Yes it was a Mistermineor. I have the expungement document saying it was erased... It was 1 month after my 19th birthday. (2002)

I answered question 16 ("Have you ever been cited by a law enforcement officer . . . "), with "YES" of course.
In the column I wrote:

Using cell phone while driving . . . . 05/11/2009 . . . . Ventura, CA . . . . paid $132 fine.


I showed him the paperwork; he just briefly looked at it (about 1-1/2 seconds) and marked it on the N-400 sheet as "okay"


Ok I guess I will reprint page #8, part 10, D, #16.. I was not arrested But cited 8 years ago I choose "NO" but will change it to "yes" hope my application will not be affected.

It's been soo long since i last visited Vj and i could not remember my password anymore. For those who's been here before i am "HAPPYWIFEYMOm".

To make the story short..my kids are finally here with me after the long ,rough journey. They are now adjusted in their new environment and got their 10 yrs. green card and their SS card.

Told my wife and daughter they had to be good until they got their US citizenship, they were. Didn't anyone tell you, you have to be good? Well with my stepdaughter, she has to be good for at least the next couple of months and is of drinking age now.

You have reportable offenses with a lot of details, who knows what your IO will say. We have a state senator with six DUI offenses, doesn't seem to be hurting his career.


Hey Nick you're right You'll have Senators/Mayors who you'll see on the local news from time to time who often times try to "bribe" the cops by letting them know who they are when stopped for Speeding .. and i guess DUI which is rare. It may not affect their jobs.. the same way it will not affect the Original Poster's Job* however, it will affect his ability to become a US Citizen.

I am sorry for not having a timeline, I used to be a member here many years ago but it appears my old account does not exist anymore.

It's an urgent question so I'll introduce myself in the proper message board area later..

I am a permanent resident who applied for her N400 3-4 months ago. I thought I'd have my biometrics by now but alas I was wrong and it took this long to get my biometrics notification.
I have gotten the form today but the problem is, due to -probable- postal delay (assuming from the date stamp on the envelope) I have only 10 days left till my biometrics appointment. The greater problem is - I am due to have a baby just 3 days after my supposed appointment (via repeat pre-planned c-section). I could, however end up having the baby already this coming week, or the week of my biometrics appointment because I am being closely monitored due to preeclampsia.
I really do not want to reschedule as the process has already taken a bit longer than expected and I don't want to end up at the bottom of the paper pile yet again - but it appears I have no other choice.

Do I need a note from my OB to attach to the request to reschedule my appointment?? How long might it take to get a new appointment? If it comes too quickly after the first date, I might still be in the hospital - if it comes too late, it might take forever..Is there a time frame how long it might take?

I will be calling them first thing in the morning on Monday but it is Saturday now..and stressing over it quite badly..perhaps for no reason...but with this high blood pressure it's not easy to not to stress over anything let alone a major "problem" like this.

Could someone give me some info/advice/reassurance please? Thanks so much in advance!!!

No Need to stress.. unless you need to travel soon and need to apply for a passport or apply for someone that requires you to be a US Citizen.... dont stress and put ya self in labor.

Call them on Monday and let them know that you're unable to make the appointment ask if there is an appointment slot for sooner if not then you can chance it and go if you weren't placed on lock down by the doctors. IF if you do then you can call them on the day and let them KNOW that you're in the hospital having a baby and you're guaranteed rescheduling ... I'm not able to answer as to their work load to say when you'd be re-booked*.

** dont know of anyone who had to be rescheduled however I'm sure someone can give you more information. **

I think tax returns are required regardless of applying based on 3 years or 5 years. Without being a "good" tax paying resident and the IRS has no beef with you, then you are clear.
Checkout the Naturalization guide http://www.uscis.gov...ticle/M-476.pdf or better yet, checkout document M-477 which is a Document Checklist for N-400 applicants...

Transcripts are indeed required...


Ok so I reviewed the document. Page 3 of the document checklist or slide #52 of the guide... Says the tax document only applies to those who are seeking a status change based on marriage (3yr) or thouse who have been outside the usa 6 plus months and should prove they maintained their status/residency and can show evidence by including a tax return.

Hi Nick,

I applied based on being a resident for 5 years, not thru marriage and I did not include any tax returns on the application. During my interview I brought the tax returns with me but I was not asked for them.

For Citizenship.... One is required submit proof of this tax thing..? I did not see that as a requirement for the 5 year requirement but for the 3 year rule showing proof of relationship.

Hello -

My friend is starting the process of applying for his citizenship, however he did not register for the selective service before age 26. He came to the US on a petition filed by his parents. Anyone have any experience with this?

HMMMM well he's shooting his self in the foot - when HE was processed in kingstion, jamaica and if he was under 26 he would have been required to sign off off on a piece of paper TELLING him to register for the selective service. Keep in mind even if he wasnt advised of this requirement at the embassy this information is included in the green card packet that is received. If it was not included then as a LPR he has to find out his responsibility as a GC holder.

Fix...

He should send a letter with the application explaining why he did not register when required then he will be considered. Again as noted above if he was 27 or elder then registration isn't required..

An LPR can petition for his/her unmarried son or daughter over 21, who are not minors. :thumbs: :thumbs:

Also, from your signature, it looks like you got some kind of dual citizenship thing BEFORE you became a USC. Did you know that at the oath ceremony, you took an oath to RENOUNCE all foreign citizenship/allegiance in order to become a USC? Here is what the oath says: "I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty, of whom or which I have heretofore been a subject or citizen".

So, after you have become a USC, if you have ever presented yourself as a citizen of another country because you USED TO be a citizen of that country, you have technically violated your oath, and thereby is no longer a considered a USC. Now, USA doesn't mind if you acquire your citizenship AFTER you have become a USC, as long as you do not renounce US citizenship in the process of getting the citizenship of that foreign country.

Now, in reality does the US govt keep an eye on the people to make sure they don't violate the oath? Not really.

No it is not necessary to have a state ID. Two forms of ID is just enough i.e. your foreign passport and your Green Card. The ID does nothing to fulfill the residency requirement.

Yes you can. Look at the date on your permanent resident card it will say Resident Since XX-XX-XXXX you can go back 3 months from that date given you were already married for 3 years to the same US Citizen.

On most times at usc interveiw the officer will ask about your marriage,,,,makeing sure everything is rosey ect, living together, paying bills, joint taxes blah blah, blah.
Not a good idea at this time for you....

Best thing is kiss and make up...work things out (maybe)...or wait until your 5 yrs is up from becoming a P.R then you don't need show joint filed taxes as your application be based on 5yrs and not 3yrs..

If you leave the country for " more than 6 mths" this will effect you if in the future if you want to become a usc. as the pysical presence comes into play.
leave the usa and stay more than 12 mths there is a very good chance you will loose your P.R card ...Unless you file a re-entry permit which will cover you for upto 2 yrs outside the usa....

But note... even tho the re-entry permit protects you....the P.O.E still could refuse you entry even with a re-entry permit in hands....this will depend on the immigration officer at P.O.E and other things such as did you abandon your P.R in maybe not having a us home, bank accounts, blah blah blah...so best you have all your ducks in a row...
No point of coming back if your staying in a hotel room on your next visit, no job ect....can you see my point?

Hubby's natz oath was today in Nashville. It was interesting and took longer than I thought it would - mainly getting everyone checked in. 60 folks from 23 different countries (hubby the only UKer). Got there at 7:30, left around 9:45 all told. Got piccys with the judge and all that. The natz certificate is pretty cool. Probably need to get a safety deposit box now to put it in, eh?

Question for you please. From looking at your timeline the N400 process took you 4 months..? I'm just somewhat off as the websit says the memphis office is currently processing cases filed May 26, 2010 and before.

I have my citizenship interview in Fairfax, VA office next month and was wondering if anyone in here had an interview there? How is it there?
This is 5 year rule and I'm very nervous.

Why be nervous at the Citizenship Interview..? It is so much relaxed than the AOS/Consulate interviews. Unless you have issues like did not file tax for any period, owe child support, committed a crime of have no knowledge of US History or  other  then there is  nothing to worry about. Your English Structure seemed on point and this portion is tested just by you talking and following instructions.

That's what i was thinking too, they must have misplaced it and don't want to admit to it. My only problem is that I could have done so much if I had my GC 4 years ago and could now apply for jobs that require citizenship by instead of waiting for my AOS I could be waiting for my naturalization application. :angry:
Once I get my GC I will schedule an Infopass and try to maybe apply for my naturalization but who knows? maybe I'll get it!


You will be able to apply for US Citizenship 5 years from the DATE on the green card that reads " resident since."

Someone posted recently they got denied for filing single. Their reason was because his wife was going to school. USCIS Immigration Officer did not want to hear it. Prevention is better than cure (an old Jamaican saying).

I did an early biometrics, actually the same day I got my letter in the mail. Went to the same office and asked if I could and the receptionist said sure. I didn't even have to give an explanation. I also did it early twice, one for removal if conditions and the other for citizenship.
