What I've noticed is that AP @ the embassy tends to happen sometimes to foreign students living in the UK. I think sometimes it's random, as well.

We went through AP at the NVC level. We think it was an FBI namecheck, since my fiance has a common name and when we Googled his name, there was someone else with that name who had had a criminal history.

Sometimes, I think it may be completely random.

Have him call the county clerk where the divorce took place and tell them he needs an official stamped copy of his divorce decree. They'll be able to tell him what to do next. This should be a really quick turn-around.

I was just re-reading somethings at the DOS website and now I am more confused. I was told that We will have to pay 1200 for AOS after Hani arrives. Now I am reading that He must pay 131 fee and anoter 355 fee just to have his interview? And that is after the fee we paid for the I129? And 150 for a doctor?

Please someone clear this up for me. He is filing for fiance visa and immigrant visa at the interview?

$131 + medical $ due after the embassy has received your approved documentation and schedules the interview/the medical is scheduled - 4 to 6 months down the road

$ for Flight ticket to the US - when the fiance decides to move to the US (within 6 months after approval)

Adj of Status fees are due when AOS is filed after the marriage (preferably before the i-94 expires, which is usually 3 months after landing)

The good part of the process is that not everything becomes due at once. It seems easier when it's spread out/you have time to save for it.

Our interview is in about 4 weeks and the consulate told us that the price will be $131, and the State Department still lists $131 that as the fee. Our letter of confirmation was dated 18 Feb.

The K1 visa increase won't be in effect for a few months yet IMO. Just remember, it's considered a one-time entry NIV, not an IV (even if it's otherwise treated like an IV).

Hey everyone

I've been told my Packet 3 is on its way so I'm getting prepared by doing as many of the forms as possible in advance.

I've just got a couple of questions that I hope some of you who have been through this already will be able to answer - mostly about employment and visit history. Here goes...

1. On my DS-157 it asks for my last 2 employers. My last 2 jobs (prior to my current job) were both with the same company (Disney) but in different lines of business and at 2 separate periods. Should I just list Disney twice? Yes, this is the same as you'd do on a resume.
2. In the same vein on the DS-157, for my earlier stint with Disney I can remember my supervisor's first name but not her last name (first-name company and they specifically won't give references, so I'm not sure I ever knew it). What should I put down? Put "Human Resources"
3. For the DS-156 and the DS-230 they want your history of visits to the US. Should I include ALL vacations or just times when I entered on a visa? I can remember as far back as 1994 but not before that but I know I visited cos my granddad lived there... Just put what you can remember. If you've got stamps in a current or former passport, those can be helpful in noting dates.

Your fiance needs to enter the US with the K1 visa (otherwise known as "POE") and then you can get married anywhere you want in America.

Hi,

I came to the US on a K1 visa in Nov 2009 and applied for AOS in 01/2010. I just received an RFE (not sure for what yet), but I just remembered something - they never opened my package at the POE. Is that normal? I was told at the embassy that the officer at the POE would open the package and or keep it and I assume send it off some place. Do you think this recent RFE due to the fact they're missing some info from that package (the medical) that wasn't forwarded on. I have the package here, sealed as is was when I received it. Hmmm...

They didn't open your package (which is not normal), but did they keep it? If they kept it, hopefully they still have the paperwork and the RFE is about something else.

I personally would wait to see what the RFE is about before doing anything. You don't know what the RFE is about until you get the copy of it in the mail.

I just sent one of the i-129 copies to Ian to take to his interview. We bundled together whatever original plane tickets we had left, photos and some greeting cards. Don't send important things like original birth certs, or passports, btw.

So my fiance's interview is set for 27th July.

I am super confused as to whether I should go from atlanta to support her during the interview in London or not?
I believe our case is very simple, we have all the required documents and in all honesty she should be pretty okay without me but then there is the other stupid half of my brain telling me if I go, our case would be more stronger. For e.g. lets say God forbid but if shes denied I would end up making a trip anyway to marry her in the UK and file as CR-1.

So do you think it is worth it to go to the UK at a cost of $2000(flight + hotel) for 3 days ? My instinct is saying yes...but like a loser I need some reaffirmation (or good reasons as to why I should not go )



I remember feeling this way, too. The interview is London is pretty easy, if the paperwork is organized (specifically the docs asked for in P3).

You said your case was straight-forward, so there should be no real reason to go. I figured my fiance would be fine by himself, and he'd probably know better than me what to do if he ran into a problem (you can read our embassy review for reassurance, if you want). :) He was fine (and it was all over by the time I woke up, which was selfishly nice) :D


I know exactly how you feel, but it didn't end up being a necessary thing. In the end, look at your finances and do what makes sense to you. Good luck! :)

Just when you think you are awaiting your packet 3 and interview you chase your application and receive this email:

U.S. Citizenship and Immigration Services (USCIS) is unable to locate your petition or application. You are requested to file a duplicate petition or application in order to reconstruct your case. In the interim, USCIS will continue to search for your approved petition, but at this time it appears that your petition has been lost.



It doesn't sound to me like they are asking for another fee. They want paperwork to reconstruct the file. All K-1 filers should make a copy of their petition paperwork prior to sending it ... just in case something like this happens.

Hopefully you have a spare copy you can photocopy to send them, and an address to send it to.

It is now over two weeks since we received our NOA2 from Vermont. Roughly how long does it usually take for the Embassy to receive the details. I e-mailed NVC a week ago asking this question but so far have not received a reply. Should I call them as it appears that they are easier to speak to than the USCIS.



Yes, call them. Sometimes applications go through secondary screening at NVC. Most are in and out within a few days, but some of them sit for 4'ish weeks. The NVC is pretty good. If your app is there, they will tell you when they received it and whether or not it's been sent to the embassy. Sometimes they say it's being reviewed. That's nothing to worry about. Eventually, it moves. :)



By the way, this was our timeline for NVC, but ours was on the slow side. No reason for the delay, either, as far as we knew. Just secondary screening. (shrug)

Yeah... lots of us do this ourselves. Use the 129F instructions from the USCIS website. If you read them carefully and ask VisaJourney when you need advise, you will have very few problems (if any) doing this on your own.

You can also refer to the GUIDES section on the top menu, as needed.

When my fiance gets here she will get the shots she needs. Now I heard there are some Civil Surgeons that will charge $495 for a new physical which is unnecessary. So, I wam looking for one who will just take the shot records and fill out the form as needed for submission for AOS.

I called a local one, he refuses to do so unless he does a $495 physical.

So my question is, do we have to be there? Can we find a CS who is 300 miles away and just mail, him the papers? What are we to do in his presence after all?


My (now) husband went through a similar issue 2 years ago. First, here is a web site to find civil surgeons if you've not already seen it: Civil Surgeons

Whichever one you call, it is important to ask to speak with the person who deals with immigration paperwork. Our CS had one staff member only who dealt with taking care of immigration paperwork; the others knew nothing about the procedures. Once you have that person on the phone, tell them you have the paperwork from the London immigration doctor available (ds-3025) and that your fiance only needs a shot or two. Ask them about the fee involved with getting the shots only.

It IS a good idea to have the i-693 completed by the CS while you are there. Ours charged absolutely nothing to complete that document, but others do charge a nominal fee. It should not be required to pay for a full physical if you have the paperwork from the exam abroad.

Hello everyone,

I am new to this site and was referred by a friend from work who has been through all of this :). I have been reading everything and going over all of the guides. There is a great deal of very good information. It has helped me a lot. I am slightly confused on one thing though, and maybe one of you kind people can help.
I have been going over the guide for the K1 process (Recently engaged) and I have been downloading the documents directly from the U.S dept. of State website to ensure the forms are up to date. When comparing this websites' guide to the horrible "guide" on the dept. of state website I found a section titled "Required Documentation" ( it is about half way down on this page: http://travel.state....types_2994.html)

They list all the required documentation such as passport-like photos but they also have a few more forms which I am not seeing on the K1 guide:

(ds-156) # wo (2) Nonimmigrant Visa Applications, Form DS-156 (prepared in duplicate). NOTE: K-1/K-2 visa applicants should not fill in Form DS-160, Online Nonimmigrant Visa Application
(ds-156k) # One (1) Nonimmigrant Fiancé(e) Visa Application, Form DS-156K
(ds-230) # One (1) Application For Immigrant Visa and Alien Registration, Form DS-230, Part I (You are not required to complete Part II.)

Are these all provided by the consular once the K1 is given and the interview is set? or do I have to fill all these our in preparation for the interview?

I would say that it would be most important to have proof that you earn income over the poverty level requirement currently. Regarding your tax returns, I would suggest you attach an explanatory letter, also indicating that this venture has been closed. You may want to have a sponsor "just in case" they teeter on the financials at the interview. You don't have to give them sponsorship paperwork if they seem alright without it.

It would be good to have suggestions from others who have been through your same embassy. Ours was pretty easy (London), financially speaking, but we didn't have any potential problems, really.

We received our NOA2, dated October 4. I've been checking to see if NVC has received it for several days now. I sent an email, and just got a response saying they have received it, and our petition is undergoing additional processing, and we will be given further instructions after processing is complete. So, I called and spoke to a live person at NVC, and I asked her if each petition is handled like this, or if it is something specific to ours-she said she has no information on that subject, and she could not answer any questions about that. If any of you have had this happen to you at NVC-please post! I am hoping someone can reassure me that this is normal procedure :help:


Our petition was pulled for additional processing at the NVC stage. Petitions spend varying numbers of days there. Some ship off to the embassy within a day or two, and some sit around in AP for 30 days, like ours. It's just luck-of-the-draw, and nothing to worry about approval-wise. It's another part of the wait.

You can keep checking back with NVC for status. They are pretty good with helping. They won't tell you why your petition is sitting around, though. The answer will always be "Your application is undergoing additional processing." :) (just to save you a bit of time in trying to find out)

As I sit and wait for my NOA2, I can't help but think about the K-1 process. I've been on VJ for several months now and I've read numerous success stories but also numerous horror stories. I know I need to be informed of the worst case scenarios to be prepared but I can't help in worrying that for some reason my legitimate relationship may not be approved because the country my fiance is from is high-fraud and the CO did not like the way he said "the".

As I've read different journeys I've realized the proof of the relationship is not necessarily in the "pudding". I feel the CO wants to see how much money are you willing to spend to validate and prove you have a legitimate relationship. Have you gone to see each other several times spending thousands of dollars in airfare, hotels, etc? Have you spent hundreds of dollars sending letters or packages to your fiance across international waters (are we not in the 21st century?!?) when you could just send an e-mail or wait to deliver the package and gift when you actually visit them?

Does quality not mean more than quantity? Why would $$ be an indicator of authenticity? If someone was trying to "buy" their way into the US, don't you think it would be via $$ (bribes)?

Why is religion such a red flag when one of my freedoms as a USC is freedom of religion? Can I not love someone from another religion? Even two USCs from different states could have such different beliefs and different cultures it would be comparable to being from a different country.

Why don't they read some of the e-mails or text messages that go back and forth between the couple? You can't make up that type of conversation between 2 people in love. Why don't they care about the details?

As I digress, I am at the discretion of the US government and will follow this process if I want to have a future with my fiance in the US. I will provide as much evidence as possible that they deem valid, but I can only hope and pray that my fiance and I have a smooth journey and that we can get married in August 2012. I can only dream that this will be my last holiday season alone and that next year, we will be able to celebrate our first Thanksgiving, Christmas, and New Year's together as husband and wife.


I think the issue will always be that sometimes there are fraudulent marriages, and, as an American, I feel better knowing people's intent (and criminal history) is being scrutinized before they enter the country. Also, they don't require massive amounts to be spent. All you have to do is see each other once in the last two years and show proof of a continuing relationship. I don't think this is unreasonable. My husband and I used Skype everyday, which was relatively free (except for the expense of our Internet connections), and sent email. Not everyone has that luxury, of course, but also I think the high end of the expense is paying all the fees to legally live in America... hence the attempted illegal border crossings.

JMO.

I would wait to see what happens. If you have sent just the forms and no proof, my bet would be they would return it to you because it doesn't meet the minimum requirements, and it's obvious that it doesn't. :)

If your packet is not immediately returned to you, you'll get NOA1 and eventually get an RFE when they're ready to review it. An RFE is not the end of the world. It delays things a few weeks, but if you have your proof ready to send out, then it's not like you're taking more than a couple of minutes to return the RFE request, the docs they need, and fed ex it out.

It will all be fine. Don't panic.

I personally would not withdraw and start over because I wouldn't be able to afford two fees. That's just me. :)

Hmmm, I never thought of this, but maybe the pictures I submitted got separated from the application. Do you think I should just re-submit the same photos? It could be something as simple as that. I'd like to send more photos than just the ones in the original submission. I wish they would let us know if they got the pictures and they didn't like the ones we submitted or if they don't have any at all. Now that would be extremely helpful information to have.



That's what I was just thinking! Why don't you order some photos through Walgreens or Snapfish (on photopaper). When you get them, document the backs of them thoroughly, and send them off. It's worth a shot.

Better move quickly, too! Your fiance and sponsor need to get you the forms and the supporting documentation before your interview. It shouldn't take long for them to do, but it needs to get there...

These instructions are as clear as a bell.

In regard to the final sentence, others above have noted that if AP is approved but the AOS is later denied, the AP is revoked and the traveler can be stranded outside of the U.S. In addition, CBP can refuse re-entry to any holder of the AP document. According to an immigration attorney to whom I spoke, such refusal is typically for any reason that the consulate may have used (and perhaps missed) during the visa interview.

Now, a comment to the general air: It's completely mystifying why so many I-129F beneficiaries/K-1 applicants -- with the compliance or encouragement of their petitioners -- are so wild to leave the U.S. so soon after the long process (and sometimes the hard fight) to enter. Do these people truly not comprehend the restrictions of the K-1 visa? Do they not think far enough ahead? Do they fully comprehend the process and its restrictions, but take it lightly? Do they intellectually acknowledge the restrictions but somehow believe that they and their situation will be excepted because of "hopes, dreams, and wishes?" No belittlement is intended here; these questions arise from bewilderment.


Personally, I would hang out on the mainland for the honeymoon until the AOS is complete. It was only taking 3 months or so when we applied. There are lots of pretty places to visit on the mainland while you wait. Seattle, for example... Southern California... Florida...

After NOA2 (K1), we were held at NVC for 30 days, for no apparent reason other than luck. My (now) husband is from England, so the country really doesn't matter at all. It's a random pull for further checks. You'll move on eventually, and then things will seem to fly by! :)

K-1 Fiance(e) Visa Process & ProceduresDS-156

Hey VJ,

I have filled out all of the forms that my fiance will need to have for the K1/K2 visa interview because he doesn't know English. Which are the DS-156, DS-156K, DS-157, and the DS-230. The DS-156 prints out with a bar code, now the blank form sent in packet 4 already has a bar code printed, now does it have to be typed up or can I just use the one I have filled out that has a different bar code? Don't know if the bar code makes a difference in the beneficiary's visa application package? :blink:

Another question in reference to this form is that, the last questions asks if this form was filled out by someone else. Do I have to put my information on it? Or can I just leave my fiance's name as he is the one that filled it out himself?

We did the eform. It says "The barcode that prints on the last page contains the information you entered and will help us process your application more quickly."

Weddings are not refundable. They point this out, and unfortunately that was the only thing I did understand. When you are within 90 days of the wedding you have completely paid for it. You will not be getting any of that money back, and in our case, it is a considerable sum.

I guess part of me wanted a normal person wedding, because if you live in a city, and you want a wedding, you cannot plan one in the 90 days they give you. You would have to get married twice.

We are discussing options of changing our wedding into a party, and not making it official. But this involves risking that the border protection people won't believe us, and won't let him come to his now downgraded wedding/party.

We are also looking into pushing the application along after is it through USCIS. Has anyone had any luck with this? Does congressional help work?

Your wedding may not be refundable, but can you get your vendors to move the date forward? It would be bad business practice to not allow a reschedule. I'm sure they'd rather have you tell your friends about their awesome services than how unbending they are about moving dates.

Also, you are probably aware that your fiance will have to enter the country "on the fiance visa", so if he comes over before it's issued, he has to go and come back. Technically, he is coming to visit you, right? I mean, if you have a party and are not actually getting married, do you have to declare that at the border?

It's just paper gathering and filling out the paperwork correctly.   I personally think you don't need an attorney if you have a clean-cut case... no legal issues in your past, etc.    It doesn't hurt to file it on your own and then get a lawyer later if something comes up where you need one.

Hi everyone

 

I am from Australia and am currently visiting my fiance here in the US on a B2 tourist visa. When applying for the B2 visa, I told the embassy that the purpose of my trip was tourism, and did not disclose that the primary purpose of my trip was to visit my then boyfriend, now fiance.

 

At the time I did not consider this to be a risk, as I had no intention of overstaying my B2. However, after reading some of the posts on here, it sounds like what I have done may impact our chances of getting a K1 approved.

 

Has anyone dealt with this situation? If so, can you provide some info? Anything would be great - freaking out a little bit!!!

Independence Day was great, caught the show downtown on the 3rd and the local one on the 4th. Heading to see my girls in China the last week of July for a month. Coming up on a year and a half since we were together last.

At this point we are planning the wedding... service (though we are not having a ceremony), invites, clothing, reception, etc.
