US Citizenship General DiscussionN400, do I have a chance?

In 2001, I married a USC while I thought I was divorced from my previous USC. Ultimately, the marriage declared void. Now I am legally divorced from the first spouse. When I got my permanent residency years after this mess, the IO was aware of all this non intent bigamy.
I am ready to submit N400. If course, I will disclose it. I did some research and it seems bigamy is a big problem to get approved. If the USCIS approved my I485 knowing this, will they approve my N400? Also this is happened 10 years ago.

Welcome to VJ

I wish I had an answer for you BUT what i can say is the N-400 carries more weight than the I-485. While an Applicant who commit an act of crime gets approved for a green card or Adj. of Status the Citizenship request maybe denied. .. "moral character"

US Citizenship General DiscussionOath Ceremony Letter

After complete my US citizenship test, How long will it normally take to receive a letter of Oath Ceremony? I've pass the test about a week ago, and still waiting for the letter. At the same time, I have to leave the country urgently due to the family in critical condition in hospital.

Anyone know?

Thanks,

Chris

Hey Chris so i looked up some information for you because I know the issue with your dad is important. I will provide you with 3 links below taken from those people who share the same office (Seattle, WA) and who filed in Sept. Nov. and Dec. 2010. This may help you to determine how long the wait between interview and oath is. From my review it seems like that office offers same day oath.

US Citizenship General DiscussionCan I travel outside of the country after I pass my Citizenship Test

I am asking my sister to ask for the doctor's notes that stat my dad condition. Do you think that might help talking to the immigration? I am hoping that USCIS will see this matter is an urgent. I am hoping that I am able to go see my dad very soon.

Chris

Hey Chris from my view an Infopass maybe worthless. IF your interview is scheduled they wont schedule one any sooner, if you have an appointment then taking it to the interview maybe the best choice. if you want your scheduled interview to be changed (if you have one) then having the medical proof would be beneficial to getting this done. You would mail the appointment notice along with your request/reason back to the address where it was sent from.

US Citizenship General DiscussionCan I travel outside of the country after I pass my Citizenship Test

Yes, I do have an valid Green Card and international Passport! However I also hope that USCIS would able to allow me to take oath earlier, and I can apply for a 1 days turn around passport before I leave. Do you also know how long it usually take to get the oath Ceremony letter?

Yes you can travel there without any problems after the interview. After the interview I suggest telling the Immigration Officer that you want to have a interview date ASAP or say after a certain time. They may schedule you and may require evidence to support your rescheduling request. Some offices performs same-day oath ceremonies.

All the best to you.

US Citizenship General DiscussionAnother Descheduled N-400 interview

I am lost here. Today, I received my IL for March 29 and another letter said due to unforseen circumstances they are going to reschedule me some other time. I am so disappointed because this the second time it happen. Last week Feb 12 , IL arrived with March 14 schedule and at the same time another descheduled letter!

I tried calling USCIS and was put on hold , after 30 minutes i hung up!

Sorry to hear of this.. there's another member who had the same issue but at the "oath" level.

That's not true if you plan to sponsor your family to live in the US. As a naturalized citizen, the USCIS will ask you to produce the original copy of your naturalization certificate along with other documentations.

Just a trivia, naturalization certificate does NOT have an expiration date on it, while passport does, but your citizenship never expires with it of course, just an interesting fact.

Which of the I-130's instructions are you reviewing..? USCIS will fly over those who dont know better. Now I'm speaking from the Revised I-130's instructions updated on 11/23/2010. It has no special instructions only for naturalized US Citizens. If it heps . it does say if Naturalized you can use the given certificate.. it goes on to say that you can use the expired/unexpired US Passport. No?

oh yes.. and it comes with a heavy price. If you have your us passport then you probably wont have a need for it.

US Citizenship General Discussioninterview date

hello visa journey members,
i received a date for an interview and the letter with the supporting documents i need to bring for the interview. I have few questions:
1) can i just bring copies for the taxes from the last 3 years or i need to go to an IRS office and get them from there?
2)and for the marriage certificate it says should be issued from a civil authority, can i bring my first original one i got when we got married, or i need to go and get a recent one from city hall.
3) i want to have dual citizenship, but i heard they might take my other country passport, is that true? i checked my country allows dual citizenship. Is there a way i could keep it?
thank toy in advance for your help !!!

November 22, 2010: sent the N400 package
January 7, 2011: biometrics
March 5, 2011: received letter for interview
April 6, 2011 : interview

I cannot address all of your questions and hope someone will soon. They will not take your passport from you at all. You are asked to take it just in case they need to verify your travel dates. You can use the First original marriage certificate that you have.

Well your file needs to be reviewed by a supervisor. This is often caused by a troubled past/history of the applicant.

US Citizenship General Discussionabout to apply for citizenship but residing in other country

hi everyone!!
i would appreciate if someone could give me a good advise about my case. i am right now removing conditions in my residency and I am actually living in miami, fl, but by the end of the month i will be going to dubai with a residency visa sponsored by my american husband who is living and working currently in dubai. I will apply for citinzenship by october this year, so i need to know if the fact of going to dubai to stay with my husband will make a difference in my procces or if is other way to procces the citizenship if u are living overseas.
thanks and kind regards.

you have to be living in the state i think 3 months before you apply. if you move prior you wont be eligible .

US Citizenship General DiscussionQuestions regarding part 10 question 16 and filling N-400

RICARDO4EVA2,
For all my 3 moving violation tickets, I took 2 defensive driving and 1 deffered adjudication, so it won't increase my car insurance. I think I should say that they might be on my driving record if I ask for driving record from DMV.
Are you saying that moving violation tickets not part of question 16?

I'm sorry you can also put N/A where it ask about your middle name. Regarding your "moral character" heck you can put the driving records information if you like but it's not required. You can take prooof to your interview etc.

almost everyone gets those.. heck I have gotten about 8 tickets for speeding in the last 5-6 years. I have not added those to my application. My brother became a USC back in January 2010 and I completed the application for him and regular tickets were not added.

US Citizenship General DiscussionQuestions regarding part 10 question 16 and filling N-400

Hi,
I just got my ROC approved by USCIS, so I'm now working on N-400.
Is it hard to file N-400 by yourself? If you don't have middle name, do I need to write "(none)"?
Does anybody have examples of N-400 that have already been filled in?

I have a question on how to answer question 16 from part 10.
The question is "Have you been arrested, cited, or detained by any law enforcement officer (including USCIS or former INS and military officers) for any reason? I have 3 moving violation tickets (traffic tickets) back in around 2002 and 2003. All tickets were dismissed due to I took defensive driving (so it will not reflect on my driving record). Do I need to answer Yes to the question 16 and disclose these traffic tickets?

You should answer NO to the question. Also if you doint have a middle name you can write - NONE

hope this will help you

US Citizenship General DiscussionInelegible for N400
if you are married to the SAME US Citizen that you gain the residence through then yes you can apply as of July 1, 2011.. i would wait until about July 10, 2010 to ensure you have met the full requirements .. otherwise they will just hold your applicant in AP after the interview.

You MUST renew the child'd card... you will not get the citizenship before completing the process.

US Citizenship General DiscussionNaturalization Clarifications. THANKS!

Hi I just want to ask the following for NATURALIZATION:

1. Does the 5-6 month process still apply or is it quicker lately?

2. I am a GC holder, petitition my wife and daughter f2a....Just want to clarify the term, MARRIED TO A CITIZEN to be able to apply in 3 yrs. What if when we got married I was a green card holder then NATURALIZED? Will the 3 yr rule automatically take effect for her? What if my wife was already here and only then I naturalized does the time she was here still count to the 3 yr or only the ones after I naturalized?

yes it has been quicker than the 5-6 months average maybe 4-5 months.

She would be eligible as if you had your citizenship prior. She would be required to meet the 3 year rule (marriage/green card). the only time that counts towards the "residency" is when she becomes a resident - it is the US and laws are stricter. someone will let me know if i'm wrong.

US Citizenship General DiscussionWould this effect the citizenship application?

She has decided to call the lawyer (Thank God the number is still the same from the time before I was even born) and get the information in which she wrote on her form. I'm not too familair with everthing but from what she has said she came into the country on a different name. This was in early 1990 when it was easy for people to place their photos in other people's passports. (She doesn't remember the name from the passport she used)

Glad she found it...!

After comming here, she did an interview in which she told the official she wanted to stay for two weeks. She was given a visa - after the two weeks were up she was officailly illegal.

so she lied..?

She has a greencars, passport etc, everything is in her right name. There is a feild on the citizenship papaer that says she must write if there was any other name she came into the country under, the date, and if she entered the us illegally.

She should complete the form as she was known by a different name.. etc

RICARDO4EVA2MaleJamaica2011-04-03 15:12:00
US Citizenship General DiscussionWould this effect the citizenship application?

So is the best thing for her to do if she doesnt know the exact name she entered the country under and the exact date is to contact the lawyer who helped her with her case?

Writing n/a or leaving that feild blank of the paper is not an option?

Ok... so during the interview USCIS will go over her file.. which will include anything that she ever sent to uscis/any case on her.. so she should answer as she did in the INITIAL I-130.. it would only benefit her.

NOT because she was cleared for the general queue of LPRs would mean that she would be granted an approved N-400
