Just the boardingpasses of all of our trips, emails, photos(in a word document), receipts and any document that stated that we did trips together.

But frontloading the I-129Fwith information is smart because the more info they have the less questions they might ask!!!!!

Why do you want to print conversation history at this time? The I-129F petition process only requires proof of meeting in person within the last two years, doesn't require any proof of ongoing relationship, that is for later.

As for printing the conversation you could do a simple copy/paste into a word processor and then print it from there.

No, the sponsor has a household of 4 Co-sponsor has a house old of 2.

The co-sponsor must only account for the beneficiary and herself. NOT the fiancee and children.

Question 8 states

The following persons are dependent upon me for support. (Check the box if the person is wholly or partially responsible)

The fiancee and children are a totally different household all together, the co-sponsor doesn't support them in any way. The co-sponsor doesn't list anyone, she's not financially responsible for them, only the intending immigrant.

Only you and her. The household is joint sponsor + immigrant + dependents. No dependents, so just you two.

2. What document(s) does she really need to send together with the affidavit of support form?

Either tax transcripts from the IRS or the WHOLE tax return + W2s, 1099s and any schedules and worksheets. Most people order the transcripts on-line for free instead of fooling with a tax return that can be many pages thick. She will need these documents for 2009, 2010 and 2011. She will also need to send proof of U.S. Citizenship or LPR status.

Hello to all Vjers! I know it's early to ask this question because I just recieved my NOA1 few days ago. But, im trying to gather the required documents as early as possible. My question is regarding affidavit of support, I know I needed a co- sponsor because my fiancee make less than the required income for house hold of 4 (Me, her and her 2 kids). Her mum is ready to be a co-sponsor, she made enough money and doesnt have any household or dependant. My question is,

Why don't you install oovoo. YOu can take screen shots of both of you with your names. Setting up oovoo, use both of your real names that appear on your birth certificates, not nick names. You can also get a nice call history with date, time and lengh of call. I open that up and put it on top of my oovoo screen which shows my name and then the call history box shows everything else and my fiancee's name. No as many pages with Skype which will be a majot pain. I take 4 screenshoots of us talking durin a month. Beginning, middle and end, Those screenshots with you call history will be a lot less than what you do with Skype and I feel is much better. To do the screenshot you press the "ctrl" + the "Prnt Scrn" keys together. I then put it in MS Paint and then crop i so I only get the oovoo screens and you can also see the date/time form my PC. Your choice though.

I'm in a similar situation like you I'm a Nigerian student here in Netherlands although my K1 petition has been approved and currently waiting for Interview. Plssss dont even try the visitors visa, beleive me it wont work unless miracle happens! The best is to apply for the K1 or CR petition, both are better than a visitors visa(but you need to wait for at least 6 months for approval). Can someone please explain a part of the process for me. I am looking at peoples timelines and some people have different events occuring.

So the NOA2 is sent via email, is this what my fiance in the US has to forward to me?

Once I have the NOA2, what do I do? Anything or wait for Packet 3?

What exactly is packet 3, what is covered in this? Is this sent via email or post?

People are then sending back the DS230 form a day or two after getting the Packet 3, is this in the instructions from the packet 3?

When they send the DS230 form back they get a packet 4, assuming this is details of the interview?

I thought when sending back packet 3 you need to include your police check and medical? if not WHEN do you provide the consulate this information? Do you bring this to the interview with you?

Hello, the NOA2 is a notification from USCIS that your petition is approved and packet 3 is a package sent by the US embassy in the country where your interview will take place. Packet 3 normally contains form and intructions on what to do next and documents needed to be gathered before the interview. The instruction in the packet 3 will tell you what to do and as soon as this is done and sent back , they will send you another packet (4) which gives information about medical and interview date. We've decided that those USCs who give affidavits will get them notarized. For the people living in other countries it would not have any legal standing to get it done, so we won't bother them with it.

My husband (petitioner / USC) and I (beneficiary) will soon be filing the I-130 petition from abroad (where we both live) for a CR-1 visa.

As part of the evidence proving our marriage is bona fide, we want our parents and our mutual friends to write affidavits stating that they know our relationship is genuine and our marriage is legally binding and entered into in good faith.

However, we cannot find whether or not these affidavits need to be notarized. The guide here on VJ doesn't mention it and I can't find mention of it on the USCIS website either. What do you recommend?

This forum has a fair amount of information on how to file from abroad. (NB. everything called 'file from abroad' refers to the USC beinf outside of the US, since the beneficiary (you) is almost always abroad anyway).

Your first step for filing the I-130 would be to figure out where to file. If Australia has USCIS Field Office, it is possible you can still use Direct Consular Filing (check the DCF-forums for that). If there is no such office, your partner sends the petition to a Lockbox in Chicago. They'll ensure the petition ends up in the right place.

We did it the old-school way :)

Used about 30 pictures and glued them to ordinary white paper. Then, I hand-wrote a little description of the picture, the approximate date it was taken and named all the people in the picture. Something like

"April 2010, vacation in the United States.

Simone and Peter visited Peter's parents and spent some time at their lake-side cabin.

My husband scanned that package and we sent the printed scans to USCIS.

No, the US Consulate in the Netherland no longer accepts DCF. However, since both you and your husband live in NL, you can file the I-130 petition to the lockbox in Chicago. Recent trends indicate that the petition will then be forwarded to the National Benefits Center. The NBC may forward the petition to a local Field Office (most likely Frankfurt) or decide to adjudicate the petition themselves.

The processing times for I-130s filed from abroad are rosy. We've seen petitions where the time between NOA1 (acceptance) and NOA2 (approval) was only 40 days. However, I do not think you will manage to enter the US with your husband on his greencard in April if you have not yet filed the I-130, because of the additional time it takes the NVC and the consulate to arrange all things needed to give your husband his visa. It is possible for your husband to travel to the US under VWP while the I-130 is pending, but since your Dutch address will be your post address (in order to be approved asap use your Dutch address), he can't be gone from there too long, or he would risk missing important documents. He'll also need to go in for his medical and his interview in the Netherlands. There is an additional risk that if you go to the US and your husband travels on VWP, he may be sent back at the border, because they're worried he'll try to immigrate illegally. If you want to prevent this from happening, make sure he still has proof of residence in the Netherlands (a lease or a mortgage, family relations, a return ticket) and make sure he goes back well before the end of his 90 days.

If you really need to be in the US in April, it may be the best to precede him and have him join you when he gets his greencard. Less chance of missing any correspondence from USCIS / NVC / consulate, and no chance of him being sent back at the border and losing his right to travel on VWP.

I have a question for a rather specific situation. Please let me explain:

Situation:
A couple filing for a CR-1 visum, with petitioner and beneficiary living and working abroad in a country that has a tax treaty with the US. Due to the nature of the tax treaty, the adjusted gross income (line 37 on US tax return) as listed on the US tax returns is a negative number, while actual income is well above the needed poverty guideline.

Question:
Is it indeed correct to fill out this negative number for question 25 of form I-864 (Affidavit of support)?

I know that form I-864 is straightforward and literally says

My total income (adjusted gross income on IRS form 1040EZ) as reported on my federal tax returns for the most recent three years was:

, but I'd still appreciate confirmation from people who've also had to fill out a negative number here. Just, you know, for peace fo mind.

Additional questions:
If we do fill out this negative number, is an explanation for this number needed, or will the answers to the other questions on form I-864 (23,24) plus the copied tax returns ensure a proper understanding of our income situation by NVC?

Is it wise to also list assets in this scenario, or is it unnecessary if the current actual income of our family is well above the poverty guideline?

No, OP is not 'complaining and justifying', OP is trying to explain hat they sent, but is running into a cultural (and likely linguistic) misunderstanding here.

Maybe I can explain it in a way that makes more sense to you.

Belgium has no 'birth certificates' in a form that is directly translatable to the US form of the certificate. All births in Belgium are registered in centralized systems, where they can be accessed by the government. The official document of a registered birth is kept in a locked down governmental archive and is never given out to an individual citizen. Instead, a citizen may request an abstract from their entry in the government database to provide to authorities who request it. This abstract is the most official document to prove the birth and parentage of a citizen of Belgium, but it doesn't look much like a birth certificate.

In a sense, OP is right when they say that what they sent to the NVC is a 'copy', because it is a formatted print out of this governmental database, but for all intents and purposes the NVC may have, it is the original document for which OP has had to identify at city hall. The document was printed by the municipal authorities specifically for the purpose of sending it to the NVC and has been stamped and signed so as to verify that it is not a forged document. Yet, it remains and abstract of a governental database behind which there is the archived document that was once filed by OP's parents.

For purposes of identifying oneself to a foreign authority, one can request this abstract in a special multi-lingual format, so that it can be read by almost any authority, regardless of their official language. It is likely that this international abstract (the official stamped and perhaps signed proof of birth and parentage) has simply been misunderstood by the NVC people, leading to an RFE for OP.

The time lapsed between my NOA 1 and NOA 2 was 55 days, which is considerably faster than almost any petition filed by a petitioner inside the US. These people routinely wait for five to seven months, just to get to the first part (the I-130) approved. So, as far as there is an expedite, I sure benefited from it. For the record, we filed in early November, expect an interview in June and could have easily won a month of time (or so) at the NVC stage had we ourselves been faster.

The form doesn't ask to send any proof for marriage. Do you need to bring this to the interview instead?


The form itself doesn't, but the instructions with the form do. It's certainly advised to send in a nice package of evidence, including your marriage certificate (this last item is mandatory). f you want to see what we sent, I made a list of it on my personal blog (link). A good general guide for things to include is found on VJ itself, namely here.

- We are not yet married but planning to do so in about six weeks. I'm assuming that we have to wait for the marriage before filing the I-130? (instead of already filing and bringing the evidence/marriage documents to the interview)



Yes, you can only file after you've gotten married, because the marriage certificate needs to be included. However, you can have the package ready to send out the moment you have the certifcate in hand if you start compiling evidence now.

- We are planning to live in the US for around two years. The I-130 form gets my wife an immigrant visa though. Should we indicate that we are looking to immigrate to the US for an indefinite period, or for two years? Or doesn't it matter?- I-130 seems to be the best way for my wife to get to the US and be able to work. An alternative however seems to be the L1 visa (I need to work in the US for my own company, which has offices in the UK, NL and US), as it seems to be processed quicker (around one month, egov.uscis.gov/cris/processingTimesDisplay.do)? In that case I wouldn't 'use' my US citizenship though and hence it would be awkward if it would be the better route?


I suppose you could go for an L1 if your company qualifies and have a partner visum for your spouse and while it may perhaps give you a short term benefit (maybe!) of a quicker filing time, it gives you less certainty. Perhaps you and your wife decide that you'll want to stay for more than two years, for instance, or maybe something unexpected will happen with your company. With a green card for your wife, you'll be the safest and the most flexible to respond to what may happen in the future. I would personally counsel to deal with the somewhat longer wait now, but to have the certainty of an unlimited stay later.

There is no such thing as Direct Consular Filing anymore for us Dutchies.

I'm going through the same process as you, except I'm in the position of your wife, and this is what I would do in your situation:

- We put our Dutch address on the I-130. You'll file the I-864 at a later time and you can then declare that you intend to establish domicile in the US. Be prepared to show proof for this (and so maybe get started on gathering this proof now)

- Wat number is the question on the I-130 that you refer to? This form is supposed to be filled out by the UCS for a foreign spouse, so they're likely asking for your Dutch address. Yes, add an explanatory note / cover letter explaining that you're a USC who resides in The Netherlands who wishes to move to the US with his wife.

- It seems a waste to have your wife go to the US on a VWP before you're finished with the visa process. She won't be allowed to work yet and she'll need to be in The Netherlands anyway for her medical and interview. It's better to wait a few months and then just move permanently.

Otherwise, spoeedwell says many valuable things about how to establish domicile and about filing taxes. Making sure you've filed US taxes correctly is a _big_ deal and you can forget about her getting a visa of you don;t file.

Now that I'm filling out the G-325A form I'm wondering if I should include the address where I rented a room during that time in the residence section of the form. It was temporary and I was still registered as a resident in my current country.

HI all, 

 

After months and months of waiting I finally got a letter from the embassy asking me to fill out the DS-156 form online. 

 

So far I think I have all the questions answered, but my biggest concern is question 29. Have You Ever Been in The U.S.?

 

The thing is I've traveled to the US countless of times. I also lived in the US for 6 years (due to my father's work) and I have no idea how to indicate that, or if I even should, on the form. 

 

The visits from my childhood are also difficult to document. I've gone on vacation to the US many times after moving back from the US but have no documentation of this. Both my parents threw out their old passports (as did I) with the stamps showing the dates. 

 

Has anyone been in a similar situation and what should I write on my DS-156 form?

Hi all, 

 

I'm unsure what to do about question 43a on the DS-230 part 2 section. When I lived in New Jersey for a few years when I was a baby I got a SSN. It has my full name on it, with a number, but it also says 'not valid for employment'. 

 

Does this mean I have a SSN or was this some kind of temporary thing they gave me while I lived there? I don't know whether to say I ever applied for a SSN or not. My gut tells me yes and I should give the number and check the replacement card box.

Note the following things from this link:
 
1) According to the visa instructions - http://amsterdam.usc...nstructions.pdf - I am to acquire documentation satisfying the criteria of this checklist, and then submit a signed copy of the checklist to the office.
 
2) I am required to prepare a DS-156, DS-156K, and DS-230. I am required to mail these in BEFORE my interview.
 
3) The same link explains that the documentation I collect to satisfy the checklist criteria (#1) should NOT be mailed. Specifically, it says "Collect and prepare the documents using the checklist above, step 1. Do not send them to the Consulate. Keep them ready for presentation on your interview day." Part of what I have to collect is "evidence of support".
 

So here's the issue: the DS-156K asks for proof of financial support, and I have to mail the DS-156K in. 

 
It is my understanding that the primary proof of financial support are my I-134 forms. However, the instructions expressly prohibit me from sending in an I-134 form earlier than my interview.
 
QUESTION: What evidence do I include WITH the DS-156K when I mail it in, if not the I-134 forms? Do I simply send in the signed checklist, or do I need to provide ACTUAL documentation for the DS-156K specifically?

I've tried looking on the forum but I see so many conflicting answers. 

 

The DS-156K asks for proof of financial support. It is my understanding that this is the I-134, affidavit of support. But does this include all the documents (aside from just the form)? The package my fiance sent me has 50+ pages of financial documents (bank statements, tax returns, pay stubs etc.). So do I make photocopies of all these pages and send that? I thought they didn't look at those specific things until the interview itself. 

 

Another post I read on here said they didn't send any of the supporting documents (financial, engagement proof etc.) and only checked off what they had or something along those lines. 

 

Any help would be greatly appreciated.

To Eric-Pris, I'm sorry if you think my question was strange and confusing. I have zero doubts in my mind. There are just a bunch of logistical matters involved. It's a huge change in my life and everything jenni17 said is spot on. Why would I hand in my resignation BEFORE my interview? Or cancel my lease BEFORE my interview? That's more strange and confusing than anything I said in my first post. 

 

I do come from a VWP country so I was wondering if it was possible to make a mini-trip before I make my big trip. That's all. Sounds like that's not going to happen, thank you everyone for the clarification.

Yup, I found it! 

 

But it seems these posts are from when the visa was still pending for many people. I have mine in my hand right now, wouldn't that make a huge difference as it is said that as soon as you enter the country (within 6 months of approval) you have to get your K1 activated?

Hi all! 

 

Last week I had my K1 interview and I was approved! I couldn't be more excited and happy! I'm in the process now of getting everything sorted here in Europe, cancelling contracts, my lease, etc.

 

My parents today suggested I go visit my fiance at the end of the summer (they want to pay for the ticket) for a few weeks to bring some of my stuff over and to see him (we haven't seen each other in a year!). 

 

I've searched the forum and most of the answers suggest that it's up to the immigration officer whether or not to let me through. I still have a valid B1/B2 visa in my old passport. My biggest fear is being turned away which would end up being a huge waste of money and I don't know what the repercussions are as far as my K1 visa is concerned. Does anyone from Europe have any experience with this? 

 

Basically what I'm asking is, is it possible to visit my fiance in the US (I'm from Europe) and ask the immigration officer not to 'activate' my K1 visa just yet? I will be moving to the US later this year once I tie up all the loose ends here and that's when I would like to have it activated. Right now I just want to visit him and be with him for a few weeks and have a late 'summer holiday' of sorts. Should I provide proof that I still have ties to my own country that need to be sorted before I can have my visa activated? (copy of my contracts, apartment lease etc.?) 

 

Also if the immigration officer tells me it's not possible to not activate it, what then? Do I go back on the first flight or can I appeal their decision? 

 

I'm incredibly confused because there are so many conflicting answers on the forum. Some people got through immigration without activating it, others didn't.

K-1 Fiance(e) Visa Process & ProceduresName too long for I-94 form

Hi all! 

 

I'm currently preparing my I-485 form, but ran into some problems with my I-94 Arrival-Departure Record. I have a long, hyphenated first name (have used it for all my K1 documents thus far) and quite a long middle and last name. The I-94 form cut off half of my middle name in the 'First (Given) Name' field, even though I was able to type in my full first name and middle name without any errors before printing it. 

 

Now my question is, on the I-485 Part 3. it tells me to give my name exactly as it appears on your Form I-94, Arrival-Departure Record. 

 

So do I write in my 'half' printed name or my full name that I've been using for all my other documents.

I know there are still a bunch of us february filers who did not received the noa 2 yet. I know it is sometimes very difficult to stay positive. Hope we will hear something this week ! keep our fingers crossed.
