The child would not have to be an orphan - The parents could be living, but have terminated their parental rights - The question to research would be how to go about getting that done - Both the mothers and the fathers - Whether it needs to be a court order or what -

But based on the criteria, if she can get the parental rights terminated I think she could adopt them and get them status - they have lived with her more than 2 years and she is the primary caregiver.

Immigration Privileges for the Biological Parents of Adopted Children

Once adoption is complete, the natural (biological) parent no longer has the status of parent of the adopted child. Thus, as a general rule, the adopted child may not confer immigration benefits on his natural parent even if the adoptive relationship has been terminated. Similarly, the natural sibling of the adopted child may not enjoy immigration benefits from the child.

However, the natural parent-child relationship may again be recognized for immigration purposes after the termination of an adoption if the following criteria are met:

- No immigration benefits were obtained or conferred through the adoptive relationship to the adopted child;
- A parent-child relationship once existed between the natural parent and child;
- The adoption has been lawfully terminated under applicable law; and
- The natural relationship has been re-established by law.



The Immigration Procedure for an Adopted Child

An alien adopted child may only qualify for immigration into the United States if he/she meets the technical definition of an “adopted child.” All three of the following criteria must apply:

- The adoption occurs prior to the child's 16th birthday;
- The adoptive parent/s had have legal custody of the child for two years (before or after the adoption); and
- The child had resided with the adoptive parent for two years (before or after the adoption).

What I've highlighed was the first thing we spoke about and yes, he will give up parental rights. They found out about the sickle cell while she was here. She was not looking to use medical hardship as a means to complete the process. The attorneys put that in her head...but then I asked her to ask the attorney, what about the other three children (no reply)



The attorney had no response. First the children would need to be classed as an orphan. Have her read up real slowly.... The U.S. Laws on adoption FOR immigration purposes. What makes it even worst is that the natural parent was deported and here is the ex wife who is wanting to adopt for immigration proposes. The lawyers know that even if they are adopted that nothing can be done. They won't say this when its not required. That's why lawyers "try." Eventually after after about 3 or more years she could sponsor them I think. I'm not 100 percent. Wish I was at home when I read this but I'm at work using my cell phone to respond.

Well, she would love to adopt them, but I don't think that would work...as far as hardship one of the children has sickle cell...the father wants them to stay here, but I explained to him it's not that simple. She maybe able to prove hardship, but only for one child. They've been here 3 years now and they're attached to her. It's just heartbreaking.


Did the child develop sickle cell while he/she was here? Many people have diseases and other illness but that doesn't prove enough evidence for true hardship.

The farther wants them to stay here have u spoken to him to see if he's willing to give up his parental rights? Again even so this cannot be done for immigration purposes.

Thanks Ricardo, I told her that...she went to see a few attorneys but they're making promises I know they can't keep and they're telling her the case would be complicated so, a hugh retainer would be required. I think it's best if they return so that it will not mess them up in the future should they want to come back to the US.

You're must welcome. After reading your message above...i had to strap a step back and look over what your first message said. They got a divorce, she isn't their mother ...she's like a guardian now. Can she adopt them, yes. Will they be granted a green card....ProbablY not, why? Because they are not orphans and fire a child to gain immigration benefits they must be certain classifications. She if she adopts them them clearly it would be to avoid the proper immigration chanel ALSO the ex-husband WILL/WOULD loose all rights to his children. Of he willing to do this? Can she prove that the children going back to jamaica would be a hardship? They just got here within the year didn't they? I doubt there has been any much adjustments.

Your friend doesn't know immigration law and is wasting money because SHE WILL NEVER BE able to petition for a "friend's child".........

they would stay with his EX wife...I don't think this is possible, but it was worth asking. The children are all under the age of 10...so, they're out of status right now because ROC was suppose to take place earlier this year.:unsure:



Unfortunately they are too young to submit for their own ROC.

Question: I'll try and keep this short -- if a child's immigration status was based on their father's immigration status and the father gets deported will the children be able to file for "removal of conditions"

background: father arrived on a K-1 children (4) of them (K2) marriage went south (divorced) he tried to remove conditions 2 years later ended up in proceedings got deported children still in the states can his EX file for "removal of conditions" on the children?

YES THE FATHER GOT a GREEN CARD BASED on marriage... if he gies then his biological children who got the benefit because of him will become deportable. who would they stay with should their stay be approved??

No, oonly a us citizen can petition a parent and he/she MUST be 21 or older. A permanent resident can tho.... File for his/her kids/spouse.

No.... The initial interview IS scheduled by the NVC for immigrant visas.

If the embassy needed more info/evidence etc. then another interview will be set up by u calling the number or following any instructions the embassy gives.....

Me and my fiancé are trying to figure out which visa path is best for us. We have the proof of one visit from May 2009 and I will be visiting again in March of 2011 the reason we had such a long period between visits because I was in college and had other issues going on but now we are ready to work on our life together. My question is if I marry him in Jamaica and we live there for a while will it be easier to get a cr-1/ir-1 or would it be better to just wait and get a k-1 visa.



Yes I'd say it would be easier.. you'llmake it much easier to have "things together" residence.. Especially since it seems you havent seen him since 2009 .... Have you maintained a "relationship" When you file for the AOS you have to be able to show proof that you have the Intent to move back to the USA..

Then I would call uscis 800 375 5283 to see how they would like to address the case. Sometimes.. even if you dont make them awake will not cause a great harm to your case. Why.. somepeople who are married - now a days - tend to keep their madien name so it's not uncomon for spouses to disregard notifying USCIS of this. It's not a requirement that you must change your name but will need to know your Maiden, Married NAme.

I used to get notorized letters from both parents giving me permission to take my grandkids out of the Country. Perhaps you should call a travel agent. They can advise you on what to do if the father is already in Jamaica.



travel agent.. naah that's not not all necessary... As SUS said .. all the parents really need are letters notorized and that's it.. The children live with the mom in the usa.. so she's the one who really have to do the drafting of the letter/s no action is required of the spouse in jamaica I think.

Letter should include name of parent/s , child/children ages, person travelling with the child/children, contact numbers and the like. travelled with my brother's kids 3 times on 3 seperate trip to Jamaica.. on the 2nd round.. they questioned me as to the child.. they said the would call the parent which they did infornt of me and the IMMIGRATION OFFICER had the gutts to say that had they not pick up the phone that the child would be held back... i wasnt even in secondary for that reason.. think I was back there because I had two green cards one expired and one not and the initial IO asked why i had two..

I emailed the embassy about 4-5 times between jul-sept. 2010 and turn around times were 7-10 days.

On Nov. 1, 2010 we had to schedule what is called a " info window apppointment " given to us on a blue paper. They responded back exactly 7 days after the email was sent and we got a interview date for nov. 23 (2 weeks and 1 day from the date they responded).

This maybe consistent as as member name "vinnette" had a interview late dec. 9, 2010 and was blue slipped due to some marriage cert. Thing... She emailed the embassy on dec. 10th I belive and got her second interview on dec 21. The embassy/consulate seemed to have rushed hers I assume because if the various holidays that were neigh.

I have only had one experience with the Kingston Consulate and that was for my parents green card so i cant say what questions they asked for people who are trying to immigrate based on marriage or other. Found some information below from members who were interviewed in Kingston and questions asked.

1.If its a coincident that after I was denied 2 times my Fiancée file for me?
2.When i leave the U.S.A?
3.How long was I @ one of my previous jobs in the U.S.A?
4.Since I've been to JA how many time I see my Fiancée?
5.Then he say, if you had gotten ur previous visa don't you think you Fiancée would take a bit more time to know you?
6.Ask how we met?

You are in a visa category where a visa is available for you.. So there is almost no wait time you'll be scheduled for an interview as quick as your case is completed. You will not be allowed in as per the embassy's rules/reg. I suggest u email the embassy asking for that pardon.. Keep it ShorT...!

You asked about the interview process? in a quick rundown...

1. Arrive at location and agents outside check the documents
2. Pass through security screening
3. Have a seat in the court/waiting area
4. Proceed inside and your documents will be verified and a # is given.
5. Sit/stand in the waiting area to be called then you go to first window ... There u will present all requested documents and they will open the package from the NVC confirm all dcks are current/correct then do fingerprints... Then the applicant is asked to sit and wait his/her number to be called.
6. Interview. The person is sworn in to confirm all information provided to be correct so help them god.
7. After the interview if approved he/she will be directed to DHL (delivery company) to drop off the passport/s..... Then expect passport soon or be placed under review. OR the if not approved...will receive a blue slip basically giving information on how to fix it.. missing forms, request to interview the petitioner etc. if denied...thats a different issue.

Spirit Airlines is your only option. I think Air Jamaica will eventually open up more routes, but for now, the non-stop flight is on Spirit.

American Airline is an option as well in addition to Spirit Airlines. I cannot see Air jamaica opening up ANY additional routes.. they are on border line and close to being sold. They used to fly directly to Tampa AND orlando but lost the route due to competition and lack of travelers using those routes.

currently from kinsgton you will not be able to get a non stop flight. So Expect a connection and American Airline will have the best connection.. Spirit may have the best fare with restrictions.

The visa will be released to DHL only, he can pick up from DHL or wait until they delivery it. DHL will inform him when they have received the visa. There is no pick-up from the embassy.

Your interview date probably won't be until late July or early August. Also the 4 days after approval is not guaranteed, so don't book any air flight until he has the visa physically in his hand.
