I am also in the same boat as you guys. I got a 221(g) 3 times and this last time, they said they were sending it back to the NVC. According to the letter, there wasn't enough credible evidence to prove our relationship and I don't understand why. I guess this happens in the New Delhi embassy as well. Well from receiving advice from multiple and helpful vj people, it's a very good idea to get in touch with your SO's congressperson. You have to take it multiple before they actually drill some sense into their heads, that is the Visa Officers head ;).

Asia: Southanyone received visa from Delhi consulate??

Any advice on the following for DELHI:

1. where and how to get the police certificates from the district station and passport office
2. what is the specific request that i should make to these departments to obtain the document
3. rough idea of what the documents will basically say?

1) From the district station, it would be your local 'thana' or county station. For the passport, by default they take 3 months to send it and YOU MUST be a resident of your place for at least a year otherwise they charge. For me though, I had contacts in the passport office so I didn't have a problem, got it in a few days.

2) Tell them you need a document stating that you have committed no crimes and are not in any way shape or form liable to India, or something like that.

3) Umm... I'd have to look, pm me if you want to know.

As for the OP, yes I went through Delhi. The experience itself was all ready. Waited for an hour then the interview came. Asked me really obvious and simple questions, probably 5. All he had asked to see was photographs of us. That's about it. I also got a 221(g) and now I'm fighting my case to appeal it, I'm not going to stand back and watch these illiterate dicks tell me that I cannot be with Mandi :).

On going to travel.state.gov she needs to make 100% of the federal poverty guidelines. With 2 people in the household, she does make more than what is required. However, since I got that taken care of, now all I need to know is how is household size calculated in the I-134. Is it just her and me even if she lives with her family? If so, then we won't move as soon as I get there so we can save up some money before moving.

The concern here is, she has 4 people in the household. With 4 people in the household, it's 25000 that she has to make. Or am I mistaken and she only has to cover herself and myself? Now, when filing the affadavit of support, does she ALSO have to support her family as well. IS that counted. Because if it is, there's no way she's making 25k a year.

Second concern is that we have somebody who makes more money for 5 people in a household however he's going to be a co sponsor. The thing is, I want him to be the only sponsor and therefore negate the fact that my fiancee doesn't have to sponsor. Reason I want that is because he does not have to compensate for the funds for her family IF HER family is counted. For the new delhi embassy located here: http://newdelhi.usem...ov/k_visas.html it's the I-134. Household size is NOT Mentioned neither is 125% but basically the USCIS follows the I-864. I'm concerned about this actually.

Well we have been approved on sept. 11, what a date to get approved on. Very happy and glad. Now I have some questions on the affadavit of support as we are running into a few problems.

Questions

1- Does the US petitioner, my fiancée, HAVE to sign an affadavit of support or can it be someone else who makes 125% above the poverty line?

2- When the app. is being reviewed, will they take into account that a job you have might be laying you off?

3- What happens when you switch jobs a few weeks before the interview date, does that hamper the application any?

4- To emphasize on my first question, just want to clarify it once again. I would like someone else whom we know quite well to sign the affadavit of support ONLY as he makes more than 125% and he lives alone. Is that a possibility? Can he be the primary and only sponsor or does my fiancée have to submit an affadavit of support form as well.

Well that's the basic questions actually. I'll be going to the interview at the new delhi embassy. Any idea as to the sort of questions they make ask? If you want to give a date for them to interview on, is that a possibility? If you miss your interview date, can you call them up and reissue another date or do you have to reapply for the I-129F again?

I know we have to send all originals to the foreign fiancee for the interview but certain originals are risky like the birth certificate or US passport. Important documents like these we have to send? Will the embassy keep the originals if they ask to see it. If so, how will we get it back? Thanks

Finally guys, I have my interview date on the 12th. Just 2 questions really.

1- What will the questions be like in the new delhi embassy interview?

2- They sent me a paper which showed 2006 federal poverty guidelines 125% above the poverty line. Now, I know on the I-134 it's only 100% of the poverty guidelines, not 125%. Are they informing me of the 125% mark or 100%. I hope not 125% just yet.

Just a lil sidenote question, when will the visa be issued if i'm going to the new delhi embassy. Thanks

Hi guys,

Interview is on the 12th and I'm excited. I just have one last question and it's about tax returns. My fiancée has only ever has filed one tax return and no W3. She only received a meager amount because before that she only worked a few months. Now I remember reading somewhere they only want tax returns and stuff like that from 3 years ago and before. Should I get a copy of the most recent one just in case?

I hope and pray that we get our visa on the 12th. It would hurt us so bad if we don't get it. Just praying to God and please guys respond to this ASAP.

Yeah they gave me a 221g. I don't believe it is a denial but I guess according to me that's a denial or a delay. All they need is a co sponsor. I don't really want to argue with the embassy as that might screw up my case so I just want to get a co sponsor and we'll take care of the I-864 when I get there.

Not the INS, the INA [Immigration and Nationality Act]. If it doesn't exist, they sure did judge me on the 'more documents' form. They gave a section of which I was judge, Section 221 (g).

To the rest of the people, yes according to travel.state.gov she meets the 100% poverty line but not 125%. It's the type of job and I made sure I had that covered. On monday I'm going to try to call up the embassy and see what they said, they basically denied me even though according to US law they denied my request for a visa. I feel so disgusted. I'm trying hard to find a co sponsor but no one wants to do it because of legal obligations which isn't the case because in many law firms it does mentions that it is indeed not a legally binding document. Just to clarify a few things:

1) Mandi does make 100% of the poverty line, not 125%. She will however in a different job which she'll be getting.
2) Only reason I submitted tax returns was because the embassy asked for it. I told them it's not what her current job requirement is.
3) I'm trying to find a co sponsor as I'm more determined now than anything else.

Well I guess it wasn't really a denial, just need more documents but then that can be considered a denial. I had my interview on the 12th at the US embassy in new delhi. Everything went well, the questions they asked was like where did you guys meet, why did you decide to meet, where does she work, and things like when did I visit the US.

Now to my denial. According to travel.state.gov Mandi, my fiancée, meets 100% of the poverty guidelines which is what is required on the I-134. However, on her tax returns it was on a different job where she was earning less. I don't know how they judged it. Whether they judged it by her letter from her employer and pay stubs or from the income tax returns I don't know, but they said we needed a joint sponsor. Really disappointed me and I was so sure we were going to get it. She's just as heart broken and we can't be together for Christmas.

Now to my questions:

1) She's getting another job which covers the 125% on the I-864. Can she resubmit her financial docs again or does it need to be a joint sponsor?

2) How do they judge if you meet the income requirements or not?

3) Does anyone here who is nice enough to help sign the papers :help:? Hehe. Apparently, no one in her family wants to sign it and we're getting kind of desperate here.

I am also going through the same process as you are, and I'm sorry to hear this. Our petition according to the embassy is being returned back and yes we are taking the advice of a lawyer if the congressperson cannot do it. One of the best options is act on it ASAP. Spam them with evidence. :)

Surprised to hear all of this. You know, this makes me thing, all this scrutiny and unfairness to us, how can we battle against this? How can we find the officers who are the culprit or put some kind of charge against them? Not saying all visa officers are bad, but man certainly in your and mine case it was. They have no idea how to tell apart a real relationship from a fake one.

Hi Ryan,

I dont want to add more stress to your situation, but the very same thing happened to me and my fiance. He went thru Chennai embassy, and we started this journey nearly two years ago. Our case was sent back to the U S in October of 2006 and it has sat without any touches, or anything since then. Yes! Five months just sitting there after being returned. I know very well the bia's and prejudices that the indian embassies are filled with. We gave them four years of proof of our relationship. Stacks and Stacks, and Im convinced that it doesnt matter how much you give them, once they decide something in their head they dont care.

Sadly, My fiance and I split up in December, after over four years. It was a heartbreaking decision, but I couldnt see putting our lives on hold any longer. It seemed no one wanted to help us. My lawyer wouldnt answer my emails. My senator wouldnt answer my letters. It felt so hopeless ! So I let them win. Maybe I was weak, but I did it with the intention of giving my fiance freedom to move on with his life.

It has been really hard for me to deal with and every time I think of the Chennai embassy Im filled with such anger . I hope and pray that some day this immigration process is made much easier for those who are sincere while being able to still weed out the fraud...

Wow, I'm real sorry to hear that. I feel for ya. This is not my job to pry into things but I really think you guys should be together. Keep trying. What keeps my faith alive is the fact that I believe in Almighty God and I know for a fact that He can make this happen. You want to talk, you can message me. You can't just let love go that easily. I know this post is about me but you also have to think, you can't let a person you love go that easily. It will tear you apart left and right.

I am also filled with anger from these stupid embassies, because no matter what you do, they have it in their stupid heads that you are a fraud case. Man I really wanted to, I could really screw with them but I just don't want to. I don't want to jeopardize anything. I love her and I want to be with her. :)

Just wanted to update the folks here, I think it has been send back to the NVC and they will send it to the DHS office. Here is what they said in response to the email I sent them:

Dear Ryan:



This is in response to your e-mail regarding your K-1 visa case number ***.



Your fiancé visa application is no longer in our office. Please note that fiancé petitions expire four months from the approval date. The consular officer has the discretion to re-validate fiancé petitions if they expire during processing. However, since the consular officer was not convinced of the relationship in this case, the petition was not revalidated. It was returned to the National Visa Center (NVC) on 6 March 2007. Once NVC receives the petition, it will return it to the approving DHS office. Please direct all future inquiries regarding this case to the approving DHS office that has jurisdiction over your petitioner’s place of residence.
