You would not apply for a K3 'there' in Thailand. Your fiance (then husband) would mail the petition papers into a service center in the US.

The consular who refused mt visa said i can go back and try on the VWP but i will need a strong case to show i'd return to the uk, whereas the lawyer wrote it off straight away and told me not to even try re entering..

The operative word here is that you can 'try'.

Personally, I'd have the USC visit the UK while you await the process.

I would think that the letter from the employer would be pretty standard - that you are an employee and that they expect you to return to work on x date. Would probably need to be on company letterhead and signed either by your supervisor or the HR manager.


VJ is a great place but there aren't examples here for EVERYthing, so you'll have to use your best judgment instead.

If you're set on getting married in India, then I would apply for the spousal visa after the ceremony. I don't see how you'd possibly have enough time to get the fiance visa, get her to the states, have a civil wedding, apply for adjustment of status/get her travel approval document (advanced parole) in enough time to make it back to India for the ceremony there in October.

Sorry I can't answer the India specific questions - someone else here surely will be able to, though! :)

SIGH. Again, the I 129f is the form used for a fiance visa. The automated system will thus still see it as a fiance petition.

If you already sent in the I 130 and received the first notice of action on it (still sort of hard to tell from your post!), then you've done the right thing.

And read the guide (link posted above) as for what would happen next - learning it on your own is always better than having others lay it out for you, don't you think?

Your lawyer is obviously an idiot.

If you are married, you are obviously not eligible for a fiance visa. However, the spousal visa option which uses the fiance visa form (the I 129f) is the K3. However, for the K3 process, you would not send in the I 129f until after you received the first notice of action on your I 130. (I guess that's that's where the genius lawyer got confused?)

You need to find out what your lawyer sent and when. Otherwise, the USCIS is probably confused as to what you're trying to do! Don't rely so much on what a lawyer says - do your own research!

There are also timelines/processing times for all visa types on this site if you'll just hunt around. The processing times on the USCIS' site will always be to cover their butts - its usually not taking quite that long.

ok , well , on dec. 1st 2006 i sent in the I-129f . at the end of feb. i moved . i went on to the website change my address on line . when i did this i recived a massage saying

" Application Type: I129F, PETITION FOR FIANCE(E)

Current Status: Approval notice sent.

On February 28, 2007, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

You can choose to receive automatic case status updates, which will be sent via email. Please click here to create an account online."

so , now i never got this in the mail becouse i moved . i did change my address on line . i do get info on line (although there has been no change )

i have not got a interveiw and/or noa2 package .

so , i am going to have to send in a I-824 to get the paperwork i am missing to find out what is going on .

now, in 1 mo. i am moving in to my own place . yes , i know why move so , much . the house i was living at was sold by the owers , so i had to move and find a place to live real quick tell i find my own place , so , i moved in with a friend ( where i am at now ) .


So, have you called the NVC and asked them where your case is?

If they told you to submit paperwork showing a joint sponsor, then you were not flat out denied. Get that paperwork to them and you should have visa in hand after that.

And for what it's worth, the NVC just takes the affidavit of support information from you - they are not the body who would issue a visa based on its merit. That's what the consular interview is for.

ATM machine, either one of your accounts (since you should be able to withdraw on your US acct from the UK)? If no debit card, take it off a credit card (cash advance) and then pay it back after the interview?

If it helps, when I was at interview time in Vancouver BC, my fiancée was able to be with me but not mandatory. Is there any way *you* can physically go get the fee while he sits and waits for his turn in queue? (My fiancé was taking my cell phone back to the car and they let him in after me by about 15 minutes.) As the USC you should have no issue getting into the embassy.


Problem is we have to have it paid in before the interview...we don't need the chas, we need the receipt that shows we paid it. Aargh!


This is what I was saying earlier; why not send him to queue for the interview while you go pay the fee and join him later? Why won't that work?

As a USC, you shouldn't have trouble getting inside. Even if you did, phone him and have him come down and retrieve the payment slip.

We've been apart now for a year and 3 months (3 visits so far), and probably have another year to year and a half ahead of us. It sucks, but it would suck even worse to not have found him at all. So I can deal.
