US Embassy and Consulate DiscussionFilling form DS 156
I guess the way I view the form is that the two questions aren't related.

The first is asking are you single, married, divorced, widowed, separated? (You are divorced.)

The second is asking you to list your spouse. As a K1 applicant, you are not married so you have no spouse to list. As leaving an answer blank is a no-no, your only real answer is 'none' (or perhaps 'none - K1 fiance visa applicant').

Your ex husband bears no relevance to your application for a visa, but as a divorced person, you want to represent your status correctly. Esp. as the rest of the documentation in this process has shown you to be divorced - so you want to stay consistent.

Remember that these forms are used in multiple situations for different kinds of visas. They have to keep them open ended enough so that anyone can answer them analogous of their current situation. You have to apply your common sense to it to know that while you are divorced, you also do not have a spouse at this time.

But to answer your question - yes you would mark your status as divorced, but you would put 'none' for spouse - since you are not currently married.

Why not print two copies while you're at it (same difference as making a photocopy really)?

US Embassy and Consulate DiscussionI-134: where does it say you need 3 years of tax info?

I think this may be wrong, Vanessa.

Just because a consulate processes the K1 through their immigrant visa unit does not automatically mean they will require an I-864. London also processes all K1's through their visa immigrant unit but relies on the I134.

I've never heard of a consulate using the I864 for the K1, although there are unsubstantiated urban legends about the practice.

US Embassy and Consulate DiscussionAdoption papers vs birth certificate
QUOTE (Destructo Bill @ Feb 18 2009, 09:16 AM) <{POST_SNAPBACK}>
This is probably something that differs from country to country... But, i was adopted as well and i haven't had any issues getting documentation of my birth. However, when the adoption went through the government re-issued me a certificate with the names of my adoptive parents on it. When i went to apply for the long-form birth certificate last month, they issued it in my new name with my proper parental information. According to the packet 3 i recieved they are looking for both certification of birth and any applicable adoption certificates. So, i would contact what ever department is in charge of birth documentation to make sure you can't get one...

Thank you for your kind and informative response. I really appreciate it.

US Embassy and Consulate DiscussionAdoption papers vs birth certificate
My fiance and I have gotten conflicting information. He was adopted and has adoption papers, not a birth certificate. We read that the USCIS would want a copy of his birth certificate or a certified letter stating that it does not exist. Is there anyone who's fiance has been adopted and were the adoption papers acceptable to the USCIS?

US Embassy and Consulate DiscussionCo-Sponsor for the I-134
My fiance and I have already filed our K-1 and are awaiting the NOA - 2. I wanted to go ahead and start getting everything together for the package that I will have to send him. I make enough to cover the requirements for the I-134 Affidavid of Support but barely. I wanted to add my mother as a co-sponsor so that we are more than covered. There is a section on the form that asks the relationship to the person that you are sponsoring. For my mother, do I put "future mother-in-law", friend? I am not sure. Does anyone know??

US Embassy and Consulate DiscussionAffadavit Of Support - London Embassy
Thank you for your response. Is your income calculated on your gross income or on your take home pay (with taxes taken out)? Typically, a person will have a paystub that breaks all of that down but I will not have that. My employer is an individual so my paychecks come from their personal account every week. I have a salary chart that we use to figure my check amount every week...ie, if I work 30 hours, the chart shows what my paycheck should be with the taxes and social security taken out of it, it also shows what the gross would be before the taxes are taken out of the check. What I can provide are copies of the checks that have been issued to me and a copy of the salary chart. Because I am hourly, my checks vary from week to week. How many check copies do I need to provide? How many months worth? I and my employer are willing to provide whatever they need, I am just not sure without knowing how they calculate income how to provide what is necessary. Any advise would be much appreciated....

US Embassy and Consulate DiscussionAffadavit Of Support - London Embassy
I have a specific question in reference to the I-134 and I have not seen it addressed on this website. I work for an individual as a personal assistant, not a company. I also am paid hourly, not salary. I have a guranteed minimum number of hours every week but on average, I work more. My employer has their own letter head that the letter will be printed on and will be notarized. Also, my paychecks have taxes and social security taken out every week. My checks are written to me weekly out of their personal account. The letter states that I have a guranteed minimum number of hours, with what the average amount I actually work and at an hourly rate what my gross income would come out to be and that I am in good standing. There is also a salary chart that is provided by their accountant that shows from 1 to 40 hours at my hourly rate what my paycheck will be. The accountant is also providing me with copies of the last 2 months of cancelled checks. Is there anything else that I need to provide? Is there anything else that needs to be stated in the letter. What other proof do I need to provide. I have not worked for them for a year yet so I do not have a w-2 and my fiance's interview will be before the end of the year. I am also planning to provide 3 years tax returns. I am able to get 2006 and 2007 but I just files 2008 and the irs will not be able to provide a transcript to me for several weeks so I was going to send him the actual return just for 2008. The last 3 years prior I did work for companies and made a significant amount more. I do qualify with the job I have now but barely. I have added my mother as a co-sponsor just in case because I want to cover all of my bases. Any advise would be greatly appreciated. Thank you!

US Embassy and Consulate DiscussionWhat to include with I-134
On the example form here on VJ, it shows you on the example to not mark the intend or not intend section but the London Embassy wants you to mark intend and then specify how you intend to support the beneficiary...

US Embassy and Consulate DiscussionWhat to include with I-134

Ok, I have been through these forums and have had so much conflicting information on what exactly needs to accompany the I-134 (London embassy).

So far both my mom and I have:
-Letters from employers
-Past pay stubs
-Letters from bank stating deposits

You will also need your 2008 tax returns, actually, they prefer the tax transcripts which you can get for free from the IRS but they will accept the tax returns. They also have the right to ask for 2006 and 2007 as well. I would send those just in case. If you send the tax returns and not the tax transcipts, you will need your 2008 W-2. Also, make sure that the I-134 questions 10 and 11 are filled out correctly. I had to re-send mine to my fiance after discovering that the example here on VJ is not how the London Embassy prefers to see it. I will go through what I sent and if there is anything else that I find, I will let you know...

To answer question 11 go to the forum under the United Kingdom and there is a forum all about this for the London Consulate.

US Embassy and Consulate DiscussionVisa stuck in London
It looks like from your timeline that the last infomation that you had was that the file had been sent to the embassy. You still have to get everything ready for the interview. I have some information that I can provide to help you. Your NOA2 will expire according to your time line at the end of November. Has your fiance gotten a letter from the embassy yet? You can contact the Department of State to find out information on your file. The number is 202-663-1225 press 1 and then 0

There has to be more to the story than this...has he interviewed there? Was he approved pending additional information? Was he informed that the visa would be put into AP? Please let us know more about your situation and maybe we can help you.

US Embassy and Consulate Discussionanother 1-134 question
The easiest thing to do is to contact the IRS and request tax transcripts. They will fax and or mail them to you for free. The embassy usually prefers them because it proves that your taxes were filed and you do not have to provide the W-2's I would suggest requesting the last 3 years. 2006, 2007 and 2008. You will need them for the I-864 affidavit of support when you file your AOS and this way you will already have them.

US Embassy and Consulate DiscussionBank Statements
It sounds like to me they just don't want to be bothered with adding the information up, even though they are bankers. I had no problems getting that information and neither did my co-sponsor. I agree, I would go into the bank and I would not take no for an answer. They have no reason not to give you that information...

US Embassy and Consulate DiscussionI134 WAY TO CONFUSED WITH THIS FOR AND SPONSORING
Yes, if your father is the co-sponsor he will need to file the I-134 as well. he will need to provide a birth certificate but a copy of a passport would work as well or even both. You have to show that he is a US citizen

US Embassy and Consulate DiscussionI134 WAY TO CONFUSED WITH THIS FOR AND SPONSORING
If you are supporting 2 people (you and your finace) the income requirement is 18,310 per year. If you need a co-sponsor both you and the co-sponsor will fill out the I-134, one for you and one for the co-sponsor. The I-864 is to be filled out for the AOS

US Embassy and Consulate DiscussionHas anyone here refused to get vaccinated
I would think that it would be much cheaper to get them in your country than in the US but you can get them in the US if you prefer. When you go to file the AOS, you have to meet with a civil surgeon here in the US. Whether you have had vaccinations or not and they can administer them to you at that time. You can come here without having the vaccinations but the forms required for the AOS are going to have to be signed off on by a civil surgeon who is not going to sign the documents for you (which are required) if you have no proof of having the required vaccinations. It is your choice, have them in France and bring the paperwork with you showing that you had them or get them here...
gmjdmjFemaleUnited Kingdom2009-11-02 12:56:00
US Embassy and Consulate DiscussionHas anyone here refused to get vaccinated
You are the beneficiary applying for a visa to come to the US. You are not a US citizen so you can't use the law to refuse vaccincations. if you want to come here on a K-1, get married and file for an adjustment of status you are going to have to meet the vaccination requirements for the paperwork or you won't get approved...
