Another Monday; another week. That means more obsessing about my spouse's immigration cases. Argh! I like the weekends more. I rarely think about this visa stuff during the weekend and to be honest, it feels good. I had a blast this weekend. Saturday, I went fishing. Sunday, we had a huge party in our house; there were 40 people over for dinner. The party started at 16:00 and went into the 0200 hours. A bunch of us decided to go watch the movie INCEPTION. Great movie! I loved the whole concept of it so much so that when I came home, I dreamt about continuation of the movie. It was brilliant. Di Caprio doesn't disappoint. Highly recommend INCEPTION to everyone.

WOW what a weekend. Had a great time at the lake/river. I got a little scrape on my ankle from going down the river slide and a darn yellowjacket stung me between my toes when I was walking around with flip flops on ... :crying: :o I see you guys have all been busy too. I received 80 notices in my email from VJ over the weekend. Man O Man I dont think I saw any approval tho, only messages of hope haha. :hehe: I was looking at a chart and it showed that in March when we first filed there was a large increase in filings. This same trend chart showed lower approval rates for our time also :crying:. I think things will seem more active this week and next but I dont think April filers should expect anything just yet. Also remember if you keep telling yourself its bad then It will be bad ...for you... The good news is the opposite is also true... HERE TO A GOOD WEEK RIGHT :thumbs:

Well I cant just sit here and watch the grass grow. I am off on my camping trip to Rock Island once I pack up my truck. I cut the grass yesterday and the fish are feed. :thumbs: . I refuse to let these low down, dirty rotten scoundrels get to me because of their inability to provide a good service. I just hope I never run into one of them on the street one day. :bonk: Wow wouldn't they feel wonderful after that haha...

You all have a Great Weekend and I will do the same. I hope at least a few get some good news today so light can be seen :hehe: ... Take care and do something fun for a few hours or more if you can...

om i agree with you a 100% and that is what i said. the armed forces are being paid for what they do. we are paying for our wives to be here and now they increased the fees even more. for us to wait so much and then i see that VSC is through june basically with k-1 approvals. it is quite irritating to say the least.

Well what really gets to me is I have read that this time between NOA1 and NOA2 is for doing background checks. I am up for that but then I have seen others on here who stated that their significant other is here in the US illegal and they got their NOA2 approved. Whats that all about. I know you cant believe everything people say here but it would not surprise me if what they said is true. SO what kind of background check would that be...

Tj, I think your case will probably be approved for expedite.

I know everyone is screaming WAIT, but for some of us at least for me, I'm fully expecting to wait. I know that mine is going to take longer. There is going to be a "red flag" just for a previous petition ( actually 2-k-1's). Whenever the "red flag" appears in an adjudicators box, it needs to be cleared before approval. I remember reading a little over a year ago an exchange between a former adjudicator and someone on this site interviewing the former adjudicator. That adjudicator was also a member of VJ, and had currently gone through or was going thru the process at that time. Although they could not give specifics, the person did clarify many things that happen and the process of how a case progress's. If anyone could find that, it's certainly worth reading.

Wow that would be good reading... Can you think or any words that might assist in a search...

Before we complain that it has been so long and we need to be approved right away so we can be with our loved ones, just think of the people in the armed forces that have families, husbands, wifes, that are separated from them for 2 years or longer in some cases. They also have to fear for the safety of them of course because they are in war zones. Yes it is tough, but it could be worse...just stay patient and we all will be with our loved ones before we know it. Good luck to everyone and I hope you all get your NOA2's soon.

I don't want to be the bad guy here but your comparing apples to oranges. We have a right in my view to be with our wifes or husbands regardless of their citizenship. We are trying to bring our spouses or girlfriends into our country for a visit, marriage or permanent relocation. When soldiers are in a war zone or on hardship tours they are doing their duty as Soldiers. They also volunteered to be Soldiers. Don't get me wrong. I was in the Army back in the 60s and did a tour in Viet Nam. I also did 4 yrs in Iraq as a civilian. I just don't think the two are equal. On top of all this we are paying for this service which seems to be crazy to me as the people who are reportedly doing this work are paid for by tax dollars. If they are going to charge us then they should charge for all government services and reduce our taxes. Sorry I just dont agree and think we are as citizens of this country we are losing even basic fundamental rights.

OMG! OMG! OMG! I CHANGED MY PASSOWORD ON USCIS.GOV WEBSITE TODAY. AND I GOT A EMAIL ON MY CELLPHONE WHICH I WASN'T EXPECTING. AS SOON AS I SAW THE EMAIL, MY HEART FRIGGING JUMPED 10 FEET HIGH THROUGH MY THOAT THINKING I WAS APPROVED. MY HEART IS STILL BEATING FASTER. It turns out I am just getting an email stating I changed the password. Way to be over-excited about nothing.

No new approvals yesterday. Hopefully we'll get a couple today. Maybe. People please fill out your timeline.

I know everyone without approval is getting real frustrated. I know I am. I've been in this boat before. had to go the congressman route just to get an answer after 6 months of waiting.

I am interested in what kind of assistance your received form your Congressman's office. Did the just brush you off with lots of words but little action or did it sound like they would be able to help you. I knew someone in the service who did this and he told me he was done in 2 months.

Yes, I think so. But since you asked, let me ask a question about that: is there anything other than an IRS transcript of the most recent tax year that is required in support of the I-864, Affidavit of Support?

My reading of the instructions for I-864 tells me that, when the sponsor meets the minimum income requirement, the only supporting document that is required is an IRS transcript of the most recent tax year. Yet, I saw several pages, including LingChen's shortcut, talking about sending IRS tax returns for 3 years, pay stubs, letter of employment, etc.

It seems that in general websites like this one recommend to send a lot more information than what is actually required.

While I understand that it may seem innocuous to send more information "just in case", I would caution against that. Indeed, this is not what lawyers typically recommend because every extra piece of information you provide can be used against you. For instance, I read on LingChe's shortcut the warning about the possibility of generating an RFE just because on one document your job title is "painting" and on another it is "painter". The fewer documents you produce, the less likely this is to happen!

I also read that it was now required to send evidence of bona fide marriage with your I-130. I actually consulted an immigration lawyer before I sent mine in and she made a face: "yuck! don't send any of this now!" :-) I didn't, and evidently my application was approved without it.

So, I think while people should make sure they send the information that is necessary for their application, each case is different and I'm not sure people should systematically send everything "just in case". Because too much information may actually hurt your case too.

My $.02.

WOW I find it disheartening that we are getting conflicting or at least excessive information as to what is needed. This process is confusing enough without being overly cautious. I would agree with you give them what they need or request without giving away the farm. :bonk:

Well I have the DS-3032 form completed and signed by my wife. I am hoping that is what I need cause I gave my wife instructions to complete that form which she did and she mailed it to me. Did anyone attach and email the actual form to the USCIS? I understand the BAR code is not required... providing you put your case # on it.

:( Are those with NOA dates of March 11th and 12th on a Do not touch list? They really seem to have skipped over us and I haven't even gotten a touch or anything. Whewwwww I hate going to the USCIS website just to see the same "last activity date" every time. Its like a punch in the mouth each time I go there. I hope they haven't lost the folders with those dates.

I know you must be feeling left out. If you're on email notification be sure to check your spam or junk mail folder just in case the notification goes there. Some people seem to only know when they get it in the mail. Either way hopefully you will know something soon.

Divina- I just copied and pasted the DS3032 format found in the LingChe guide. No signature was on there and they accepted it just fine. :).

I dont know the name of the dish but its simple. A little like Rice A Rone. The SF treat... It consists of Basmati rice, vermicelli pasta, bell pepper, onion, garlic, chicken stock, butter, oil, bacon, peas and such... Got the recipe from the Food Channel... Now what do you mean no signature on the DS 3032? There is a signature at the bottom which should be signed. This is what authorizes the USC to get all the doc's sent to them. Is a simple doc so if you dont have a signature then the person can sign it scan it and email it in from where ever they may live. Some do both email for the other country home and mail it in from the US.

Its nice to see things moving albeit ever so slowly. As it has been suggested for those waiting NOA2 now it the time get those ducks in a row. :yes: I just received the last bits that I needed from my wife. :thumbs: Thank you honey... Having said that now I am anxiously waiting USCIS for our NOA2 which looks to be here shortly provided I dont get a RFE which is possible because I didn't provide evidence of past history with my wife and myself. I figured the Marriage certificate show say it all and if they needed additional proof we could provide that at the interview. I dont know if they will see it that way and if they dont then I will send them pic's and email support up the kazoo.. :hehe:
I do know that if I have to wait much longer I will be speaking to my Congressman for assistance. I know government offices dont like these guys poking around much and will move faster to get them out of their space. Just as we dont like the attention neither do others.
My other fear is this, right now I think I know whats going on and what I need to accomplish this journey. However once I get my NOA2 I will probably go brain dead and just stand there like a deer in the headlights... Hey folks, in visa interview beneficiary has to show original tax returns and W-2s of petitioner OR the copies would work ?

Yeah I saw the 17th earlier but its still new to me and I havent seen any later dates yet.

I would not think so because they were submitted earlier in the process with the I-864 package. However everyone says bring all the documentation you can to the interview. I would not think the Tax info would be ask for here. I am thinking Pictures and Marriage certificate , birth Certificate. Remember you or they will only have copies to show as the NVC has originals already. I also think this would be when they return the originals to you.

It seems that the NVC has slowed down a bit. Part of that might have to do with the new fees that are going into their system. I wouldn't doubt it if they have a bit of trouble for a short while after tomorrow trying to work out the kinks.

No your not. I didn't send one in either. I really don't think it matters on that. Regarding your other question on the DS 3032 you can have her email it or you can mail it... Its your choice from what I can tell. At first I was hearing folk state the the USC should mail it in but then others stated that they had the Beneficiary email it without differently or trouble. :hehe: But if they are passing you bye then all is for Knot :crying: . I wouldnt let the touch thing mess with you either several have stated that they were not showing a touch and received their NOA2 in the mail.

Looks like the average days it takes to get the NOA2 just went up by 4 days. From 115 previous to 119 days now. I am on my 76th days now. So another 43 days to go. Originally VJ suggested I would get my NOA2 by July 18th. Haha. If that was true, I was going to get my NOA2 in less than a week by now. Wow! What a feeling would that be. I guess I will find out in month and half how it feels.

Yeah Tom he is here without inspection, aka illegally. As i said I would ask for him to leave with permission, as in ask for advance parole, which I've found out that he is not eligible so if he wanted to leave it would have to be a voluntary deportation. Husband does have his Honduran passport, as any "unlawfully present" immigrant can go to their consulate and acquire one. I too am surprised that the I-130 was approved so quickly, but then again we do have a child together, and from what I'm reading every case it considered "unique". My worries are in proving extreme hardship in front of a BIA Judge due to not being familiar with how a Judge would interpret and apply the waiver to my specific case.

I do know that what I have on my side is that we have a young child who would be psychologically damaged by the separation, I am a U.S. Tax paying citizen, my parents are U.S. Tax paying Citizens, and we are not eligible for “federal means-tested public benefit”. Even though I have learned to speak Spanish with my husband that I'm not comfortable with the thought of leaving the U.S. to seek residence in Honduras. Secondly, I would not be able to complete my B.S., nor do I think my child would be able to get the same education in Honduras that she would be able to attain in the U.S.

I know there are some other folks here who might be in the same situation so I've posted some links and quotes from some pages I've found while doing my research.

Tom- I wasn't trying to say that we have the same scale as various other countries at all. I have been subject to both systems and prefer ours. At least when they tell you here that you have to pay $20, $20 is all you need instead of $20 plus "whatever I feel the other fee will be today to maybe do what I am telling you I will do."

I agree with your last statement Tom, if that were the case in our society you would be ahead of me for sure. The majority (if not every single one of you) would've been ahead of me :P. Luckily, I have some luck on my side up here.

Tom- We here in the US do give bribes sometimes but it just isn't as open as in other countries. I don't think that you should have to bribe someone to get a fair result especially when you aren't cheating on anything but it can be beneficial if you have screwed up and need some "assistance".

Oh how I miss the liberal thoughts of my youth. What you say is True enough. We have bribes, theft, rigged elections and most other crimes that are committed elsewhere are also committed here in the US. But to think it is even close to the same level would be a gross over statement. Its like stating bad things happen to good people or that there are good people who are serving life sentences in prison... Its true enough but I would not then give any prisoner the benefit of the doubt.

You're so right, we shouldn't have to bribe someone or do anything extra for that matter to receive fair and equitable treatment. Fair and equatable are however subjective terms and depending on where you are positioned will determine your evaluation.

I am fairly confident that when it occurs here it is the exception to the rule and in some other lands it is the rule... If it wasn't I would be ahead of all of you haha... B-) :lol:

Hello, everyone. So far so Good, our I-130 was approved but we are still waiting for our packet from the NVC. Anyone else who filed in March already receive their forms? Second, I have our mailing address listed which is different from our residence, does the NVC have this same information?

Another thought while I have been researching here, we are contemplating filing for a K-3 Visa so my husband can see his family, but re-enter the US legally this time. It has been nearly five years since he's left Honduras. Although our I-130 was approved, I was wondering if it might be faster to have him ask for permission to leave while filing for the K-3 Visa. This is all so new to us. What we are worried about is the wait time after the interview for them to process everything. My husband has friends who keep egging him on that he might get stuck in Honduras for a year or more since he entered with out inspection. Any feed back would be helpful. I think you have several issues going on here. First off it sounds like your Husband is here illegally. That's not go I in my view. Secondly how would he go back to see his family. I don't think he can just jump on a plane and fly back to Honduras as you need Passports and Visa to travel abroad... I am not an expert here and perhaps I misunderstood what your saying. If he is illegal I am surprised you got an approved NOA2 as the US homeland security supposedly do background checks on applicants. That is what I believe takes so long... But hey what do I know... I am sitting here waiting like almost everyone else.

Hi fellow Marchers.. am back today after a kinda week-long journey. I tried for the second PCC that I need... i have a funny story to share..
In the place where i lived for 21 years from birth..theres a weird system. For the district police office to issue me PCC, they need 1. Conduct certificate from a govt officer saying that he knows me for atleast 3 years and that my character and conduct is satisfactory.. (and who will decide the defn of character / conduct..? should I be a non-drinker/ non-smoker ??!! ) 2. Letter from consulate or relevant foreign authority. 3. Notarized copies of passport....

Thinking..thinking..thinking... Now I guess the police is acting extra-smart there.. one obvious thing is they want bribe money and secondly, for some jobs and some countries, they want a certificate issued post a 'local reputation' check...
So they have decided on some policy like.. 'whoever wants whatever kind of PCC.. come and give us all these set of docs.. we dont have time or will to know who needs what'

In short, no PCC from that place for me..atleast for the time being.

I knew a lady from Russia who worked for their Government Visa office but now lives in the USA. She was telling me when she went for her Drivers license she failed it 2 X then ask the man what he wanted to let her pass... OMG :o ... I told her that this was not looked upon favorably in the US and she stated that's what the tester told her. Different strokes ... It is also why you should well never mind...
At this point I am wondering which way of government is better wait forever or pay as you go...

I then ask her how much did she get in Bribes when she worked in Russia. She told me 4X her wages... :yes: and thats every month... I know in some countries if you don't put money out you will not get a JOB...

Hello my fellow March filers!

My husband has filed the I 130 application on 03/03/2010.
Our NOA1 is 9th March 2010.
We have not received any other reply from USCIS YET
Anyway my question is related to the NVC Stage.
I have read that we need to provide police certifiaction of every country where we lived in from age 16.
I want to confirm this.
If that is the case.I will take the necessary steps now itself.
It is like we are completely blindfolded...

It states "Police Certificate based on country: Use this link, [5] select country, and scroll down to Police Certificate section
NOTE1: Police Certificate is required for any place in their country of citizenship; the beneficiary has lived longer than six (6) months, after age of 16.
NOTE2: Police Certificate is required for any places which beneficiary has lived longer than twelve (12) months in any other country other than country of citizenship, after age of 16.
PCC can take a long time to receive, so request it earlier rather than later (for some countries, such as India, your PCC may need to be within 6 months, for most within 1 year)

If this is applicable to you then I recommend that you get your Police Certificates from those places, If you have not already started that process.
