i appreciate the advice, but can anyone tell me if i have any chance of being let through. My wife rang USCIS and they said if i can get back in i can file and it is up to the broader patrol officer as to whether or not i get in. can anyone tell me what my chances might be?


You're asking us to predict what a CBP officer in Shannon will do when you cross his/her path? How could we possibly know what might happen?

If you must visit the US (if for some reason your wife can't visit you), then I'm sorry, but this is a risk you have to take.

My husbands interview is scheduled for May 23rd. On the one hand I am excited that it is scheduled, on the other, it seems that date will make it impossible for us to be together for our anniversary on the 30th since he wont have possession of his passport to try and meet me in Canada and with all the Swedish and American holidays it is unlikely he will have his passport and visa before the 31st.


It'll take that long for him to get his passport back? :o I know that Memorial Day is the 29th; what Swedish holiday will be holding it up?

The reason I asked about the age of the article, and some of the more seasoned VJ vets can correct me for sure - but I thought that the K3 was a 'newer' visa that was added at some point when the CR1/IR1s were taking such a long time. It was seen as a 'quicker' alternative for spouses. Hence the sentence in the article, "The rule expands the K visa status, currently available to fiancé(e)s of U.S. citizens, to include the spouse of a U.S. citizen, who is waiting abroad for an immigrant visa, and the spouse’s children."

I think that could be what that article is talking about.

I could swear I read that here somewhere, either a post from a VJ superstar (Yodrak, where are ya pal? LOL) or on the guides. I'll be buggered if I can find it now though. :lol: So take that with a grain of salt till someone else says for sure. :D


the K3 was introduced I believe in 2001. the article posted above is the news release that announced it. Until that point, spouses of USCs had to wait several years abroad until their CR1/IR1 visa petitions and applications were approved.

Hi! I'm in a similar situation, I have a visitors visa already ("laser" visa) and submitted a I129F for a K1 visa. But since it's taking soo long we want to know if we can just get married and apply for a K3 or adjustment of status later once we are back in the US. Is this possible?


You can, but you'd essentially have to start the visa process all over again and petition for a spousal visa. The second you say 'I do', you nullify your basis for the K1 petition (a FIANCE/E visa).

The K1 is the fastest route possible, and even its pretty slow.

Tell your Irish friend to get on over to VJ. After about 15 minutes of looking at the site she will realize that she cannot enter here and stay without a visa. In fact she may very well get turned away if she comes over here married to a US citizen and it looks to the CBP folks as if she is NOT planning to return.

Then after she's over the initial shock (that we all experience) tell her there is lots of help here!

I can't think of any scenario beyond that where what she is planning to do would work. The minute she showed up at the POE into the states, tons of suitcases in tow, they'll be asking her where her visa is - because clearly, no one visiting on the VWP would come over with all their worldly possessions.

TracyTN, I'm not sure that's correct. Passengers heading to the US clear both US Immigration and US Customs when leaving the Vancouver airport.

Good Luck.......................when i visited while going through the process i took my NOA1 with me, which i'm glad about as the officer asked me how our marriage worked with me in the UK & Hubby in the US, & did we have plans........i said uh huh we are currently going through the immigration process, he asked did i have any paper work for this to show him, and i did :D ...................but i also took other ties back to UK to show i would be returning :thumbs:



My wife is considering a visit from South Africa, but I don't know if it is worth the risk in being denied. It is a 19 hour flight over the ocean and 2000 dollars for a ticket so it would probably be best for me to go over there again. I can't imagine how horrible it must be to travel across the world, drop that kind of cash down only to be turned down and sent home! Not worth the rist IMO.


Perhaps route her flights through Dublin (dunno if that's possible...not very knowledgable on flights to/from SA). She can clear US immigration there and IF she is turned away, at least it wouldn't be at the end of a 19 hour journey.

I would really spend some time reading the step by step guides to each visa type. Then, discuss the pros and cons of each type with your boyfriend, and decide what makes the most sense for you. Each couple has different things that are important to them.

I think you missed one small detail of Reba's post; AOS is different from the K1 process in that you go through a DISTRICT OFFICE, not the Texas Service Ctr that your K1 would be processed through.

Very difficult to reply given the limited information you have supplied.....eg did your spouse enter the US legally? IMO, a consultation with an immigration lawyer to determine what course of action you should take given all your circumstances would be the best bet.

Ditto. Is he still in the country, has he left the country? etc. Not to mention that I agree about the immigration attorney.

And it would probably help to read the guides section here so that you understand the process for each visa type when you meet with an attorney.

You need to be cautious with that approach. Marrying while on the VWP is perfectly legal, so long as your fiancee's intent upon arrival was not to marry you. Sort of hard to prove if you are already engaged, not to mention if one arrives with several suitcases full of their belongings.

The burden of that proof would then lie on you during the AOS process, and if they don't believe you, then good luck to you!
