An immigration attorney is not going to do anything at this point - they can't speak at the interview on his behalf -

Lol get a lawyer... A waste of $$$.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa interview

No, it's not possible to schedule an interview before NOA2 - it's not even possible to schedule an interview right when getting NOA2 - you have to go through the NVC, then they send it to the embassy, then the embassy will tell YOU when the interview is on their schedule - unfortunately you have no control over it.

Second, having or not having a lawyer will not speed up / slow down the process or avoid a request for additional evidence.

Just a personal edit "NOT UNCOMMON... a list of long discrimination is widely preached and tolerated in some of those churches EVERY where".

Discrimination is not limited to church in Jamaica...or just church but throughout organized religion (not all). My comments aren't directed at any one person...when we make comments we should refrain from making generalizaation, especially based on PERSONAL observation and experiences. The path to hell is paved with good intentions. Just my two cents

All background is important. yours is a recent bankrupcy. and declaring bankrupvy stays with you for 10 years now. they alao consider the medical bills you say. Is this illness reoccuring so it will affect your income in the future. YOu sign applicaiotn giving them permission to look into anything they want for informaiton on income, character and financee. Homeland Security can even look into your chats and emails. This process opens up your whole life for inspection.

i agree.... see what these people must understand is that a benefit is being sought and so yea... they will inspect the person requesting the visa and the person in charge - petitioner.

Your post is so far off base it's not even CLOSE to reality - Do some research on Jamaica, since you want to post an authoritative statement about how pregnancy out of marriage is frowned on there - It's far more common in Jamaica to find single mothers and or common law marriages then legal ones -

The hot topic in Jamaica of recent note is the ongoing issue of "Jackets" - Your post is irrelevant and hurtful to someone in a tough time.

Sus... wht you know about jackets.. ok u know too much about these local things..

Please stop the mean spiritedness. I am sure tolsab meant no harm.

This might seem like a random story. However, I visited Jamaica about 4 years ago. and at that time I attended church on the Sunday. This was a 3 hour long service dedicated to women with children out of wedlock and the fathers who don't do enough to support their children. They seem to be pretty prejudice against those who are pregnant before marriage. Even though, from what I gather, many people do not have enough money to have a legal wedding. Sounds like discrimination to me.

K-1 Fiance(e) Visa Process & Procedureshow do they print visas?

hi vj, does anybody know how do they print visas? do they send it somewhere? does someone else review the petition after the the consular officer approves the visa? why does it take two weeks to be delivered? why does dhl tracking says SHIPMENT PICKED UP though the embassy still has the petition and has not delivered it to them as yet? sorry for all the questions i just don't understand. aarrrgghh!

Visas are printed at the Embassy.. How..? Unsure if that could be answered. Why it takes 2 weeks..? Average turn around time is about 7 days... and after a petition is approved some administrative works do happen and it is possible they just process in the rear...

Wow lots of misinformation:

There is no fee fir the waiver; it's just a simple letter describing the previous petitions and a short what happened. Sounds like you are good to go; I've never seen those get denied.

There is no max limit to the number of petitions you can file; depending on the country expect the fiancé to be questioned about knowledge of the previous and possibly the validity of the relationship.

MCat filed for five also.

It's just a simple letter; the 601 form is not used.

Well :wow: .... I dint give any information.. to mis-inform any one.

K-1 Fiance(e) Visa Process & ProceduresDenied ?

Great advice -

To answer a few other points raised in this thread = Jamaica does not allow the petitioner to attend the interview= so being how close JA is to the US is irrelevant - on top of which, distance doesn't make a difference, ticket prices are nearly double right now. If they want to interview the petitioner, they will blue slip for them to come back. Secondly, any additional evidence (financial, phone records, etc...) they would blue slip for.

I am so sorry you are going through this but I agree with the above advise - do not wait to see what response you get before contacting your senator, you need to be proactive not reactive and fight to keep your petition in JA before it gets lost in a hole somewhere - contact anyone and everyone you can, and keep doing so until you get an answer.

K-1 Fiance(e) Visa Process & ProceduresFiance Visa Proof

+1 especially considering the boy is only 18. He's got his whole life in front of him. Over 50% of all marriages end in divorce. No need to rush into anything. Spend some "serious" time together... weeks together over a period of years. Honestly, what's the rush. Statistics show if you marry, there is over a 50% chance it was a poor decision. You guys have never met, he's only 18, he's not even in the working world yet. Give it time.

i agree almost NO ONE will marry at 18 and stay married.. well not the america i know...

You know if people's comments on the age difference bothers you now... Wait until you get to America.

Posted Image

Proof of meetings is the best evidence of a bonafide relationship, not least because of the time and expense involved. Also photos, especially with eachother's family. Then phone logs, emails, proof of gifts you've given eachother.

Honestly, I am not sure I;d mention you knowing eachother for 4 years, unless it is via family, that may raise an eyebrow or two due to tthe age difference and him only being 14 (but never lie if they do ask!).

This is definetly an immature decision !! You guys need to give more into it .. Marriage is not a game, its a whole different life... If its based on at least meeting each others yet, its definetly not ganna work..
Goodluck :)

I would wait until you find out what evidence is needed. If a refusal continues and really is a denial marriage will not improve their position. It may show your continued intent to resolve any issues remaining. I would continue to talk and keep track of your conversations, letters, photos and cards. Maybe another trip without a marriage would be beneficial, and show your serious interest. An attorney is always a good option at this point.

K-1 Fiance(e) Visa Process & ProceduresBrought fiance. And things didn't work out. She won't leave

Hi there,
This is probably not a typical post.. but here it goes..
I applied for a fiance visa. After 8 months it's approved and I brought my fiance here. We had major issues shortly before arriving and I don't want to get married. What do I do now? She won't go back home. I bought her ticket, I made a change to the date as she asked, and still.. she's not leaving. Her visa expired in 3 weeks. What are my obligations? do I need to inform the immigration of the status? Please help????

stay illegal for ever or she will eventually leave if she needs to file a new petition. desperation kicks in for her..

K-1 Fiance(e) Visa Process & ProceduresInterview canceled AGAIN

My fiance was supposed to be interviewed today in Kabul, but because if the terrorist attack on September 13, they canceled our appointment, only appointments September 14, 15, and 18 got canceled. This is the second time our appointment is being canceled. So yesterday US embassy called my fiance and told him that his appointment is canceled and that they will call him later for a new appointment.. So my fiance is in Kabul staying at hotel all worried and confused. They didn't even tell him to go back or stay they just told him that whenever they made a new appointment they will call him. I don't know why this is happening to me, is it because of my bad luck?? I am so stressed out.. :crying: Do you guys know how long will it take to obtain a new appointment?, has anyone been rescheduled before?
THank you

Sorry to hear. i can just imagine how costly that . appointments are cancelled all the times when there is an unrest. This benefits the US/other officials and applicants at the embassy. To avoid targeting a US post this is done which we should understand. The response time could depend on how long the people of the country carry on the antics. Oftentimes as a courtesy to applicants they might schedule interviews at near by locations if it continues for a long time.. uncertain if this could be requested via email.

If you are concerned about your parents' reaction, why rush to file so quickly? Why not tell your parents about him, take a trip to Jamaica with your parents, let them get to know him? Although its hard to be apart from the one you love, time only makes the relationship stronger when the love is true - One of the questions you will deal with with immigration is about your family, has he met them, talked to them, etc... - Why not go in there being able to say yes?

SMH ... woa.. this will be a long road. Bit strange. BUt she may use what ever address she chooses as she calls home.

Please read what Gary/Alla has stated and understand the difference between pettioning for a visa application guidelines and the guideines that the consular uses to issues a visa. Here is his statement "There is NO LAW that says you only have to meet once. That is for the PETITION it is NOT for the visa. For the visa you must convince them you have a realtionship that is NOT established for immigration benefits. There is no specific requirements to do that. It is your job to have "enough" evidence, whatever the CO determines is enough."

You're right and I hope they get it. U can have 10 visits been married for years.. Yet that still couldn't be enough to convince bonafide... Not to mention just one visit.
