This seems to be weird! Getting RFE in I-130 process is Good or Bad?

To clear the RFE would take couple of weeks to months - which is bad.
But when the RFE is cleared, since the officer reviews your file again, is the chance high to get the approval? If yes, it is good.

All those experienced this would have upper hand to share their experiences.

If you have an RFE right near the beginning of the process, it's usually for a missing signature or a critical missing piece of paper. Did you get a letter in the mail yet identifying the problem.

You can get an RFE anywhere in the process. It just means you have to get them something extra, as you know. It's not a sign of good or bad... it's just a delay.

Hi all,

Hopefully one of you can help with this simple question.....

I'm making 3 copies of all my documents in preparation for my interview on Wednesday and I am not sure if I need to make copies of the joint tax return paperwork that is included as evidence for the i-864.

Should I make copies of this or not bother (It is quite a big document) ?

You should keep a copy for yourself, if you've not already made a copy. The embassy only needed one when my husband interviewed in October 2009.

If you do Skype, then phone calls are reasonably free. Also, I don't see how gifts figure into the 129-f petition.

Probably not on his K1 visa. 5 months is pretty optimistic. The service centers are averaging over 4 months to approve petitions right now, and the Guatemala consulate is averaging about 2 months to get to the interview once they receive the petition. Add additional time for your petition to travel from the service center through NVC to the consulate. Also, getting the fastest processing means having all of your ducks absolutely in a row, and delivering your documents quickly. If you rush the delivery of documents at any point and make any mistakes, it can cause substantial additional delays. Some of the documents you'll need may take some time to get, and I seriously doubt you have all of the documents already.

Guatemala is not a VWP country, so he'll need a visa to enter the US. This can be considerably more difficult to get once he has a petition or application for a K1 visa. They consider the odds that he'll use his visitor visa to stay in the US much higher since the K1 demonstrates a desire to do so. He'll need to prove strong ties to his home country to get the visa. I think this will be true if he has ANY family visa pending.

Also, you mentioned you'll need his financial support once he gets here. Are you aware of the financial requirements for the petitioner of a family visa? You have to demonstrate that you - the petitioner - have sufficient income to ensure that he won't end up a "public charge", which means receiving any government financial support. For two people - you and your fiance/spouse - this generally means you have to show income of 125% of the poverty level, which is a little over $18K per year. If your child is born at the time he goes to the interview, then the amount goes up to almost $23K, since there will be three people to support. If you can't provide proof you can support him, then you'll need a co-sponsor who can.

You also mentioned "babies". Are you pregnant with twins? Each additional person you have to support increases the minimum amount of income you'll need to prove.

There are also fees involved. It will cost almost $500 at the time you apply for the visa, several hundred more for the medical exams and fees at the consulate, and over $1000 to file for adjustment of status (i.e., to become a permanent resident) once you're married. This doesn't include travel costs. Once you get the ball rolling by filing the initial petition then you're going to need this money available when it's due. For instance, if you don't get married and file for adjustment of status within 90 days of his arrival in the US then his K1 will expire, and he'll have to go back to Guatemala, and you'll need to start over from scratch.

If it's really important for you that he be here for the birth of your child then I recommend you hold off filing any papers, and just let him come here on a visitors visa in October. You can get married while he's here and then he can return to Guatemala while you file the CR1. It will take a little longer, but he'll have his green card and be able to work when he returns to the US. It will also cost less money than the K1 process. This will also give you more time to learn how the process works and get your paperwork in order.


Thank you so much for your detailed explanation! So it takes a total of about 5 months for the K1?? He already has a tourist visa, but ends in October. I know I won't be able to have sufficient income, but I think sometimes having a co-sponsor is not always safe from what I've heard. I think the best choice would be CR1, would I be able to start the process while he's here? About how long would it take for him to get his green card? And there's no requirement for me to proof if I have sufficient income or not?

I had the same situation. I called USCIS and they said to send a letter to CSC. There is no official form for the beneficiary. I attached a copy of my NOA1.

I believe Otto and Karin have a good approach, and I'll probably follow their suggestion, just to make sure the address change is successful.

If you're the USC, your SO needs your completed Affidavit of Support/supporting documentation (I-134). The form and instructions can be found on the USCIS.gov site, under Immigration Forms.

We've been discussing supporting documentation, and I believe the list has come down to the bank letter, the employer verification letter, several pay stubs and 3 years worth of tax statements/W-2's, just to be safe/prepared for adjustment of status. Anyone else have additions to that?

I also sent Ian our complete 129F filing, original boarding passes, an updated letter saying I still want to marry him, and additional emails/etc., to fill in the "we're still having a relationship" space between filing our petition and now.

It IS quite difficult to see others approved before you do, when their NOA1 date is later than yours. I saw that, too. We waited almost 4 months for ours, thanks to the immigrant worker visa extension. Hopefully, yours goes much faster.

I think it stinks that not all the April and March filers are not approved yet.

When the NOA2 comes, there are new hurdles. It's a relief at first; it's an important step! But later on we may be listening to people who might get AP at NVC or whose embassy takes a lifetime to schedule an appointment or takes their time sending out packet 3 or takes 2 weeks to finally print off the visa and return the passport (someone London has been doing). There are no websites to check for status after NOA2. It's all long-distance phone calls or hoping someone responds to your email.

Are we really going to restate timelines and who might have had a quicker response the whole way? It's going to be a longer journey that way, IMO.

We're here to honestly support people, or is that not the case?

I was touched in July so there's the connection. I also once replied to someone who knew a person who had a relative that liked July too. I even dated someone named Julie once, that is darn close to July phonetically. So there!

Apparently some people have included child support as income and it's worked (after researching and finding this link http://www.visajourn...?showtopic=305). I didn't think anyone was going around and around about it... just asking questions about it. Or did I miss something?

Hard times on the Atlantic Ocean for families at these fishing villages. Mom, Leidys and I traveled by Motorcoach to Santa Marta del Rodadero (2 hours north of Barranquilla). Some people live in very primitive housing as shown in these photos.





My Mother had been raised in complete poverty in the Jim Crow South. Born at home, her house was later bulldozed in the early 80s. I faintly remember the house as a small boy before it was demolished and turned into a city services parking lot. There was not much for her to go back to as most of her siblings have now passed, and her only brother now has Dementia.

I have no idea, really, except I do know one person who elects to not have his taxes taken out during the year. He just pays what he owes when he files his return. I think that's a recipe for disaster myself, but hey.

Lisa I hope you are able to get the tax transcripts you need! If they don't send you the transcripts then you will need the 2007 and 2006 tax return AND their supporting W-2's.


I was able to fax off the form I linked today. Only one signature required. I think I'm set. Thanks for your help! I agree it's better to be safe that sorry. It's kinda frustrating when you think you're done with something, and you're really not. lol

I should probably work on that. The IRS won't let you have copies if you are divorced and your ex-spouse is on the paperwork, but I'm sure I could get copies from my former tax preparer.

Where did you see something about needing the past 3 years' tax returns? The i-134 says they're only needed if self-employed, or did I totally miss something?

I'm going to be the village idiot here and ask about the I-134. I have 3 years of tax transcripts, pay stubs, a letter from my boss-- but what else do we need? Do we need a letter from the bank with date opened, date closed, deposits made, etc? I was under the impression that that wasn't entirely necessary if your income is sufficient (mine is, but I have a co-sponsor for safe measure). Any thing I'm missing? wacko.gif


The form says that you need evidence "as appropriate", which only involves the employer letter and the letter from the bank. I'm not sure how they determine if it's "appropriate", so I got both. I see VJ'ers all over saying the bank letter isn't necessary, so I "phoned a friend" who was recently approved, and they got the bank letter, so I did, too.

The tax forms are only needed if you're self-employed (but I sent last year's tax return and w-2 anyway). I also needlessly included some tax stubs and some bank statements because I have a need to be overly prepared. wink.gif

Btw, I get child support, but I didn't note this in with my income (I saw Allie mention this.. I don't know if you can do this or not). Instead I checked the box that said my child was partially dependent on me for support (for whatever difference that makes).

My income is sufficient according to the poverty guidelines (be sure to calc your household for yourself, your SO and any dependent children).

I'm not an expert until this all flies with the London Embassy. smile.gif star_smile.gif
