They do that too, I went for my K-1 interview, 2 days later the CO called by herself to my office to confirm that I worked where I said and inquiried to my supervisor if he knew about my SO and me moving and so on. He knew about my moving but didn't met in person my SO, so he told her what he knew at that moment.

That sounds like an invasion of privacy. I can see them asking if you were still employed, but they should not be asking your employer about your personal life.

We received via e-mail the Notice of approval on Augusto 20th. And the green card arrived on the 26th.
Biometrics were done back on July 24th.
We were expecting the all process to take longer than the 3 months it took since we sent the petition back in mid May.

So, we have come to the end of this Journey, for me it all started back in September 2006. It's been a long way. We moved to Seattle about a year ago and are now raising a 11 month daughter.

If an American citizen decides to move to the UK, they need a visa to stay beyond 6 months, yes?

Sorry if I appear dense. I'm just not understanding how naturalisation helps them "stay in the UK" without someone having a 6-month restriction.

There's no reason to not sign up, really. smile.gif I got the first sign of my NOA2 through an email update, thanks to signing up for updates.

Plus, later, when you apply for AOS and have 3 cases to follow (potentially), you can keep everything in one spot without having to manually type the numbers in.

Only you need to be there... just make sure you have the appointment letter, GC and DL with you when you go there. Also, make sure that you don't get any scratches on your fingers or else they might ask you to come back in a few days when the scratches have healed.

A K1 adjusting status will not have a greencard to take to biometrics. A valid passport and the appt letter are enough.

My 2 yr conditional visa will run out in Aug 2011. I have not been able to find work in US for some time now and have the opportunity of a job back in the UK. Does anyone know if there is a maximum amount of time I can go back to UK without it affecting my visa? when the time comes could i send in the removing condition forms without living in US? My husband would still be here in US. i realize i would have to fly back to US for biometric test. I would only take this job as a temporary measure for income and as I intend to come back to US permanently to be with my husband so wouldnt be able to do it if it jeapordises my US visa situation. This wasn't our plan at all but unfortunately the economic situation here is meaning we have to think of other options ;(
If i went back to UK and did not remove conditions,what happens, would we have to start the whole perm. residency thing from scratch again upon my return to US?

I have read in a few places (http://britishexpats...ard_Abandonment, for example) that the limit is 6 months off of US soil. Also, "The same will apply if you have made multiple trips outside the United States, returning only for short periods every 6 months."

If you have a permanent job in a country outside the US, your desire to be a US resident may be questionable by immigration.

I've often wondered that too, does it mean SINCE you've obtained your green card or do they want the documents you've already submitted in the original petition stage?



It means "if you have EVER been arrested or detained"... you must submit documentation explaining why.

I am completing my I-751 as my second anniversary is in January 2011.
I am reviewing the instuctions and I am confused about the criminal history information required. Do I need to resubmit any information I presented with my original application or is it only necessary to submit any criminal history that may have occurred since obtaining my green card.

The instructions seem to indicate that you only need to submit evidence regarding a criminal history ONLY if you have ever been arrested or detained. See pages 2 and 3: http://www.uscis.gov.../i-751instr.pdf

Hi Lisa and Ian. Good to see you pop up again.

Joanna--We have the same house situation as you and had no problems or RFEs. It just took VSC a long time to approve because they are slower. I'd apply sooner just to get in the queue. As a matter of fact we don't have the same last name, only one joint utility bill, no kids, no beneficiary status on health insurance or pension plan. I just gathered all I could find with both names, like even the cat's rabies vaccination LOL. I also sent photos where we didn't look all posed, where we were working on our house and looked cr@ppy, as well some with family on holidays (ie Thanksgiving and Christmas, not vacation "holidays"). I thought those showed a shared life better than posing in front of Buckinham Palace. Try to get a smattering of documentation covering the full two years of marriage and you'll be fine without a lease or house title.

Meanwhile....it's time for us to start learning the citizenship stuff and apply around Christmas. More forms...more money...more waiting... ::SIGH::


So, Nich... what do you do in that timeframe when you greencard has expired and you're waiting for ROC approval/new card, as far as being able to leave the country? Do they give you an extension letter?

Not everyone has a long wait for biometrics. Biometrics appointments are based on the ASC center and how busy or slow they are. Some people got their biometrics VERY quickly for September filers. Had they left for a trip they would be in a lot of problems with missing biometrics.

NOA1 is the receipt that also says your greencard is extended.
There is a long wait after biometrics, so 3 weeks will be alright.

Hi guys!

I did an adjustment of status from student visa to 2 year GC and got the GC 1 march 2009.
I was thinking of sending in application to remove conditions to get a 10 year GC the first January 2012.
This would be exactly 1 year and 9 months.

Question 1: Is the time ok? Too early?

Question 2: I was thinking of buying tickets now to visit my family 3 weeks around middle of January returning in February.
I know when adjusting status you shouldn't travel unless it's been approved. Is it the same thing when removing conditions?

Please let me know if you are 100% sure. Since when they receive my application, I would be outside US.

If your initial 2 year greencard was received around March 1, 2009, wouldn't it have expired by March 1, 2011?

hello guys! i have something to share and i hope you guys can advise me, coz i'm a little bit confused for the next step. sigh

i was married to a Dual citizen US-Filipina last march 2011. she brought me here via fiance visa. we have a 4 month old daughter born last june 2011 here in anaheim CA, USA. i already have 2yr GC (conditional) and EAD, SSN (received Green Card Sept 22, 2011). so were starting to gather information regarding removal condition for residency. i'm working temporary on a retail store. my wife is also working part time as a caregiver. but we can't afford the cost of living here. My aunt (co-sponsor) is helping us to pay our rent, utilities and sometimes for the food. so our plan is to send my wife and daughter to philippines for the mean time until i can save money. but i don't knonow if sending them back to philippines is a good idea now that we have to be together for 2 yrs to prove our marriage for ROC on sept. 2013. pls help me! thanks

1. what are the needed documents for Removal of condition?
2. do i need to notify USCIS if my wife goes back to philippines?

California is expensive. Any chance you could move to a more affordable location? Compare the cost of living where you are with Idaho or Wyoming, for example.

If he is moving, then he needs to file an AR-11 to change his address and finish up in his new state of residency.

I've been a member here for several years, but due to the sensitivity of this topic, I chose to sign in under another name. My husband and I have been married for 2 1/2 years or so. We went through the k-1 visa process, aos, etc. we're approaching the time to fill out the paperwork for removing conditions. my husband told me about a year ago (around the time our own son was born) that he has two other children that he never told me about. I was, understandably, very upset but we have been working through it. We have since been in regular contact with the children (who are not living with their birth mother but with a friend of my husband's family). My question is that we didn't claim the children on any of the other paperwork-not with the k-1 or AOS. If I would have known, we would have claimed them. I don't want to lie and I''m so scared that we're going to have issues suddenly claiming these children. They will not be moving here for the time being as we may move back to my husband's home country to be closer with them. For right now, though, we are proceeding with ROC, and I'm just so confused....I feel like we need an attorney, but I don't know where to start there either. I know it's probably a shot in the dark to find someone who's been through the same thing, but any advice would be appreciated. Should I find a local lawyer (small town) or find someone form a bigger law firm? Help!

Copies of tax returns and w2s 2010 and 2011
Bank statements for savings and checkings (only one I found from last year and the rest this year
Car insurance and bills joint
sworn affidavits from 2 people (notarized)
Copies of previous joint health insurance and current dental with bills showing me as beneficary on policy
copies of both drivers licenses showing same residence
copy of newborn son's birth certificate
lease agreement

Do you think this is enough evidence? OR we might get an RFE or interview request??? BTW, his green card expires july 20 do we send in the package april 20 or send it a few days earlier to make sure that Vermont receives on april 20

Yes definitely I will send them the latest tax return (2011) which I submitted to IRS after I sent the ROC application back in November last year. I have also sent them the rental agreement with both our names on it. The car insurance is another thing I can send. I will also ask my corporate for a letter stating that my wife and kid are the beneficiaries of my benefits (life insurance, disability, etc..).


It may be a good idea to explain in your letter why you don't have a joint bank account, if you have a really good reason. I know some couples who are both American don't have them because they don't believe in them, but they have the advantage of both being citizens, unfortunately. Everyone else is expected to co-mingle.

You have some good advice from others. I hope your RFE is resolved and you can move on quickly.

yes kind of sort of. He requested notarized translation of my medical procedure in Russia and our tax return for 2011. We will amend the previous tax return. To get the new tax return it takes several month. I already posted how my husband filed through a friend of a friend and she filed as he was single :bonk: Anyway we will send him the letter confirming that. That's all he asked actually :translation of my medical bill and tax return. But lawyer came up with a whole bunch of other stuff we can submit.Including mine and my husband's letter explaining our marriage, living arrangements and etc He wants us to submit more affidavits too. Every affidavit should be notarized and only US citizen or GC holder can submit. So i guess we are going to ask my husband's many cousing to help us out on this. And my husband has A LOT of cousins :thumbs:
He didn't ask us any personal questions. Just where we live, work, date and place of marriage, date of birth and previous addresses.


Can't you just get the amended tax return filled out and photocopy it for proof?

It sounds like you're getting it sorted, even though it's a lot of extra work.

My interview is on Tuesday... So we are getting all the papers again. I emailed the lady who did our taxes and she emailed me our taxes. I am soooooo mad. It says that my husband's filing status is single!!! He is saying that he told her to file married. She even had 2010 returns too and that shows we were married. I didn't work this year cuz i broke my limbs and i couldn't even walk. So i was home for a long time. But i didn't get any money from the goverment and don't have W-2 form for this year. I don't know this tax lady is stupid! And i'm stupid to not even check what my husband filed. Like year 2010 i didn't even have to sign they used my e-signature from previous years. My husband is so busy all the time. He didn't look it over. He just dropped off the papers she asked for and that was it.
SO what do you guys think is it really bad? We have taxes for 2 previous years. I'm calling this tax lady on Monday to fix this! But i mean we will try to explain the situation at the interview but is it totally the reason that they might deny our case?

They can ask for an interview for ROC. It just doesn't seem to be common, but it is done.

So, as some of you may know i'm waiting for our interview appointment. A couple of days ago my husband was going through our mail and what happened was he put all the letters on the table and then went away for like 30 minutes. There was a baby in the house and she completely took advantage of the situation : she spilled juice on the mail and destroyed it. Including the letter from the immigration which said that our case was moved to SD office and interview was being scheduled.
I called USCIS to request a courtesy copy. I waited on hold for an hour and then this lady...She just didn't listen. She was under impression that i lost my extension letter. I told her like 5 times i do not need it and then my husband told her the same thing (he has no accent), but she was like a robot. She was putting in a service request to resend extension letter. I had to literally yell to stop her. AND THEN she was like," so what is your problem again? i can't really hear you" OMG i told her again and she went, " oh no it doesn't show any interview in my system. it just shows that we received your BIO. cases like yours are processed within 6-12 months. so just wait and if by November 2012 you don't hear anything, then we will put a service request". Can you imagine? SO, i told her again that this letter said that we are going to have an interview, but she was telling me that it is not true and there is no interview being scheduled and no your case hasn't been moved anywhere. OMG....finally i made her put a service request to look into it. Srsly...i guess she was just avoiding putting service request...It's funny how NOW they are saying that this cases are processed within 6-12 months. It was a different story before.


Good gosh... Sounds like you got connected to a rocket scientist. :) I hope the mail will be out of the way of the baby when the appointment letter arrives. :D Hang in there. It sounds like they are getting close if the letter said they transferred the case.

Thanks HeatDeath! Yes we are relived though we are currently in the Philippines and our neighbor is collecting our mail! I received notice in the last few hours of production of one of the two cards (mother and daughter) and mailing of the same. The second card - if it is anything like the approval notices will follow tomorrow. The first time through was a nail biter. This time I didn't have as much to send... go figure. We did send a sh*t load of photos covering events over the entire two years. I know they said two affidavids but we sent three. Last time we were interviewed. This time has anyone been interviewed?


My wife says she will start studying for the naturalization test as soon as we get back to the states.


Wait till you see all the stuff you have to send with the naturalization request. It's like the fiance visa all over again. (grr)

By the way, Vermont filers, the service center is currently working on August 2011 filings. (linkage for newbies: https://egov.uscis.g...sDisplayInit.do At Service Center, pick VSC and click the processing dates button for info.) The processing time-frames were last updated on March 31, 2012. Hopefully, there are more updates soon!

They usually seem to be knee-deep in applications there.

Sounds like they flubbed up somewhere and need the biometrics again. I guess you could call them, but my bet would be that they're probably going to move quickly after you get the biometrics done. Call your biometrics office and see if they'll let you walk in early, if you want. :)

Me and my wife are saying the same thing. We filed on November 8,2011 and had her go for her Biometrics appointment in Boston on December 20th and haven't heard anything since. How would I be able to add our names to the Vermont list of those who filed in November 2011? What and where is the VJ Text editer located? Thank You for any help you could give us.


I wonder why Vermont doesn't pass out work like the CSC does. It's not really fair for the Vermont people to have to wait so long. They should at least let them file 6 months in advance instead of 3.

Immigration must be very busy these days. Our online status hasn't changed and no email notification of our approval. We were totally surprised to get the letter in the mail yesterday.

Hang in there if you're still waiting. Approval is coming. :)

It will be a specified doctor, only civil surgons can do it, you will be able to find out who exactly will do it from your consulate review or on the european board. No actions by the USC and/or beneficiary are required."

OR, you might call the DOS. I have a note in my notepad saying, "DOS is who you can call to see if your interview date has been assigned. 202 663 1225" I'm guessing they might know what to do with your expiration date.

it says "even if divorced below it so I assume you would. What did u put for your passport Issuing city? I left mine blank in the end cos UK passports don't give one.

What you received is Packet 3. The Embassy no longer mails out the forms, you need to download and print them from the website link they provided.

Evidence of Financial Support. Is the affidavit fo support. THese is nothing on the US embassy webpage to help here. What form should i use to complete this information to their standards?

If you get stuck filling out any of the forms, go here: http://www.visajourn...p;page=examples. The DS156 is not the Evidence of Financial Support. The i-134 is the Evidence of Financial support. This is what your fiancee should be filling out and sending to you, with her documentation.


Evidence of engagement: What they want? Ring receipt? If you have it, or we just collected emails talking about our impending wedding. My fiance asked my father for my hand in marriage by email, so we included that. This is not something you send with Packet 3.

Birth certificates of all children: Do they want this even if they are ot accompanying me? I don't think so, If your kids are 21 or over, then no. Otherwise, I don't see why they would need these. Anyone else have this info??

Do i send in photo-copies of all additional documents (which are also on the checkilist)? Or do i send nothing in and just take the evidence with me?
All supporting evidence goes with you to the interview. Only the DS forms and the IV15 are mailed to the IVU.


DS230 part 1
Part 1 only - leave Part 2 blank. Is this correct? Leave blank any part that says "Do not write below this line". Fill out everything else. We sent part 1 and part 2 in our packet.

Q35 - All trips to the USA. Got to remember them all? Well, you can only record what you can remember. Do you have stamps in your passport? Anyone you travelled with who could help you out?

Well, I would suggest the correct answer is yes, but considering it takes approx 2 weeks to get the police check, how close are you? How close are you to getting your affadavit? I hear packet 4 takes at least 2 weeks.


Court / prison record. Never been to either. Do i stilll need this? No

Additional
Evidence like photos etc. re required. Assume just for the interview? Correct!

Be sure you include 2 copies of Form DS-156 and DS-157 for each family member applying for a visa.

Keep one copy of everything for yourself! This will help in case something gets lost at the embassy or in the mail along the way.
