Do it yourself. This site has excellent guides and you can always ask questions here if you're puzzled about something. If you use a lawyer, you'll just be paying him to basically fill out forms. A lot of other documentation (birth certificates, travel records, financial info, etc.) you'll be digging up and collecting yourselves, and eventually you'll feel like YOU are doing all the work anyhow! Save money and do your research here. :-)

Trim the photos to 2x2" that fit the format. Write your name in pencil or light-colored felt-tip pen on the back.

 

If you're still not happy with them, try going to Target or a store besides Walgreen's. And make them adjust the exposure until the photo looks correct...they've got a lot of latitude with those printers. I went by the post office passport desk and asked them for their opinion on mine, and they vetted them. You could do that too.

You don't have to have a "wedding," just a legal ceremony, maybe at the courthouse. Be sure to get multiple copies of your marriage license; you'll be happy you have them later. Easiest time to get them is right after the ceremony at the courthouse.

Mine is the same. 2 months today and not a peep. I'm a little on edge because I sent mine in nearly 4 months ago and have yet to hear anything, although I know the receipt date is the "official" date. I feel for you. I almost wish for an RFE just so I can feel like I am doing something. It seems as if they are going through the early and mid-September files, so we should be soon........I hope.

I'm using an attorney and my advice is that you can easily do it without one with some good research. My lawyer is a nice guy and relatively cheap ($650), but his role has essentially been to make sure I had our packet together correctly. The biggest positive for me came in the fact that he was aware of the IMBRA documentations and I saved time by sending in the proper paperwork (although, I did send off our packet nearly four months ago without any word yet).

In my opinion, the lawyer can offer some peace of mind and maybe save time by knowing the correct way to apply, but I agree with others that all the information you need is at your fingertips. Save the money.

OK, I am officially getting very nervous. I am seeing people with NOA2's a week after mine from California being sent to their consulates and I keep contacting the NVC by e-mail and operator, yet they keep saying they haven't received my packet from CSC. Maybe three weeks is not panic time, but we've already been at this for almost 5 months and for the NVC to not have our approved petition is wearing on our nerves. Should I just call the consulate in Lima? Is it possible that they have it and the people at the NVC are just behind or am I being a little too quixotic?

I think it will show up. I'm in the same boat, an early Dec NOA2 that hasn't "arrived yet." It's playing on my nerves, too, an the holiday breaks haven't helped. There seems to be no rhyme or reason to the order in which they come in and out of the NVC. There are people whose NOA2's were a week behind me already at their consulates. It looks like some take up to 4-6 weeks to get out, so I guess you just have to be patient. Of course, I can't, so I imagine you are waiting on pins and needles as well.

Yep. As far as the divorce is concerned, the only waiting period is how long it takes her to get the relevant documentation to you. Once you have a translated copy of the final divorce decree in your hand, you can slip it into the envelope with the rest of the I-130 packet and send it off that afternoon.

I've got no idea, though, what the process for a CRBA is, or what kind of documetation they'll need. Are you listed as father on the birth certificate? That would, I suspect, simplify things immensely.

If the daughter is yours she cannot apply for a visa as she is eligible for US citizenship. File a CRBA and get her a passport. Your fiancee divorce must be final and she must be free to marry before you can submit the petition. There is no waiting period after the divorce is final. You must submit a copy of her final divorce, translated to English, with the petition.


Seriously, there's no waiting period? Don't get me too excited! I'll see what I can do with my daughter, that might be a trickier situation. I assume I'll need a DNA test or something since she was, technically, married at the time.

Hello, my first time in a while back at visajourney and, since it has been so long, I have a question I'm having a hard time finding a good answer for.

My story, like most, is very long, so I'll stick to the basics. My fiance is living in Peru with our daughter (Born in July 2008). She was/is married to an Englishman that she hasn't even seen for two and a half years. However, the divorce between the two has taken quite some time, although it is scheduled to be finalized sometime this week in England.

What I would like to know is how long must we wait to apply for her and our daughter's visa? I had always assumed six months after the divorce was finalized, but is there any way to apply sooner, especially with our daughter? Any help would be appreciated, thanks.

Sorry, this is not right. You both must be eligible to marry at the time you file the I-129F Petition. That is one of the two main purposes of the petition. I think "az" is thinking of the birth certificate which is only required of the USC Petitioner.

You absolutely positively must include the "certified divorce decree" of the alien beneficiary. Otherwise if you answer divorced on the G-325a for the alien fiancee and do not provide the divorcee decree, you will either get an RFE or a rejection.

The divorce decree does not require Peruvian certification at any time UNLESS the US Embassy requires a single certificate and many embassies do not need that. The divorce decree needs to be a certified COPY (not original) meaning it requires a judges, cort official or court clerk's signature and a seal or stamp of some type.

So yes, when your USC fiance has your ENGLISH (from England) divorce decree, that is all that is needed for both the I-129F petition and the US Embassy in Peru.

You don't need a divorce decree for your fiancee to file the I-129F, only the USC is required to provide a divorce decree at the time the petition is filed.

The good news is that you'll have approximately 6 months to sort out your fiancee's decree before it will be needed for the interview, so I'd start on that right away and get a head start. I'd have your fiancee call her ex-husband and see what sort of arrangeents they can make to get himn to resister the divorce at the Peruvian Embassy. Perhaps he can do it via courier instead of having to appear in person. I'd definitely do some research.

Your fiancee will be required to obtain a single certificate from the Peruvian government prooving that she's legally able to marry and that all marriages have been terminated. The problem lies in the fact that the Peruvian government will not issue this certificate to your fiancee until her divorce is recognized by the Peruvian government.

This is sort of a catch-22 in the fact that the Consulate at the US Embassy will require the single certificate to issue a K-1 visa which meazns your fiancee will need to prove her divorce to the Peruvian government...

In my never-ending quest to bring my fiance and daughter to America, we have hit another snag in terms of the divorce document.

My fiance, who is Peruvian, was married to an Englishman. He completed the divorce in England last week and my fiance went to the registrar in Peru, asking what she needed to do in order to register the divorce in Peru (and get her ID card changed - they were married in Peru). The Peruvian office said that the Peruvian Embassy in London had to stamp the divorce before she could register the divorce in Peru. The problem is that her now ex-husband lives six hours from London and the Peruvian Embassy, so I can't imagine he'll go out of his way very soon.

So, my question is this; can I simply use the divorce documents from England in her application? I assume that a divorce in England is recognized in the US, so could we, at the very least, begin the process with the English documents? Do we even need for the Peruvian office to recognize the divorce since we are looking for a US visa?

Any help is greatly appreciated.

I dont think any past history would affect the NOA1. The NOA1 is simply an acknowledgement that the USCIS has received your petition.

The timing of NOA1's seems to be all over the map, best to sit tight a bit longer before you get too worried (I know - easier said than done) :bonk:

I am wondering if there have been any issues regarding the issuing of the first NOA. I sent my package 10 day ago and have heard nothing. It seems as if the first NOA is largely a formality and people receive notification in half the time I've experienced thus far. The one issue, I suppose, may be that I applied for an I-129F for the same person 4 years ago before canceling the application late in the process. I have to wonder if they are checking this out or what.

In any event, is anyone else having this issue and is my concern about the previous application valid? Or, am I just being paranoid and be patient?

Wife just entered on Cr-1 visa, and Ive read a bit on here about a I-551 stamp that would let her work while waiting for her GC, but she didnt get any kind of stamp, is there any workaround for this?  Or is she just going to have to wait on the GC to start working?  Speaking of which, about how long are the GCs taking to be sent out these days?

 

Also, for a SSN, what does she have to do?   Do they automatically send her one?  Or does she have to apply?
