There is no 'appeal' for this - you have to be able to prove that the alien will not become a public charge when he lands on US soil.

If you cannot find a joint sponsor, then I'm not sure how you'll get the visa approved. There have been a FEW instances where they've accepted an alien's job offer in the US, but that certainly is not the norm - and each consulate views this differently. And it may be hard for him to find work when he is there.

FWIW, I happen to think this isn't ridiculous. I wouldn't expect the public at large to support my (now) husband just because we wanted him to emigrate here. If I could not have supported him, nor found a joint sponsor, I would have moved to the UK.

The reason i say the 125% is that i know people that have done the I-134 for K visa's and their lawyers told them that they needed 125% not 100 and one was told at interview that they needed a co sponsor as they did not meet the 125% level


Certain consulates apply 125% and some apply the 100% rule to the I 134. I think London has generally gone with 125%. Even if they didn't, it's still best to 'front load' yourself and have more than they may be looking for. IMHO.

Typically, yes - esp. in a consulate like London. Some others do not look favorably on it (I believe the Philippines is one) though so you can't say that is true across the board.

I-134 and the I-864 are both affidavits of support, but the I-134 goes by the 100% of the poverty guidelines, and the I-864 goes by 125%. The I-134 is used at the K-1 interview, but the I-864 is used at AOS, which is why people generally always follow the guidelines for it.

Edited to add: For K visa purposes, the I 864 is not used until the adjustment of status phase. It is used during the visa process for immigrant visas (CR1/IR1s).

The only way you'd really be 'burdening' your mom is if you actually thought you'd need the $$ from her. If you're pretty sure you can sustain yourselves, then really all she is doing is filling out a form to get him here.

The more binding document is the I 864 used at adjustment of status time. If she is still on the hook for that (meaning your income situation isn't improved when you file), and the two of you ever divorced & he used public assistance, the government could sue her for that $$. From where you sit, I'm sure that does not seem likely - but I feel it's best to at least inform potential joint sponsors of that responsibility.

Most people here would go through family members, one by one until they could find someone to cosponsor. It doesn't run your credit, all you need is a signature, an employer letter, some pay stubs and maybe a w-2. It's not the crisis situation that everyone imagines it is.



Agreed. And it doesn't even have to be a family member - just a US citizen or LPR who are willing to agree to it.

Or there is the option of a second job as Nik+Heather has mentioned several times.

Beyond that, I'm sorry that you didn't research this as you should have before filing - but it is what it is. All you can do now is try to overcome the obstacle.

It will not be sufficient.

If your using assets to make up the difference between income and the poverty level, you would need 3X or 5X the amount that would close the gap.

At 2009 poverty levels (making $10,000 income)

Level 3X / 5X
100% = $13710.00 / $22,850

125% = $24636.00 / $41,060

(some embassies go with the 125% level, not 100%)

I am aware of all of that, but by the time this visa is done, We would have more than 2,000 dollars. the thing that worries me is i am not above the poverty line, and i cant get a co-sponsor so i am left in limbo. feeling helpless


$2000 is only half of what even your adjustment of status will cost ($1010). And remember too that you will have to prove support again at the adjustment of status phase. If you cannot either increase your income, line up a cosponsor, or your fiance can't self sponsor - I'm not sure what other choice you have.

Perhaps it may have been better to file the I 129f once you had this situation a little better in hand. I know you can't 'unring' that bell now, but this is one of the many things a couple has to take into consideration when planning for a visa to the US.

They do not take 'future earnings' into account. How would they gauge such a thing? Nor do they care if your family members have become public charges or not - that would have no bearing on you whatsoever.

All they want to make sure of is that the alien will not become a public charge when he/she arrives on US soil. The only way to do that is current earnings of either the alien (alien's can self sponsor. See http://london.usemba...faffidavit.html -- though I don't know your fiance's situation enough to know if this would be a viable option), USC or a joint sponsor.

As others have said, if you have concerns that what you or your fiance make will not be adequate, line up a joint sponsor in advance of the consular interview.

If you don't do that, then yes, the visa application can be denied.

London case numbers start with LDN.

If the NVC have already shipped your case to Dublin, then there isn't much you can do now except wait until it gets there and contact Dublin at that time. I agree that they'll likely ship your case to London once they realize the error.
