the Oath letter telling us where and when it would be.

He thanks us for our patience and said Congratulations. We then returned to the waiting room and were called to the desk about 10 minutes later to sign the photos and we were given a bright pink letter telling us to be at Faneuil Hall on March 26 2009 at 12.00.

We left the building at 9:50am.

So happy that we are almost done.

Well the day has finally here, The wife has her interview at 8:30am today, she spent ages going over all the questions last night and double checking her evidence folder to make sure she has everything she thinks they could need. She even had me do this years taxes this weekend so she could take the 1040 and the e-file acceptance receipt with her. blink.gif

Had my N400 yesterday. Was at the Charlotte DO for about 2 hours total. Actual interview was probably 10-15 minutes. The IO was very nice and very professional. Was given the English and civics test first. Questions asked were:

Congrats on a good interview, you are almost done. I have not heard anything about an interview date as of yet. I think it will be Jan or Feb before I get my interview.

Well I have just made an infopass appointment at my local office for next week, as I was reading the post for people who filed in Sept 2008 and I see that at least one person from my local office who filed more than a month after me has an appointment for their interview in Dec.

So I am going to go ask why I have not heard anything. I worry that the interview letter has got lost in the mail.
