Also forgot to say that when we told an agent that our reason for visiting the Newark Field Office was because it's taken 1 year to remove conditions on permanent residence, he said that removal of conditions takes an average of 2 years. Since I'm familiar with everyone else's experiences here, I told him that most others are approved in only 3-6 months. I don't know if he meant that cases that get transferred to Newark normally take 2 years total or if he thought that the average in general was that long, but it really took me by surprise. Just the way he said it sort of shot me down. Now that I checked the AILA estimate from the VisaJourney link, I see that the I-751 at the Vermont Service Center takes about 6 months. What the hell was that Newark USCIS agent talking about?

Does anyone know a place where we can see processing times from the Newark Field Office? The link from VisaJourney (http://www.visajourn...m/content/times) only showed estimated times for I-485, N-400, and N-600. It also looks like VisaJourney doesn't have a graph for processing times for Removal of Conditions? The charts seem to stop after Adjustment of Status and Advanced Parole.

Update: we got the I-551 stamp on Karen's passport and a little information from the Newark office today. We found out that the case was transferred from the Vermont Service Center to the Newark Field Office on May 29, which was after we responded to the RFE (May 4) but before we did a service request by phone (July 15). The USCIS agent told us that we are already in the queue for an interview, and he estimated we will hear back from the USCIS in 30-60 days about when our interview will be scheduled. He also said that the USCIS is not delayed because of the sequester since they are a fee-based organization and said the Newark office has added more people so hopefully we will be interviewed quicker. So sadly after all that, we still probably have another 2-3 months. :(

 

 

I believe that after (or near, please check) the 1-year anniversary of your filing the ROC, you are eligible to file for citizenship - and they have to review your I-751 during the citizenship interview.

 

Thanks for the tip. I had read that elsewhere, and we've thought about it, but I'm not sure Karen is ready to apply for citizenship yet.

 

 

That's right. I've been waiting for an answer on a RFE replied more than 60 days ago and nothing yet. My extension expires on 11/12/13 and I'm sending my n-400 package this monday, hoping It'll help expedite the ROC process

 

Has your case been transferred to Newark too? Karen's extension was set to expire on Nov. 2 2013, but now it's extended until August 2014.

 

I had a similar issue with the Newark Field Office. When they make you wait all this time it is because they are gathering a case regarding if the marriage was entered in good faith. Be prepared to be drilled in interview but stand your ground if the marriage is entered in good faith.

 

Could you share how your interview experience was? Did you have a Stokes interview (where they interrogate each spouse separately)? Now you've got me a little nervous! Everything I've read was how easy the interview was and how we have nothing to worry about.

 

Thanks for posting this, I am in the exact same situation except I filed a month earlier. I just made info pass appointment to get an extension and hopefully find out some more information about my case. I also know my case is at the local field office. Just cant believe its taking this long. I know exactly how you feel. I also contacted my congressman who said they will try to help. Thats all I can recommend. My lawyer advised me not to file N-400 until I get the approval, but after reading  of so many people filing while still waiting on approval makes me think I should just send it and maybe that would speed things up, but I dont know. Well I wish you the best.

 

Are you also at the Newark Field Office?

 

For those who are still waiting close to (even pass) 1-year mark, if you are qualified and wanted to become an US Citizen, go ahead and file N-400. But first make an Info Pass appointment first to extend your NOA-1 for another year so you are not out of status.

 

I have to do this route last year. Even after getting my local congressman involved I was able to get the N-400 approved with the ROC still pending.

 

And just for poop and giggles I checked my ROC status on USCIS' website, it still says "INITIAL REVIEW".

 

What a joke.

Thanks everyone for your helpful advice! We scheduled an appointment through InfoPass at the Newark Field Office for this Monday. I chose the Case Services follow-up appointment so hopefully we can bug them about the long delay, but I'm a little worried they'll give us a hard time because we didn't wait 45 days after our service request. At the very least, we should be able to get my wife's passport an I-551 stamp.

Get an infopass appointment - they will stamp your wife's passport. Done that recently. Traveled abroad with no issues.

 

Do you remember what choice you picked for the InfoPass? Was it "information or other services"? I chose "need service on a case that has already been filed", but I'm hoping if they can't give use information on that, maybe at least they can stamp her passport.

The case was transferred only recently.

 

I should have said in my previous post that we don't know when our case was transferred from the VSC to the Newark Field Office. We only received a message from the USCIS on July 22 because we put in a service request the week before. The USCIS showed no desire at any point to update our case status or to inform us of any transfer, so the transfer could have happened as early as May after we sent in our RFE response or any time until July 15.

 

That means our case has been at Newark for anywhere from 3 weeks to 3 months! As I said before, how long do we need to wait?

Shouldn't we wait 45 days from July 15 to make a Case Services follow-up appointment? Thanks for the link to the Ombudsman Liaison's office, but I'm not sure what to do there. They do ask for customer service feedback to help identify issues that affect us, but for case-specific issues, they just say to contact the 800 number at the USCIS National Customer Service Center ("For case-specific inquiries, please refer to Case Status Online or contact the National Customer Service Center at 1-800-375-5283.")

 

 

 

 

You just need to wait.  You'll most likely get an interview within the next month.

In only 2 days we will have reached the 1-year anniversary of filing an I-751 petition to remove conditions on Karen's permanent residence, and we still don't have a timetable for the next step and we have no hope for approval anytime soon. sad.png It's been 3 months since we responded to a Request For Evidence, but still no official USCIS response on what will happen next. What's worse is that we are finally going back to the Philippines in November for the 1st time in more than 3 years, but we're afraid Karen won't have a 10-year permanent green card by then. Her 2-year temporary green card expired in November 2012, but we have a letter that extends it one more year. Still, we were almost certain that we'd have a 10-year green card by now after applying more than 14 months in advance, but now we're just getting more and more frustrated by the day.

After filing the I-751 on Aug. 10, 2012, we received an RFE on March 25, 2013 and responded on May 4, but did not hear anything from the USCIS until we filed a service request on July 15. It took the USCIS a week to respond on July 22 with a vague letter from the Newark, NJ Field Office that said "Your petition/application is still pending consideration and has been relocated from the Vermont Service Center to the Newark Field Office for interviewing and processing. We regret that we are not able to give you a timeframe for when we will complete the review of your petition/application."

So our big question is what do we do next? It sounds like we will most likely have an interview, but what bothers me is that there is no timetable for the next step. I was hoping we could call the Newark Field Office to get more information, but it seems that they purposely do not list a contact phone number or e-mail address. Does anyone know how to contact the Newark Field Office?

Our Case Status still says we are in "Initial Review", so that is not much help. Our only other options, as I see them, are:





  1. to file an e-request (which just seems like an online service request)
  2. to use InfoPass to schedule an appointment at the Newark Field Office.

It turns out we cannot file an e-request until 30 days after a previous service request. In 6 days, we will be at that 30-day limit and will probably file an e-request immediately. For cases that have already been filed, InfoPass says there are only the following 4 kinds of appointment:

  • Order from Immigration Court - If you were directed to us for processing based on an order from the Immigration Judge. You must bring all documents required in the post order instructions given to you by the court.
  • Case Processing Appointment - If you received a notice to go to your local office for further case processing.
  • EAD inquiry appointment - If your I-765 employment authorization application has been pending for more than 90 days.
  • Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment.

We could pick the Case Services follow-up appointment, except the NCSC (National Customer Service Center) did respond to us, albeit in a rather vague way.

So what do we do next? Our feeling is that we should be able to contact the Newark Field Office directly, but we have no idea how. Any suggestions?

Removing Conditions on Residency General DiscussionHow to check status of green card production?

My wife removed conditions on her permanent residency at an ROC interview at the Newark Field Office on Oct. 8, 2013. Is there a way for us to check for when her green card will be made? Will we receive anything in the mail before the green card?

The USCIS Case Status page has not been updated since Aug. 2012 and says we are in initial review even though we are approved. We are also signed up for text and e-mail alerts and have not received a single update that way. I think the text & e-mail alerts are not working for us. Any thoughts?

I schedule an info pass but USCIS called me to cancel my info pass because of malfunction which they are only one that understand....I know that one day everything be ok...

 

Deys -- has your case been transferred from the Vermont Service Center to your local office? Judging by your timeline, my guess is that it already has been transferred, even if USCIS hasn't told you yet. If you ever find out that it has, here is a good resource to find out processing times for each local office: http://dashboard.uscis.gov/

 

If you have been transferred to the NYC Field Office in late June or early July, you'd probably be about number 1700 in line. With that office processing about 450 cases/month, you should be scheduled for an interview in ~4 months, which means you might have an interview in late October or early November. Sure, a lot of what I say is speculation, but your case looks very similar to ours, and my prediction for the Newark Field Office turned out to be true.

Received a letter from the Newark, NJ office of USCIS responding to our service request. Looks like we are in for an interview. unsure.png My wife is gonna freak out because she desperately wanted to avoid another interview. Not sure why it took so long, from May 6 until July 22 (2.5 months), for them to transfer our case from the VSC to Newark and why no one said anything to us until we asked for a service request, but I guess we can't really do anything about it. :(

The letter says "Your petition/application is still pending consideration and has been relocated from the Vermont Service Center to the Newark Field Office for interviewing and processing. We regret that we are not able to give you a timeframe for when we will complete the review of your petition/application."

Congrats, Canadiandggal! FYI, you didn't update the total number for Vermont to 24 of 31 applicants approved.

 

I was just curious what made you call USCIS so soon, since you'd only responded to the RFE on 6-12, a little more than 30 days earlier? I wish we would have called sooner, but we thought we had to wait 60 days.

I did a service request on Friday and got a responce today via email. However nothing has updated, both USCIS phone and Website still say that im in initial processing so we will see if it's true

Thanks for your response! It makes us feel a little better, maybe not about the lack of status updates or punctuality, but maybe our case is farther along than the USCIS Web site says.

Getting really nervous now. We responded to our RFE on May 4, 2013 and haven't heard a word since. ClockWatch2.gif In fact, there's been almost no activity for August filers at the Vermont Service Center since early May, with the exception of a single person whose ROC was accepted.

We just made flight arrangements to go back to the Philippines, which is exciting since my wife Karen hasn't been back in the 3 years since she's been in the US. But now we're getting a little worried that we may not have a new green card by then. Not only that, but the I-757 was issued in November 2012 and only extends the green card for 1 year. Will USCIS give us a problem letting Karen re-enter the country when we come back on Nov. 25 with only her green card and the I-757?

 

I just called the USCIS today, and they are doing a service request since it's been more than 60 days since they received our response to the RFE. Hope that speeds things up!

I just wanted to say congrats to all those who have gotten approval since the last time I was here, and it is especially nice to see a few of my fellow RFE'ers get approvals too smile.png

We're pretty sure the problem was that we didn't get enough evidence from our landlord, which is pretty important since we don't have any children yet. Since I (Jay) initially got this apartment without Karen and needed my father as a co-signer since I didn't meet the salary requirements, all leases and bills list my father and I as the first two people. When Karen applied to be a tenant, her name was never added to any bills or leases because our apartment complex only lists the first two applicants (dumb policy) . When we brought this up with the leasing manager when first applying to remove conditions, she made an artificial document with my wife's name on it and sealed it in an envelope to show that we hadn't tampered with it, but apparently USCIS didn't see my wife's name there and said it was "an expired lease". So this time, we got a photocopy of my wife's occupancy application, a letter from the leasing manager, and we explained the whole ordeal in our cover letter. Hopefully that will clear everything up.

It just sucks because we were hoping to be done with everything by now, and it took us more than a month to collect more evidence of our joint residence and accounts. We don't want to be the last ones from August to be accepted!

Removing Conditions on Residency General DiscussionCRI89 transferred to local field office from VSC

Everyone here -- be thankful that your case got transferred!

We filed at the VSC in August 2012 (yes, that's the previous year), got an RFE in March 2013, sent additional evidence in early May 2013, and just got an interview and approval today. That's a massive 420 days! I suspect that we may have gotten stuck in some traffic at Vermont after our RFE. Looks like transferring to local offices has worked out well for most of you. Why don't you personally make a phone call to the school and ask yourself about the yearbook scenerio? Maybe talk with the principal or a leader of the high school and expalin her situation to them. At this time, my fiancee will head back home for a visit to get her school records and any other "old" documents she can scrounge, then head to Tacloban to (hopefully) get her passport!

The DFA rejected my fiancee's passport application for the 2nd time now, this time because she didn't have an "old" form of ID! sad.gif I have a feeling her difficulties might be due in part to the fact that her birth certificate was late registered. She was rejected the 1st time because postal IDs are no longer accepted as a form of ID, so our main priority for the 2nd attempt was to get a valid ID. For her 2nd try, she was able to get a new copy of her school ID, but that apparently wasn't good enough. To be honest, neither of us expected that she would need an "old" ID!

Here's the problem -- my fiancee lost her ONLY "old" ID, which was her school ID, and as far as we can tell, doesn't have any other old identifying documents! She doesn't have an old school transcript (or school form 137), and she never bought a school yearbook! So how can she obtain an "old" form of ID if she doesn't have any?

Since my fiancee comes from a simple background in the province of Samar, she doesn't qualify for most of the suggested forms of ID or supporting documents, such as a Marriage Contract, PRC/IBC ID, Land Title, Government Service Record, Seaman's Book, or Income Tax Return, and stands little chance of getting a Driver's License. She has already gotten a new copy of her school ID, has an SSS number (and can apply for an SSS-ID card if she can find a job at a company that actually contributes to Social Security, which is apparently quite difficult in the Philippines), and can apply for voter's registration card. However, even if she gets the SSS-ID or voter's registration card, these are "new", not "old" forms of ID! Her Baptismal Certificate is "old", but apparently it only qualifies as a supporting document and not a form of ID.

Has anyone else had a problem trying to obtain an "old" ID? Does anyone know specifically what the DFA is looking for? How can my fiancee get an "old" ID when she barely qualifies for any current IDs?

I thought this might be an "easy" form of ID to get, which it is, but the DFA told me on the phone that an NBI clearance renewal ID card is NOT accepted for a passport application!

which DFA is she applying at? manila? if she's still refused, try applying in Cebu or Tacloban (Leyte), nearer to Samar, hopefully more reasonable towards applicants.

To the best of my knowledge, her NBI clearance wasn't accepted as a form of ID, but could have been used as a supporting document. Here is a summary of what she presented:

Postal ID = not accepted as ID
NBI clearance = supporting document
Baptismal certificate = supporting document

I guess the NBI clearance and baptismal clearance are considered to be the same category. I was advised that she need to get an ID. She lost her school ID, but was able to get a new copy. However, when she went back with the new school ID, they rejected that as well. This is what she presented the 2nd time:

New copy of school ID = not accepted
NBI clearance
Baptismal certificate

Postal IDs are no longer accepted.
My fiancee has NBI clearance, baptismal certificate, and a new copy of her school ID. I hope this is enough! She is at the DFA right now!

If she is from SAMAR maybe she went to TACLOBAN DFA......be aware that there are some agent in TACLOBA DFA that they are very strict and seem they are psychologist... like they knw what you said to them....Just be honest and tell the truth about your PERSONAL profile,.......

I don't understand why it is so hard to get a passport! If the DFA doesn't accept her school ID, she is going to have a hard time getting another form of ID! sad.gif

I asked her, and she IS late registered! sad.gif She is now applying for her SSS-ID, so after she gets that, she will have:

  • Baptismal Certificate
  • SSS-ID
  • NBI Clearance
  • CENOMAR
  • Cedula
  • Barangay Clearance
  • Postal ID

I hope this will be enough!

thats what i meant earlier...those things are just documents not really id though it has your information but its not an id card...dfa wants an id card not a documents or papers...

i guess thats why they didnt take her postal id because they want two different id card and having two postal didnt really work...

some dfa are strict some are not i guess thats why some people were able to get passport just using nbi or baptismal...

so if shes getting sss id now then all you need to do is wait...then apply for passport again once you get the id.



Thanks! I guess it would help if I knew what these documents looked like and what information is included on each. It would be nice if the passport application made this clearer! My fiance thought she could use a postal ID too! mad.gif

As I said before, she already showed the DFA BOTH of these documents, but she claims that the Baptismal Certificate and NBI Clearance are not IDs, so they only count as supporting documents.

What do you mean by late registered? It does seem like they are giving her a hard time, perhaps because her Baptismal Certificate listed the wrong date of birth. However, she paid them a fee to "correct" the Baptismal Certificate and they claim they accepted it afterward.

Do you think they didn't accept her postal ID because her supporting document had a mistake?
