If you're outside the US and the petition has not yet been approved, you'll want to get it corrected because the consulate will send your documents to the address they have on file (which would be what is on the I 129f/G325a, etc). I've not seen this happen very often, and unfortunately, even what I'm going to suggest may not work. First have the USC call the USCIS (mis) information line and tell them.

Then, once the case is approved and moves to the NVC, I'd have the USC call them as well and see what address they have on file (basically checking whether or not the USCIS request 'took' or not). If it's wrong, ask them again to correct it as you will need to receive mail from the consulate.

Failing that, I'm not sure how well mail forwarding works over there but I'd be sure to have that in place, too.

Depending on the consulate, I'd say good luck with that. Even if it were a routinely 'easy' consulate (London), that huge of an age gap is going to be scrutinized big time.

Not enough information. If you worked there in 2008 and received a 1099 or W2 form, that will document 2008 income. If you are working "under the table" you'll need to crawl out from under the table. Legal income can be documented and taxes are filed on it.


I am not getting paid under the table. I am basically self employed and responsible for paying taxes on the money as if I am self employed. I am just not sure how to do that. I have always worked for corporations but I was laid off at the end of 2008 and had to find something in order to pay my bills. 2008 taxes are not due yet. I am just trying to plan ahead and didn't know if anyone may have some suggestions. I just want to make sure that I have everything that I need for this process. I have a w-2 for 2008 but I am no longer in that job.

Question 10 is I have submitted a visa petition to U.S. Citizenship and Immigration Services on Behalf of the following persons. My mother did not file the petition, I did. and Question 11 I intend or not intend to make specific contributions...my answer is to be N/A (K-1 visa process for permanant resident) is her response to be the same? If anyone knows, I would greatly appreciate some clarification.

When I filed my K-1, yes, I highlighted phone records and put sticky notes on items that I thought needed to be explained. Also, anything that is very personal in an email that you don't want to be seen, you can mark through. If you go to the guides and read them very carefully and follow them to a tee you should be fine. I know it is overwhelming but take a breath and look at things very carefully before sending. My fiance and I even put cover sheets on every document explaining what they were and I signed and dated each one. I wanted to make sure there was absoultely no question. It took a little extra time but I wanted whoever reviewed our file not to have any question. Good luck. It is a long process but you will make it through. We are still going through it but we are getting there and you will too. This website is a great resource and I am not sure what we would have done and would still do without it. If you have any questions that I can answer, you are more than welcome to send me a message if you like.

I have a specific question in reference to the I-134 and I have not seen it addressed on this website. I work for an individual as a personal assistant, not a company. I also am paid hourly, not salary. I have a guranteed minimum number of hours every week but on average, I work more. My employer has their own letter head that the letter will be printed on and will be notarized. Also, my paychecks have taxes and social security taken out every week. My checks are written to me weekly out of their personal account. The letter states that I have a guranteed minimum number of hours, with what the average amount I actually work and at an hourly rate what my gross income would come out to be and that I am in good standing. There is also a salary chart that is provided by their accountant that shows from 1 to 40 hours at my hourly rate what my paycheck will be. The accountant is also providing me with copies of the last 2 months of cancelled checks. Is there anything else that I need to provide? Is there anything else that needs to be stated in the letter. What other proof do I need to provide. I have not worked for them for a year yet so I do not have a w-2 and my fiance's interview will be before the end of the year. I am also planning to provide 3 years tax returns. I am able to get 2006 and 2007 but I just files 2008 and the irs will not be able to provide a transcript to me for several weeks so I was going to send him the actual return just for 2008. The last 3 years prior I did work for companies and made a significant amount more. I do qualify with the job I have now but barely. I have added my mother as a co-sponsor just in case because I want to cover all of my bases. Any advise would be greatly appreciated. Thank you!

Since you are applying to come to the US and have not been refused entry, there should be no problems. The US is not going to care about her refused entry into the UK. At this rate, if you get all of your stuff done quickly, you could have an interview set in the next 6 to 8 weeks...and she can come and join you... If you need any information at all about the packet 3, links to the embassy, checklist, police certificate, etc...let me know and I will be more than happy to send it to you..

If you have received the NOA2, you can contact the Department of State to see if the packet 3 has been sent to her. If it has, she does not have to wait for it to arrive. She can go ahead and start getting everything ready to go and there is a lot that needs to be done at this stage, booking the medical, forms to be filled out, police certificate to order, etc.... I have a lot of information that I can send you that I got here off of VJ through research. If you are already this far in the process, then you don't have much longer to wait til she can come to the states...

Another suggestion is that once you have the interview date scheduled, she could come around that time and go with you to the interview and at the same time meet your family...

There are 2 types of AP. ALL files when they first arrive to the NVC go to AP. They have to get the file ready for the embassy. I read a lot on here about AP and got so upset when I called and found out my file was in AP and then 3 days later it was sent to the embassy. I finally found on VJ where someone had written that term is used by the NVC to mean 2 different things. Don't panic yet...It may not mean anything and your file may be sent onto the embassy very soon

I agree that it is ridiculous as well. I have tried to find information on this and what I have found is that k-1 visa holders used to be able to get a stamp(temporary work permit) in their passport that would allow them to work if they flew through JFK airport upon entry into the US but now the I-9 form, which was changed in Feb of this year does not allow that anymore and he will be required to get an EAD. Right now, it is taking the USCIS about 60 days to approve them after your AOS is filed. I still cannot get a confirmed answer on this but so far that is what I have found....

That is correct. You are the petitioner and she is the fiancee. She will receive packet 3 and 4. Packet 3 is only going to be a letter that directs her to the Embassy website to download forms for her to fill out and return to the embassy. A lot of times, people do not wait for the packet 3. We didn't. All we did was confirm with the Department of State that the packet had been mailed and then proceeded from there...Sorry if I am jumping ahead

If you have already set up notification on the USCIS website, you can check it as much as you want but for me I checked it quite a bit but I saw no change to the status until the petition was approved. Ours took 4 months from K-1 to K-2 but others are taking much less time now. It just depends...there is no rhyme or reason. At this point, the name of the game is patience...and a lot of waiting. As far as packet 3 and 4, that will be sent to your fiance. I would suggest to start looking at the forums set specifically for your region. and also looking at the guuides for the other paperwork that will be required for the next steps so you can research the questions that may come up for you at that time. There is a lot of information that will help on this website but you have to search to find the answers so I would also suggest getting familiar with this website. You can start preparing for the next steps while you are waiting for the NOA2. Once you receive the NOA2, the file will go to the NVC and then to the embassy. Sometimes the file is in and out of the NVC in a couple of days and for others it can be caught up in the system for a while...

You are correct. The USCIS will take what you send apart and put them into their own folder but in our case, my fiance and I developed our own checklist (revised the example that is on here and put everything in two pocket folders. We also put coversheets on each section. None if this was necessary but it made us feel better when we sent it

They don't care about that. As long as all of the forms are signed and the payment is there...that is what they look for when first receiving the file. They are going to take your documents and put them in their own folder anyway.

Once you receive the NOA2, then your file will go to the National Visa Center and then to the Embassy. When the file arrives at the Embassy the beneficiary will receive what is called "packet 3" which usually consists of a letter that will direct you to download forms that need to be filled out and returned to the Embassy. Once that has been returned to the embassy and entered into their systems and a interview date is set then an official letter with the time and date is sent to the beneficiary which is referred to as "packet 4". You don't need to worry so much about the photos. They are definately good to have but the copies of his boarding passes and of his passport photo are more important. Our photos did not have dates on them, we just wrote on the back the date and where we were. No need to stress so much about the photos. You have proof that he traveled to California and that is all that matters. One thing to notice is that on boarding passes they do not print the year so make sure that you show the stamp in his passport with them. We also printed out the email confirmations to go along with them as well. I hope this helps...

Your file will be sent from the Vermont Service Center to the National Visa Center to be processed. It is typically in and out of there in a few days unless the file is put in for Additional Processing and that is sometimes at random. Then the file will be sent the the Embassy. Once they receive the file and log it into the system a letter will be sent to the Beneficiary with instructions of what forms on the embassy website need to be downloaded. You do not have to have this letter in order to download the forms. If you go under the forums and go to your specific region there should be a thread that someone has posted with the links to your embassy. A lot of times, people will contact the Department of State to see if the embassy has received the file and has sent the packet 3 to the beneficiary. If the packet has been sent, the beneficiary can go ahead and download the forms and mail them back to the embassy. The National Visa Center is going to issue a new case number for your file. You will need to call them to get it if they have not already sent you a letter with the new case number. The beneficiary will need to follow the instructions on the Embassy website as to what items they will need for the interview. The petitioner will have to send a packet of information to the beneficiary as well for the interview. There is a lot that you can go ahead and start gathering now to get prepared.
