One follow up question on your comment ---I understand the DS230 is not filled out my me the petitioner but I have TWO BENEFICIARIES- my wife and stepdaughter- do we need to complete TWO DS230's?  My stepdaughter is a minor just 9 years old.

So, planning ahead- with admitted OBSESSION over this process- these are not statements but questions making sure that I am understanding the process to come - so I may prepare--   

 

I am soon expecting a NOA - or a notice of acceptance (1)--

 

at which time I understand they MAY ask for evidence (RFE)- or they may forward it on to the NVC (national Visa center to be processed)  which would be the second NOA (notice of action)

 

Once the National Visa center (NVC) has the package they will contact me and ask for MORE DETAILED DOCUMENTATION - including forms:

 

Form OF169-- Instructions for immigrant applicants- which more or less is a checklist that needs to be signed-- and sent in with ALL documentation-- I am assuming that would be filled out in my wifes name and only one copy is required- minor children do not need one?

 

Form OF-230-- part one and two' Part one being Biographic data, and part two being a sworn statement- AND I am ssuming that one of these has to be filled out for everyone? including the petitioner and the benficiary and all minor children?

 

Form I-864 -- Or affidavit of support-

 

at which time also need copy of all birth certificates and marriage certificates and divorce decrees (long form)--

 

Is that correct?  am I missing anything? -- I want to have this stuff WAITING for when I receive the NOA.

Will the "FORMA LITERAL" be required by USCIS, or will the STATE DEPARTMENT request that?

 

either way- I am working on getting them BEFORE being asked for them, my MArriage certificate and stepdaughters birth certificate we have to go to SPS for, my wifes birth certificate we have to go to YORO for that--

 

we have mother in law and aunt working on them as we speak--

 

I still have not been notified if the applications were accepted they were delivered on 8/19 am.

 

I attached a G1145 form--  what should be next? and how long is normal?

You are absolutely right-- in addition to putting POSTS on this website- I took the paperwork down to the USCIS office (Nashville)- and showed it to  a woman working there--  After I showed her the paperwork I thought it was OK-- so I sent it ---

 

I was and I am anxious to get the process started- I will start working on the literal forms just in case ( or when ) they ask for them- hopefully it wont add too much time-- 

 

BENEFIT - of having this website-- to Plan ahead

 

even when I was processing the Consular Report of Birth of biological daughter they accepted my marriage certificate- in its current form--

 

and to be honest with you this IS THE FIRST I am hearing that a marriage certificate is available in the literal form-- I thought that was only BIRTH certificates

 

doing my best - and thank you for your input- I do appreciate the criticism.

 

SEEMS to me that this DOES NOT have to be this difficult- but even when the woman saw my daughters Report of Birth abroad- she said- OH!, this is what the new ones look like- and further went on to comment that it looked HARDER TO PHONY up and said they had lots of fraud with them in the past-- I guess looking at things from THE OTHER SIDE- NOT EVERYONE has the same moral standards - and need to be checked and rechecked- sad thought.

I DO HAVE the FORMA LITERAL birth certificate for my biological daughter- it was required for the "Consular Report of Birth Abroad of a US Citizen" (CRBA)- so I am aware of that AND - I know HOW to get them IF they are required-- it did NOT specify that in the instructions for the I130 - and it DOES specify that in the instructions for the CRBA.

 

so now you got me worried.. I thought I had EVERYTHING covered checked and double and triple checked - -- Even went this morning to the USCIS office here in Nashville Tenn and she told me they do NOT check paperwork at that location - but.... in conversation she looked it over with me and seemed satisfied with what I had...

 

This is what I "LOVE" about this process-- always a grey area...  room for interpretation... 

 

EITHER WAY- it is GONE -- SENT OUT today and I have mixed emotions - so HAPPY to have checked off ONE MORE thing to do- BUt at the same time had been working so hard on the paperwork and for so long -- getting it perfect...  I miss my paperwork-- feels like I have nothing to do now... except wait- for the next check box---

 

It does seem to me this should be easier than it is-- a while back I spoke to an attorney who quoted me $7,500.00 to handle it for me.-- to me this is an ABSOLUTE REDICULOUS amount of money to ask for and question WHY LAWYERS MAKE LAWS SO COMPLICATED?  but I digress.

Do NOT want to be  any bother- but I want to make sure I do NOT make any errors- and expedite the process.  WE ARE TALKING TWO DAUGHTERS.  One is my biological daughter who is not on any petition because we already processed her BIRTH ABROAD as a US CITIZEN - and we already got her passport-- it is my stepdaughter who actually has NO passport as of today but is working on getting her HONDURAN PASSPORT- like her Mother (my wife)-- TWO I130 petitions are being filed ONE for my wife and one for my stepdaughter---  My wife was never previously married- BUT nine years ago listed a good friend and missionary as the father (not biological) -

 

It is the paperwork on my stepdaughter that has me concerned-- OR is she approved as the daughter of my wife once we establish our marriage and relationship?

 

Actually not too complicated but has me searching for the "CORRECT" answers BEFORE I am hit with requests for additional paperwork IF ANY.  I have time NOW to get what I need if I need to...

I am starting this thread - for a couple of reason:

One to track the progress of my application.

Avoid errors by gaining insight from other knowledgeable / experienced people at this web page.

 

My situation.

 

I have a Honduran wife and stepdaughter.  I lived in Honduras with my wife for several years.  We were married in 2009.  Together we parented another little girl in 2011.  In 2012 for financial reasons I had to come back to the USA to work until I could take care of our financial challenges.  (that is another book all by itself)

 

I have been back here and working since the very beginning of the 2012 year, while I was in Honduras I only worked on our farm and had very little or NO INCOME to speak of.  When I returned I learned that my petition for my wife and her daughter would require verifiable income- and I had none for at least 4 years previously.

 

I attempted to apply for a tourist visa on two occasions and we were rejected two times.  In the meantime we filed a consular report of birth and successfully obtained a USA passport for our daughter.  She is a US Citizen by birth, I guess these were even more reasons WHY they rejected our "TOURIST" application - and they failed to believe us when I said my wife just wanted to VISIT - after all if ahe is not at our farm things will rapidly deteriorate.  All along the officers at the embassy encouraged us to fill out the I130 petition for family member and so that is what I have done.

 

I am mailing in the application TODAY.  it is complete--  and this is what the package includes-

WHAT A VALUABLE WEBSITE--  I already learned some things just browsing- I HOPE somone with experience can comment on my application I do have some questions--

 

I AM ADDING a certification of the translated pages-- Will include those with the application---

 

MY WIFE was never previously married but had asked a missionary to list himself on her daughters birth certificate ( my stepdaughter)--  my only concern is my stepdaughter -  not to get too personal but my wife NEVER had a relationship with the natural father- he has NEVER even met his daughter - -- but after she was born became friends with this missionary family ( who was a  married amercan and he claimed to be the father -- thinking it would help)--  we still keep in touch with this family although they are no longer spending time in Honduras - they live in Puerto Rico---  What documentation IF ANY should I get to help my stepdaughters application- it is CLEAR that she is the daughter of my wife - and it is clear that we are married-- therefore she is my stepdaughter--  Like I had stated my wife has never been previously married.

Follow up question on this-- in general--  WHAT are they looking for with INCOME?  current income?  THREE YEARS WORTH -lets say someone was making LESS than what is required in past years but NOW can document with paycheck stubs and a letter from employer showing where he / she is making MORE than enough-- would that be acceptable?--

 

Lets assume last years taxes was UNDER by $5K but now is making $20K more than last year and has a letter it is a permanent full time position--

 

does anyone have PAST experience or knowledge of a similar situation?

Yes..Thank you both :)..its just so frustrating I guess to wait as they (nvc) were so quick to take the money..as Ive said Im retired Army so I know the wait game..and his paperwork is filed under his Real name Jensen..he was eagar to change it to my name..all paperwork is Under his original name..Im just frustrated..well we both are as its been a very long hauland a wait..and to have such a simple issue arise and the fact he sent hs original paperwork that he cant ever get again is very scary..for us both..we have clean slates..never been in trouble and we are old..Just this is very frustrating

The problem I see is if he changes his name in Denmark, in the USA this isn't customarily done and the NVC may be having the issues with that.  So the option of course would be to wait for the supervisor review to finish because they normally have a better idea of how things can work outside the USA vs the normal people who review cases.  

Yes..Gonna sit this out now...I just find all of this incredible,to jump thru all of this..I guess its because we are older and that's not the normal?

OK..this is whats happening..when we married last july here in the USA..jan went back to Denmark..we did the I130 etc here ..its allllll done,..OK..he sent in all required docs and he didn't send in his Original BC he made a copy of it..and made a copy of the marriage cert..sent it in as they asked for an RFE on June 7th of his ORIGINAL BC and Marraraige and where he lived since 16 yrs of age..he left a gap On the places lived since 16..Anyways....He sent the ORIGINAL copy of BC and marriage and filled the gap in...Nothing to do with his name change in this.....The PROBLEM is..Now he has let his ORIGINAL BC out of his hand..he CANNOT get another like it..ever...because when he went back to Denmark he changed his name to MINE..so for some ODD reason..he can never ever get a BC in Jensen again..Its so diff then the uSA..The name change is NO affect on this Issue with NVC YET...He sent what he needed to..Our worry is now..He can NEVER send a JENSEN BC as he changed it....It sux cause its NOT this way in america1!...I told him when we married..PLEASSE don't change your name....*sigh*

Yes..well its now under supervisor review..the problem with a new BC is..jan has taken my last name!..so any BC will now be under my last name..GRRRRR..Things are so different In other countries then the uSA..in the uS your birth certificate will always be your born last name..today he is going to the forgien monisters office in Copenhagen and he has a lot to do..I cannot believ this is happening to him..Its not like so many illegals coming into America and things..Im sooo angry!..Ill be 50 yrs old and he is 47..to be treated like this by my own GOVT and Ive served in Iraq and retired/disabled war vet..pfffttt

I am the US citizen and the operator told me that today 8 july the document sent is not enough..its a Original document!!..Its all Jan has from Denmark!..I just called him and he is crying as Thios is all he has!..I don't know what to do,,she said that the hand written doc is not good enough..OMG,,Ill call the NVC night and day now..I just woke him..6AM his time to tell him this, I told hiom to call the medical board in Copenhagen and ask them what to do...I cannot believe that the NVC is doing this as we are both almost 50 yrs old and going thru this


Its his Original Birth certificate of birth from the church......here in the USA all we have to do is go online and get a copy..is Denmark not the same?

I really think I know the problem tho..he took my last name once we married when He went back to Denmark..he kept his old name on his passport..everything else is In my last name he changed over...UGH..I really wish he never changed it and yes its very unusual to take the womans last name...but he liked my name better..I think this is the problem cause he cant get some docs In Jensen(his old name)..all comes up in witter now..my name......but his SSN is always the same so the NVC needs to start looking at the numbers of his ss card and not the name..its all the same..

Well...supervisor looked at the checklist and now my forgien husband has to send in police certificate and divorce papers in AGAIN...I wonder how long it will take them to look this over again..Hubby is going to the foreign affairs office to get a TRUSTED police record and Im getting the divorce papers here in the United states..he married an American before but when he went back to Denmark they decided that they didn't want to be married...that was 10 yrs ago..so he will send me his police cert and I will have gotten the divorce papers from Arkansas for him..put it all 2gether and mail it off..This all is becoming ridiculous..How much do you have to prove for heavens sake!!!!!..we are both older..never ever been ibn trouble so No police record are bad...Im just tired of the waiting game

I call it an RFE on checklist..because he sent everything in on the list..NVC said they wanted the Originals on BC and 2 other things..so he sent them..THEN they wrote and said the needed certified copies of police and divorce!..He SENT them already so he had to get them FRESH stamped certified!..I cannot believe this treatment...NEVER been in trouble and to be run the ring with this..guess every case is diff.3 times we have had to do this and Its unbelievable that this has happened...

I had an RFE on the checklist..police record and his Divorce papers..got them AGAIN and certified..so those are the only  items NVC wanted..Just want to know...if anyone knows after they see this how long till an interview date..a Guess...Its no big deal Im patient just wanted some ideas thrown at me..TY

Ok..NVC will receive our RFE docs tomorrow as Ive trace tracked it..Now..How long does anyone estimate it should take for them to look at the 2 items requested for RFE and to HOPEFULLY get an apt for interview?..any ideas? Thanks

I'm a late Nov/Dec filer living over in the Dec Fliers' thread and one of our members had success calling this number (603) 334-0700 today and was told her case had already been approved and sent on while she hadn't received anything. Has anyone here tried that? I'm curious before I dedicate my heart into calling and playing the hold game there

 

 

No, we didn't call....not sure that it would really help.

My fiance just called today and he asked the TIER2 Officer if we were ever getting a RFE since there were lately always people getting NO E-Mail about it or Letter! So we have no RFE so far and it's been almost 6 months that we wait for NOA2.

And they told my fiance that our case is still in TSC and in background checks.... Not Lost either she told him......
Omg I'm glad it's not lost!

So still waiting....
