Finally, 6 days after being approved, I receive the hard copy of the NOA2 in the mail today. Can't begin to tell you how happy we both are. Of course this is just the beginning but at least we know the ball is rolling.

A few questions and some guidance needed from those who are ahead of me in this. Now that I have received the NOA2, what do I do? Do I stay put and wait for correspondence from NVC? In the Step-by-Step guide here in VJ.com, there is a list of things I need to do upon receipt of the NOA2. Do I have to do them now or once the application has reached the consulate, which in my case is Australia.

Second question, #2 in the guide talks about sending originals of documentary proof - I had sent copies of my passport, naturalization certificate, etc. Do I need to send those originals? Or is this referring to something specific?

The letter mentioned in #3 of the guide, I presume it would be the same as the statement of intent that I had submitted or somewhat different. Do we have any examples of them here?

Lastly, at what stage do I send the I-134 and the necessary documentation?

Any and all help you can offer me will be greatly appreciated.

Not sure what isn't clear on the guides. But at any rate...!

No need to wait on the NVC to send your fiance anything, although common sense may dictate to wait a little while to send the affidavit of support so that it is dated closer to the interview time.

You need to send original proof of your citizenship for your fiance to have at the interview. If you were naturalized, then the logical proof would be your original natz certificate. Doesn't seem like sending your passport to your fiance would be a good idea.

The letter of intent example that is on this site says exactly what to do at the consulate stage. Download it and see what it says.

That is so odd that you had to 'file' an extension of the NOA2. Usually, they accept an updated letter of intent for that - but maybe it depends on how long ago the NOA2 expired.

The affidavit of support is not needed until the visa interview (in the benficiaries' country). Why your lawyer included it in the petition packet, I'll never know. (Though a lawyer not knowing something about this process - not the first time that's happened :lol:

Anyway, what is an ITR? Are you saying your fiance (who I assume is the USC?) did not file his tax return in 2005? If so, he should file it asap. As the embassy will have seen the affidavit at the time of the interview, they may already know that he didn't file taxes in 2005. At any rate, they will also be expecting a new, more updated version, so I don't see how the 'old' version would hurt you - just as long as you make sure that your fiance has sorted out his taxes in the meantime.

This is specific to Philippines. The visa fee has to be paid at a bank. From what I've heard, some banks will stamp the back of a filled ds-157, other banks will only give you a blank ds-157 stamped on the back. It is essentially a receipt of payment. I think the packet 4 instructions say the bank will validate the ds-156, I think it's the 157 they actually validate. You could take both, just in case.

Thanks for all the responses. I now know what to list and how to document the assessment/mortgage if I decide to list it.

My fiance is going to have more info than he will probably need on my finances (pay stubs, bank statements, copies of 1040s and W2s - along with the employer letter and I 134), so I'm not even sure yet that I'll list the home.

I think the example form needs to be updated.

Here's the way I personally handled it.

I took the value my insurance company had given my home from my current homeowners policy, and subtracted my mortgage balance from that figure.

It was the easiest and cheapest way to show my equity.

Or.....as we often say in our office when we are trying to simplify a procedure....."good enough for government work".

Seems like an appropriate commentary, eh?


Ok - I get that (and can probably get it easily). What I don't understand is how that is listed on the form. There is a space for the assessment (figure from homeowner's policy), a space for the mortgage balance, and then the lines for the physical address of the home. Where exactly are you supposed to put the equity? Or are you saying that you're putting it in front of them with the two figures, and its up to them to do the math?

So if one does decide to list their house, then it appears you would have to have an assessment done to show the value of the property - I would assume that a 'guess' (or in my case, what I was told a few years back during a refinance) wouldn't be good enough. I think it would be easy enough to get a copy of the title deed, but to my knowledge, those do not show the estimated value of the property.

I asked this in the UK forum, but am getting no joy on an answer so I thought I'd try here.

Using due dilligence, I downloaded VJ's example form of the I 134. The part that has me confused is question 7 - "I own real estate valued at ..." The example form lists no amount for the 'valued at' or the 'mortgage/encumbrance' - it only has the person's address in the line 'which is located at'. So why list the address if you disclose nothing else about the property? It tells the adjudicator nothing except that you own a house. That makes no sense to me at all.

It looks like the example form is in the same situation I am in - where the income is clearly enough for the support, but they also happen to own a home. So why even list it at all if you don't need to use it for support (or are not prepared to document the assessment and mortgage)?

What did you all do (anyone in the same situation)?

I didn't think DCFs were processed by the same folks who process K1, K3s and CR1/IR1s? Mainly because K1s, K3s and CR1/IR1s were done by the State Dept, while DCF was done by Homeland Security?

Wow - it does seem like they're hitting a slow down right now. Although I wonder if sending the forms and checklist separately made a difference. We were having a debate about that last week - I'll try and dig up the thread.

Hello,

I'm a couple week behind you as we just posted our completed packet 3 and checklist to them today. I've been looking at lots of timelines as well and it appears to me that the interview is usually about 1.5-2 months after you send back the packet 3.


Is it taking that long to get an interview? I hadn't noticed that same trend when looking at recent timelines. In my head, I was thinking a few weeks after mailing in packet 3.

Of course, I suppose it can slow down at any time for any reason.

I'm not sure I'm fully understanding your question but I'm trying!

I do know that one of the forms (can't remember which!) asks when you're planning to travel to the US - I'd put that on there. Also it couldn't hurt you to send a letter with the forms explaining your situation, and requesting the June date.

Surely they won't complain if you want a LATER interview. That means they can more likely accomodate those who might need an earlier date.

Apparently you can call ahead and book your medical if you have your London case number. I guess I'm old fashioned, just going to wait until we receive the instructions to do so (via packet 3). Thus, I've not looked up the number for the Knightsbridge Doctors yet. Looks like we're about a week behind you (NVC sent our case over on 3/29). :)

I have known people to recieve an interview date and then contact the embassy to say that date was not convenient for them - and they were assigned a new date. So that's a definite possibility for you (if it comes to that).

That's sort of what I figured - that I'd somehow tick them off, or put the cart before the horse. Which might actually cause a delay (instead of speeding things along).

I'll keep my timeline updated - plus I'll probably post that in the UK forum here on the site. I think its taking about 2 weeks now to get in the system and receive the packet. My two weeks will be up Monday, but of course, we lost 2 days thanks to the Easter holiday. So my guess is sometime next week before we get the packet.
