We already have our marriage license. Nebraska doesn't even care if you show up together ... we got it through the mail with photographed ID's, which I had easy access to, thanks to our 129F packet.

I don't understand. You are now legally married in the USA ... BEFORE your K1 is approved?

I see attaya already answered that. smile.gif

We have a license to get married, not a marriage certificate.

I've been spending time meeting with venue people to get our little wedding together. Yesterday, we got cake samples. smile.gif Most of me says I wouldn't mind the courthouse thing.

I find it to be really helpful.

Love the new timeline!

EOTR - Thanks for the list. V cool. I haven't seen anything from Neil in ages.

Our P3 paperwork was sent to the IVU by registered one-day delivery today. We're closely watching Britt and Duv, who are a week ahead of us with their paperwork.

Well guys, i guess we just get what we get with our processes huh. We shall see. I'm always worrying about SOMETHING lol....right now its the worry about Nigel's air letting out --NO LIVE TRACE-- on his police thingie cause its a "stepped down" charge since he was 15. I keep on telling him to find out the date and so what, pay the 60 pounds to the court for the record...but nooooooooo......he says he'll be fine, watch, he'll be the "approved pending police certificate" thingie...JEEEZZZZZZ....I sent off the last of his forms to him being his printer's messed up and so hopefully he will get off his ####### and fill out the rest of the forms and send them when this one comes in next week. I am also gonna ride is ####### on making a medical appointment Friday too...whether he likes it or not!!!!!! LOL....see how i am?

I feel like I'm running a constant race, in place, and really not getting anywhere. Monday is (hopefully) "mail the paperwork day", then it's just a matter of hearing from the embassy and scheduling the medical. wacko.gif

P.S. Don't worry about the police report. Even people with offenses get approved...even people worse off then "no live trace" (which I really think is no big deal). It's better than having something show up, eh?

Congrats, Starlight on getting that all sorted out!

Allie, Lamine and I primarily speak French together, but he speaks four other African languages as well.

His dentist appointment was very sobering. The dentist couldn't believe that he had endured that much pain for so long. He managed to do an emergency procedure that was basically a root canal minus the crown and the reconstruction. He put in a temporary filling, and we'll go back once he's on my insurance. God, he was in so, so, so much pain today. He was writhing on the couch when I got home and had a fever of 102 because the tooth was so infected that it had spread to his blood stream. He's taking some major antibiotics and pain medication, but he'll be ok. They gave him tons of anesthesia, but the tooth was so infected, that he could still feel the entire procedure--even after four shots! Poor guy. The doctor was so, so kind, though and helped us out a lot by doing this emergency procedure instead of calling it a root canal. This way, we'll pay the majority of it later, but with the x-rays and everything, it was only around $130. I was afraid it would be 1,000's and I had no idea how we'd pay it.

Hope everyone is doing well!

I hope he's feeling better! Root canals can be really painful.

I called DOS today and they (Jessica) said "your file has not arrived in Guangzhou yet." Huh? I said. My girl received her P3 already and we have returned it. Then she said that "sometimes the consulate will premptively send out the P3 before the actual file arrives." WTH???? I would call the consulate themselves but that is a for-pay service! So I don't really know what is happening. *sigh*

I take it Guangzhou doesn't have an email address (?). You might call DOS and speak to someone else tomorrow.

It just gives that "beep beep beep" thing when he calls it.

Isn't NVC one of those places where it sends you to a menu then you can choose options?
I wonder if their phone system is down or something.

EDIT: Haha, I'm magic. Just as I post this he gets through. laughing.gif

And, what did they say?

Well, he forgot to ask about what day it was received.
They sent the package to Montreal today.

Now all I have to find out is if there's some way to know when they send Packet 3 to me, the Montreal website is so not useful.

You can call the Dept of State for that. I just did that yesterday. You might give it a couple of days to arrive in Montreal first. (202)663-1225 press 1, 0

I know what you mean.. been doing the same thing as well. I will try till about midnight tonight if I have to. No idea when's a good time to call. It could be because it is Monday.

Telephone operators are available to respond to more in-depth inquiries.

Hours: Monday through Friday from 7:30 AM to 12:00 AM (EST)
Tel: (603 334-0700).

Note: This service requires the use of a touch-tone telephone.

BTW, I think the touch the day after NOA2 is shipping it out to the NVC.

Hope everyone had a wonderful holiday .... anyone do anything exciting? I pretty much sat home to save money for the rest of this process ...

Good news for us today though ... Manila has received our petition now ... and our Interview is scheduled for October 2, 2009 !! Woot ...

We could of go in as early as September 15 - 25, but she picks up her passport this week still and I still need to Fed Ex her the rest of these documents for the interview so had to push it out to October 2. But that is just right around the corner so not to much longer and we will finally be together again !

Instead of faxing paperwork, I was able to email forms in .pdf format directly to the embassy. Manila does not accept emailed forms? It was the most economical, fastest, most accurate route for us to take.

The money I saved on FedEx for the DS-230 and DS-2100, I was able to go Jeeping in the desert east of San Diego. good.gif kicking.gif

Interviews now done:

Perry/Elena Interview Date : 2009-09-03 (delayed for more info) sad.gif
attaya_girl Interview Date : 2009-09-08 <-- any word, maybe our first visa?

All DOS will say is, "The NVC is just waiting for the queue in London to clear up a bit and then they will send your packet". I believe this is untrue, because while I was waiting, several London-bound petitions came through and left long before I did.

You know, maybe they're only allowed a certain amount at certain times... I donno....its #######, thats just how it is!! Like I said, i'm giving it till the end of the month, then i'm gonna freak! lol.

Ash - Good luck with that. Are you at the embassy where you can fax your stuff in?

Ian's filling out his forms tomorrow. There's a lot to do and bizarre questions along the way. I like the 156, where it asks for a "Spouse's name (even if you are divorced)" I wonder who wrote that question.

How was Neverland, btw?

Allie - Hang in there! Maybe we should form (or join) a book club! smile.gif I've been thinking about taking a class... cake decorating or creative writing. Something.

End of the Road - At least I'm not the only one with nightmares. This is a rough process, and it's even worse in China, I'll bet, because it has to be secretive, and she has no ability to leave to visit you. How are your plans going to visit them?

Endoftheroad: Your too far in the journey to give up. It's just like when you are running a marathon and you are so close to the finish line, but you still have to keep running. I can relate to how you feel, as I feel like that about my NOA2. I was crying thinking that its going to be so difficult to provide what they need and they will deny our case. I would hate to go through this process over again. Stay strong and think about how close you are to finishing.

I try to think of all the positives. For instance, what if I got my RFE 5 months after like others and that would really delay everything. So, just focus on all the obstacles you have overcame in the process, and you will realize that the rest of the process is a breeze.

I still remember when you told me that may not get our interviews until Jan - March 09. But, you are way ahead of the game. I have a feeling my fiance will have his interview that late. He is more patient than me smile.gif .

Last night, I had a nightmare that Ian decided he didn't want to get married, or be with me, for that matter. When I woke up at 1am, I wanted to call him, but I couldn't remember what time he got up for work (turns out he was up by then!), so I just went back to sleep and had more of the same.

I cried on an off through half of my morning.

After being in the black hole for so long, I started to lose hope we'd be together, even though people kept saying we'd get out. People have been through it and survived, but it was hell, really. The waiting stinks.

It's difficult to focus again. Some days, it's just SO depressing! But, you know, this paperwork/red tape is NOT gonna win! I keep thinking about plan B... saying f'it and moving to England. smile.gif or somewhere else without crazy immigration laws. I'm not sure where that'd be, though.

Chin up, people. Keep your eye on the ball.

Well it sounds like whatever the congressman did helped as you are now out of AP!! Yay!! Yes I will be on my way soon, I am currently packing and dealing with wedding stuff. Just had my trial hair-do done this morning, and the seamstress called me for a fitting!! What a perfect day!! I can't wait until the wedding! BTW, heard from the congressman's office. By the time they called, it was already in transit to London. They said they would call the embassy next week to see how long it would be. They'll probably come back with the long ballpark figure. But, hey. It was something to do.

Somehow the Royal Mail lost our Packet 3.....Ahhhh!

I called the department of state about two weeks ago to find out of the packet 3 had been sent. They said it was sent out on the 10th of August however I still havent received it. I thought I would leave it another week or two just in case but I finally bit the bullet and called the £1.20 per minute phone line to the London embassy. It took them 7 and a half minutes (£9.40) to tell me that I would have to email them....

Very frustrating indeed...

Why don't you just pull the forms down from the Embassy website? The info is all under Application for Immigrant Visa..

http://www.usembassy...a/iv/iv_15.html

You don't need to wait for packet 3. All you need to know is that one has been sent. This means they have you in the system and are awaiting your paperwork.

Allie-what hobby are you going to get smile.gif If you ever want to "###### and complain" again, though, that's what we're here for smile.gif

SS-I'm so sorry this is taking so long, but I'm still betting on an NOA2 soon, and will pray for a speedy process after that.

Lisa-Hope everything is well with you. Any news?

endoftheroad-hoping that your process speeds up as well and that you get to see your girls soon and have a sweet reunion.

I was up way before 5 am again today....Lamine called me because the hospital called him, but he missed the call. He's tried calling back again with no success. Don't know what they want, but I'm going to pull my hair out if he backs out of the appointment.

Ken-as far as him wanting money or something-I wouldn't be suprised. We've had to pay extra for pretty much every one of Lamine's documents in order to get them in a timely manner. I know that's how things go in many parts of the world, and it's definitely frequently the case in Senegal. I'm nervous about doing this, though, as he is the only doctor currently working with the embassy (until the other guy comes back from vacation), and I don't want word getting out that we bribed or attempted to bribe anyone at this stage.

We'll see....

Keeping all of you in my thoughts and prayers and hoping there's progress ASAP!

Thank you for that... You're always so sweet, and I'm so pleased you and Lamine will be together soon. smile.gif

We are still in AP as of 7:30 last night, when I called again. They are always so nice, but I just want them to ship our case off to the embassy.

We are hanging in there, but frustrated. Things go haywire along the way sometimes. This is our haywire issue, and we realise it may not be the last.

Star, so sorry you have to wait longer. At least it will only take a couple of weeks to get that divorce decree -- and you don't need to go to India again for it I hope? Really hope you get the visa very soon!

No I don't need to go to India to get this. As they can get this from the priest in India. It seems like I will get the decree by next week if all goes well. The priest that got me and my ex married was in another city, and will be back in town this Sunday. So, he would be the one that would be issueing the divorce decree as well. Crossing my fingers now.

Good luck, Star! I hope you're able to get the documents you need quickly. We're ready for another happy ending. biggrin.gif

I don't think you have to file before the I-94 expires.
You just have to get married within the 90 days and then file as soon as possible.

I read once the I-129F visa is good for 6 months from issue, since you have to get married within 90 days, I assumed that gave you the other three months to get your AOS paperwork together and filed and any other requirements completed. I know once your AOS is filed then your new spouse is legal to stay until it's completed.

Actually, you have 6 months to use the K1 visa to leave your country and travel to the US. Once you enter the US, you have 3 months to get married. I'm not clear on when the AOS is actually due, but normally people are in a hurry for their new spouse to be able to work or leave the country in the event of an emergency, and file right away, from what I've read. I've seen others say they waited ages, but the link I posted above allludes to the fact that if someone is challenged for legal residency after the i-94 expires, then there could be a problem involving deportation and bans. I'm not willing to risk a potential problem.

I found this in the guides:
"How soon after we get married should we apply for Adjustment of Status?
A..Right away, or at least right after your honeymoon. You should make every effort to get the Adjustment application filed within 90 days of the fiance(e) entering the United States, which is when the K-1 status expires, as indicated on the I-94. Filing for Adjustment of Status within the 90 days protects your legal status. Your legal status as a K1 expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS before the K1 visa expires. On the practical side, it is often difficult to arrange for the marriage, and get all the paperwork ready in time to file for AOS within 90 days. Many newsgroup couples have filed for AOS a few days or weeks after the 90 day limit with no problems. Thus far, newsgroup experience has shown this is not a major issue with local USCIS (INS) offices. "

http://www.visajourn...sa-aos.html#6.1

I agree with Rhiann that it seems when you've been married, you are actually out of status, but on the other hand, an NOA1 for filing AOS seems to let people who may inquire know that you're pursuing legal status.

It's all confusing, isn't it? smile.gif

I just can't imagine having an expired K1 visa, an expired i-94 and not even an NOA1 for AOS and being challenged by anyone for residency and not having something to show them.

As soon as possible, like, as soon as you can afford it? That would be nice.....

After the i-94 expires, it appears your SO is "out of status". Read this: http://www.visajourn...h...t&p=3440111

I hope so! Do you think it will be tomorrow?

Ok, so do you have plans for getting it? How long will it take to get, and what are the procedures for getting it to the embassy?

How did it go otherwise?

You're almost done! star_smile.gif

6 officers interviewed him and grilled him like anything. Started asking things that would not normally ask. He managed to remain calm and positive. Seriously, some of these questions should not even be asked at a interview. But at the end they told him as long as he gets what they want he should be fine.

I can get the religious decree in about 1 to 2 weeks from india.

Congrats Chaz!! Its always good to hear some good news.

Star - It's odd some of the info they ask for, isn't it? You may want to add into to the embassy page on VJ, if you can, so others won't get stuck. At least you can get the paperwork back quickly.

Chaz! Congrats! smile.gif

I'm getting ready to file the AOS paperwork (which I should have done a couple weeks ago). Lamine's I-94 expires the 10th, and they'll receive the paperwork on the 9th, probably. Ugh. Makes me nervous. Wish I would have done it sooner so that I would have gotten the NOA1 before his I-94 expired. I'm hoping that we'll have the NOA1 before Christmas, but I'm not really counting on it with the holidays and everything. We'll see. We're flying to my parents' for Christmas, though, and it just occurred to me that this might not be a good idea if we don't have the NOA1 in hand.....

We're getting ready to file ours, too... Just the G-325A to go. I hate that form. Even though we can pretty much copy from the last, all the work history and residence history shifts to one spot down.

See you (virtually speaking) in Chicago!
