The citizenship application will depend on whether he has an unexpired permanent resident card. He has to renew his card before he can apply for naturalization. As for his status, he is still considered a legal resident but the jury will be out for his status when/if he applies for renewal. The USCIS will look into his file and do another background check. That is where the felonies and tax problems will be in play. Two felonies will not look good in front of an adjudicator. He needs to get a good immigration attorney.

You can talk to a good immigration / criminal atty and the convictions could be vacated. Not knowing the details, we can no suggest, but talk to an atty who can help you.


Thank you... did speak with a very close friend who is a criminal lawyer yesterday who has death with high profile cases and suggested he might go for a voluntary departure because he could be denied for the marijuana charges which is about 2 charges - over 400 grams.

I would definitely renew the GC and NOT try for citizenship. Get his mess sorted, pay the back taxes and penalties, get the criminal stuff sorted -

His CARD expired, not his status as a resident. He is NOT out of status. They would need much more serious reasons to revoke his permanent resident status. No, he's not going to get deported and he can apply for citizenship as soon as he renews his card.

trying to get information for my cousin.

Cousin's 10 year greencard expired in January 2010 (20 months ago) and he has not renewed it. He's yet to submit the I-90 to renew the card because he has 2 (maybe more) charges that were classes as a Felony .. (Bank/Drug). The charges were created between 2001-2003 and he's seeking a waiver/expungement since the waiting periods has passed however he is out of status.

Questions are
if he successfully gets the charges expunged is he still eligible for another 10 year green card..?
If he subjected to be deported ..?
Will be he able to apply and be approved for his US Citizenship?

majority all of you said that Im in big trouble due to my second marriage. I do understand what your saying and I thank you all for all the time and effort for replying all my concerns. If USCIS push it into marriage fraud even though i know I didnt commit any fraud. Would that Appear on the notice after they review? Will they give me notice that will say example we deny your citizenship because " you committed fraud" and so on ...what ever they see in my case. I dont really know if I can save my career and life after this . Would it make a differenece if I hire an attorney If i will be called again? What would I expect next from them deportation? If they will really psuh it to fraud is there any way I can have my geencard back? Thank you all.


dont think so far ahead. I am going to assume the worst that would happen is that you would be denied the benefit you are after. I say no, dont hire/secure a lawyer now... or at least until a decision is made that is not in your favor. The lawyer at that time would be able to assist with an appeal.

I felt really shaky about what you said,

How can immigration officer prove it was fake when we have all the documents passed for CG to ROC. what about those paperwork we sent that they reviewed during our interviews? Anyway I cant undo whats done.

I know on my first marriage was real and all for love but people might judged immedietly and dont know the real story how marriage fell apart. How can immigration prove.. the documents to approve the case to get the documents means nothing. They can go based on the face that right after the case was completed it was so that the marriage fell apart, divorce filed. Please understand. I see what they are saying and would agree. The marriage could have been ended - fine - but jumping to marry a foreign national did no justice.

Your problem is how this looks to the IO. i'm going to tell you how it LOOKS (obviously you feel it's different)
1. You got your GC based on marriage to your USC
2. Your attended your 10 year GC interview claiming all happy happy
3. Conveniently after the interview for the 10 year card you claim abuse of USC spouse
4. Your ex-husband files for divorce the SAME month you interview for your GC (this makes it look like you lied at the interview, only stayed together for the interview/GC)
5. One year after your divorce is final, you conveniently find another man to marry in your home country (how did you meet?). You then file for citizenship, and I assume will shortly file for your new husband.

Unfortunately you've made it look like your marriage to your USC husband was fake. That once your got your 10 year card you left him to marry your REAL husband/bf back in your home country and now you will petition your "real husband". Unfortunately the evidence you presented for a valid relationship could be explained as evidence from your USC husband loving ou and you just going along with it for the GC. This wouldn't normally be questioned but your new husband, from your home country no less, is the one that makes your USC marriage look fake. I don't know your chances for approval honestly.

My questions are;
1. Am I in trouble for not letting immigration know immediately when my husband files the divorce and my green card is till on process. I got my green card on November and he filed divorced on October and divorce was final on the next year of April.
2. Will they revoke my green card? What are the chances of IO to push my marriage into a fraud? I was granted with CG and it was removed granted with 1o years GC. We are both interview on getting all my green card.
3. Will my current marriage affect my N400?
4. I didn't not file income tax on 2009 because I didn't make enough money on that year, I started working Dec 2009 so I did not file. Will this could be the reason for denial?
5. If they deny my N400 is that ok not to appeal and just be happy of my 10 year gc.It seems like citizenship is very complicated that I thought.
6. Can I leave the country for 2 to 3 weeks while N400 on process?

Is there anyone, have same issue with me? Please share. I am really worried and stressed. I'm scared one day ICE will pick me up from work or show in my door step just because of this. I don't have any criminal issue. Thanks you very much.

Hi,

So my husband has his naturalization interview soon, he has applied an i-130 for me. Our case has been completed at the NVC but the file is sitting at the office cuz our PD is not yet current.

My questions are:

- Once my husband becomes a US citizen what exactly should he do to change his status from a LPR to a citizen?

He will contact the NVC and send in proof of Citizenship via email or mail.

- Secondly, should he contact NVC and inform them that he has become a citizen? Will that speed up our process? Since our case is complete, will NVC send our file to the consular office of my residence?

Yes he should... Yes it will speed up the process. Your current priority date is in March 2011 I think.. you will save your self about 7 months of waiting. Once your case us updated form F2A to IR! then you will have about a 40 days days or LESS to get from change to Interview if there are no scheduling delays at the consulate.

- Thirdly, does he need to fill out any further forms and send to the NVC once he's a citizen?

No, No forms to fill.. just proof to send.
What exactly are the steps after a LPR becomes a citizen, has applied for his spouse an i-130, needs to change his status?

Estimate the dates as best you can... If you have nothing in the passport, go back and look at credit card statements to get the dates etc... But Don't sweat it too much unless you were gone for long periods of time... Just put the days to the best of your knowledge... It is a common issue.

I have few Questions regarding form N-400 that I can really appreciate someone's help with:

1. Part 3C - Date you became permanent resident ; Will it be the date I received my Conditional PR card or will it be the date I received my 10 year PR card ?
From the moment you were approved.... the date on your green card... conditional or 10 year which will be the came "residence since/from" date.

2. Part 7 A,B &C - Time outside US - I am applying based on the 3 year rule, so, do these questions still apply to me or is it only for people applying under 5 year rule ?
you are included. you are ONLY able to apply because there is an exception to the residency requirements. All other req. applies.

3. (Really Stupid Question) Part 8 G- How many times your current spouse been married ?; This is our first and only marriage, so the answer should be "1" right ?

I am concerned about the waiting list for the exam. I was going to call and schedule the exam since we SHOULD be receiving our NOA2 in a week or so. Am I jumping the gun here? I would rather have it out of the way as apposed to waiting until the last couple days prior to the interview.

What date are you going to schedule the medical interview for..? You will not be able to do the interview without the Appointment letter... I think the medical review from Canada is valid for 6 months.

That maybe true.. with Canada being a very advanced country. The medical could be done a few days prior and the physician would give the applicant a sealed envelope.

I agree could you arrange to get to montreal a few days early? and then you could do your medical the same week as your interview.


I dont think the said option above is possible. The medial is typically done at least 10 days prior to the Interview.....so that the medical facility have time to test the solution/findings etc and for the applicant to pick up the results or info me fwd to the embassy/consulate. Unless the OP wants to stay in a hotel for 10+ days which might become costly.. if there's a friend there then yes.. I'm all for it!

Great thinking.... You WILL not be able to do your medical in the USA... that would be considered as part of the I-485 packet and USCIS would give your the necessary paper work to do that not the NVC/Counsulate... so with that being said... unfortunately.. you will be required tomake the 4 hour drive... just hoops that immigration throws at us that we gotta hop thru..

One positive thing to remember is that Canada is not that far away and you guys can see each other more often than most of us. Most of us can't drive across the boarder or can fly over a weekend if we want to. I am in no way trying to make light of this situation and I know being seperated is hard. I have been apart from my fiance since May and will probably not see him until January or February. This process is challenging to say the least but the main thing to remember...it could be worse...he could be half way around the world and seeing each other often over the time it is going to take to get this process completed could be a lot more difficult... I wish you guys the best of luck. And as someone had mentioned before, you will find support and understanding on this website because there are a lot of that have gone through it and are still going through it...

Thanks... Well it turned out it was lost SINCE Friday, Feb. 4, It was lost/dropped in Subway close to my job where i go once a week or so. I decided I wanted subway today. While leaving the guy outside on his smoke break told me that they found my IDs. Since I had called USCIS prior and they told me that I had to pay $450.00 to get another one and had no choice it seemed.

I have no touches or updates after biometrics. Wanted to check if someone else here is on the same boat or if this has any negative implications. I got FP notice on 1/19/2011 (There was a touch then saying a Fingerprint notice have been mailed). The actual FP date was 02/03/2011 and I went in and it was a weird looking guy who I'm not sure he was very happy to see me LOL.

He did FP and took photo. But I had no touches or updates on 02/03 when I had FP done. I am worried he may not have submitted/transmitted the information electronically and it may appear I never showed up for FP. Has this happened to anyone or is this normal to not get touches a week after your biometrics ?


No touches have to me made on the case because the case isn't touched by uscis the testing is done and then sent to the FBI/other agencies. The case is Normally transferred to he Local office above 30-45 days after the biometrics. Also as Nigel mentioned the Stamp serves as proof.
