K-1 Fiance(e) Visa Process & ProceduresFiance did not get visa b/c of insufficient evidence

I just talk to future husband and he said that tons of people get approved in jamaica off one visa. I think that the OP needs to speak with their significant other and see what questions were asked and what was responded.

I feel better now.

Thanks all.

How does he know? He has tons of people around him doing the same thing? Remember each case is so.different and that is what I like. One visit then filing a case is so different than one visit in 2 years.

Your post scares me because I have only had one visit with my babe. Mainly becuase of my job and my extreme fear of flying. So in 2 years I have seen him once. Wow! scary.

I suggest u find a way to see him.real fast or find a next fiance

how can they determ what is real and what isn't when at the same time you proved that you have a past together.

Based on the immigrarion officer's decision. Showing/proving that one have a past together means nothing otherwise all cases would be approved. It's more asking along the lines of.. "is that relationship bonafide" etc. All cases placed before the IO is viewed the same and the burden of proof for immigrarion purposes are left to the petitioners and those who benefit.

You can call and cancel the appointment. Then someone else who is waiting can get the open appointment.
You cant tell them you want a specific person to have the appointment it doesn't work that way.

Has anyone ever went in to a local office for an Info Pass on a NOA2? If so what were your results? I am just trying to stay one step ahead... After putting a service request on OCT 20 I have been asked to wait 45 days for an answer. I am now 7 days away from the 45 days. Put in Info Pass for Thursday of next week. Just curious will this be a waste of my time because my local office is 2 hours away from my home.

before picking up and driving 2 hours way.. why not call USCIS and speak with them. 45 days from Oct. 20, 2010 wouldnt be 7 days from now.

K-1 Fiance(e) Visa Process & ProceduresGet married before the fiancee visa apporved

You get married before K-1 visa and before you are in the USA = NO MORE K-1 VISA.

You are married you cannot get a K-1 FIANCE visa.

You start all over again from the bottom. New fees, new waiting time of 1 year, new forms, new everything. You do not " change " or " switch " you start all over again.

K-1 is a ONE TIME USE.
If you enter the USA and then leave without filing AP/ AOS and without the AP card or GC then you have to file all over again to come back to the USA.
If you enter on the K-1 then leave to the Phils to get married you cannot use the K-1 you wasted the K-1. You will have to file a spousal visa to come back to America.

quality of life is not guaranteed even in Europe. That is a HUGE misconception. If that was the case then there wouldn't be people homeless and destitute. I saw a good number of people who were destitute in England. You would have had to be blind to miss them in London.

NO i wasnt Blind.. but i was 14 years old when i visited LONDON (south hall) but the same is here in the USA not a misconeption about the great America.. take a walk thru ANY city just go at random but we know that's anywhere though list isnt guranteed in america - the bed of roses .

Being in the US as an illegal alien might be appealing to someone from a third world country, but living legally in any country in Europe would be better than being an illegal alien in the US.

I agree.... why would someone have issues going back to EuropE where you'd be better... money there is great know that much been to london in 1998 quality of life was as good.

K-1 Fiance(e) Visa Process & Proceduresi love you phrases cause denial of visa

I think that if you are saying 'I love you' within the first weeks that you met, this can look suspicious at high-fraud consulates - and on some consulate websites, this is specifically one of the warnings. For example, this is on the Morocco Consulate's fiance page:

"Some of the signs that an Internet contact may be developing a relationship with a U.S. citizen in order to obtain an immigrant visa through marriage are:

Declarations of love within days or weeks of the initial contact;
Proposals or discussions of marriage soon after initial contact;
Requests to the U.S. citizen to visit the foreign national's home country soon after the declaration of love or proposal;..."

Hello everyone,
I really need some expert advise. My engagement has been disolved and I wish to withdraw my petition. I am still waiting on the second NOA and am not sure if I should wright now to USCIS or wait until I get the second notice and not to take any action. My primary concern is what information is sent in the packet to my former fiance. Particularly I am concerned about my personal identification number such as my ss # getting out. I thank you in advance for your advise.

send the request to with draw/cancel now before the approval of the case.. you can use the first NOA letter received.

K-1 Fiance(e) Visa Process & Procedures2nd interview:VO said i dont wanna handle your case anymore!!!!
This is a pain to deal with. Getting married right away will NOT solve any thing nor does it provide any more room for an approval. Away the receipt of the case and as suggested have the petitioner contact the DOS and get clearer details of the denial / why case was returned. Knowing these things will be important to a successful CR1 interview.

K-1 Fiance(e) Visa Process & Procedureswhat could it be

It is surely correct that you have some red flags in your case. The fact that you met this man while you were still married and the fact that you have only visited him once before filing for him. If you truley want to be with this man, I suggest you marry him and file for the I-130. Good Luck!

suggesting marriage to overcome what is assumed will not change a thing. She should not just get married and go file another I-130 with even knowing the reasons for the denial. One person suggested contacting the necessary dept. and getting info on the interview/denial.

K-1 Fiance(e) Visa Process & ProceduresMedical exam.. stupid move, dont repeat, heads up to others!

:( my fiance just went and got his medical today.. and we thought that it would be a good idea to get some of his vaccines done at a local clinic cause it would be cheaper.. even though the embassy told us to only get them done at the medical centers they recommend... well just so everyone knows, we were stupid. Our interview date was for the 14th.
But the embassy medical exam doctors wont give my fiance his last immunization shot till the 21st.. so we have to reschedule... of course we should have know better! But I just wanted to give a heads up to anyone who thought that it could be possible to make a short cut.

Now im in the proccess of changing interview dates.. uugghhh it sucks!! :(

Sorry to hear this.. the short cut WORKS.. B.U.T you need to allow time .... you did not do it properly.. The medical examiners in Jamaica will not take the vaccinations if done 1-2 months prior. The applicant.. should have taken the necessary vaccinations upwards 2 months prior to the actual medical Exam.. for it to to be accepted. Him doing it a few weeks prior was not smart and has cost you time.

Everything for kingston is through email unfortunately so you just gotta wait for them to reply...hopefully they reply fast.

We went to a local clinic about 3 months before the actual medical and had no problem...he still needed his last dose of Hep B when it came to his medical and they just marked it on the sheet that the last dose is needed still.

K-1 Fiance(e) Visa Process & ProceduresCan't Leave US?

Si, man -- leaving the U.S. is no problem; being allowed back in comes only by virtue of Advance Parole (filed for after marriage along with AOS & EAD) or the green card (after AOS is approved).

Posted ImagePosted Image

Either the CO was mistaken or your fiance didn't understand them correctly. Your fiance can leave the US anytime he wants to. If he wants to get a green card then he needs to remain in the US until he either gets advance parole or gets the green card. If you marry soon after he arrives and submit the adjustment of status application then he should have his green card in a matter of months.

There are some limits on how long he can stay outside the United States if he wants to keep his green card.

K-1 Fiance(e) Visa Process & ProceduresPlease tell what does this Mean

My fiance asked him what more proof can he give?

Hmmm he was pushing it here.. they wont give suggestions to build "the" case.

They handed him a white sheet stating that enough evidence wasnt presented (for a) to believe that we were in a legitimate relationship.

This here seems to be why others and my self are saying the case was denied.

I am totally confused. Is this the Ap process or what? Was he denied or what?

I'm saying denied.

I was told usually when a person is denied their passport is stamped. His passport wasnt stamped and my fiance said during the interview they fingerprinted him. Please somebody let me know what this means.

A finger print is done at the FIRST part of the interview process which is standard for anyone. This is done BEFORE the actual interview. Is that so that a denial stamp would be placed in the passport..? Is that now a new process.?? There's no visa in the passport for them to stamp a denial to.. unless he has a tourist visa that they found fit to cancel/revoke.

Naah.. they are smart people..

Was the first guy who was arrested for rape the same guy she was trying to petition in this thread? If so, she is beyond help. And yes, the CO was spot on. Getting him fingerprinted will help a lot in preventing him from using the system some how later on. If not, then she got engaged to another guy in like 90 days? Some one help me out here.

K-1 Fiance(e) Visa Process & ProceduresPlease tell what does this Mean

My fiance went on his interview on Friday. After providing his proof of relationship, Immigration Officer asked him for more proof. My fiance asked him what more proof can he give? He had phone records, Western Union receipts, Pcitures, Letters, and Proof of my last visit in July. The Immigration Officer asked him why didnt I come back after July? He told the immigration officer because I started a new job and couldnt get the time off from work. So the immigration officer told him that they will have to conduct a background check on me for more evidence. They handed him a white sheet stating that enough evidence wasnt presented to believe that we were in a legitimate relationship. The officer told him that after they do a background check on me they will call him back and make sure he doesnt lose the paper because he will have to bring it back with him to the embassy when they call him back. I am totally confused. Is this the Ap process or what? Was he denied or what? I was told usually when a person is denied their passport is stamped. His passport wasnt stamped and my fiance said during the interview they fingerprinted him. Please somebody let me know what this means.

THIS is a big joke... did you really and truly expect an approval after all that fiance/spouse of yours went though... and the bs he did...? The immigration seemed to have served purpose.. They have revised this case/relationship as not a real one and now you have been slapped by the U.S. Govt - now jump. They (uscis) will communicate to you via mail once the case is received. Blessings this season.

K-1 Fiance(e) Visa Process & ProceduresCan the petitioner go out of country?

Hi, long time forum reader and couldn't find this issue.

My fiance and I are planning on getting married and right before we file the k-1 visa, I (the US Citizen / petitioner) found out my job will have me go to Amsterdam for about 2 months for work.

Will this affect our K-1 visa process?

Or would it be substantially easier or faster to bring my fiance to Amsterdam with me, get married there, and then bring her back to the states?

Thanks-

GreenPen

yes you can go for 2 months.. stay 9 months if offered. It will not affect the K-1 visa. If you get married you cannot for for a K1 visa. The k-1 visa are only for those who WILL get married inside of the USA. If you get married outside the USA you will file for the CR-1 visa.

You can be receiving foodstamps and sponsor someone as long as you have a co-sponsor, you will be fine. There are people on Section 8 that have sponsored their spouse with a co-sponsor. I dont see this as being a problem as long as it isnt for a long time. Some people fall on hard times and need the extra help. All the best to you..

K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?

Below is a list of Foreign Reciprocating Countries.. Doesnt appear to contain Jamaica,,

http://travel.state....issues_582.html

Australia, Canada, Czech Republic, El Salvador, Finland, Hungary, Ireland, Israel, Netherlands, Norway, Poland, Portugal, Slovak Republic, Switzerland
The United Kingdom of Great Britain and Northern Ireland

Cant find anything regarding children of a forreign parent born in the US, however there are laws governing children abducted from a parent abroad, but that doesnt apply since the child will hopefully be born in the USA.. Eitherway, it seems the "so called" father would have to pay all the fees to retain a US Lawyer and there doesnt seem to be much informaation available regarding a case like this where the father has no status in the US and the mother and child live in the USA,,

JAMAICA wouldn't be on there.- not yet .... I could have told you that ... look at the countries on the list they are FIRST & SECOND world listings...

I asked based on all what was said. They prey on Caucasian women ... matter of face matter of fact - Americans as a whole. Many of them (travelers) see it as love... but two can play the game. K-1 Fiance(e) Visa Process & Proceduresis my fiance a fraud?

Ok i have read through your comments and i really appreciate the advice. I am now preparing a letter to send to the consulate. I told him this morning that we are done and i can't continue with him because he doesn't respect me. He said i am accusing him of things i don't know anything about.

He also said that i can't end it how, because i already signed with the US Government to petition him. I told him that is not true

, i can withdraw the petition and then he started to say why suddenly i am acting this way and all he wants is to be with me. So i asked him what would happen then if i came to Jamaica to live with him, he said jobs are hard to get and i wont make enough money and we wont survive and that i wont have my comfortable living and that it is not good that baby stays in that environment. He started to basically tell me everything that was wrong with Jamaica and why it wont be good for us and we wont be able to make ends meet. I told him i have my savings to start up with and he said that won't do because life is hard and the government take big taxes. What do you guys think? Thank you so much again for helping me through this time.

-Kristina

Hahah he got some nerves to say you cant end it now... sounding like a staright fool.. sorry to say.

Thanks for all your guys comment and help. How do i contact the consulate, when i was inquiring about the case i wasn't able to contact them by telephone? Do i need to send a letter so they can have it in writing? I don't know what to do. How do i prove that those are his intentions? We also have a child on the way, how will this affect his rights? will i have to take the child to see him? this is all so overwhelming!

there's no way to contact the embassy via phone... to get case=related information. You can email them and you will usually get a response in 1-5 business days. How long after you met him did you submit a request for him... how did you meet him..

Tell him you're thinking to relocate to Jamaica rather than him moving to where you are.... Hmmm see what his reactions will be! His rights in Jamaica will not be affected.. if you take the child to him - that would be up to you. The local government does not pull strings to seal local family affairs ... not to mention international family affairs.
