I'm sorry that I have not posted anymore of the story. I really thought that I would be able to finish the story this weekend. But, it doesn't appear to be in the works. I guess I didn't thiink about that I was basically thinking about the quickest way to get him here is to use his 10 year visa. I would like to go and see him regularly but th etickets are not the cxheapest and wiht my son's father giving me the hardest of time with getting a passprt for him.and I doubt I would be able to pull away from him if I was to spend only a weekend with him....

I have missed out on so much I feel lost going through the threads....
I do need your assistance once again..when in a bind if you can't turn to family who else can you turn to.

Have you ever heard of any one who after filing waited too long to finish up ( I started filing back in 06, it was approved the K3 went down and he, Jamaican spouse, let it expire, well the I130 which was at the NVC expired after one year of being there without payment but back in Feb 08 the husband sent off the Choice of Agent and they reopened it) well we are at the point where they are asking for the $70 and the $400 but I refuse to pay it and he said he is working on it but still cannot come up with it yet. I could pay it and struggle harder than I am right now, temporary, but I wanst him to make a contribution to the filing...more than just signing a piece of paper.
Well he found out that he still has his 10 year visa.....My question: Do you think he can travel on it and then when he comes here he gets a lawyer and work it out? Or do you think I should just let him keep working on getting the money to pay for the $470????????? I am at my wits end and just wanst him home...

Yes, CairoBound, that seems to be the case. We have to call to see when they get our case and assign a number.

As for I-130 vs. I-129f, I still believe our K3 will unite us quicker, which is what we want. We're a only a day's drive to Montreal, so we could go back there for the CR-1 interview. But everyone's different. Some may not be close to their Embassy, or may want to work immediately, or would rather do AOS. How about you?



I am thinking twice ( not of giving up) about this, to await the approval of the K3 and then ajust here, the I130 is taking forever.
Is it possible to adjust here if the I130 has been approved already ? ( I am a little confused on that)

I'm so happy our case has been sent to the Mumbai Consulate today. I was so worried cause i spoke to someone at the NVC yesterday and was told that our case was in "Administrative processing" I wanted to just cry....all i could think of was God please help me. I'm so happy everyone i want to say good luck to you all and it's a good feeling looking at DHL tracking for today and seeing a package out of all 50 sent today saying going to Mumbai :dance: :D :dance:

If you use Correspondance or is it Correspondence it will giv eyou a page of all items sent out to which consulate. That is how I checked my K3. just make sure you have a round about date of whe the NVC sent it off. My date was screwed up because they said the 14 but the only Jamaica they had was on the 16.

For those of you who have gathered evidence for the visa interview, have you shown the consulate evidence regarding calling card purchases? I mean does this evidence have any relevance since I could buy these calling cards and use it to call other people? Has anyone used this form of evidence or does it makes sense to do it? I have plenty of other evidence but the more the better is what I go by.



I am in the same predicament. If you have the cards, try and call the customer support deparment and ask them if you could get a print out of the nubers dialed on your pin number. This only works if you have teh pin number of the cards.
I have found this site www.pincity.com, they give a monthly summary of all call in your account.

Does anyone know if certain countries have a reputation for faster processing of the K3 visa/I-130 application than others?

My husband is British and I'm American. We were recently married in the UK and are now facing a move back to the US, as I have a job offer there. We're wondering realistically how long we'll have to be apart during this application process. Is Britain fairly quick? From reading the Guides and various information, 3 months looks about average.

On a related note, does anyone know if the American Consulate in London will agree to process our I-130 if I am not technically a legal resident? (I have been living with my husband in the UK for 7 months, but haven't been working...I've just been in and out of the UK on a tourist visa.)

We have finally decided that waiting is not an option I need to send inthe petion and start the visa process real quick. Anywaayswe are gonna send it by the end of the month to the first week in March. I have been procrastinating getting my legal documents changed over into my married name. However because of taxes and my job I had to get it done today.

My question is:
When filling out the I130 do I use my married name?
The only document that has changed is my SS card, my passporthas not been changed as yet.
Would this cause a delay?

I also want to know, on the I130 required proof it asks for 'a certified copy of marriage certificate', but the FC-029 states that 'the INS has changed the policy requiring.... You may submit ordinary legibly photocopies of the original document.... You may be required to present the original....' Does this mean that I can submit a copy of my marriage cert? B)

Congratulations, Yes use your married name, as you will be sending a photocopy of your marriage certificate with your I-130 application!!.the originals are presented at the interview, as long as your copies are clear there should be no problems!!...........Good Luck :yes:



THank you. I was getting worried there. To get a certified copy of tthe marriage certificate is $35 and any others requested at the same time is an additonal $30 each. A little expensive.

I used my married name when my husband filed for our I-130. I have no idea if it will cause any problem if you won't use your married name on the petition.

This is true, you can submit a photocopy of your marriage certificate but show them the original at the time of your interview.

This is already an obsolete form. We did not use this with the petition.

I would put US citizen - since you are a US citizen. Also if you plan on taking the K-3 route, don't forget to have your husband sign two copies of the G325A ie. a total of 8 pages since each one is 4 pages. this is something I forgot to do and it cost me about 2 weeks of time sending it back and forth. :crying:

1. It is asking you to list all previous visits to the US so if he is there now you would put the date of entry....the date he will be departing, the POE and the type of visa.

2. There shouldnt be a problem as many leave their passport in their maiden name. The visa though will be issued in the passport name.

Do I send this packet to Vermont or the the P.O Box in Chicago?
I am aware that I do not need this until about the next two weeks but I would really like to know, doesn't hurt to have everything ready before hand.

You send it to the Chicago lock box, they then send it onto Missouri for processing!!

We got our NOA for our I-130. The form says recieved 4-3-06 and notice date is 4-5-06. So my question is now can I file for the I-129f? And if and when that is approved whats the next step? Will my husband be able to join me here in the States? So many questions, my appologies, I just dont want to mess anything up! I am a few days behind you I sent my packet on 4-3-06 they received it 4-5-06 but I am still waiting for the NAO1.
Inregards to your question:
Yes you can now file the I-129F, when it is approved it will be left to you spouse and the foreign embassy to complete the proces for the K3 visa (the infamous interview process-police certificate medical etc...) Follow the guides in assembyling your I129F send it out and wait until the second NAO on it before you send you husband the required things for the interveiw.
Your husband will be able to join you here in the States after the interveiw-but only if he was approved for the visa.
If I am wrong someone will be along to add or correct me.

:unsure: What if people could go wherever they want, with out going throw all this, I mean worent it be great if there was no immigration office, you could say I want to life in that city you get up and go if it dosent work out you go somewere else, that will be grate, however we have to go throw all this and what if it dosent work out what if after all this the person dosent get adjusted to life in the USA, that is possible life here is very deferent than in most other countrys. I some times wonder, my husband has here already and he knows how life is here however there is people how have never been to the USA.
I am only wondering!!!!!!!!!!!!!!


Well it happens, and sure it would be lovely if our SO could just come here all freely but the US has to protect it's citizen. They should not be has strict when it comes to people like us applying for our SOs to come and live but I guess it is understandable but hard to grasp.
I think it would be hard but my husband is vaguely familiar with life here seeing that he visists for months at a time. I also understand visiting and living are two different things but when his K3 is approved at least it wont be his first time coming here.

OK, SO I AM SAT HERE STARTING TO FILL OUT THE FORMS WOOOOOOHOOOOOOO! NOW LIKE I SAID THERE WOULD BE, I HAVE A FEW QUESTIONS. FIRST ONE IS AOUT THE G-325A FORM. THERE IS A BOX RIGHT NEXT TO THE SIGNATURE OF APPLICANT THAT SAYS THIS FORM IS SUBMITTED IN CONNECTION WITH APPLICATION FOR: NATURALIZATION, STATUS AS PERMANENT RESIDENT AND OTHER (SPECIFY). WHICH BOX DO I CHECK FOR MYSELF AND WHAT BOX DO I CHECK FOR MY HUSBAND WHEN I DO HIS SET?

I check the box with other on both our G325A and wrote K3-Sposal Visa

THE NEXT QUESTION WOULD BE ABOUT THE DS-230 FORM. IT IS ASKING QUESTIONS ABOUT MY FATHER WITH WHOM I KNOW NOTHING ABOUT. WHAT DO I PUT IF I DONT KNOW ANYTHING? (AND BEFORE ANYONE SUGGESTS THAT I ASK MY MOTHER OR ANY OF MY FAMILY MEMEBERS THAT WOULD KNOW, I DONT SPEAK TO ANY OF MY FAMILY AND THEY DONT SPEAK TO ME LOL) ALSO, IT ASKS FOR MY MOTHERS FAMILY NAME GIVEN AT BIRTH, MY GRANDMOTHER AND MY BIOLOGICAL GRANDFATHER GOT A DIVORCE AND MY MOTHER WAS THEN ADOPTED BY HER STEP FATHER WHEN MY GRANDMOTHER REMARRIED, SO WHAT NAME DO I USE? HER ADOPTED NAME OR HER NAME THAT WAS LEGALLY GIVEN AT BIRTH?

I am not too sure how to ansewr this one. IMO I woud say use the name that all her papers are in. About your father I would say N/A or NONE-which ever seems more approriate. I will be using N/A for my father.

K-3 Spouse Visa Process & ProceduresNOA-1 for our I-129F

As I was getting my mail today I said my usual little prayer hoping to get our NOA, and finally it was there, I was so excited I could barely contain myself, hopefully not too much longer before my hubby can come home, but when I went to the USCIS website I cant enter our reciept number in to be able to check for updates, even the first 3 letters arent an option to enter (as it gives examples) ours starts with MSC, also I had seen another post asking about processing times, mine also says 60-180 days, so I am thinking that they are getting back logged and thats the reason for the change in time frame. Just wanted to tell everyone, I am so happy and cant wait for the next step! Have a wonderful day everyone!!!! :thumbs:

I am applying for K3 visa for my spouse .

1. Do I need to send copies of both our birth cirtificates ? In instructions, it says something about submitting documents in Q 3, 4, 5? DO I just send my birth certificate or I need to send hers also?

2. What to answer for B.17 and B.18? In instructions, it says N/A, but in sample form in website, B17 was answered

I sent copies of my NAturalization and her birth certificate with its translation. B17 and 18 is N/A.

I recently completed my I129F and I only sent my Naturalzation papers with a copy of my passport ( all pages) no BC for my husband. If you want youcan send a copy ( it does not hurt to send more than requried, if they want the original they will send a RFE or just wait until the interview.

hello all. i am new to this website. I think this is just what I needed. I must admit that I am both a little discouraged and excited. I've only been married to my husban since 4-20 this year, and I havent mailed off 1 single thing!
It's a money thing with me! I am waiting on my husband to wire me the money for the forms. Can somebody fill me in? Which form do I file first, I-129f, OR THE I-130? :unsure:

At this point, I dont really have anything to add to a timeline. Those are soooooo inspirational. Some of u have really decent time frames going on here, some people I hear have to wait a year and more on their loved oned to get here.

I kinda need yall, right now. I am so stressed out, and I am just starting out, technically, I haven't started anything untill this weekend. How do you all make it??!! :crying: :crying: i know I have at least 6 months ahead.

I just thought of an idea. I am waiting for receipt of I-130 so that I can file I-129F for my hubby. But since recipt is taking a long time (8-10 weeks). Would it make sense if I send papers of I-129F get NOA1 and the reciept date and let them issue an RFE and then submit I-130 receipt notice.....This way, my dates for I-129F will be set ..Thoughts ?



I would have to say wait b/c teh receipt from teh I130 is required for the I129F. You need to have a pending I130 in order to get and I129f off so wait youshould be getting a reply soon.
