The initial filing fee is $455.00 for the K-1. Once the petition is approved you will have costs for the medical exam, police certificate, and application fees (paid at the interview). Once you come to the states and are married, you will have to apply for adjustment of status. That fee is $1,010. The timeline varies. Our petition took 4 months to approve but as you can see in our timeline we are still waiting for an interview date. Some embassies are busier than others so there is no way to know after that, how long it will be. I would suggest going to immigration timelines here on VJ and seeing how long the average time is taking. So far for us, we are looking at about 6 to 7 months from filing to POE but we still don't know yet....There are other options for you as well. I would read the guides carefully and find which ones would work best for you...

I am in no way trying to be a jerk but why did you plan a wedding before you knew what your options were?

I think what she's saying is that they were given information or at least the impression, that they could what they had planned without a penalty and once they hit the 'front lines' so to speak, their options changed.

I think we all at one time or another have spoken with person on the phone and have been given advice/suggestions and when we walk in the door, what we were told over the phone 'suddenly' became the wrong advice...and we're out of luck.

That doesn't mean they were at fault for believing what they were told.

That makes sense, I guess I am less trusting of what I am being told and do the research to make 100% sure. This process is above and beyond confusing and it took us a long time to find out correct information...It was this website that I am so thankful that we found....

The requirement for supporting 2 people is $18,213 per year. I make enough to qualify as well but I am paid hourly and my concern is that my income will not be calculated correctly and I have not been with my current job long enough to receive a W-2 for this year. I added my mom just in case to be on the safe side...We may not end up needing her but I don't want anything to delay the process. Also, make sure that you read the posts in reference to question 11 on the I-134 in the UK forums. The London Embassy is very particular in how they want that question answered. It is my understanding of everything provided and asked for at the interview that the I-134 and supporting docs is the most important to them...

The file is going to go from the USCIS to the NVC (National Visa Center), the time spent there varies (usually no more than a couple of weeks but it depends), they will also reassign a new case number to her. She can call the NVC to see if the file has been received and what the new case number is then the file will get sent to the Embassy. The Embassy will send you a "packet 3" which will direct you to the embassy website to download several forms, and give instructions of what is needed next. You will have to order a police certificate and get a medical exam She is going to have to gather a lot of information to send you to take to the interview as well. I-134 affidavit of support, financial docs, etc...I would advise you at this point to go the the forums section and scroll down to the regional forums and do to Austrailia's forums. Each Embassy is different so you can get a lot of information there...I could tell you what to do for the London Consulate but that wouldn't do you any good...

Once you marry, you will have to file an Adjustment of Status and the total cost is $1,010 in fees to the government. The K-1 is a temporary visa that only last 90 days. The Adjustment of Status is needed for you to become a permanant resident of the US and that is good for 2 years.

The NOA1 is the notice of receipt from the USCIS when they receive your petition.Obviously they sent one because you have your case number. The NOA2 is the approval of the petition. Since you went through an attorney then those documents will be sent to them I am assuming.

Is she still in the military? I have seen a lot of K-1's get approved quicker because of that. Having said that rough estimate, January or February but it all depends on how quickly they approve the petition, how quickly the file gets to the embassy, how quickly you get your stuff done on your end as well as hers after receiving the NOA2. Of course with a lawyer involved, it will depend on how quickly they take care of it for you. I would suggest going to the immigration timelines on this website and see what others are posting there. I would set up a timeline as well because it helps you see in comparison to others on average how long it is taking and will give you approx dates. It also helps others judge their own dates as well.

I would tell you first off, you guys could have saved a lot of money doing this yourself but at this point, I understand why you hired a lawyer. We debated back and forth for a long time until we found this website. I would advise you to do a lot of research on here for your own education in this process. No one is going to care about your file like you do. Having said that, the I-129 petition was taking about 4 months approx to get an NOA2 )this is the approval from USCIS). Now things seem to be moving much quicker for others. On the USCIS website, our file NEVER changed status until it was approved. As far as from beginning to end there is no way to know for sure. We filed in May of this year and are still waiting for a scheduled interview date. We received our NOA2 on 9-23. Once you receive that notice, your file goes to the National Visa Center and then to the London Embassy. Once you have an interview, and are approved, you will wait to have your passport mailed back to you. At that point, you can book a ticket and come to the states. The other option that you guys did have that your attorney should have told you about is Direct Counselate filing. You could marry in the UK and file directly with the consulate. This basically allows you to do everything that you have to do with the K-1 all at once. I would suggest that you go through this website and look up and research everything that you can to know what to expect and your options. Good Luck!!!

If you file the K-1 and marry in the US. Once you are married and file the AOS, along with that you will file what is called Advanced Parole. Until the AP is approved, you will not be allowed to leave the US. Usually, the AP comes back about 60 days from the time you file it or there abouts.

If you are planning to file a K-1 (fiance visa) you will have to marry in the US. You could get married in the US (small ceremony), file the AOS paperwork that then later in the year, have another ceremony in France. If you choose to marry in France, you will have to file a K-3 or CR-1 after you marry. I would recommend looking at the guides to see what is best for the 2 of you.

First of all, it look like you have found the right place. This website has gotten us through this process so far and continues to. The letter of intent and the G-325 is good. He is also going to need to provide you with passport photos as well.

As far as not having a long history of work, that will not be a problem. If it were me, to be on the safe side, you may want to get a co-sponsor. You are not going to have to worry about that until you get to the 2nd phase of this process, since you do not have to prove any income in the first phase. There have been a lot of people to go through this process that have been students, just out of school or without a long work history. You should be fine.

Mine were not sent certified mail and I got them in a few days. If you need them soon, they will fax them to you while you are on the phone with them as long as you are right next to it. You have to get someone on the phone but they will fax them to you. Or you can call and request them again to be mailed. The extension for tax returns was October 15th and they may just be really busy right now...

Yes, you have to have a police certificate from every place you have lived in the past 5 years. Yes you can contact your GP for your vaccination records and actually get the vaccinations from you GP it is much cheaper in some cases then getting them at the medical and you will HAVE to have the long version of your birth certificate for the interview that has your parents names on it. If you take the short form, they will request it and not issue the visa until you have it...Hope this helps..

I believe the 'long form' and 'short form' birth certificate distinction refers to the foreign fiance/e's birth certificate. As long as you sent a certified copy from the state you were born, you have sent the correct one.

If your soon to be wife leaves the US before you have filed for AOS and she has advanced parole then she is not going to allowed to return to the US and you will need to file for a K3/CR1 visa to bring her back....

The Advanced Parole normally takes about 90 days after filling to be approved.... you could make an infopass appointment and ask about emergency AP, showing them your orders from work.... but you wouls still need to file for AOS first....

The other option is for your wife to remain here in the US until she has her greencard.... it would mean you would need to fly home for her interview....

I am in the exact same situation as you are. My fiancee was given a certain name at birth which appears on her birth certificate. However this name was never used anywhere else since her family gave her a new name within a few months (old name was too boring!). As a result, all her documents like passport, degree certifcate, tax records use her new name. So I did some research to see how the USCIS and ConOff would like this situation to be remedied and I found the answers in the I-129F and Packet 3 instructions.

Basically you will need a sworn affidavit made by someone who was present at the time of your birth (your parents of course) stating that you were born with a certain name as stated on the birth certificate and then you came to be known by a different name which you adopted as your new name and furthermore that both the names refer to the same person. This affidavit will have to be notarized as well. Hire a lawyer to do this, it is worth it.

Attach this affidavit and your birth cert to the I-129F application.

Well, Jack is a nickname for John. I am not sure how he was able to get everything under the name of Jack rather than John either (I don't like my first name, which my mom chose when she was 7, so I really wish I did know. Did your parents legally change your name to Jack when you were a child? Or is it a common enough diminutive in the UK that no change was needed, in which case can you document that somehow?

I've not filed yet, but I use a variation on my first name that is a little unusual, so on all the emails and letters and such that is how my name appears. Although my full formal legal name appears on all the other documents, I never use it without my middle name, so it is shortened various different ways on plane tickets. I am just getting my petition ready to file next month right now, but I intend to include a note explaining this to avoid confusion. I would guess you may need something more, though, since your actual passport and birth certificate do not match precisely.


My husband also uses a common variation on his first name, which was on all of our communication. I think this is pretty commonplace.

But to have conflicting legal documents - documents that immigration frequently use and key on - will be more of an issue, and thus makes the OPs situation a bit unique.
