I posted this in another forum here on VJ...but what is everybody here's thoughts on this?

Ok from my reading on here it seems that it is highly advisable for my fiancee to obtain her SS# BEFORE we get married, then apply for the name change. It also seems that you need to wait 2 weeks after POE for her information to be in the system to obtain the SS#. My fiancees POE date is Dec. 13th, I want to be married before the end of the year for tax purposes. If I wait two weeks then that puts applying for the SS# around Dec 28th or 29th...that is IF she is in the system by then, and I think that may be iffy because of the holidays. Then this would only leave us about 2 days for the marriage. My question is...does it really matter? Could we marry right after she arrives, then apply for the SS# 2 weeks after her arrival but apply using her maiden name, then when she receives her number, file for the name change? Is this doable?

Yeah this is pretty much what i did. I went to get my SSN 2 weeks after I arrived & I wasn't in their system yet so I went back later, still not in the system so I just applied for the number (they have to send away for it, it'll take 8 weeks) 2 days before we married. after u get married u have to apply for the marriage cert & that takes a month or more, we got married on the 11nov & still dont' have our cert. so If she waits untill after u get yr cert it'll be too late. so yes go ahead with yr wedding plans then go & apply for her SSN as soon as u can in her maiden name then change it when you finally get yr marriage cert. U can't apply for AOS till u have it either. Man i can't wait for it to come so I can apply for AOS!

Hope this makes sense biggrin.gif

I just reviewed the site: http://www.losangele...quirements.html and it does not mention the need for a Social Security Card or number in order to get married in Los Angeles, CA. I also did a search of Las Vegas requirements, and neither did 'Vegas require a Social Security Card or number. Leidys arrived almost 2 weeks ago, so I am wondering if this requirement has to do with requirements in other respective states? Anyone?

-Ken

I can speak for Nebraska, which doesn't require an SSN or even picking up the marriage license in person. smile.gif

Like Rhiann said, it varies by state. You can Google marriage licenses on official state sites, and that would help. Here's more info on LA: http://www.lavote.ne...k/marriages.cfm You can even apply online. smile.gif

Good luck! Keep us posted!

Just thought I'd share that Ian and I were married over the weekend. I wondered what a courthouse wedding would be like, and it turned out to be wonderful. The ceremony took about 20 minutes, and was full of the customary, "Marriage is an important commitment" statements, which was really nice... it wasn't a quick "do you?" kind of ceremony. As soon as the judge opened her mouth, tears started rolling down my cheek (happy tears).

At the end, my dad was even crying, and he rarely does that. It was a really happy day!

We had a dinner at a really nice restaurant afterward. They were kind enough to reserve a table for 15 in a quiet area and their pastry chef even made us a cake. It was perfect.

We work so hard and so long to come to this place, it is really amazing when we get to the spot where we are actually saying "I do". smile.gif

We all get there. This is the goal we work for, and it comes eventually. Keep working and I hope everyone makes good progress on their journey this week! star_smile.gif

I wish you a very happy marriage! It sounds like you had a wonderful wedding day smile.gif

I was also pleasantly surprised how nice our ceremony turned out in San Francisco City Hall -- it's really such a beautiful place. We did not plan much for our marriage day, because we are planning a wedding later in April so our families can attend. But actually the ceremony was very special, and I also had tears in my eyes. A few friends came to City Hall and brought champagne and cupcakes. I organized (very last minute -- a week in advance) a dinner at a spanish restaurant and 18 of our friends came, and then we went dancing to a small club which had african music. It was a very special and fun day smile.gif

Sounds like you had a perfect day! smile.gif I love the intimacy of a courthouse wedding. It was sweet of your friends to bring cupcakes and champagne.

Best wishes for the future! smile.gif

Ian & Lisa - Congratulations on your wedding. After dropping serious $$ on going to the Interview, money is in short supply. We are trying to figure things out, so it will be creative. whistling.gif EOTR - don't give up, it sounds crazy the things you are being put through, but it will be worth it.

Leidys is at school tonight, learning and practicing her English. So many Latin American immigrants in the city where we live, gives her so much hope about a bright future here. She's my Superstar! star_smile.gif

How exciting! I'll be interested to hear what she thinks of it. smile.gif You can't go wrong with a courthouse wedding, in my opinion. It's nice and very low $$ wise. Good luck! I'm so happy for you guys!

Good, keep us posted! I'm all somewhat happy, cause I called the DOS Friday and they said our documents qualified however they didnt make the visa yet....soooooooo, we'll see....I'll be bugging them next week....I keep on remembering Marm I think, she says the DOS ladies lie. Soooo, i donno...we'll see.

You shouldn't have the same sort of delay from the embassy. It sounds like you're approved to me.

Does Nigel have his ticket from the courier? If so get the tracking number and check the courier website. Once the tracking number is recognized, they have your visa in-hand, and you'll see your delivery date.

Even when he sent the passport with the courier, they gave the tracking number, however even SENT it was never a valid # on the website, I will have him dig it up again to 2nd check but I will phone our ladies at the DOS every day or so...they know me pretty well now...lol...

The tracking number will not show up as valid until the day before delivery, which is when they have it in hand. If I remember correctly, ours took 4 or 5 days. As you know, it varies according to how much paperwork they're shuffling that day. smile.gif

Now I am so worried about all this. crying.gif

My fiance went to the VFS office to submit everything and they did not take any proof of our relationship or the affidavit of support. They told him to bring this at the interview. This is very unusual because they usually take the affidavit of support at least. They took everything from his side that is required. I don't know as I am not feeling so good about this now.

London only takes the aff of support at the interview. Are you sure they normally take it prior to the interview? I know they're all different.. (it seems, anyway).

Wow bro...truly sorry to hear this. I hear what you are saying, but I think the stress between the two of you is probabely magnified by the facts of the distance apart (physically), the time apart and the unbelievable ####### you both are going through. It is true that rough times can show how a relationship really is...but it is sooooo much harder when thousands of miles apart. Maybe you both can just take a little time away to think.

Of course once I write it then we have a wonderful conversation (this morning) to smooth over everything (my gawd I am so happy). Being apart and the ####### happening is tearing at us. We do try to take time away but it never works... she called today to say she was sorry (that is a huge thing for a Chinese woman) and I was shocked. Cultural thing. Just a rough time for us, and the consulate is waiting for us to tell them when we want to interview!!!! I tell you, I am on page 457 of the book I am writing about this. I wonder what the next plot twist will happen. Not that I want more. We just want to be together.

So, how soon till you anticipate you can have the interview? Things can be difficult when you're apart, but hang in there. Hopefully, you'll be able to make a visit soon or schedule that interview. smile.gif

PASSED! CO was very nice but asked tough questions. I have no doubt that had i not been here, it would have been a denial as he was ALOT more interested in interviewing me than my fiancee. Interview was about 25 minutes long... about 10 minutes quizzing my fiancee and about 15 minutes on me alone. Thanks for all the encouragement from everybody here...and thanks for the PM Ken.

Strange how consulates operate differently. At the one in Guangzhou, China they don't even let the petitioner on the same floor of the building for the interview.

Will you post the questions they asked you two in a consulate review?

He got a white paper that said under section 221(g)which meant they cant give him the visa at the time because of lack of documentation. He had a new guy interviewing him and a big lady(the boss?) behind him watching over him so that probably didn't help his situation either. Obviously he didnt have what he needed due to pure blind faith going in there. Nigel told me point blank that they said we're approved pending the documentation, cause he would have told me were outright denied and I would have freaked out and so would he have. He told me that he wouldn't have left there without a fight essentially so I think I was right in thinking he had to have proof of his stupid-ness back then. Which I think even in package 3 they stated they want records anyways of whatever stuff you did, so its only logical I believe. The end of this month we should have that subject access, so i'm gonna be curious to see come December when the embassy looks it over to see what they come up with for a verdict.

I hope it goes well for you. I really do. smile.gif

Yes, it is, but I'm sure they discussed all this at the interview. Remember how approved you are with only the receipt of the court records. smile.gif

No, letting the air out of someone's tire is not "a crime of moral turpitude". Not by a long shot. Bringing someone to the USA for slavery is, or real criminals. That is what the they are wary of. Let's not mince words. Teen pranks on autos are not.

The adjudicator's manual says differently, dude.

I am wrong anyway. Moral Turpitude is defined in the manual, but I don't believe this offense falls into it in the slightest. You know the manual better than I do.

Plus is criminal damage a crime of moral turpitude?

Yes, it is, but I'm sure they discussed all this at the interview. Remember how approved you are with only the receipt of the court records. smile.gif

No, letting the air out of someone's tire is not "a crime of moral turpitude". Not by a long shot. Bringing someone to the USA for slavery is, or real criminals. That is what the they are wary of. Let's not mince words. Teen pranks on autos are not.

The adjudicator's manual says differently, dude.

Just love the encouragement...you wonder why i put myself in this place....why i torture myself coming here...

Remember the day when you read through the adjudicator's manual and you determined that everything was fine? It says that anything committed 18 or over isn't counted, and his crime of letting air out of tires, whatever name you call it by, is absolutely minor. You didn't get a white slip. You got a blue one. They need the document, is all, to put in the file.

You'll be fine!

Obviously, I'm not helping. I'll leave you guys to it.

I cant seem to function about now, all emotional, weepy, headache, fumbling at stuff walking around in a haze, kind of a good thing I took off work...this would have been ####### having to deal with this there. I know its only a setback, have to wait for his subject access thing we sent away for to come in, it had a deadline of 40 days to receive it so that should be the 20th of this month at the latest. Not sure what court house to go to being his is shut down, so thats a wild goose chase, I called the big one near him and they have no records of him, just his dad's old traffic ticket..go figure. Just a basket case over here anyways... I know I have read of people just sending their stuff in and a couple weeks later (3-5 days ya right) and they get their visa. So..........we'll see.

I found this on the British Expats forum. If they can't find info, then they need to provide a letter saying so.

"The information is exactly as reported earlier in the post - apply for the MOC at the convicting court with as many details of the offense/offense that can be recalled. The fee around 40 UK Pounds is typical. Ask the court to stamp or emboss the document as the US authorities are keen on this 'authentication' - typical MOC's often look like a photocopy.

If the information cannot be found (usually because inaccurate details have been provided - the information never 'lapses'), then the Court will provide a letter to this effect."

Hmmm....so maybe if he trotts over to Derbyshire court and requests things, maybe they can write out a letter saying they have nothing. I called them twice today and they only found his dad's old speeding ticket. Go figure. Maybe I need to contact Nigel's member of parliament (MP) in his area and make them find the damn thing! Jeezzzzzzzz

Ian says, "The MP's are not going to do anything". (MP's apparently not as helpful as US congresspeople are).

If you want Nigel to speak to Ian, Ian's willing to toss suggestions out, since he's familiar with what is where. I'll PM you his email address.

Can I just say that I am off the deep end and I recuse myself from this thread going forward, sparing you my situation's continued meltdown?

Thanks and best to all of you.

Sorry you're having a difficult time. Maybe just get ahold of her and say you understand this is quite important to her, but you are sometimes so wanting to see her and be with her that any anything else seems unimportant in comparison.

I hope the legal issues are resolved soon. Is there any time limit in sight for a ruling from the court?

POE Minneapolis = piece of cake
The packet was reviewed by the immigration officer, they gave him the low-down on the getting married within 90 days bit, and off he went. No questions asked at all. star_smile.gif

Endoftheroad-I'm so sorry for all of this hell that the court systems over there are putting you through. Don't give up! It's not going to be six years. I sure hope that you're going to see them soon.

IAN IS IN THE USA!!! WELCOME BROTHER!

Thanks attaya, There is no way I'm giving up even if I have to wait six years. My boss is going to let me know this week if they are going to give me the money so I can go to China next week. xfingers_crossedx good.gif

Ian says, "awww". I had to laugh this morning, because every 3 minutes he says, "I live in America now." biggrin.gif He is currently downloading US maps to his satnav. Very cool.

Fingers crossed for your trip to China!!

Allie.... Thinking about you and sending ALL SORTS of good vibes your way. Can't wait to hear your news tomorrow morning! biggrin.gif

You know, I DID buy some chocolate "for Halloween" hehe...but ya, i'm a wreck right now, i'm really glad every day is over just to get to the next, like squares in a board game. I dont want to even think about if we get denied, I really dont know what we'll do. Sell the house, the car, move to England, whatever it takes, but I dont want to think like that right now, I'm just going round and round in my head with stuff right now, Lisa tells me just to BREATHE but its easy for her to say right now. So, i'm really trying to think positive and to keep the thoughts swayed to the approval not a denial...4 more sleeps....lol.

Oh, and breathing is not the only thing I've suggested (breathing hopefully gets you out of anxiety for a moment, though).

My tips for the interview: Listen to the questions carefully, answer them honestly. You know they are not going to care about his juvenile offense. They may discuss it, but it's not going to be a show-stopper. You know that from reading the manual. It's just that it's stressful and you don't want your interview to fail. It's not going to!

Star - Hang in there... At least you're making progress! Having an interview date is a good thing. Knowing they're approving people, also good! Smooth sailing from here. smile.gif

EOTR - I really hope things work out quickly for you. It stinks that their computer was stolen. sad.gif

Have a good rest of the weekend everyone!
