K-1 Fiance(e) Visa Process & ProceduresRunning Out of Time

Also, for me personally, I've never felt it was any kind of 'right' my government owed me to live in America with a citizen of another nation. I've always felt the onus was on me.

I couldn't agree with that more.

Failing that and having negotiated with my employer we will have enough money for regular flights from LAX to Manchester, a European honeymoon, Christmas in the UK etc to make it slightly bearable.

Just be sure your fiancee/future wife has advanced parole before you take advantage of these plans.

UK - California K1 Application, NOA1 received 2/2/07. No further contact.

Well, it is coming up to 30 days now since NOA1.

30 days since NOA1?

Try more like 90.

K-1 Fiance(e) Visa Process & ProceduresTotal Confusion - Texas Service Center

As it states, If you are sending after July 30th, you'll have to send it to VSC(assuming you live in a state that falls under their jurisdiction)

If you'll read the thread linked below, current TSC filers can actually send it to VSC now. The first post in the thread has a memo from USCIS which states they will accept 'advance' filings to the new locations.

K-1 Fiance(e) Visa Process & ProceduresCitizen number?
I suspect he is getting confused about the question on the I 129f about the petitioner's citizenship. The number they are asking for is the one on the naturalization certificate.

If he derived his citizenship from his birth in the US, then he obviously would not have a certificate number.

A passport is a completely separate document from a naturalization certificate, so what good would that number do?
TracyTNFemaleUnited Kingdom2007-07-03 13:42:00
K-1 Fiance(e) Visa Process & ProceduresMovement of K-1's
Its not 'rumor'. For a while now, any K1s sent to TSC or NSC were forwarded to CSC for processing. VSC was uneffected by this (meaning those who fell under VSC's jurisdiction remained at VSC).

On June 21, USCIS put out a memo stating that the processing locations will be changed as of July 30 (at the same time as the fee increase). That same memo also stated that you can start sending the petition to the new location now - instead of waiting for July 30th.

The memo, along with the new locations by state, are all in this thread:

K-1 Fiance(e) Visa Process & ProceduresI-129F Question
Since you all are going to get married anyway, and she is living in the UK, I'd research Direct Consular Filing.

This will get you started:

http://www.visajourn...h...om&page=dcf

Once you've read it, you may need to ask some questions of the London embassy, as well as in the DCF forum here on VJ. I believe she'd have to have a certain 'status' of visitor in order for you to qualify.

K-1 Fiance(e) Visa Process & ProceduresQuestion regarding proof of relationship...in relation to NOA2
All you can present at the visa interview is what you have. And frankly, I've not seen very many cases in London where they actually ask for the relationship evidence anyway.

Just collect and save what you do have, have it in London for the interview (just in case!), and you'll be fine.

This is a very complex situation. I'd be hesitant to go on the advice of people on a message board.

What answers does your lawyer give to those questions: ("if then within that period of we were to get married, would he still be able to file for AOS, or would he have to go home and come back or K3, or would we have to wait to do anything until he was granted a K1? AND...would his overstay (within the 180 given days) gravely affect our chances?")?

^^

Service Centers don't expedite just because a congressperson asked them to. There are few instances in which a case will be expedited - impending military deployment is likely the most common.

K-1 Fiance(e) Visa Process & ProceduresTotal Cost Sheet

Costs can include stomach lining, increase in gray hairs (which causes higher salon bills), extra martini costs, skyrocketing wine bills, high manicure costs for constant hand-wringing and nail chewing . . . .

;)

 Sooooooo so true...

ooh, btw, what is Biometrics? How much does it cost?

please dont say $2309482308940239,00.

They are in with the AOS forms... I think both of the forms cost $1010 in total?

The fee for biometrics is currently $70, which you add to the $325 fee for the I 485.

After July 30th, the $1010 that you pay will include the I 485, AP, EAD and biometrics fees.

After USCIS receives your AOS forms, you will eventually be notified about a biometrics appointment.

K-1 Fiance(e) Visa Process & Proceduresscared I have screwed up
If the above suggestion garners no results, I'd phone the consulate's phone line, get the 'code' that is needed for sending emails. Then email the embassy and inquire. Beware that the consulate's phone number is a pay number, and its pretty outrageous, so make the call short and sweet - just get the email code. The people who answer that line are actually in Scotland, so they really can't tell you much, but they are handy in giving the code that is needed to email London.

Come visit us in the UK forum for more specific info.

K-1 Fiance(e) Visa Process & ProceduresIs our I-129F package too big?

It is all about the quality of the evidence and not the quantity... My I-129f petition was less than 25 pieces of paper (8 of which were of the g-325a's). No RFE's and NO questions at the interview... so quantity isn't a determinant on how smooth your process will be...

K-1 Fiance(e) Visa Process & ProceduresI-94 question?
No, the example on the example form IS different than yours, as the foreign fiance on the form is in the US as the petitioner is filling out the form. Thus, the I 94 is in the passport.

Your fiance/e is not in the states with you now (at least not according to your original post), and as I 94s are supposed to be taken as you exit the US, your fiance/e would not still have an I 94 to refer to.

ok. So I've sent in the form, gotten a NOA (Notice of Action) and now we're just trying to plan the honeymoon. I was wondering if anyone knew if, after getting married in the US, we would be able to travel out of the country for the honeymoon? Thanks!!!

You can, but you need to have Advanced Parole in order to re-enter.

K-1 Fiance(e) Visa Process & ProceduresNEW Filing Locations for Fiancé Visa

Thank you so much - we are trying to get the petition in before 30th July anyway and due to the news on the homepage of VJ didn't want to send it to California if possible...

Quick question as it seems to be the right place for it:

If my fiance is filing an I-129F and he lives in California does the petition *have* to be sent to the California Center? Obviously post 30th July it does but where can we send it to before this date? Also is there any difference in centers in terms of how quick they are to process the petitions? Only we already booked the wedding but the USPS is not being our friend...

If you look at the 'schedule' above (in the USCIS link), you'll see that your fiance must send the petition to the California Service Center.

Booking a wedding before starting the visa process is risky. Hope it works out for you, but there are no guarantees (and the USPS will be the least of your concerns).

K-1 Fiance(e) Visa Process & Proceduresexpedite for active duty military possible?
The OP had a legitimate question. I suspect he didn't come here to be badgered about the military.

Since you clearly have a problem with the military, why not start a thread in Off Topic about it?

K-1 Fiance(e) Visa Process & Proceduresexpedite for active duty military possible?
Those in our military on active duty and assigned to a war/conflict zone can have their cases expedited. I would include your military ID and information about your deployment in your I 129f package (can't hurt, right?). Once it is recieved by the service center & you have a case number, I would also call your elected representative for their assistance with the expedite. The previous poster had a good idea, too, about JAG. They may also be able to help.

Whether or not anyone here 'likes' this idea (or has some kind of grudge with the military) is patently irrelevant.

K-1 Fiance(e) Visa Process & ProceduresCan you travel to the US while K1 is processing?

Hmm - so you can enter the US even though the visa process is underway? Or is that just for Canada? I'm from the UK and tbh am totally panicking we aren't going to get the K-1 in time for our wedding on February 11th 2008 :/...

Now I know many have said we are "brave" (read: crazy) but tbh neither of us realised the process would take so long and now I don't know how I am going to sleep in between now and February :/

So a couple questions... this might not be the best place for them but...

If I were to enter the US while my visa application is underway could I then get married to my fiance providing I left the country again afterwards?
If I were to do this, could I then enter using the K-1 and go through the K-3 process?
If everything goes wrong (I am praying with all my heart it won't as family have booked tickets already) then can I cancel my K-1 application, go get married, fly back to the UK and then apply for the K-3?

I'm trying to calm myself by finding out other options and contingencies... Any advice/help/ideas/comfort despite my stupidity would be welcome!!!

First of all, yes, you can enter the US while your K1 is pending. Just bring plenty of proof of ties to home.

The second part of your post is a bit confusing. But suffice it to say: if you enter the US while your K1 is pending and get married, then you'll have to abandon the K1, leave the country and start completely over with a spousal visa.

I'm confused why you say your from the UK but your timeline says 'Armenia'?

Packets 3 and 4 are what you will receive from the consulate in London. Packet 3 forms are filled out and sent back to the consulate as an indicator that you are 'ready' for an interview. It also includes instructions on how to book your medical exam.

Packet 4 contains your interview date and instructions.

K-1 Fiance(e) Visa Process & ProceduresK1 visa - many problems

Hi all.

Well to start:

I am a male, 17 years old (18 in november) and am a UK citizen.
I have never had any criminal record
I don't have any kind of disease or illness
I have never been deported from any country
I have been refused a B2 visa because the immigration officer didn't think I needed to be in the US for 6months.

The situation for me is:
I have visited the US 2x this year on the Visa Waiver Program, January 1 2007 > March 28 2007 and August 24 2007 > July 21 2007
On July the 3rd me and my fiancee sent off the I-129F petition to the USCIS and it was received and we have our receipt number.

I have read from a lot of sites that if I try to re-enter the United States on the visa waiver program (I wanted to return to the US to be with my fiancee witihin a month today) I will be turned down or there is a very high chance of denial.

I do not know what to do :(
She can't come visit me in England because she has a job.

What am I meant to do?
Please any help would be appreciated.

Thank you

I'd spare yourself the grief and likely turnaround at POE and have her come visit, or meet in a third country (Canada?).

Lots of us have jobs, but we also have made time to go see our fiance/e's, too. Is she not entitled to days off?

No, what I'm saying is that is the 'standard' reply, but they still do reply to emails. Not with the frequency that they used to, unfortunately.

I just got the respocne that you said i would. Is it likely i will get a reply? i headed the e-mail with my case number and included a request for cancellation in the message title. I'd be more at ease about travelling next month knowing that they knew i attempted to contact them with regards to cancelling.
