IR-1 / CR-1 Spouse Visa Process & ProceduresMarch 2010 CR1 filers

Hello my fellow March filers!

My husband has filed the I 130 application on 03/03/2010.
Our NOA1 is 9th March 2010.
We have not received any other reply from USCIS YET
Anyway my question is related to the NVC Stage.
I have read that we need to provide police certifiaction of every country where we lived in from age 16.
I want to confirm this.
If that is the case.I will take the necessary steps now itself.
It is like we are completely blindfolded...
Thank you for your help

Hummm have you read LingChe Shortcut? http://www.visajourn..._IV_Package.29:

It states "Police Certificate based on country: Use this link, [5] select country, and scroll down to Police Certificate section
NOTE1: Police Certificate is required for any place in their country of citizenship; the beneficiary has lived longer than six (6) months, after age of 16.
NOTE2: Police Certificate is required for any places which beneficiary has lived longer than twelve (12) months in any other country other than country of citizenship, after age of 16.
PCC can take a long time to receive, so request it earlier rather than later (for some countries, such as India, your PCC may need to be within 6 months, for most within 1 year)

If this is applicable to you then I recommend that you get your Police Certificates from those places, If you have not already started that process.

OK well here's the deal......I asked one of my friend who has been through this process, and he told me that he didn't send PCC to NVC at first time when he sent DS-230. So NVC has generated a checklist letter / missing documents letter and he presented that to the PCC office.

I hope now NVC just issues a cheaklist letter with BARCODE SHEET which we get after we pay the fee's.

Kruz_patz based on what you said I am thinking this might have been a RFE letter that your friend recieved from the NVC stating what he fail to provide them and what he needed to provide. I would not walk that path and provide them those items identified in the Shortcut List. Again I hae not received my NOA2 yet and can only guess what might be sent by NVC in that process based on what I have read. Good Luck

Phil is Philipines, sorry for the short form. I normally never use short form :)

Loto

I knew what you meant Loto. I just us PI cause I am lazy... I received my NVC # on 7/28/10. Got my complete on the Sept 13th which just missed the cutoff for Oct. Saw people with Competes of 9/10 get OCT interviews. I still have no interview date but I am hoping next week to receive something. I would look at 3 more months and some days before you interview. Try to reduce your time in NVC by getting your paperwork in ASAP. If you miss getting your Complete by the 2nd week of the month then you will wait another month... So look at your window of time and if possible get it all in by the 1st week.

It is not our intention to be mean to anyone. We simply posted here because there seemed to be more activity on this thread than the april filers thread. We are all here to support each other and share our happiness or pain, not trying to be mean. When i filed for my husband, it took a long time and lots of people filed after us but were approved long before we were and i was not upset, i was just happy for them that someone got out.

Thanks. I sincerely hope that you can just be happy for us. Take care.

Using your logic we only need one thread... What you dont know is how many JVs wouldnt even think of looking in March thread for April info... Just saying...

Well another month is coming to an end. All Marchers have recieved NOA2s but I see there are still some April filers waiting for USCIS NOA2 Approval. Maybe at the end of this month a new thread should be started for April/May 2010 CR1 filers. Just keeping in tradition...Hope all April filers get approval soonest...

Hang in there buddy... Soon things will fall in place I'm sure...

It pisses me off too... that an average time for a spouse of USC takes at least a year to immigrate to US....
and I have had friends on student visa who have gotten married and their spouses came to US immediately with them...

just so Frustrating...

Yeah I hear that!!! What a crock... where is the security in that or the Dignity and Respect to the US Citizens for that matter. :girlwerewolf2xn:

I called. The first lady put in a service request and transfered me to some jerk. He sounded like an uneducated and unprofessional. Talked over me many times. I can't believe he's an immigration officer. Anyways, he also verified that I have no RFE so far. And told me to call me in 30 days. Turn me over and #### me up. More waiting. Time to get the senator's form cracking. I have it filled. Just gotta date it, sign it, scan it, email it. I should probably call the lady as I email this ####.

I think the people on the phone are just subcontractors and perform damage control without being able to fix anything. I would hope your Senator could or would do something but I dont have much faith there either although you may have a good one. Luck to you... an luck to all those who have passed the ridiculous 5 month milestone...

Congrats JohnDoe12!!!!

After getting "touched" four times in as many days, my USCIS login still says "Initial Review". Looks like I am heading for a RFE!!!! That will be difficult to take care of as I am in China until October. Hope it's not true.

What can I do?

Do Nothing and dont start jumping to conclusions. Mine said Initial Review for a day or two after I recieved approval. I never saw a touch. I would not concern yourself with that status page as I think its less than reliable. I never got a RFE either. Just becareful not to play these mind game it will make you nuts. :bonk:

Another day gone by without any updates. Looks like we wont be seeing anything anytime soon. Most likely they have reached their goal for the number of visas for this fiscal year. Just thinking out loud might not be the case. So I think i will just give up hope of getting anything until October. Good luck to others.

Sorry to see that everything has stopped at the USCIS... What a impossible situation. Hang in there people and try not to despair. This too will pass...

Yeah I will be active again on this thread. I'm not as brilliant as many members on this thread. I had to really focus and handle my NVC process like a newborn baby with lots of love and attention.

Also, Instead of flying her to the Medical then back home and then back for an interview, Someone gave me the wonderful Idea of setting her up with an Apartment in Manila. She hasn't seen a doctor since who knows when, so she must get her exam at least 2 weeks in advance. Found some Great places where people are renting condos for a month completely furnished in the heart of Manila at half the cost of a 2 week's stay in a nice hotel. This way there is no rushing, no back and forth to her province, and she has all the time she need between her medical and her interview.

Enjoy the city life, malls and restaurants all she can. Because once she arrive in the US, we will be eating salami sandwiches for about 6 months  I need time to rebuild financially.

LOL Salami is good for me...lol None of us are as smart as it seems. Sometimes just look at our post. We give advice like crazy but when its our turn to roll we are asking for it... Human nature I guess. I know that how I felt once I needed to do something I froze up a little.

:ot: If she like the apartments you found let me know cause I have some good friends who are going in Dec Jan and they are always lookin for a deal. They stay down in Makati area near Jupiter and Makati Ave but they have to pay about $2000 a night per room. Just sent a PM.

Now back to waiting for the interview letter....

I'd like to thank Tom D, Indigo Skies, The Jesal, Johndoe, Russ and Mary, Rich and Bey, Marie_yahya and especially TEYAVALENTINA for accepting me in this group. Tolerating my rants, and impatience. Giving me tips and making me feel that i can do it without a lawyer. My wife has her Interview date of OCTOBER 20. I know God is with us, but Its in her hands now. I've done all I can do. With the help of many people in this group, I manage to do what seemed impossible before I joined this group. I know I've been gone for awhile but after I got my NOA2, I had to really focus to kick that can across the finish line. Thank you all so very much. I was truly lucky to find this wonderful group. :crying:

Great News rVince!!!  Your welcome but remember we all lean of one another from time to time. We all rant and are confused and wonder what the hecks going on... It all the support we give each other that make it tolerable. Glad your interview is OCT 20 maybe I will be early November then. I did say Maybe. This place is like Las Vegas you get on streaks of up and down... Right now I am rope a doping it. Hi Everybody I hope all is going well with you, as we all know that USCIS has too many applications to work on, I know its hard to wait for such a long period of time, but we have to understand that people work on our petetions have bosses on them and bosses have big bosses on them and big bosses have bigger bosses on them and this chain never stops, My point is that these people have to follow the procedures to do their job where they have to follow the rules and regulations they are given, just providing you link where you can read the rules and procedures they have to follow to work on I-130 petitions, So you guys will have an idea what they go through everyday, like we do our jobs they are doing their jobs, they dont have to do anything with our personal and emotional stuff, We all are just like good and normal citizens for them, we never seen them and they never met us, they just make decision on the basis of paperwork and proof we provide them for our relationship, I wish good luck for all of us, and pray that we get unite with our loved ones ASAP.

Here is the link USCIS-Standard-Operating-Procedures-for-Adjudicating-I-130-Petitions
Thank you All

Thats good stuff in my view and I have a strong hunch they have SOP for all the steps. Think I will start surfing...

Marie, There are a few surprised like the plane tickets or proof of travel and things like that but I am guessing that they are asking for that because you fail to provide sufficient documentation in the beginning. All or most of what I read was known to us when you put together our I 130. Many of us submitted this documentation then which supported our claims of marriage and having a prior relationship. I think you are or have made some assumptions early on in this process and now it biting you. Again its fixable provided you have the documentation but its going to take some work on both of your parts to do this. It will also take time which unfortunately you have no control over now. Going forward I would pay more attention to the detail as that is where the devil lye's. Just keep doing your best or get help from someone who is detail oriented. Remember its never what you think it should be its about what they want and are asking for. Good Luck

Ruth called me and told me that i needed to send in more evidence so i ask her what do i need she said i dont know but she had my case so who knows but she told me it will take anywhere from 2-3 weeks omg this is crazy they have nothing better to do....i told her if she told me i could overnite it and still she would not tell me damn...anyway i will update you on what i find out from the senators office thank you all for listening.....

So Sorry. To them we are just numbers that they deal with everyday. To us its personal and not always fair in what they say. Just keep on Keeping on and eventually your dream will become a reality in spite of the hardship and frustration you're feeling right now. Don't give up hope. This is just a set back not a denial. All the Best...

 I hope you are joking about me joking  . I thought I was suppose to glue the barcode on each document so that it could be easily scanned. I read it on one of the wiki instructions. It said to make sure not to use tape because it causes problems with the scanner. I must find it.

  Who is zooming Who? I'm not joking . I know that on the short cut is spoke of making your own bar-code and gave instructions on how to do it. But then they started putting it on the cover letter so it wasn't really necessary anymore. The only bar-code needed with the pkgs was to have the cover letter with existing bar-code that we printed out from the Pay online page. I dont think what you did will be a problem . I did put the NVC number on the upper right hand corner of each page of my documents.

I think were are both good to go. Well have to go bar-code man ... :P ... Personally I am a numbers guy..haha

Everything was moving faster before May. Now everything is at stand still. Do you think this is because the recent anti-immigrant feeling going on in America? What is they actually come out and say "NO MORE IMMIGRATION OF ANY KIND?"

WHOA Come on Indigo, Sorry buddy I dont see it quite that way. You're right about the Anti Immigration feels that are prevelent. They are also as you would expect stronger in the boarder states. My feeling are that those anti feelings are directed toward illegal immagration and not those who are going through the process as we are. Most dont like the amnesty idea. That was done in the 80s and it didnt work.
Secondly all countries I know of have policies and control immigration within their boarders. Many are much stricter than the US. This is especially true if the person trying to enter the country is from another country though to be less developed. Some of our posters here would know better than I because I have only visited but never tried to immigrate to another country before.
I dont see immigration as 100% positive or negative. Its a mixed bag. I think those who do it however should be doing it for the right reasons. If their loyalty remains in their homeland then I think visits are enough. They could also work if it was work that was not able to be filled by a US Citizen because of a variety of reasons from expertise or willingness to perform. I think there should also be a time limit on these visas but that's just me. Many Americans also work abroad. I knew a fella from England who happened to be of Indian heritage that went back to India to do his residency. He told me it was a true awakening for him and he was able to see and get 10 fold the exposure and experience he would have received if he stayed in England just because of the shear numbers. So in a nut shell I think immigration is wonderful if done properly and according to my rules. haha

it's really frustrating :( huhuhu.. i was looking at Igor's list and we're the only person with NOA1 date of March 23 who never got an approval :crying: does this mean that there's something wrong with our application? or did they forget about us? I'm really freaking out... it's been 5 months and we never heard anything from uscis...should i call and ask? or it's not gonna help :(

I would guess that the people who are getting faster approvals might be based on the type of VISA they are applying for. Not all are types are equal. Just guessing here but that may explain some of this.

I sent you a message Tom and I apologize because I already know the answer.. I forgot what AVR meant.. I am a bit nervous because i mailed the DS-230 on the 16th of august and the 864 on the 10th but neither are mentioned in the AVR. it says STILL WAITING FOR BIOGRAPHICAL INFO. I called them and they said it will take 6 to 8 weeks to process :wow: But i look at your signature and it only took a couple of days. I'm pretty sure i did the barcoding correctly. I used glue and not tape. :crying: but it was Elmer's Glue.. I should have used crazy glue!!!

Hummm crazy clue  I am hoping your joking about the glue bit and sent the Barcode pages in with your packages. I dont know what to say. Mine said the same thing when It was waiting for the DS230 and maybe I got in under some stroke of luck or had a good rep handleing my package. Maybe he like the pictures of my wife. I dont know hahahaBut I am not complaining ...about that anyway. Hang in there When did they recieve it cause it took about 8 days after before they entered it and the date was back dated cause I check every other day.

"Oh well." then nothing is wrong to raise a little hell while we wait...

Millions have come, millions have gone
Millions to come and millions to go
Life web that lasts like ebb and flow
Nothing lasts for ever that would glow.

Rose is a rose as sweet as its smell
Oh, no one on the earth knows it well
Go to the heaven all 'Senior' could tell
For one has to, but, raise a little hell.
