When my fiancee arrived we first got the marriage licenses - my state does not require blood test nor ssn for that so it went smoothly.
At city hall they also gave me us a list of people who can marry us, here they are called Justice of Peace.
I called one nice lady and she married us in my sisters garden smile.gif
The ceremony was for the family and friends, we plan a bigger one once we go back to Poland since our both families leave there.

3) Since I came here directly after finishing my studies, I have little in the way of assets. My parents are both working professionals, and have volunteered to sponsor my fiancé for the visa process. Is my earning potential (Bachelors in Multinational Business) and sponsorship by my family sufficient or will we be denied due to no assets?

Those are my major concerns. I have decided to forego returning to the US until my fiancé gets her visa. We can support ourselves here for as long as the process takes. I don't want to spend a day without her, and hope we can stay together in the States soon.

Please feel free to ask for more info. I would just like to get acquainted with the community and hear your take on our situation. Thank you for your time!

first of all congratulations!!!
1. The fact that you have lived together for a while is definitely a positive thing. It is however rquired to have and U.S. income to sponsor someone's visa (regardless of type). You might want to ask you parents to be your co-sponsor to provide prove of adequate income.
2. I am assuming you are a US citizen. You age most definetly won't be a problem. I am not sure about your fiancee age though, but i think she can legally marry in US and that's the main purpose. You might want to call UCIS on that though.

I would also get that lawyer to pay the difference for a new fee. He or she evidently did not know what he/she was doing.
I'm afraid you will have to refile, but i don't think you need a lawyer. Just read the post and read the instructions on the form CAREFULLY!!!!
I got my fiancee to get her visa within 5 months (she is flying to Newark today biggrin.gif) all i did is purchase Fiancee visa kit on the net ($50.00) which had sample of filled forms and some additional descriptions.
Just make sure the forms included in those kits are up to date, if not, download an updated one form USCIS.
I will keep my fingers crossed for you guys.

the passport needs to be valid for at least 6 months after visas expiration date.
Since K-1 visa is valid for 6 months a year of the passport life should be enough.
If you have to years however i would consider renewing it. You will need a new one when you are in US and sometimes it cost more to get passport from consulate...

It is sad that those "guaranteed" preparers are not controlled by someone.
I would give them a call and DEMANDED a refund. I would also contact the Consumer Protection Department in your state.
As for the case itself, call USCIS and ask them what to do, i was calling them a few times durning the process and was able to speak to someone after holding no longer than 10 minutes.
Also, all the forms have pretty good instructions, read them carefully.
As for breaking something, don't brake anything that you will miss later biggrin.gif

I did some research on this topic because my K1 petition is now being processed by the NVC. Go to this website. It is directly at the consulate in Guangzhou. It explains everything about how to contact them about your case.

Also, if you have a complaint about the person you've spoken to, you can fill out a form. The following information must be recorded when you do call:

1. The date and time of your call.
2. The name of the customer service representative with whom you speak.
3. The identifying information you gave about yourself.

They will retrieve your call with that person from their database and listen to the actual call, thereby rectifying any problem and to help train their staff to "better server you" !

Ok great. Now I understand. From what I've read, the NVC takes about 1-4 weeks then sends it to Guangzhou. But, as you were saying, "receive" means not as it comes in at the consulate, but it sits around until they can process it. Please correct me if I'm wrong.

I am almost finished with the I-129F package, however I already received my bank letter and the letter from my company.
Am I supposed to include this in the I-129F package? Or can I?
Or do I have to wait until it is asked for?
If I have to wait, will my bank letter/company letter be good by then?

I just received my NOA2 which is the approval of the I-129F from the Vermont Processing Center. I am now working on the I-134F. I got a letter from the bank yesterday and am waiting for a letter from my employer now. Then I will send it and other supporting documentation to my fiancee in China. So, your bank letter and letter from your company would not have to be sent with your I-129F form. But when you receive you NOA2, you will need them for the I-134F as supporting documentation.

My approval notice expired on 11/24/06, but the interview is scheduled for January 16th!
What should I do?

I just read somewhere on the site that the Embassies do routinely extend the date of expired approval notices. I just received mine and it's good until April 20th, 2007. So, I will definitely be calling the Embassy when the date approaches if the interview hasn't taken place!

K-1 Fiance(e) Visa Process & ProceduresImmigration attorney needed ?

I am interested in peoples opinion on whether a Immigration Attorney is needed, or if used would speed up the process. My Fiance is in Hunan China, and that consulate seems to have very long lead times for interviews. I have been reading the support material on this site and generally understand the process, though this is all new to me.

Is it worth the ~$2500 for a Lawyer to make sure things are correct ? Do they know any tricks to speed things up ?

I was going to use an immigration attorney before I did a lot of research and found enough information to convince me NOT to use a lawyer. A couple of reasons convinced me. One, our case wouldn't be 'special'. Two, the fact that I had all the information necessary to do the job and follow up on everthing withing their respective times. I've just called the NVC to see if they've received my K1 Petition. They have and are currently processing it before sending it to the Consulate in Guangzhou.

As far as processing times goes, there is really nothing a lawyer can do because the rules are set in stone. If you have an emergency or you think your case should be expedited for a GOOD reason, there are standard processes to follow. But, where a lawyer would help, is if you truly had a special case and would need to petition the government through the courts to move your case along faster. That can only be done by a good immigration attorney. Otherwise, our case isn't special and I don't anticipate any emergencies, therefore, I will do the work myself and save the cash!

You on the other hand have to decide if you got the time and cash. I guess that is really what it comes to. But, you will still have to hunt for all necessary paperwork, call your bank, get stuff from your employer, etc..., then give these things to your lawyer, at which point he/she would just arrange everything neatly, clarify somethings with you, make copies, and send them off. So the time spent on the lawyers side is negligible, especially when his/her assistant would probably do all the work.

My fiancee is in China and had to do the same, except she lives in China. When the I-129 gets sent to the Consulate in Guangzhou, they will send her information. I assume that they need to have the name and address in Chinese to get the documents to her. That would be the same in your case. But to make sure, you should probably contact the consulate or USCIS that your going through.

I am also working on my I-134 and had the same thing happen to me. The bank representative typed a letter with just the date the account was opened and present balance. She told me to go on-line and download the statements that I need. That is what I did. Basically, I downloaded all statements for the past year and every statement has the total deposits made for that statement date. I totaled them up and wrote a small letter showing the total deposits for the year.

Wow, I just realized that your fiance is from the Netherlands! If you look at our picture, you will see the bus for the Netherland soccer team. They were playing in Stuttgart for the World Cup 2006. We were living there at the time and someone took our picture right in front of the bus!

I had to do the same thing for some receipts and travel documents from Turkey and Germany. I did a search on the Internet and found something through the local yellow pages, for myself that is. I also did a search for you and found several in the Chicago Illinois area. I used Chicago arbitrarily, but you can type in whatever city you want. Here is the link that I copied from my search:

Paste this in your browser and you should get the same results as I did. You can also go to google or yahoo and type in "translation services in Illinois" you will get a lot of hits!

Also, you can just about send your documents to any company in the US, or world for that matter, that do translation services. They will normally translate your documents withing a day or two and send them back to you right away. Because my translation service was in the area, it took only 3 days.

First of all, I've tried to find (legitimate) ways around and K-1 or K-3 Visa are the right ones to use. By coming in on a visitor or student visa and then marrying, you should stay in America and then apply to change the status of your visa from a visitor, student or whatever to the appropriate visa to get married. I also understand that if you get married in the U.S. and then leave, you will of course need to prove that your intention was not deceitful. In other words, the U.S. government sees everyone as a potential immigrant and there are deceitful ways to come to the U.S., such as, come on a visitor visa and then marry. You had to prove that you had good reason to go back to your home country in order to get your visitor visa. Then all of the sudden you get married! That is deceitful in the eyes of the U.S. government. So if you leave the U.S. and try to come back, it will take probably a really long time. I read 6-7 years on one website. But I don't know. Best thing is to use the appropriate visas and follow the rules of the government. And keep in mind, if you try to do anything that could possible look like deception in the eyes of the government, you will have to answer for it. And this could be a real problem.

I got a letter dated 12/29 saying they got our case and it'd be mailed off to the Paris embassy within a week... when I called they told me it had been mailed out to Paris on 12/28! :D

They might be closed on Monday for the holiday, but you could still try. They have live operators there from 7:30am til midnight EST. Their number is 603-334-0700, 1 for English, then 5 to speak with an operator. If they say nobody's available and they're transferring you back to the menu just hang up - if you choose 5 for operator they say try back later and disconnect. I put them on speed dial and, after an hour and 20 minutes of re-dialing, got someone live on the phone at 9:20pm EST lol.


I had the same problem when calling the NVC. It took me several tries to get an operator but I finally got through. That is how I found out that it arrived at the NVC and how I found out that it left the NVC. But still haven't gotten a letter. Of course, it may be on its way. I just have to be patient.
