IR-1 / CR-1 Spouse Visa Process & Procedures	AOS and Employment Authorization?	When this happened with our K1 ... it was because something was not signed ! Had to wait until they mailed it back ! I called them today and it is still pending , the check has not been cashed yet. But from what I have been able to gather is it WILL get rejected but what happens to my check and my packet!!! Will I get another chance with the same packet I send and will they cash the check anyways and then I will have to come up with the cash again... OMG this process is freaking me out!!!!!!!!!!!!!!!!!! You have delivery confirmation? Thenh relax, they have it. You're going to be doing a lot more waiting. Calling them will only frustrate you. You will not believe me when I tell you this so you will call and get frustrated. You will be even more frustrated when you get the NOA1 because it uses fancy paper to tell you what you already know...they received it. Well I AM RELAX NOW....just not knowing what i did wrong in the first place was nerve wracking. . I recieved the package back with RFE because I did not sign it!!... I will send it back tomorrow of course with a delivery confirmation as I did with the first time I sent it... I am sure you have been in my shoes at one point of your journey!! SOmetimes coming here just to vend and open up is a chill pill in it self.. And I would love to continue hopefully with not feeling like I am bothering anyone!! Thanks for giving a listening ear!! I wanted to end the lawsuit in order to have NO issues with my current process but the Attorney says it has no baring on my future ... Ok I read somewhere I could be held up in NVC due to name checks cos i have history with ICE( i dont the EX does) but will my lawsuit hold baring on this too....... I wish I would have asked on here before I started all this process I would have insisted my attorney took my case.. she said I did not need to hire any attorney or her and all will be fine... she is a high end immigration attorney in LA with years of experince . She stated what happened with my Ex has no bearing on me. He was deported over staying school visa... The AOS was denied due to him nothing on my part...we did file a appeal but withdrew it. I know many ppl will love this post cos it gives opportunity to vent on me... I have heard it all from family members and friends. "Why go thur this again and are u crazy.. many thing I chooose not to post.....". But once again i did not go looking for love across the miles .... I was looking for friendship in a country I am fond of and have a bond with. Took a lot of time to decide to take this risk again and fell in love over time... My SO knows every detail of this past and for all accounts did not run the other directions ( if he was looking for GC I was absolutly was not a sure cure) So we are bone fide in LOVE and I want him here just as everyone wants their SO beside them.. K1 NOA 1 5/ 2009 all documets and photos and proof of on going relationship... Please is there anything I can do to either stop this anxiety of over thinking this or should I get my attorney involved even if she says I dont need her.. start to get senators in line with my case..... Or throw in the towel and give up and find another solution ( possibly give up my life here and move there with him).... Please be gentle...... Extremely terrified to hit the "post new topic key" Amana Shouldn't affect anything. You are entitled to bring a lawsuit for some alledged wrongdoing, it has nothing to do with a visa. If the former petition was not approved within the last two years, you shouldn't even need a waiver. As fas as name checks, that can affect anyone, no guarantees there, but it is not unusual and if you have no criminal issues, it should not be a problem other than a delay. I think you stumbled across an honest attorney (even blind squirrels can find an acorn sometimes) and she has been honest with you, IF you have been honest with her. She is actually my attorney in the lawsuit.. And was also my ex husbands & i attorney in the AOS/ deportation issues and process.. so she knows 100000000% of the history and I trust her... just I wanted to get some info here to make sure I was o the track without her.... BUt we are not married... Should he remove it for the interview... in our emails and snail mail he calls me his wife and i call him my husband ... but we know it is a justa gesture of ours.... GREAT now i am terrified we cold get denied cos i sent some of the emails and snail mail in with the package..... I hope I did not screw this up I am tears cos I am thinking I really will never be with my SO in the near future..............It could be a another year huh? I am just in not so positive mood..... K-1 Fiance(e) Visa Process & Procedures	Touched again....???????	OK I am starting to feel on like I am being teased with,,,,,,,,,,,,,,, Touched on the 23rd of Sept. due to congressman I am sure.. Touched on the 10th of Oct due to address change... Touched today but I dont know why........................................... how many times can they just touch it with giving a decision ? at least give us RFE or somthing..... Tha congressman told me they CSA are doing background checks on me.... but i thought that happen at the NVC ... he told me NVC gives the visa numbers and makes sure thier is enough in quotas.... this whole process is unnerving..... I am coming up on the 5th month in a few days.... CAN I still start calling and demanding a decision or since I have the congressman involved to I have to wait,,, Thank everyone for the support here.... K-1 Fiance(e) Visa Process & Procedures	K2.. can you bring a child later on?	We are having a bit of hold up on our K1 visa.... (they have held his passport for a week now) I believe we are approved but ????? The Consulate called again today asking about his son and if he was taking him now (he answered this on Monday at the 2nd interview( she told him if doesnt take him now he looses all chances ) he complied and told them that is fine his Mother has custody for 8 yrs now so it is fine.. Now today when they called and asked the same questions about his son... they understood his reasoning(at least she said she did) then told him it is his right to bring him at a later time with the visa we are doing.(we even put in the papers that we will bring him later) SO has anyone brought a child later after you have established. He feels it is better to settle here first and understand things and then we start the process to bring him here... His son does not speak any english and I think it is fair to let my fiancee get aquainted with life here, so we can be prepared for his schooling and tutors and such things... Well this is a harsh statement ..sorry This is the child of the woman u love so he will be apart of your life whether he follows her to the US or stays with his father,,. If my SO would even whisper these words under his breath he would NOOOOOOOOOOOO longer be my SO.. YOU LOVE and ACCEPT her , you should Love and accept her children tooo, You dont have to be a father to her sonjust be a role model. What first	HI VJers, Well now that we are very much settled in our lives , we are sooooooooo ready to bring his son ( which was included on the original K1 app) but we opted out of bringing him at the time of Azzeddines visa. Because we wanted to be fair to him(son) and have his Baba adjust first and know this is good place for him to be. Now we have received written notice from his mother (which is also out of the country) His grandmother his taking care of him rite now , for us to bring him here. So where do I begin ....... ! My husband has been here since 4/2010 he is working full time and so am I so the income guidelines are not a issue. At the time of the interview the Consulate said we can bring him at anytime cos his father has already been approved but I dont think it really can be that easy.... I am already in the US, my husband and I don't have health insurance as yet and I am 11 weeks pregnant however my baby qualified for medicaid and because I am carrying the baby I too qualify until the baby is born . My baby will continue to qualify for medicaid until he/she is one year old. So if you come to US to deliver your baby then I'm sure you will qualify especially since you are a US citizen. I wouldn't recommend paying for a lawyer. if your case is straight forward just follow the guidelines. In hind sight it is not a difficult process just a lengthy one. VJ is also an excellent source of information and support, so if you have questions this is the place to write where you will no doubt find an answer. I (US Citizen) am worried that if he sells in a few months that means our I-129 form is incorrect and that it will be RFE of his move. K-1 Fiance(e) Visa Process & Procedures	About to file K-1 petition	Hello everyone! My Fiance and I are about to send in our K1 packet and would like any last minute helpful hints. We have read all the guides and I have spent hours reading topics in all the forums. I guess I'm looking for typical things missed in the filing or reasons the USCIS needed more evidence. Also in reading the forums I got the general impression that putting the packet together with formal legal tabs and a nice bound cover wasn't necessary since they just tear it apart and make their own - should I continue with my plan of putting together a "fancy" presentation?
