I saw others there together, when i went on the 29th of October and i also saw that they sent for a petitioner that was outside and the husband was at the interview but didnt know the documents. She was in the car and they sent for a guard to go get her and she was interviewed with him, so has was already highlighted jamaica is very inconsistent and deals with those matters on a case by case basis.



THEY SENT for the petitioner that WAS outside.. so they werent allowed in sir/ma'am. I've made least 2 calls to the consulate and was told the policy has since changed. Now we can overcome this by sending off a VERY qucik and Short Email.

My Brother's Filing will begin on December 21 the day after my mom arrive and applies for her SSN if she wasnt assigned one at the airport during processing. I have hopes to be in the Interview for my little 15 y/o brother someway. It has a lot to do with how people carry them selves and though we may be dressed up.. act the part..!

The photocopy requirement did not specify black/white or color. if you want to submit a "color" photo go ahead .. if they need a copt of the submitted document (original/cert./photocopy) high high change it wont be in color just cost more. but you wont be denied.

I confirmed with NVC that case was sent to embassy last week, but they said that there's no way to track and I would have to call embassy to see if they received. Is there a number to call or is email the only way to make inquiry?


You WILL NOT get any information should you call the embassy - its a waste of time...! You can email them at one of the emails provided to you above. They usually get it. but keep in mind EVEn if the files say were sent last week and it got there in 6, 7, 8 days etc they may not have opened the files.. but definately worth the try.

We're considering requesting the NIM next month-- even though we haven't received our NOA2. We're concerned about processing time.



Honestly Since it does expire in 6 months... you'll just waste your $$$ and most of all... time. If i were you I would not rush it.. you only filed a month ago... K1-4 all process in 5 month... do you know if your case will be one of those that gets processed within 6 months? or if approved within 5 months... could ake up to a month to receive communication from the NVC.

Solution -

Wait about say March 2011 before you even think about geting suck documents... it WILL expire because start to finish WILL NOT BE 6 MONTHS - i'm just saying so you'll know.

Unfortunately the benefit you are seeking asked if you have met in 2 years.. if you havent than it becomes a problem. A waiver for him if child support is stopping him then there's a problem maybe more than just child support.. because child suppor back payments can be fixed in the blink of an eye.

This is why any hint of a 'ceremony' prior to receiving a K1 visa is a BAD idea. Esp. when you call it a marriage!

None of us can say whether or not she will be banned from the US. I guess it depends on whether or not they feel she misrepresented herself as a fiancee when she was actually married. It's quite possible that is how they'll see it, which I believe would indeed trigger a ban.

Yes, consult an attorney. Immigration law is federal so you do not need to have one that is in Florida. Costs vary - many will do at least a free consultation. www.aila.org is a good place to start your search.

You're not missing anything. I explained why the K3 was created in my original post. It's pretty much useless now (as far as I can tell). Its no faster and you have the AOS process to do once the alien arrives. I say pull that band aid off all at once and get the green card in hand before the alien even gets here.

Option 3: Marriage-base Immigrant Visa
Again, she has to come here in Canada and get married. Is this faster than K-1/K-3? Or has any other benefits except immediate green card processing? I assume average is 1 year to have green card in hand.

Again, you can marry anywhere. K1s are generally faster, but Immigrant visas and K3s take nearly the same time. The benefit is no adjustment of status once the alien arrives. Read the guide again.

Option 4: Direct Consular Filings in Canada
I read few sites stating DCF in Canada is possible. But does my fiance HAS to be residing in Canada? (Coz she doesn't reside in here)

I'm sort of a DCF dummy, but generally, the USC has to have lived in the alien's country (and generally have some sort of resident status) in order to be eligible. Each country's requirements are different.


Option 5: Flight to US and marry
I am aware that this option is a risk and illegitimate but also a so-called loophole. If I stay in US for 2-3 months and then get married and file for adjustment, would be able to avoid the suspicious or is it still risky?

No one can answer that for you. It's basically up to the Immigration officer adjudicating your adjustment as to whether or not you had immigrant intent when you arrived. What scares me about this option is if you apply for adjustment and are denied, you have no right to an appeal. The alien simply must return to their home country.

Also, the CBP officer at the point of entry may question your intentions and the alien may never be allowed to enter. You'd have to have the alien show ties to home (apt lease or mortgage, $ left in the bank, employer letter) in order for them to believe you were coming here strictly on a visit and not to marry.

Thus, this option is ONLY for couples who truly had no intentions to marry when the alien arrived. At least in my opinion.

1.) No point in giving a condensed itinerary at this phase. A brief sentence on the I 129f about meeting initially online and then the date/place of your first meeting in person is more than sufficient. I believe I also gave arrival dates of our other meetings at that point, but nothing else beyond that.

2.) Why include information that is not asked for, and/or that paints you in a slightly less than flattering light? When asked, tell them when you were engaged. That's the only thing that is really relevant.

By far the best post on this thread. Forget the K visa's unless you and your spouse plan on living abroad, or want to jump through hoops in order for him to gain any kind of normality in the US. CR1 visa has the K visa's beat hands down and is pretty much a no brainer. The K1 IMO is for USC who can only afford one trip abroad to actually meet their future spouse in person. Also CR1 interviews are usually pretty straight forward, unlike the K1 interviews who get the 5th degree when they go in for an interview.


What a load of tosh.

Since when does a K1 mean you want to live abroad? We did a K1 and I went to England 4 times to meet my (now) hubby AND he was asked maybe a grand total of 5 questions at his interview. Hard for you to believe, I know. :lol: There may be some consulates where you get the third degree at interview, but I suspect those same consulates would do an equal grilling for a K1 or a spousal visa.

'These papers' being what - the initial petition? No, there is no specific period in which you must submit them. Just after you are engaged if a K1, and after the marriage if going the CR1 or K3 route. The guides should illustrate this pretty clearly.

Of course they can - but if they were not from a VWP country, then they'd have to procure tourist visas to attend.

You must still go through the visa process whether or not you are married or engaged. Just because you get married doesn't mean he can stay while you await the process.

The K1 visa - like any visa - is for ONE PERSON. They cannot issue 'blanket' visas to cover your fiance and every Tom, ####### and Harry who wants to come over for the wedding.

Honestly a K1 visa is a tad faster than either a K3 or CR1 (which I would do in lieu of the K3) - but only a few months difference. It's negligible.

EVERYONE here who has gone through this is very much and love and wants to be together - so nothing new there! The way we decided was did we want to be apart as an engaged couple or as spouses? We opted to be apart during our engagement. It just seemed weird to me somehow to be married and be apart, but each couple has to determine that for themselves.

Normally, the physician will give her a copy of the DS 3025 which she will then need to retain for AOS. I suggest she get what jabs she can from her regular doctor prior to the visa medical if she can - will probably spare her some $$.

I guess I don't see taking one more piece of paper as a hardship. Plus you need one for AOS anyway so keep the copy and mail it in with the I 485.

A lawyer can advise you better than we can, but all you can do is report it when asked on the I 129f and go from there. Read the instructions on the I 129f - it should tell you what other documentation you'd need to include in lieu of this.

And be sure to disclose it each and every time you are asked on any forms.

Agreed. It's a best practice to keep a copy of the exact package you sent - in the event they lose something, it's much easier to just make an extra photocopy. If you didn't keep a copy, then I guess you'll have to hope you have your NOA1 before you travel.

Just to be picky, your fiance will not be 'filing' for a K1 visa. He'll be submitting an I 129f petition which, when approved, will allow you to apply for a K1 visa at the consulate in London.

Sometimes understanding the exact terminology is a huge help in this process.
