First off, sorry to hear the bad news on your brother sad.gif

Monday morning, make an info appointment with your local office where you had your biometrics done to get your GC or do a walk in if you can and explain to them that your brother has passed away, you may need proof of this for them to see. Ask if you can have your passport stamped to allow you to travel beyond the 18th December to your brothers funeral and back to the USA. All you need is an extension of 2 weeks at the most.

If you don't get your passport stamped with this, you will not be allowed to return to the USA after the 18th as you will be out of status.

Make an infopass appointment with your local office and go and see them and explain what has happened, take along the letter of denial to show that you still get mail at your address, tell them that the other letter in question was not delivered by USPS, so therefore you have not abandoned your residence here in the US. Ask them to review it based on a postal mistake, I am sure that someone will help you at your local office once they see that you have recieved all other mail from USIS including the Abandonment letter. Be calm and don't loose your temper with them. It's worth a shot in the dark to see what will happen.

Errmm ......... If your not living in the USA .... you will be classed as 'abandoning your residency' here in the USA, so therefore you will have to start all over again. You will need to obtain a new visa etc.

Since you have not lived here since November of 2009, you have no current evidence that you work or live in the USA, it's not going to work. The only way for you to go without having to do the visa thing again is to move back to the USA within the nect month or so and get a job and some place to live to rebuild your life here as a single person, this will be the only way to save your residency status.

My card expires in the end of May. When is the best time to file?


File within the next 3 weeks, don't leave it any longer, make sure you enclosed the correct fee and a cover letter with details of what you are sending in and info about your marriage and that it was entered in good faith, but you are now waiting for your divorce papers due to a break down in the marriage.

I've got my US Citizenship interview today Oct 22 in Boston. I got at the office at 10:30 and left at 12:30. First I've got the civics and history test. The guy asked me if I want to take the old or the new one. There were 6 questions that were exactly from the book. Then he asked me to read and write a simple sentence in English. Then I went to a different room, where you take the actual interview that is going thru your application and the officer asked me questions about everything. At the end she recommended me for Naturalization, the papers went to her supervisor he approved and at the end they gave me a paper for the Oath, that will be on Nov 12. Can't wait!

It was the Judge that married my Wife and I that did the Oath Ceremony. They have to be a Federal Judge to do the Oath Ceremony and there was no fee to pay.

You are allowed to make copies if it is for official business, USCIS request a Copy if your spouse is applying for N400 or you are petitioning for a relative. I filed for my parents and I had to make an infopass appointment to ask about copying the certificate so I could include it with the I-130's for my parents. I was told that yes it is ok to make copies for USCIS or any other government dept and that they can be color or black and white.

Because if they are needed then my wife should not be a US Citizen as we do not have any Utility Bills that are in Joint names. We never included any utility bills with the N-400 or took any to the interview.



I know darn well that utility bills are not listed and have stated it's a really dumb form of evidence. See someone else posted about Minneapolis, actually listed as the St. Paul office, but not in St. Paul either, but in Bloomington, MN where we had to go. So from our friends ahead of us, I did call our cable, phone, and electric company and had my wife's name added to these bills and submitted that as evidence as our friends had to make additional trips. We this information in our folder, we didn't have to make that additional trip.

For us, it was either doing it or trying to fight city hall. Yet another friend in Quincy, IL, a long trip for her to downtown Chicago with overpriced hotels got an RFE for utility bills even though she had joint home ownership and three years of tax returns, so that is two offices I know of that is requiring this dumb form of evidence. This friend that was always nine months ahead of us ended up eleven months behind us due to delays caused by the RFE, we didn't want to risk taking that chance.

I very seldom if ever used this word, but was really "pissed" off I had to dig out my divorce papers again, 50 pages long and double sided, plus my wife's divorce papers and another eight bucks for our marriage certificate, and they already had three years of joint tax returns for the ten year card plus all of our bank account, joint ownership, etc. evidence. Would have thought that ten year card would have been enough. But you have to play their game and they can make up the rules as you go along.



If you feel happier having those joint utility bills then go for it, bor for most people these are not required and never asked for.

The only evidence that my wife took was our joint tax returns for the last 3 years, a copy of out joint bank account, a copy of our e-tickets and our boarding cards for our trip to the UK in dec 2008 and her passport.


Can you take your IO to court if they refuse to grant you citizenship until you make yet another trip and bring that evidence in? I am not making this stuff up, happened to a friend in Milwaukee and another in Cadot, WI. Or do you just bring in the evidence they request and get it over with?



You take what evidence you have, If you have gone all the way through USCIS and not had your spouses name on the utility bills then there is no reason to have them added for the Citizenship interview.

Have a read through the 100's of interview reports from people who have got their Citizenship and you will see that none of them have been asked to produce a utility bill in joint names so they could be approved. Maybe your friends did not have any other evidence.

Any Ways you can only take what you have. If you do not have utility bills in joint names then you cant take them can you. To suggest that you MUST have utility bills in joint names and joint names on deeds/mortgage and if you dont you will not be approved is just not right.

As for taking USCIS to court for not approving a N-400 application because you could not produce a utility bill in joint names, Yes you could do that.

Shouldn't your bank know the laws on transferring sums of money? If they don't, find one that does, even in my small town we have just as many different banks as we do taverns and churches. Don't understand why you couldn't open an account. I went into a bank last summer asked to open account and as I didn't have a SSN# or green card they just wanted to see my passport, took a copy of biographic page and was done in 15 minutes.


Yes I agree, my parents are just about to immigrate to the US. When they were here in march on vacation they opened a joint checking account and individual savings accounts so they can transfer their money when the time comes and also have the account numbers to get their pensions paid to them in the US.

They do not have SSN all they did was show their passports and deposited $500 to oppen the accounts. took no more than 30 mins to do this.

They have since transfered well over $100,000.00 by wire transfer from the UK to the US they have never been asked to complete any forms when transfering money.

A Greencard is a greencard, you became a LPR the day you were approved for your Greencard, the fact you had to file to remove conditions does not make any diffrence.

You have to have been married for 3 years AND have held a greencard for 3 years AND have lived in the USA with your Spouse for 3 years.

You may apply 90 days before the 3rd anniversarry of you getting your greencard as long as you meet all the other requirments.

There are a number of posts in the 'Removing Conditions' forum about the slowdown with the production of the permanent 10-year green cards. No idea what the problem is as they were generating them very quickly for awhile. My question is: my I-751 was approved and I have the letter to prove it but no physical 10-yr card. I'm eligible to apply for naturalization in July. If I still don't have the card, will that be problematic in any way?

Yes, I have the two year card.




You dont need the card to apply, you can include a copy of the approval letter and then when you go for your Citizenship interview take a photocopy of the new card as well as the card its self.

Only way to find out for sure is to go to your local office and ask them what you should do. It is the local office that issues the interview letters.

Make a infopass appointment as soon as you can.

I still waiting for my citizenship interview, but I would like to apply for a US Passport right after the oath taking. Just curious what documentation did you provide State (passport processing) to prove you are a citizen if your naturalization certificate is not right away in hand? It's logical I guess to assume that that is what State needs.


You get your Certificate at the Oath Ceremony, I went to my local Post Office to apply for my Passport all I took was The Passport application forms, my certificate, my state drivers license, utility bill showing address and 2 passport photos and the fee.

I put my certificate in a clear plastic wallet and stapled it closed, that way when they were attaching the application together the did not staple through the certificate only the plastic wallet. I thought the passport office might take it out of the plastic wallet but when I got it back it was still in the wallet.

Hopefully 2-3 days letter in a first class envelop from exactly the same address you received your passport from. Don't know why they can't save a stamp and toss that in the same heavy cardboard envelop. Had to sign for that cheap passport compared to a replacement certificate, that expensive certificate was jammed in with the rest of the junk mail.


I paid $100 for my passport (normal service) and I had it back within 10 days as well. You will get your certificate in the normal mail 2-5 days later.

Like NickD said I cant see why they cant return it with the passport. Congrats on completing your journey.

We always paid for expedient service, but was wondering, how do they send you your passport if you don't? Regular mail? With expedient, you have to be around whenever the postman decides to show up and sign for it, if not, he leaves you a note to deliver it the next day, or the next day, or you can drive over to the post office and pick it up.



It was delivered in the regular mail, no signature required.

You need to take your certificate into your nearest SSA office and complete a SS5 form. They will photocopy the certificate and update their records and a new card will be mailed to you. You could have had the restriction removed as soon as you got your greencard there was no need to wait until you became a citizen.

I visited the SSA office on the way home from my oath ceremony to update my SSA records, but I already had a unrestricted SSN card.

As for the US Passport, I applied at my local US Post office, just took all the forms and my certificate and the fee and they check everything and sent it all off to be processed. I had my Passport back within 10 days and the certificate came back a few days later.
