Removing Conditions on Residency General DiscussionShould we reschedule our biometrics appointment?
QUOTE (poetrywriter @ Aug 25 2008, 03:31 PM) <{POST_SNAPBACK}>
We went to the Embassy about 2 weeks ago because my husband's passport expires Sept 15, 2008. Little did we know that they had to send in the old passport so we could get the new one. They said it would take 2-3 weeks to get the new passport in the mail. Today, we got a letter to do the biometrics for the I-751 and we have to be there on Sept 4. What if we haven't received the new passport by then? Should we ask for another appointment?

You do not need his passport to do Biometrics, all you need is his greencard. no need to reschedule.

Removing Conditions on Residency General DiscussionConditional Greencard Expired
Once your application to remove conditions has been accepted you will recieve a extension letter (NOA) that will extend your greencard for 12 months, That extension letter and your expired greencard are all you need for work and travel.

YOU WILL NOT BE DEPORTED OR PLACED INTO REMOVAL PROCEEDINGS, you have filed the correct paperwork so all you need to do is wait for the NOA to arrive.

You need form AR-11 and yes you can do it on line at the USCIS website, you need to do it within 10 days of moving address and dont forget that you spouse also need to complete form I-865 as sponsor and this needs to be done by mail within 30 days of the change of address.

You need to do this everytime you move from now until you become a citizen.

I am thinking to file the N400 on 12/12/08 (the day i become eligible). The problem is that what if i didn't receive the 10 year green card yet by then. Can I still file N400 anyway, or do i have to wait for it.

Also about the new test, anybody know detail infomation about it? are we gonna have the test the same day as the interview or what? How can we be well prepared for it?

Yes you can file for the N-400 before the removal of conditions has been approved, in fact that is the only way of forcing USCIS to make a desision on your case.

All of the new questions for the test are available on the USCIS website http://www.uscis.gov...0004718190aRCRD

you can study from the list of questions there and also when you go for your biometric after you file the N-400 you will be given a booklet with all the questions in it. The interview includes the test, so yes it is all done on the same day.

Lady applies for removing conditions. During the processing time hubby divorces her and divorce is final before she gets the 10 GC WITHOUT interview.
Should she let it fly? Take the 10 GC and run? Will something pop up if she applies for US citizenship?
Is it fraud not reporting the divorce during the ongoing processing? What if she doesn't apply for USC at all?
Maybe have problems when she tries to renew?

If she applies for Citizenship she will have to provide a copy of the divorce papers and it will be found out that she was granted unconditional status based on a marriage to a USC without filling for a wavier, they (USCIS) may well revoke her Greencard as it was granted fraudulantly. She would be much safer to be honest and file based on married in good faith.

If she does not report it she is commiting fraud.

Make an infopass appointment and ask then to check the system and also ask for the I-551 stamp in your passport so that you will not have issues when you travel.

Also when you go for your Biometrics be sure to check they have the correct spelling in the system, We were asked to check all the details on the screen when they had finished taking the prints.

Hi! I'm almost 30 weeks pregnant and I have not received my biometrics appointment for my I-751 application. I sent my application last week of August but I have received my NOA1. I called USCIS a week ago about me not receiving the biometrics letter and they sent a request to CSC to send another appointment letter because it might have been lost. The representative told me that an application should've received appointment within 30 days from the Notice Date on I797C Notice of Action.

Now, I'm almost 30 weeks pregnant and my doctor told me I should not travel more than an hour starting 34 weeks. My place is almost 4 hours away from the office where they perform fingerprinting. I'm getting worried because I might receive the letter from USCIS after my 34th week (Because USCIS Representative told me to wait 45 days for letter).

Any ideas? wacko.gif

I would make an infopass appointment at your local office and request a biomertics appointment before your 34th week, take a letter from your doctor. They may be able to do it the same day!

An unrestricted SS card with driver license satisfies the requirement of the I-9. The employer cannot discriminate and ask for a specific document, it is against the LAW.

Here is the wording from the employers handbook.

http://www.uscis.gov...ments/m-274.pdf
QUOTE
Types of Employment Discrimination Prohibited
Under the INA

Document Abuse

Discriminatory documentary practices related to verifying the
employment eligibility of employees and the Form I-9 process
are called document abuse. Document abuse occurs when
employers treat individuals differently on the basis of national
origin or citizenship status in the Form I-9 process. Document
abuse can be broadly categorized into four types of conduct:
1) improperly requesting that employees produce more
documents than are required by the Form I-9 to establish the
employee’s identity and work authorization; 2) improperly
requesting that employees produce a particular document,
such as a “green card,” to establish identity or work eligibility;
3) improperly rejecting documents that reasonably appear to
be genuine and belong to the employee presenting them; 4)
improperly treating groups of applicants differently when
completing the Form I-9, such as requiring certain groups of
employees that look or sound “foreign” to produce particular
documents the employer does not require other employees to
produce. These practices may constitute unlawful document
abuse and should be avoided when verifying employment
eligibility. All work authorized individuals are protected
against this type of discrimination. The INA’s prohibition
against document abuse covers employers with 4 or more
employees.

All you need to show is an unrestricted SSN and a State DL or State ID, you do not need your extension letter or anything else. The Employer can use the E-Verify system to check if you are authorized in the same way they would for any other employee.

Your employer has no right to ask to see your greencard, all they are allowed to do is ask you to redo your I-9 form and for that all you need is a state drivers licence or state ID and a unrestricted SSN.

It is against the law for them to demand a Greencard.

Hi all:

My wife and I moved from our previous address [where we still receive mail] out of state for school. We never submitted a change of address form because a) we knew we'd be moving fairly frequently and cool.gif we read about others whose change of address screwed up their entire process. Now the time is coming for us to submit our I-751 and I'm getting a bit worried, as all of the evidence we will be submitting will be based on our current address. Is this going to cause a problem?

We don't really want to submit a change of address form since we're planning on moving again in the next year [it will be the 3rd time in 3 years], but we can do it before we submit the I-751 if we need to.

Thanks in advance!

You are required by law to notify USCIS each and every time you change your address. The Greencard holder has to file form AR-11 within 10 days of changing address and the Sponsor has to file form I-865 within 30 days of changing address, it is not optional.

I would submit these forms as soon as possible and when you move again be sure to submit the forms you are required to in a timely manner.

Hello,
We have not received the biometrics letter and have filed in January 2008. About a month ago I called the Vermont service center and was told that they were going to send me one. They even gave me a reference number and the actual EAC number. Well, nothing came. So, today I called and the lady did not want to hear about the previous call. She said that my appointment was in February for the biometrics. Something the gentleman from a month ago did not mention or did not see on the system. I explained that we have never gotten one. She kept quoting things from the letter, even though I told her that we have never gotten the letter. She said that I would need to check the ACS office page and call them for another appointment. Well, the ACS office page tells you to not show up without an appointment, let alone no biometrics letter to be stamped, etc... The ACS page tells you to call the national service center. I called the NSC again and got the same lady, lucky me. She told me the same thing again and then went to talk to a supervisor for a while as she did the first time. She came back to tell me, to do an infopass and as I explained to her that I was looking at the infopass, but I do not have a letter from them that tells me to do an infopass, etc... she started to laugh...
Ok, all this is fine.

Anybody has any ideas on what I should do?

Thanks,

You need to make an infopass appointment at you local office. You do not need a letter to make the appointment you just go to the website and make an appointment then print off the appointment letter and take that with you on the day of your appointment.

My wife has her conditional residency, and it expires 12/30/08. After much back and forth over the last 4 years we have finally decided to divorce and she is going to return to her native country. Does anybody know if we need to notify anyone that she is not staying?

We are not going to file to remove the conditional status. I have checked the USCIS website and I can find nothing about what to do if someone just decides to not stay. I do see where removal proceedings begin if we do not file within the 90 days before expiration, but nothing more. I want to make this as clean as possible should we decide to try our relationship again later and need to apply for visas and sech.

Thanks

Capitalism at it's best -- "Rob from the poor and line the pockets of the rich !!"

Capitalism generally refers to an economic and social system in which the means of production are all or mostly privately owned and operated for profit, and in which investments, distribution, income, production and pricing of goods and services are determined through the operation of a market economy. It is usually considered to involve the right of individuals and groups of individuals acting as "legal persons" or corporations to trade capital goods, labor, land and money (see finance and credit). Capitalism has been dominant in the Western world since the end of feudalism, but some feel that the term "mixed economies" more precisely describes most contemporary economies, due to their containing both private-owned and state-owned enterprises, combining elements of capitalism and socialism, or mixing the characteristics of market economies and planned economies.

I can see some loosing their job if they work to rule and some will look for another job where they will not be used like this with wage cuts and bonus schemes.

I can see morale in the USCIS will tumble and sloppyness will increase, loads of cases could end up being delayed because this could lead to strikes by the workers over pay and conditions, what a farce this is, and I thought I'd left all this behind in the UK !! whistling.gif

Why not just hold off on filing the n-400? You could just send it the first week of October, and head off on you trip without worrying about it. Alternatively, if you do choose to file on Sept 14th or so, if your fingerprint appointment does fall during your trip, you can just skip the appointment, and do it as a walk-in when you return. All finger print offices do accept walk-ins on Wednesday afternoon, and , at their disgression, may choose to accept you at any other time.

Not all ASC offices accept walk-ins, I know that boston does not do walk-in at all. If you can not attend on the given day then you have to follow the instructions given on the letter to reschedule an appointment.

Nooooooooooooooooooooooooo....

In applying the 3/3/3 rule it is the later of 1) three years of marriage to a USC. 2) three years as a legal permanent resident, & 3) the USC spouse has been a citizen for 3 years....

In most cases it is the 3 years as a permanent resident that is the last date to come true.... So for you it is in three years (less 90 days) of the date on your greencard that says Permanent resident since:

Agreed, you can file for Citizenship 90 days before the 3rd anniversary of the date you were approved as a Permenent Resident (greencard)

She must have been:

and

Held a Greencard for 3 years.

The earliest she can apply is 90 days before the 3rd anniversary of her approval for Greencard as long as she meets all the other conditions, See the USCIS webite for full details of Citizenship requirements.

Giving the excuse "no one is forcing you to be a citizen" is idiotic. No one is forcing people to commit crimes and some people would like to torture those who do. And yet we have laws saying that is unconstitutional. Even though no one is forcing you to be a citizen, there should not be unnecesary and perhaps fatal consequences.

THANK YOU!!!!!

If you choose to immigrate to a country and that countries immigration policy is that you need to have a vaccination done then you have a choice, you either have the vaccination and get the immigration status that you want or you dont get the vaccination done and you dont get the immigration benifit.

Every country of the world is free to impose its own immigration laws and requirements. The US are not making this a requirment of Citizenship, They are making it a requirment to immigrate to the US. If you are already here in the US and have your Greencard then you do not need to have this vaccination done to become a citizen. If you are just applying for a visa then you will need to have this vaccination done if you are in the age group before they will approve your visa.

What would happen if I entered the US on my UK passport? Would they make me do visa stuff? If so what if "overstayed" the visa limitations?
(e.g. US passport expired or lost)

Thanks for any input. For some reason I've never been able to let go of this question ever since I thought it up.

As a US Citizen you must enter the US on your US Passport, if your US passport is lost or stolen and you are outside the US then contact the nearest US Embassy, they can issue travel docs to allow you to enter.

If your US passport has expired and you are outside the US then again the US embasy will have a passport section that can help you.

Do not try and enter on a UK Passport. as far as the US is concerned you are a US citizen and nothing more and therefore must enter the US on a US Passport.

US Citizenship General Discussionwhat is a permanent resident?
QUOTE (Lorenzo @ Sep 28 2008, 01:54 PM) <{POST_SNAPBACK}>
I have been explaining to my wife about this and I am reading things at USCIS leading me to think I am correct. I want to be sure.

Is she a permanent resident when she arrives on a K1 visa or the 90 days before she receives the 2 year green card?

She was told she can file now as a permanent resident.

She arrived on the K1 July 26, 2005, we were married August 26, 2005 and she received her two year green card June 7, 2006.

I need clarification of this.

Thank you.

She has been a permanent resident since June 7 2006, so I hope you have filed to remove the conditions of her residency before June 7 2008. If you did not then she is no longer a permenent resident as her greencard has expired and you failed to file at the correct time. She is now out of status and is no longer allowed to work or travel.

Please clarify what you have filed for since she got her 2 year greencard!

I was in and out of our local office (Boise) in 20 minutes. I got all the questions right. The officer didn't ask for any additional proof or ask to see originals. Didn't require the passport photos that I decided to take in. Oath ceremony on October 23rd - just in time for voting. Woo hoo!

Congratulations.

US Citizenship General Discussion10 days after filing and no FP letter yet: is it normal?
QUOTE (gigant @ Oct 11 2008, 10:06 AM) <{POST_SNAPBACK}>
hi,

i filed my N400 on Sept 28, check has been
cashed but as of today oct 10
i did not received a fingerprint appointment letter yet;

is there something wrong??

should i call them?

thank you

thank you

If your check has only just been cashed then they are just starting to look at your application, most people dont get FP letter until about 30 days after they get the NOA1, if you have not heard anything by end of Oct then might be the time to find out if there is a problem.
