When I went through with the visa interview for my fiance, my tax return didn't show that I made enough money. I was way below according to the tax return... that is why they ask for the last 6 months of paycheck stubs, a letter from your bank, last 3 months of bank statements and a letter from the sponsor's employer stating how much he makes... His tax return shouldn't make a difference. We were approved and there was no questions about the $$. We were not through the same country as you are filing but I wouldn't think that should make much of a difference with this topic. Good luck!

BTW, I made plenty at the time of interview... it just wasn't reflected in the tax returns.

He asked for advice, not to be judged... Why must people troll? If you don't have helpful advice then why post? This may be a culturally common thing for him even though it is not so here in the USA.

I would agree with being sure this is what she wants and asking her what her intentions would be. She will be the one who is interviewed should the k1 visa be approved here and forwarded to the consulate in her country. Also you will have to meet her within the last two years and prove it for the K1 petition.

As stated above, fill our all the forms yourself and have him get you the information that you don't know, then send him the forms to have him sign them. If you sign them that is forgery and will not be accepted.

By the way, when his time for the interview comes around, they will have him go to the US embassy in San Jose to pick up his packet and that will contain directions on how to proceed. Just a heads up though, he will have to get official translations of all the documents done at that time by one of the translators on the list that he is given. He will then have to get the documents certified by Casa Amarilla that they are authentic. That is the only point you will need to have someone else do the translations for you.

Thanks for your post! It is really helpful to talk to folks who have actually done this successfully as it can be very overwhelming and often discouraging to think about. Provided he gets all the paperwork he needs there, I know all of it needs to be translated into English for the interview. Does that have to be done by an official translator, or would I be allowed to do it? And what does that look like? Do you show the original document and write the translation below or on a separate page or something?


Yes, you can do the translations yourself for this step in the process. I suggest making a copy of the original document and printing the translation on the back of the copy with this at the bottom of the page:

I, (insert name of translator), certify that I am fluent (conversant) in the English and Spanish languages, and that the above document is an accurate translation of the document attached entitled Certificacion de Antecedents Penales.

I would suggest following what they say here on visajourney about making two copies of everything and having a complete copy of the packet that you submit just in case they lose anything and so that your fiance can review everything and see what has gone into the packet as well.

Hi Maryellen,
I skimmed over some of the advice that was written here and I recently brought my then fiance over from Costa Rica as well. I would be happy to help if you are still having any questions. You will need to get a sponsor as was stated previously, but that can changed later on if you get a job in which you make enough to sponsor him before the final interview and AOS. As for applying for the K1 visa, it will take a number of months for them to accept it and mail you the NOA2 so you will have plenty of time to go and find a job or more than one, plan on that part taking at the least around 4 months.

The mail system in that country does work, although by our standards it leaves much to be desired. I am not sure where your fiance is located in Costa Rica but I do know that DHL and Fed Ex are quite big in the country and many times they can at least drop a package off at a local town if your fiance is as rural as you say he is.

I would suggest reading everything you can get your hands on and figuring out exactly what forms you need for him (birth certificate, single certificate, police records, and whatever else) and then either going down and taking him to San Jose, Liberia to get all the papers in order, or to whatever town is nearby that is large enough to house the offices that handle these sorts of requests. He should know enough of how to find the local office that provides the transcripts for that sort of paperwork. Also, I included a letter from my fiance's parents and my own attesting to our relationship being valid and accepting us as a couple and into each others' families. If you are getting paperwork from him I would ask him to have one of those at the same time. It is known as front loading and basically you are providing the USCIS with anything they might possibly have questions about before they question it.

Ummmm...I'm new to this site. Can somebody please explain to me what an RFE is.


An RFE is a "Request For Evidence". This happens when they want more information or are missing something in the packet, you will then receive an RFE. Not everyone gets one though, we never did. Just go over everything you are going to submit before sending it in and be sure that you have filled everything in and when needed, fill blanks with N/A or None on forms. ;)
