Hi there

I just thought of an idea. I am waiting for receipt of I-130 so that I can file I-129F for my hubby. But since recipt is taking a long time (8-10 weeks). Would it make sense if I send papers of I-129F get NOA1 and the reciept date and let them issue an RFE and then submit I-130 receipt notice.....This way, my dates for I-129F will be set ..Thoughts ?



I would have to say wait b/c teh receipt from teh I130 is required for the I129F. You need to have a pending I130 in order to get and I129f off so wait youshould be getting a reply soon.

An immigration lawyer told me to do the same, it's an extra pre-caution so nobody feels the need to second-guess the relationship...we included a a photo-layout i created on the computer and laminated [along with a few originals] particularly photos with all of our families together, along with some sample phone bills, e-mails, and customs forms attached to packages we'd sent one another (like chocolates and things from v-day).....so i think that was a smart thing to do! I spent the first 14yrs of my life there and I truely love jamaica, but the way I see it you need to be preety hooked up to live there. My husband and I will go for vacations with my son, but that is all we can bank on for now VACATIONS.....I have gotten accustom to life here I don't see mysself giving up life here anytime soon.

Jersey Girl: I sent the pictures but they were a set from a duplicate. so I have the original for the interview. I am unsure where it was but I was told to include pictures along with my marriage certificate, so I did.

We have similar timelines and are doing the same things. I assume your husband's birth certificate is in English and doesn't need a translation. I'll assume we're going to get similar instructions in Package 3 and 4. If this is the case, he should be looking for his vaccination records. He may also need a police name check, or fingerprint check if he has a criminal record. If this takes awhile in Jamaica, he might want to start now. I'm not certain how old the report can be when he submits it.

Is his passport up to date? Will it be valid for 6 months (I believe) after his entry to the U.S.? Do you have any wedding photographs in case they want evidence it's a bona fide marriage? Do you have a notary lined up who'll look at your I.D. and put a seal on whatever you want to bring forward as financial support evidence? Can you assemble bank statements going back a year? (The more the merrier, is my philosophy.) Are you making plans to be with him at the interview?

Better check everything I'm suggesting because I'm just as unsure as you are!

Well to start off, when I was sending off the I129F I sent in a few wedding pictures I am sure I can fork up a few more ( it will be hard seeing that he only allowed me to get a few pictures at the cermony- he is one of those people who think that his soul will be captured in a picture. I think it is funny but that his his belief so I accept it.) Yes his passport is up to date and i have his BC which is in English.
I am wondering about the bank records, do I still have to give them if I make well over the 125% poverty level. It is not a problem getting one from this new bank bu tthe previous bank might ba little trouble ( I had it out withthem b/c of poor service).
Yes I am plannig on going down fo rthe interview ( wont hurt - I even asked for teh time from work already.)

I have a question: On the NOA1 it says it takes about 60-180 days to process the I129F but on the website it says 60-90 days, which should I go by?

On May 15th I mailed my I129F - according to teh USPS it was received on May 18, 2006 . Today I came home and found the notice in my mailbox. I am so happy it says it will take 60-180 days to get it process. I am :dance: :dance: :dance: :dance: :dance: :dance: :dance: :dance:
Can someone please tell me what is my next step? Am I doing it right? Well I am using the quides but I am asking that someone please tell me I am in the right direction please ( silly I know).

1) I am in the process of getting the I134 ( required by Jamaica)

2)
a.I am about to request the letter from my employee

b.my last three paystub-which will change based on when I send it off.

3) Request from the IRS the tax transcripts for the past 3 years.

4) Do I need to get my bank records too?- I am well above the 125% poverty level

5) I am also filling out the DS-156 and 157 ahead of time so my husband can have it .

Am I going in the right direction. I have come so far it would be hard to screw up things right know. I would hate to mess up. Can someone who have been here please tell me if I am in the right direction please?

I have noticed today that on the UCIS website in the status section in both I130 and I129F the wording has changed. Previously it used to specify something like "This type of case is typically taking us between 60 to 90 or whatever number of days" I have today noticed that on both of them it now states this "You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates." Is this happening just to me or to everyone and if to everyone does anyone know why? Should we start expecting long delays now?

I just called INS and the guy was really helpful. He checked on my I-130s and said that they have been staged but the machine is not working that is why receipt notices are not being sent out. Once the machine starts working they will start issuing the Receipt notices....and it can be anything from 8-10 weeks ;-( I guess I will have to cancel my trip to India as I need to wait here to get receipt notice and then apply for their I-129F......



It is probable up and running now I sent my intial I130 in April and got a reciept notice and then on 5-26-05 I got a new notice from them .
They also sent me the reciept notice for the I129F : received May 18 with a notice dated May 23. So you should be getting yours soon. :thumbs:

Hi to the OP,
I am not sure which service center you are using, but you should realize that with IMBRA all the I129F are being held up. If those dates above are correct then you should just hold out a bit. I understand that it has been a while but things get lost in the mail daily as well as in the USCIS, just give a few more days and see what happens.
Why didn't you wait until the 30 days as per USCIS response to your wife's inquiry.
When you resent the I129F did you send another moneyorder/check? (it does not matter )
I130s seem to be going a little faster seeing they are not directly affected by IMBRA, so just use a little patience. Call the 800 # on the back of your receipts to see if any of teh money orders where cashed and when. You might need to get in touch with USCIS to make them know that you had two submissions of I129Fs.

What ever you do just don't give up, your wife needs you has much as you need her this process is long and tedious and no matter what in the end you will be together........it might be a year or 2 may be more or less but you guys will be together.

Just wondering if there is a way to check and see if they have actually received the mail (1-130) petetion I sent on May 24th. I sent a money order and didn't have tracking on the package ( I know mistake of course) but I was simply wondering if there was some other way to check..

Hey all;
I know you all are waiting for some good news. Me too. At least I got one from USCIS today: My Mom's I-130 was approved today (reciept date of Jan. 29th, 2006). The reason to let you guys know is that parents and spuses fall in same category, as far as I-130 is conecerned. So if you filed for your spouse around late Jan., then you should be recieving good news too.
Another good thing about it is that they are now moving at Vermont.

I don't know whether to believe this, but when I called USCIS the other day, they told me that K3s with an approved I-130 were NOT affected. The rationale they gave me was that "I-130 is the more important of the applications, and you're already married with an approved petition." They said no RFE would be issued and our I-129F would continue processing.

Again, this could be another case of the "Mis-Information" line spewing out incorrect info, when in truth, they don't know the answer, but that's what I was told. Make of it what you will! :no:


So in other words, we're going to put your $170 in our pockets while you continue with CR1..... :unsure:

However she told him, that he shouldnt call back before September 17th to check on our I-129f because it is taking at least 6 months for them to approve the K3 now. Hello? Am I dreaming? #######? Wasnt the K3 supposed to bring spouses together faster? They really messed THAT up!

So basically we need to wait for the NVC now. Well it is better anyway but still....it is ridiculous that it should take SIX freaking months for a K3 now.

I got an e-mail today saying my I-130 was transferred from Vermont to California Service Center as it has jurisdiction over the case and I will receive a letter from the local office. I live in upstate NY 2 hours from the Vermont Service Center. How is California local???????? Any ideas why??? What should I do? Is it possible Vermont is so backlogged they need help???? I am stressed now. Anyone else have this happen?



I just found out the same thing, I posted a thread in CR1/IR1 to see i could get an answer from sosmeone. I guess Vermont is realizing that they can't do it by themselves so they are asking fo rhelp or it is like I have been reading that California will be the service centre to process I130 in the future, I am just a little distraught though, was kindda hoping for an early approval seeing I was going through Vermont.

Where did you enter "NO"? The instructions say to check all that apply if you have ever been convicted of those crimes against nature. I assumed if you had never done any of them and signed your name you were attesting to that fact.

The form also says I am legally able and intend to marry my fiance upon her arrival in the US - guess what - we're already married!!!! SO I guess that means all of us K-3 filers are committing purgery!!!!

I opened my e-mail this morning thinking I was going to see "RFE" but I really got a letter of APPROVAL for my I-130! Yipeeeeee! So the K-3 is being held up for quite some time so I think we will be going just with the CR-1 from here on out. Good luck to everyone and I'll probably be posting more in the CR-1 forum from now on. I received my first RFE on July 3rd and sent the reply the same day. I received my second RFE on July 17th and sent the reply the same day. Yet I have no notification that either has been received.

Does anyone else have this issue? I'm trying not to worry, but it's getting out of my control.


Hi I am in the same boat has you. Same days and all, but no response about either one.

When I didn't get any response about the first one, I sent the second one delivery confirmation with RFE RESPONE on the envelope, just so I will know when they got it.

Most people have received an e-mail like the one I got after submitting my first RFE:

Application Type: I129F , PETITION FOR FIANCE(E)

Current Status:

On July 11, 2006, we received your response to our request for evidence or information. I received my first RFE on July 3rd and sent the reply the same day. I received my second RFE on July 17th and sent the reply the same day. Yet I have no notification that either has been received.

Does anyone else have this issue? I'm trying not to worry, but it's getting out of my control.

So the best thing that has happened to me since I met my husband was last night when I received my email that our i-129F got approved in Missouri!!!!! I am so happy I can't believe it.
