HELLO GUYS.,
:help: i need help with this situation. i am a dual citizenship. we know each other since 2009, we used to talk to each other on Facebook and skybe since may 2009. on June 2012 i came with my family to Egypt and got engaged on June 26, 2012. we mailed 129-f form application on august 14, 2012. until now i am still in Egypt with my fiance. on February 14, 2013 we received an RFE. my questions are >>>>>

1. if i stay in Egypt with my fiance until our paper approved will be any problem with this?
2. when my fiance goes to the interview, it is OK if i went with him over the interview to support our situation
3. when i send the RFE response back, what is the expect time for the NOA2. if found that it says " A new processing period will begin when we receive your
response" what does this mean? it means my case will start from all over or they holding on it until i response them .
4. is if we got married before the interview should we filed the 130 application with the RFE letter or should we keep it like as we are.

So the I-134 form is useless in our case?

 

The most important thing I have read is that she must show intent to return to India. I think she can show this through her job and the fact that she has applications for school to UK. The job is not high paying, so she can not show enough funds to pay for trip, but since we are married, can I just set up an account in her name and transfer a lump sum to it? She is my spouse, so it is our money essentially. Any other suggestions are welcome.

Hello, 

 

With delaying our spouse visa application, we would like to go ahead and apply to a B-2 Visa (I didn't want to change forums since you have the details for my case) for her to come visit in the Spring.

 

I have been reading some information that says I can sponsor her through the I-134 and make note that I will pay for her trip, explain where we will go etc, but then I read elsewhere that this form is not even looked at by the embassy and it really only depends on her proving her own financial support and ties to home country to show she will return. She has a job to go back to and can show applications to schools in UK, but she will need my financial backing.  

 

Does anyone have a success or horror experience with sponsoring a non-resident alien spouse for a B-2 Visa?  Thanks.

Any answer I have to that question depends on the answer to this question that I have, if she is going to the UK in August to start a PhD program, how long would that last?

PhD would be about 3-4 years. She would get a student visa and as post-graduate student, she can bring spouse. It seems like we should just wait it out to see if she is accepted to the program and do the DCF towards the end of her studies. If she doesn't get in to a school, we can look at beginning our CR-1 application to bring her directly to the U.S.

If she is in the UK or Australia by the time the file reaches the NVC, you will have to contact the NVC to ensure the file is routed to the country she resides in.  She would not have to fly back to India

 

 

The relevant immigration authorities of the UK and US will not communicate and will not care if your wife has a pending file with the US and if you apply for any extended stay in the UK.

 

Once the visa is approved, it must be used before the printed expiration date (which will be less than or equal to 6 months from the date of issue).  The validity of the visa is tied to when the medical exam takes place so the medical should be done as close to the interview date as possible.

 

Thank you Ryan. I am trying to play out all possible scenarios in my head, so this really helps. I know every case is different though. This is where I kick myself for being an obsessive planner. 

 

With her and I both possibly going to UK in August, do you think it is smart to start the CR-1 process now and simply move interview to UK if it takes until August? I assume I would have to remain in U.S. until visa is final for her since proof of domicile is required?

 

What would happen if I we both moved to UK while in process of application?

 

Is it even possible to file from the UK if I waited until her school was close to ending?

Would it further complicate things if she has open application for CR-1, is living in UK and I apply to UK for Visa as spouse to come live with her during school? Do consulates even discuss between each other? Like why is he applying to come here and her to go there? We want to come back to US after she graduates and during year for visits, so it would be easier to have her green card.

 

Once CR-1 is approved, she needs to come here within what time frame?  Is there a minimum time she needs to stay before leaving the country again if she had to go back to school?

Janice and Micah you bring up another question. My wife is applying for PHD programs in UK and Australia. If we begin the CR-1 application process now and it takes a year, she may already be accepted in April to school and moved to either country by August 2013 on student visa. Would she be able to change here interview to that country or would she need to fly back India? I hate to wait to see if she is accepted to school and miss out on beginning this process.

Hello,

 

Couple questions I hope to find answers to. I am trying to figure out what proof I need to provide to show my marriage is real and what else we might expect.  

 

Background:

Wife is Indian, I am American

Have spoken or text daily since meeting

 

July 2012 - Met in Taiwan where she was getting MBA and I was on a 30 days study abroad. 

February 2013 - Traveled to Taiwan and Philippines with her for vacation

July 2013 - Traveled to Taiwan to propose and get married (no ceremony required, registered with proper agency, received certificate and celebrated with small dinner with friends)

August 2013 - Wife graduates and goes back to India to take brief research job (working towards PHD) and visit family she hasn't seen in 2 years, celebrate holidays etc. 

 

Now the present - We want to be together in the U.S.

 

As you can see we, fell in love fast and moved quickly to marry without thinking about Visa and stuff to be together. Since we eloped, we have no photos of a wedding, just some dinner photos and our marriage certificate. Is this an issue? Are chat sessions on FB, Skype and Whatsapp enough "proof?" 

 

How long can we expect the process to take? We hoped to be together in April this year, if the Spouse Visa is not final, can she get a tourist Visa to come here and wait? 

 

Would it be easier to get a fiance visa even though we are married? Or would that be considered fraud? 

 

Do you recommend using a legal service to file the forms etc.? Do they have more success than doing it yourself?

 

What is the total cost to get all of the Visa complete and my wife in U.S?

Thank you both. As long as it is not illegal, I think i will try to go to a different branch and ask to speak with the manager. I am also going to contact my online account and see what their process is. 

 

Guess I need to go back and try to find our vacation receipts for flights and hotels. We eloped, so there are no family "wedding" photos except us together and dinner with some friends to celebrate. I assume the Embassy realizes that every case is different and will accept different evidences. Lots of work to do.  

 

Do either of you know if it is possible for her to come to US on a work visa (H1B) prior to us filing for CR1? If she received a job offer would they allow her in even though she is married to me?

Are you talking about evidence of a bona fide marriage?  I see you already filed to obtain an ITIN and got an ITIN, but you haven't filed joint tax returns yet?    The problem is that you will need her to sign on joint married tax filing.  You can still file "married filing separately" tax filing with "NRA" for your wife with your signature and without her signature.  You can amend tax from MFS to MFJ after your wife arrives in USA on her CR-1 visa. You have 3 years to amend. 

 

For adding your wife's name to your US bank account, she cannot sign as a joint account holder.  I tried that before. Most US banks don't allow that unless spouse needs to be present to sign.  For evidence of a bona fide marriage, you can send money from your bank to her bank in her country or country where she studies, but make sure to show your name and her name on wire tranfer receipt.  Wire Transfer Receipt can be an evidence itself.  Or you can still send money to her via Western Union and they will give you the receipt.

Yes, sorry, evidence of bona fide marriage. We did obtain the ITIN and filed taxes jointly, as the 1040 was due with the ITIN form. I simply mailed the forms to her for signature and she sent in with her auththenticated copy of passport to fulfill their identification requirements. I hope it wasn't wrong to do this.

 

Do you know if it is illegal for banks to allow a joint account if she is not present? I haven't tried adding her to my online account (it wasn't an issue for my credit card), but they have no physical locations for someone to even go to. However, I am sure they allow joint accounts. We have had some money sent through Western Untion, but how much is enough to prove bona fide? I thought having her on my account would be stronger proof. Thanks again!

I am a U.S. citizen, I married my wife (Indian) last year in Taiwan where she was studying for her Master's degree and we have been separated since July. She went back to India to visit family and accepted a job as research assistant to build experience for PhD. In preparing for CR1 Visa application I read that it is good to show a joint bank account and joint tax returns.

We have already filed for and received an ITIN, however, when I took the ITIN and a certified copy of her passport to my bank, they told me that she needed to be present to sign as a joint account holder.

Has anyone run in to this issue?



 

In addition, they told me it would look bad for visa process if we showed a joint account and she had never set foot in U.S. to get one (claimed some law prohibit this?). I find this very strange considering I have online accounts that never required to see my face. He also said that they couldn't do it anyway because our last names was different and they would need to see marriage certificate to verify same last name. As far as I know it is manadatory for a woman to chnage her last name.

 

So, is it ok for my wife to be added to my US bank account if she has never been in this country? Should I switch banks?

For interview process, is ok to show just a joint account and the money just sits there? Or do they like to see transfers and deposits from time to time?

 

Any advice is helpful. Thank you.

I'm hopeful that maybe some of the veterans on the site or perhaps someone with a legal background can help shed some light on my situation. I'm a Canadian citizen and my fiance is a US citizen we've been dating (long distance for 5+ years) up until about a year ago we worked for the same company and were able to see each other very regularly (almost every other week) because we worked on the same projects that required us to be working on site at customers together in the US every other week. At the time I had a NEXUS card and was never given any hard time when entering the US primarily at Trudeau airport in Montreal or Pearson in Toronto that was up until about two years ago when I was flagged at Pearson and after a very lengthy secondary screening was told that my employer need to apply for a TN, H-1B or L1 Visa for me. After a lengthy period of time my company finally settled on getting me a "B1 IN LIEU OF H1B" an obscure visa that is notoriously abused by some foreign IT companies to get employees into the US under false pretenses. Having this VISA now in my passport seemed to make matter worse at times and I was constantly told that I really should have a TN visa if I was flagged for secondary screening by the NEXUS machine.
Jump forward to Oct of 2012 my Nexus had expired and I went for my interview at Trudeau airport after receiving my conditional approval the USCIS agent conducting my interview seemed to think I was abusing my NEXUS on behalf of my company and that I didn't have the proper work permits to allow my entry into the US he did not approve my renewal and said he was submitting it to his supervisor for addition scrutiny (to this very day I have never heard anything back) he did enter in my file that I was warned that my company needs to provide proper VISA paperwork TN, L1 etc or I would be barred from entry.
I'm sorry this is a long story to get to the point about my K1. Given the problems crossing the border for work and the fact that my employer had chosen to close our Montreal office in June and had given everyone a working notice of 9-12 months my fiance and I decided to submit our application for the K1 visa seeing that timing of approval would coincide nicely with me wrapping up work in Montreal sometime in June. I informed my employer of the issues arising once again crossing the border and also informed them that my fiance had petitioned for our K1 visa AFTER WE HAD BEEN WARNED. The company is now saying that because I've applied for a K1 visa that I've nullified the B1 IN LIEU OF H1B and are using it for grounds to terminate me.
Does anyone have any insight into my situation I've spent countless hours trying to search the internet for answers to no avail.

Hi all,

 

I have submitted my I130, G325, etc. about 6.5 months ago.  I just realized that on my wife's G325 form I made an error on the line that says: This form is submitted in connection with an application for _______.  I selected 'status as a permanent resident' instead of selecting 'other' and writing in I130.  :/

 

Will this mistake cause my application to be rejected?  Is there someone I should notify about this error?  Thanks in advance for any help you can give.

Finally got approved for interview in August but the letter I received showed that my Financial Evidence = I  for incomplete.

 

I submitted my 1040's and transcripts for the past 3 years along with my co-sponsors tax forms/transcript.  I'm not sure what could be incomplete? 

 

I'm thinking about bringing my pay stubs or records for the past 6 months along with my i-864 and copies of my 1040's for the past 3 years for the interview.  Do you guys think I need anything else?

We're about to send our package and I'm really worried about this form. Turkish addresses are a bit long so I was a bit confused about how to write it down. I added an attachment but I didn't know if I should also include the other parts to the attachment, like city, country etc.

So far it looks like this:

Hello everyone,

 I am thinking about filing for K-1 Visa. I have completed all the required documents but I was wondering if this is too much proof.

So far  I have:

 

about 6 pages of skype call log

about 25 pages of skype chat log

about 10 pages of sms while I was with her

about 15 page of facebook chat log

about 10 page of viber chat log

about 20 pictures

and some receipts.

 

I was hoping if some one could help me with this process.

I think it's too much. I've read somewhere that it shouldn't be more than 7 photos, and a few pages of each of those is enough. The most important is passport stamps and tickets etc. 

 

 

They just need to be sure you have a relationship and that you've met in the last 2 years. They don't need to read or know all of your conversations and see all your photos. 

 

If the evidence is too much, they just need more time to analyse all of them and it can only longer the process.

Essentially we started filing for the K1 visa last November. We have had our  petition approved and am currently awaiting completing the next stage of the process, i.e. the embassy appointments/ DS160 etc.

 

My issue is that since I will be going to the US in June for a couple of weeks, I didn't know whether it was best to hold off completing this form and having the actual visa in my passport until I was back from my visit in June as I didn't know if I would be able to hold the K1 visa in my passport yet not use it in my visit in June as I will not be looking to use the K1 until August.

 

I'm not entirely sure about this, but I think you can't have two different visas on your passport. When you get the K1, the tourist visa should automatically be cancelled, because Fiance visa starts counting down for your wedding upon your arrival to the US.

Yes I have filed for a K1 and had the letter last week in regards to the next step of completing the DS160 and the embassy appointments etc.

 

So if I am unable to use a tourist visa whilst owning a fiancé visa, then I assume my best bet would be in holding off until mid june to go ahead and submit the DS160?

 

You can get your tourist visa and travel to the US before actually getting your K1 visa. But after you get your fiance visa on the passport, you can't travel to the US with the tourist visa.

 

I'm sorry but I didn't really understand what you want to do. :) Do you wish to go to the US with the tourist visa after getting your K1? And when do you think you'll get the K1 visa? It takes about 7 to 9 months to get everything done.

1. Yes, if you get the interview soon, you would definitely get your passport with the tourist visa in it by June. Mine took only a week to get it after the interview.

 

2. As far as I know, after you get your fiance visa, you can't use your tourist visa. But when you use your fiance visa when entering the US, you don't necesarily have to get married immidiately, you have 3 months to get married to your fiance. 

 

But have you filed for a K1 yet?

My American fiance and I want to apply for the K-1 visa at the beginning of March. I want to go to the US to visit him in May and my question is; someone told me that it takes 5 months for our visa to be processed and when I'm entering the US, I can just tell the officer that I'm visiting a friend and not mention my fiance since they wouldn't know about the K-1 visa we applied in March yet. So should I just say I'm visiting a friend or my fiance???

But it's very risky! I don't know what to do!

I already have a tourist visa which is valid for 10 years, and I visited US last summer and stayed for 3 weeks. We are trying to do everything legally and I'm very stressed and worried about the procedure.

I applied for and was turned down two times for a visitors visa- and in both interviews was strongly encouraged to file for family visa--

 

It is our intention to retire abroad- and in all of my wisdom felt that a visitors visa was MORE applicable--

 

have learned over the last couple of years that what is often logical is not the law when it comes to immigration.

 

I would think that a visitors visa is next to impossible to get approved when you have family ties to the USA or a USA citizen--  sad as it appears you are guilty of breaking immigration law until proven innocent and they wont give you a chance to prove you are innocent- (IE respecting visa expiration dates)

 

It is all about the financial responsibility and the affidavit of support- (in my humble opinion)

(bad assumption (I said she- but we do not know if your child is a girl or boy)-- I will let someone with more knowledge answer your other questions but I believe if you can not prove income or assets you would need a co sponsor- but if you have current tax returns that should do it-- but again- dont know enough to comment on that- but I do know FOR SURE- what you need to do for your child--  you would file that in Singapore and they would issue passport there.

I will anser question 2 for you-  I also had a daughter born out of the USA--

 

What you need to do for your child is file a consular report of birth abroad to a US Citizen- she is automatically a US Citizen becasue she is your child- she would get a USA passport when your application is complete.

One follow up question on your comment ---I understand the DS230 is not filled out my me the petitioner but I have TWO BENEFICIARIES- my wife and stepdaughter- do we need to complete TWO DS230's?  My stepdaughter is a minor just 9 years old.

 

Or just one for my wife?
