This may not be a satisfactory answer, but recognize that a K1 who marries after the 90-day period and applies to adjust status is not applying for adjustment as a K1. They are applying on the same basis as any other non-K1 non-immigrant who is present in the USA (having entered with inspection), marries, and wants to adjust.

I think that the 90 day K1 stipulation is, frankly, silly and superfluous, since it can be 'overcome' by filing a I 130 and the
I 485 concurrently. The only 'downside' to that is what you pointed out - and I have yet to see a case where that fact has become an issue at the AOS interview.

Some embassies will re-issue the visa if the beneficiary can not use it within the six-month period. I would suggest you check with the embassy processing your petition. Once the visa has been executed it, meaning the beneficiary arrives in the U.S., the visa is done! Good luck


Beneficiary is already here in the country, so the "extention" of the visa is moot!


Done deal then. You either need to marry before the I-94 expires of have the beneficiary return to their home country.


This has always made me wonder what the point is of the 90 day K1 'stipulation'.

If the K1 leaves the USA prior to marriage and prior to the end of the 90-day period of stay the consulate can renew the visa. The renewed visa will expire when the original 90-day period of stay would have expired, and the person must still get married within that original 90-day period.

Once the foreign fiance has entered the US using the K1 visa, it is null and void. Their status is now derived from the I 94 form in their passport. Which is the long way of saying no, you cannot 'extend' it.

The first page of your passport is the 'bio page' with your picture and personal info.

The instructions of the I 129f say if you're using your passport to prove citizenship, however, you must copy all pages of your passport. Doesn't sound like the OP did that (though I do find it a slightly silly requirement - its still what they prefer).

Depends on the adjudicator who looks at it, but I would suspect so.

I'd go ahead and order one from the state you were born to have on hand in the event of an RFE.

Certified copies usually have a seal or a stamp of some sort (mine is a stamp). I made a photocopy of it, too (don't send USCIS your originals unless you want them to get lost. :lol:

No, it has to be done by the state in which you were born.

Google it. You can probably order it online for little $ and have it in the mail in a week or two.

Sorry, I guess I was not clear on that. Yes, we needed a new I 129f amoungst other things. He did express mail it all to me and his paperwork along with all of my paperwork was overnighted.

I'm sitting back watching all these December fillers get approvals. I'm not gonna lie - I am getting jealous! :whistle:
The more December approvals that I see, the more I start to wonder. I feel really stupid being this way, but when I see someone who sent there application in weeks after mine - I wonder why - I think 'is our petition one that is stuck in a pile of someone who's on sick leave?' That would be the typical luck for both of us! I know that there are so many other people in this situation - but wouldnt this whole process be alot less stressful and worrying if CSC actually processed applications in the order that they are received?????!!!!!



Don't feel stupid for wondering about it! Imagine how you'd feel if you were an October or November filer watching all the Dec people charge ahead of you. I'm not the only one in this situation. Some have it worse than me.

I know Huskerkiev has talked about 'first come first serve' before, but there's no way you can convince me that is how its actually done. Its first come, first serve if you're in a small box, or if you get a fast adjudicator.

Obviously, they don't have anything in place where an adjudicator says to themselves, 'Hmm I'm starting on December cases - I wonder if there are any November's left I should look at first?' They just forge ahead with their 'box', paying no mind to what anyone else has.

So for them to say 'first come first serve' - the statement should actually come with an asterisk:

"We process applications in the order they are received.*

*unless you happen to get stuck at the bottom of a pile somewhere* "

But I guess it'll be a cold day in Hades before we get that kind of truth in advertising.

Trust me when I say its easier said than done to just 'calm down' or 'take a valium'.

We all realize patience is necessary in this process - but when everyone else whizzes past you for reasons you are not privy to, your patience unfortunately starts to wane. Being told to 'take a valium' is a tad inconsiderate, esp. from people who got their NOA2s in record time.

I wouldn't wish the wait that ch1ch1 has had on anyone.

I know a little about how it feels to be 'left behind' - but not as bad as you! I think the numbers David -Mae posted are very interesting - and somewhat comforting for those of us who seem to be on the 'slow track'.

What infuriates me is the notion of having no information whatsoever. Personally, I think it'd be comforting to know if my case had been pulled for an additional check or whatever (as opposed to the black hole that it feels like you're sitting in). You'd think if its your personal information and your LIFE that you would at least be entitled to some information beyond 'its pending'. At least once you get past, say 100 or so days.

But, trying to find rhyme or reason in anything done by the government is just a futile effort.

I hope this week is the week for both of us. :)

Robor007 is spot on. If my fiance tried to 'cancel' our plans, I'd go BUY a plane ticket and be on his doorstep in 24 hours to sort it out. I'd leave there only if he changed his mind again, or if we decided that I would move there.

Why you wouldn't use your (already purchased) plane ticket to do the same thing is beyond me.

Make sure your fiance's passport won't expire for 9 months or so past the estimated interview time. My fiance had to get his renewed.

The only other thing - I can't tell what service center you're going through, but if its TSC/NSC/CSC - I do have one more suggestion. Drive yourself down to the store and buy up all the PATIENCE they have in stock...! :lol:

Not just what the others have said, but it read as if you expected the government to 'tell' you something. Isn't it incumbent upon you and your fiance/e to do the research and figure out what makes the most sense for you as a couple along each step of the process?

If you were smart enough to find this site, I'm surprised that you weren't better prepared on what to expect. Or perhaps you just read enough to get you through the service center and the embassy but didn't look at anything else here?

You don't HAVE to. Its just a recommendation.

Mine was 90 pages and I copied all of them (including even our passport photos!). I wanted him to have it all with him at the interview just in case. Plus I wanted a complete copy for myself, so I just made two copies while I was at it.

see she is listed as a widow and we have all the paper work to prove it she was married for 2 months before he died suddenly
and several years later she meet the dead beat

i guess my post is will the interviewer be considerate to what happen buy the time of her interview everything should be final as far as the annulment ..we not trying commit fraud

What you seem to be missing is that she had to be free to marry when the I 129f was sent in, NOT when she gets to the visa interview. If you did a 'marriage background check' and found this, the USCIS surely will find it. Then you'll have a denied visa on your hands instead of a withdrawal - which will make your chances the second time around much harder. I find it extremely unlikely that the interviewer will be 'considerate' to what happened.

If you've gotten the NOA2 already and its on the way to the consulate, I'd contact them to withdraw.

And for the earlier poster who said the interview is in Hong Kong (not Manila) - it doesn't matter one iota where it is if they find out this marriage was not annulled at the time the petition was filed.
