Wow Day 40!. I know we should be thankful but I really expected to be further along by now. So what is everyone hoping for in terms of date of POE? I'm hoping late October - am I crazy?

Keep calling them. After you get your case number and IIN. Keep calling them to find out when the DS-3032 is generated. Once you get a go on the generation of the DS-3032., have the beneficiary e-mail it to NVC. This will start the process of IV Packet. Once your case is uploaded into their system (usually when IIN is generated) is when you technically can start the AOS packet process. It just depends right now as the process seems to have run amuck at the current moment.

Finally - I was just told that our case was received yesterday. I'm still confused though because this has taken longer than I expected. The rep said that I'll be able to get the INN number in a few days, and that the case will be uploaded in/by 15 days. I'm assuming that once that happens I'll have to wait a few days for the invoices to come through.

So I won't be able to pay for 3 weeks?! Is this correct?

Our case was complete on August 4, and he got his interview date sent to us the same day. His interview is next Tuesday, September 13. Hoping it goes well, because he's already got his ticket home for the 24th :) Good luck!

I believe I've only seen 1 other person who is waiting on a London Interview date. Are their any others?

Just curious. I read a form the other day that made it seem as if 2 UK interviewees got AP.

Case Complete 8/25.. hoping to find out the interview date soon to buy tickets. Good luck to us all. :thumbs:

I mean no offense in my post I am trying to help figure this out for you as well.

Your spouse in in the Morbidly obese category. What I think denies him of the following is the risk of diabetes, Cardiovascular, disease, osteoarthritis, cancer and gout.

I know NZ (New Zealand) denies immigration to people in this category until they are at least below 40 BMI.

My feeling is that the person that has the high BMI is going to find it hard to find medical insurance coverage with precursors such as I listed above. Being a new immigrant and all REALLY makes it tough and the problem then becomes if you

are unable to get medical insruance in the States and your husband becomes sick your going to rely on the Government Medicare/Medicaid to get help with his medical coverage.

I know this seems like a blow just think of it like the affidavit of support its the same thing but related a medical concern. This was found out in a surprising way though.

These are all my opinions and assumptions... I hope he gets here soon and there is no delay.

So are you suggesting anything in particular? I don't have health insurance. I could try to get him covered but I'm not sure if thats possible without a SSN.

I haven't gotten all the details yet (if there are any) but my husband said that his BMI was extremely high (51). We knew this might be an issue because he is extremely over weight.

The U.S. medical doctor said his high BMI kept him for receiving an 'automatic pass'.

I can't imagining the embassy denying someone for their weight, especially if they have no intentions of getting any medical procedures to fix the issue which could possibly cost the U.S. We plan to both get healthier when he gets here by eating better and exercising more.

Am I correct on this? Our tickets are booked, I arrive on the October 13th, interview on 14th, fly home together on 29th... I know the flights are a risk in theirselves but is his high BMI really an issue?

You might get an October interview. I can't figure out their scheduling system.. I'm not sure their is logic to it.

I got CC on 8/25, and found out on 9/12 that Ben has a 10/14 interview.
I know someone on here got CC on 8/22 and found out during the 1st week of September that they had a 10/13 interview.
I also remember someone getting a 8/23 CC and getting a 10/20 interview date and finding out about their date the 1st week of September.

Someone else got a 9/4 or 9/7 CC date and found out this week that they had a 10/14 interview date (same as mine).

So you probably will get one in October but I can't figure out a formula to know for sure.

Additional Question: Can I travel to the UK and then file the I-130 from there. I know it had to be mailed to the US but can I just mail a packet to the destination or mail it to someone in the U.S. and have them mail it for me?

Hello Everyone. I apologize if this has already been stated somewhere else.. I searched but could not find the answers to my questions.

Today I have finally spoken to my criminal lawyer and it seems as if I will be waiting to go to court for sometime. I can leave the country if I'd like too, as long as I come back for court in 4-6 months. My husband and I miss each other terribly and are trying to figure out how to see each other. If I could leave the country I would automatically apply for a settlement visa to join my husband in the U.K. but due to my pending charges this is not possible. It seems as if this process could take a long time so we are probably going to file a cr-1.

My questions are:
1. Can my husband visit here on the vwp and us file the cr-1 while he is here?
2. Can we file the cr-1 before he comes for a visit on the vwp? He hasnt visited since May of 2010 (when we married) so I believe he would have no problem getting in.
3.It says that you can stay for 90 days so could we actually buy a plane ticketfor him to visit here on the vwp for 89 days.. without it looking weird?
4. Also, following our wedding I visted the U.K from May 21st - Oct 17th. I am thinking about visitng the U.K. now and then my husband visiting the U.S. when my case goes to trial. Can I file the CR-1 and then go and visit England on the VWP while it is processing? I'm worried it will look weird me visiting so soon again. I've even thought about buying a 2 week ticket and then changing it to a longer stay once in the U.K. Would this be ok as long as I got the 6month stamp?

Are there any other traveling arrangments that you guys would suggest? Has anyone been able to complete the CR-1 process without hardly being apart?

The I-130 petition on the USCIS site says it expires 1/31/2011. I'm looking to fill out my form next weekend, can I use this form or what should I do?
