So, yeah, I had my interview this morning and was granted a K-1 Visa! :D :dance:

This is how it went...

08:15, made my way from Royal Sussex Hotel to the Embassy via a Taxi. (advice - dont use mini cabs or private hire vehicles, only use official London taxis 'the black cab' style ones. I paid more than I should have with a guy in his own car with no meter...wont be doing that again.)

Don't let my fiance hear you say that! He's a 'guy in his own car with no meter' kind of cab driver! Most companies have set rates from point a to point b - just be sure and ask before you take off what he'll charge to take you to your destination. :) You can get out and find another cab if it seems unreasonable.

But congratulations on your approval!

I read the I-129 just yesterday and all it said about previous marriages was proof that they had been legally terminated.


It may not say it on the I-129 but they (marriage certificates) are asked for at the interview stage for the London Embassy (if you see my post up above, at least that's how I read it).



Yes, I understood that very clearly. What was new to me was that it needed to be included in the initial petition .

Sending it in with the initial petition as well as having it for the interview is quite different than just needing it for the interview. I was trying to figure out which is true.

We were told when we went for interview that although a divorce certificate does indeed give evidence that a marriage was terminated they also needed the marriage certificate to prove that the marriage was legal in the first place etc...I guess it's a case of being thorough and seeing the whole picture rather than the end result. She led me to believe that with the K1 it was also to substantiate the information you put in the section where it speaks about prior marriages, name, place etc. to see if the information tallies with what the actual document says.

The lady told us that neither our K1 nor our AOS could have been approved if we had not had a copy of BOTH the marriage certificate and the divorce certificate.

Basically she said that at the interviw stage they have a right to ask for any pience of documentation in the original form that relates to any piece of information you've given within the application, and if you can't show it, it will hold up the approval.


Sure, I can understand why the K1 wouldn't be approved if they couldn't prove the legality of BOTH the original marriage and divorce. And I know that they can ask you for any documentation they deem necessary at the interview.

But again, proving the legality of the marriage and the divorce at the interview is quite different than proving it for the initial petition. That's where your post got confusing (at least to me).

I'm sorry you're not getting the help you need, Matt, and I hope you can find what you're looking for. But calling meauxna a troll is just laughable.

The definition of a troll is someone who comes into an established community (such as an online discussion forum) and posts inflammatory, rude or offensive messages designed to annoy and antagonize the existing members.

M is a long standing member who posts all over the board, and has helped many people (myself included). If her posts annoyed you or antagonized you in some way, that's your interpretation and right, but it doesn't make her a troll by any stretch of the imagination.

That said, please let us know what you find out as far as documenting your cosponsor's assets. I know that the information will help others who will be in your same situation.

I would assume they'd need either a copy of the deed of trust or of the mortgage paperwork (if they are still paying mortgage) to show it is in their names.

I thought the petitioner was, by default, the sponsor of the beneficiary for support purposes in a K1 visa process. Perhaps my understanding only extends to certain consulates (say, London)?

All the consulate cares is that you will not become a public charge upon arrival in the States. How that is acheived is up to you and your fiance (and cosponsor, in this case). The consulate just needs documentation to prove that you won't be a public charge.

Lets be clear on the terms, though. Your fiance would be the sponsor and needs to fill out an I 134 regardless; anyone else who files a I 134 would be considered a co sponsor.

The USC petitioner is always the sponsor by default, even if they need a co sponsor to make up the difference.

To my understanding, yes. The 125% is enforced for the I 864, but is more a 'rule of thumb' for the I 134, and a guideline for CO's to use.

But, that said, you'd still want to be in the ballpark, as you will need the same amount in the few months after receiving the K1 - so why not get your ducks in a row in advance?

I think the cosponsor has to be a US citizen. Though I would mention on your fiance's I 134 that your father will also be contributing to your support - can't hurt!

I think it's with the fiance(e) included. Im not exactly certain about the co-sponsor guidlines (so someone please speak up if I am wrong). But the poverty level the sponsor has to exceed is for however many people he/she has to support once you guys get married. Hope that wasn't too confusing, Im having a big fat Monday! :)

How can they RFE you at the embassy? The I 134 is not looked at until the interview. So there is no way you can 'submit' your fiance's first and see what happens.

If you feel your fiance's finances will not be sufficient, then secure all the necessary forms and paperwork from your future father in law and take it to the interview.

I suggest you read the K1 guide and familiarize yourself with each step in the process before you find yourself in a bind you can't work your way out of.

I don't see the confusion. You said that you will be working once you physically arrive in the US - that your employer will be your current employer. As Yodrak said, who you work for is of no consequence. You will still be here, working, without work authorization. If you would 'say' that you will NOT be working, then that is a misrepresentation.

As I suggested above (but was ignored), you could use JFK airport as your point of entry into the US and request to receive a temporary work authorization (EAD) stamp. It is only valid for 90 days, so you could legally work during that time.

However, once that 90 days is up, you would have to cease work until your AOS work authorization is approved (assuming you would apply for AOS as soon as possible). This 'gap' is why most folks don't bother with temporary EAD. But, at least you would have 90 days of earning money under your belt (and in the bank).

You didn't state that about your job before, globetrotter. We were replying about your fiance's contract job ending and what issues that may present you.

If you will still be employed when you get to the States, that may be taken into consideration. You'd probably have to get temporary EAD - via JFK airport - (and then apply for EAD right away) in order to do that, though.

And I'm not sure how that would be documented for them to see in London, but I'm sure someone here has done that before.

They take into account whether or not your fiance can support you when you get here. If his job has ended, they will want to know what $ he has in the bank and what other assets or means he has at his disposal to support you, or if he is getting a new job - what would that pay be and when would it start?

Failing that, then you'll need a cosponsor.
