Thanks for the suggestions about more bank statement cover pages, I'll definitely include those as far back as we can get them (I think we started this account pretty soon after I got an SSN).

As for employment, while I realize it's not listed on the instructions, I figure it can't hurt... my thinking is that if they know I'm not a drain on the system (which my taxes should prove... stupid self-employment tax) they're less likely to want to interview.

Hi folks,

I was just wondering if I could get some input on our I-751 package and its completeness before I send it in. Have I forgotten anything?

  • Cover page / table of contents (basically a more verbose version of this list)
  • I-751 form
  • Copies of the passport (cover, front pages, executed K-1 visa and I-94), Permanent Resident card, Social Security card, and PA Driver's License (front and back) of Spoom (beneficiary)
  • Copy of ScooterMac's (USC / spouse) driver's license showing same address
  • Affidavit from ScooterMac's parents
  • Affidavit from ScooterMac's sister in law
  • Lease agreement and letter from ScooterMac's grandparents, our current landlords
  • Countersigned purchase contract for our new house (still in escrow, don't actually have the lease yet, I explain this on the cover page)
  • IRS tax return from 2010
  • Provisional IRS tax return from 2011 (I explain that we may have H&R Block redo it so it may not exactly match what we file, since the US Government just loves taking our moneys)
  • Signed letter from my company's president verifying my full time employment
  • Signed letter from my HR person verifying ScooterMac as primary beneficiary of my 401K
  • Copy of designation form showing designation of ScooterMac as primary beneficiary of the 401K
  • Copy of ScooterMac's 401K summary showing me as beneficiary

I applied for AP and had to re-apply for the second AP - and this is when it did cost extra.

That's kinda some BS right there; that you should have to pay more because USCIS is taking longer. I agree with everything you said though.

I applied for both when I did my AOS; the AOS was approved first and they just abandoned the others. Like the others said, it costs nothing other than a little extra paperwork. I think if there's a life-or-death emergency and you don't yet have one you can also get an INFOPASS for an emergency AP.

You should also mention that other mortgage brokers you spoke to were completely flabbergasted by what to do with your (Canadian) credit and offered to give us a loan based on my income/credit alone (which wasn't going to get us anywhere). Our realtor was great at helping us find a mortgage company who would work with our situation.

Yeah, PNC sucked in that regard (which was weird because they're awesome for personal banking). They weren't even going to count my income in the calculations because I didn't have their minimum of, I think it was four(!) US trade lines of credit. Union National has so far been great though. Hopefully that doesn't change once we're fully signed to the mortgage ;)

I got really lucky; our mortgage broker accepted my (great) Canadian credit history at face value, while I've never had so much as a US credit card. I figure the mortgage should be good for building US credit.

Did I mention we bought a house? We bought a house. :)

Honestly, if I was in your guys' situation, I would have coded up a script that checks ever X minutes and emails me upon finding results (I did this to buy a Wii at retail when they were super-popular and out of stock on online stored within minutes, worked well enough). USCIS probably wouldn't like that though ;)

CanadaMedical Insurance in the US
When I couldn't work or was doing contracting, we had to pay for two separate private plans to cover each of us, since they wouldn't allow us to be on the same plan due to my wife's conditions. It was veeerrrrrry expensive, for both premiums and the huge deductible on both plans. I went the full-time employee route instead of continuing to contract primarily because of the health insurance situation. I unfortunately don't have any other advice than to have one of you do the same if you can, and get group coverage for both of you. The situation in the US makes it very difficult to do anything else.

CanadaTD canceling my Visa becase moving to the US?
The only company I've heard of that does close down accounts whose owners move out of Canada is PC Financial (which is primarily why they don't know my new address). I was able to change the address on my RBC visa with no problems. Don't know specifically about TD.

Just did a successful walk-in biometrics at the Cleveland ASC; was scheduled for Buffalo on the 19th. Got a little bit of the evil eye from the clerk but when I told her I worked in Cleveland and this was easier than a two hour drive out of the way it seemed to be OK (I waited for the people with actual appointments first). On to approval without interview (hopefully)!

Article here. In all likelihood, the baby will be an automatic United States citizen because its father is a citizen.

Furthermore, if your wife's trip is of a temporary nature (i.e. just to have the baby), she should be able to return with no trouble, assuming the trip is less than six months in duration. She should just show her passport and conditional green card.

Be sure to register the baby's birth abroad with the US Consulate in Korea. The baby's record of birth abroad obtained from said consulate should be enough to allow return entry to the United States, without a passport.

Stay calm.

You're in very, very serious territory here, but there are still several avenues available as people have mentioned. I cannot say enough how badly your attorney has screwed you over here. Immediately fire them and request a refund of any fees paid, because due to their negligence, you are now shortly going to be in removal proceedings if you do not immediately file a petition of some kind. If it comes down to it, you would almost certainly win a lawsuit against them for your fees.

After firing your attorney, find a better one, and investigate the possible options available to you.

If I were in your position, I would setup an InfoPass appointment and talk to USCIS, bringing all documentation available from your attorney stating that he told you to wait for a USCIS notice to file for removal of conditions. It may not help, but I don't think it would prejudice your case in their eyes either. If they say that's not good enough, you can always file for another I-130 spousal petition as mentioned.

OK.

First, drop your previous lawyer who told you not to report the theft. That's horrible advice.

Second, report the theft immediately.

Third, talk to someone as soon as possible. All reports I've read are that the call center is useless, so make an InfoPass appointment. This will give you an appointment at a local USCIS office. You shouldn't need to call them directly.

Worry about your evidence for removal of conditions once you've let USCIS know that your green card was stolen. That's the most important thing at this point to make sure you don't lose status.

I don't think you need a lawyer, you just have to make sure that your status is maintained and stay in communication with USCIS.

We're sending it out today. I printed out more first pages of bank statements; one every six months for the life of the account, in addition to the oldest and newest statement. I also added more Waste Management bills. Hopefully that'll be enough!

Looks like we're in for a wait from the timelines. Oh well, we're pretty good about waiting (other than checking the USCIS update site every week obsessively).

In addition to more bank statements from various months within the two years, maybe add copies of debit/credit cards that show the same number for both of you. That's what they asked us to show at the AOS interview and luckily we had those with us, so this time around I sent a whole stack of bank statements + copies of all cards that we have in both names just to be on the safe side.


If you have joint title of any of the cars (or any other big purchase), you could send this as well, but it's not as important considering all the other stuff you are giving them.

We have a joint bank account but differently numbered cards. I honestly thought that was standard. No?

No shared titles on the cars unfortunately.

Will they really RFE for the full bank account statements if I only send cover pages? I'm not too concerned about the content of them but it'll be adding a bunch more paper to the package.

Hi folks,

As I mentioned in the February 09 VSC thread, we filed our I-129F package on Saturday (February 21, 2009). I'm just looking for some opinions on its quality and chances to be approved directly as opposed to them sending us an RFE.

It included:

  • US personal cheque for $455.00
  • Doubly signed cover letter and table of contents
  • Signed I-129F form (reviewed a million times by both of us to make sure we didn't leave anything out)
  • Attachment for question 18 (about a page long explanation of how we met and our different trips to meet each other, individually linking to photos of said trips, see below)
  • Photos in baggy (about 15 photos, printed on a photo printer, all of which are numbered, dated, and described on the back, with names of everyone in the photo, and every one has both of us in frame, many from US locations, two photos have dates from the camera in frame which are from December 28, 2008)
  • High quality colour copies of two of my Greyhound itineraries heading from London, ON to Buffalo, NY to meet her (one of which was stamped by USCBP with a dated entry stamp, on February 13, 2009; the only thing I worry about here is that she lives in PA and picks me up from Buffalo because otherwise the Greyhound trip would take nearly 12 more hours, so it may seem weird to them)
  • Copy of engagement ring receipt (which made her feel bad once she accidentally saw how much it was tongue.gif)
  • High quality colour copy of signed letter from her pastor who will be doing the wedding indicating that we are a real couple and have attended church together, on church letterhead
  • High quality colour copy of signed letter from my best friend and the best man of the wedding indicating how he knows us and that we're a real couple, etc. with contact details to call him if they so wish (apparently this is the "toned down" version where he doesn't directly criticize the US government tongue.gif)
  • Many pages of cell phone bills totalling 109 hours of calls from me over six months, with post-it notes providing totals and with calls from me highlighted smile.gif (she couldn't call me as the phone is in her parents' name and they blocked international calling, besides, I have an unlimited Canada / US long distance plan)
  • Signed G-325A (from me)
  • Signed G-325A (from her)
  • Signed attachment for her G-325A for employment, last five years (she's worked a lot of jobs smile.gif)
  • Signed intent to marry letter (from me)
  • Signed intent to marry letter (from her)
  • Back-labelled passport photo in labelled baggy (from me)
  • Back-labelled passport photo in labelled baggy (from her)
  • High quality colour copies of all pages (and covers, for completeness) of her US passport (which took about an hour to do sleep.gif)
  • No previous marriages or criminal records for either of us


What are your thoughts? I hope that the Greyhound ticket itineraries and USCBP "admitted" stamp will be enough primary documentary evidence that we've met; I'm not too worried about the rest (though please tell me if I should be! tongue.gif)

I don't see why the specialized training would cause problems if there's a legitimate reason behind it, such as mandatory military service. If that were the case, the US would have many fewer immigrants from those countries. smile.gif

I wouldn't worry. It'll likely be short and sweet like most of the K-1 interviews I've read about.

As long as you have, as the border patrol officers put it, "strong ties to [originating country]", they'll let you in.

It's easier for us Canadian folks as we don't have to apply for a visitor's visa, but it does provide more of a scare when actually going through Customs as you never know if or when you'll be turned back. (I have been, once. It wasn't fun.)

Having money helps a lot (bank statement or cold, hard [USD] cash), as does a lease. They actually gave me a checklist when I was rejected back in 2005; if I can find that, I'll post it here.

You could totally do this without a lawyer, many of us have.

In any case, I'm not sure how long it will take (take a look at the Timelines, they can often give you a really good estimate), but you could send in a note with your package explaining the dates; they will be read by a human, after all.

So we received a letter from the National Visa Center yesterday explaining that they had received an approved I-129F visa for me and would forward it to the Montreal consulate within a week. Awesome!

The weird part is that the Case Status website for USCIS doesn't actually show any updates on the case since February, when we initially filed it, and we haven't received an NOA2 in the mail yet. I'm wondering if the officer simply forgot to scan it in when he was adjudicating it, and if so, whether or not that will affect us in the future or how to fix it.

In any case, woohoo, through immigration, on to the State Department smile.gif

That is correct; we got our NVC receive letter in early July, even though USCIS case status still didn't say it was approved. Still waiting on the NVC sent letter. Thanks guys smile.gif

Edit: It should be noted that the Timeline app here doesn't accept "out of order" dates like mine (NVC receive before NOA2), even though they are the right dates. Should this be fixed?
