It shouldn't cause her problems getting a job - all the notation is intended to do is make an employer see another document proving she has authorization to work...which would be her green card (or card and extension letter).

I would still get it removed. It's not hard to do anyway - plus you are supposed to submit any changes in immigration status to the SSA. You'll only need to do it again if she decides to become a citizen.

I don't think how you submit the photos is a big deal - so long as they are printed out and the adjudicator knows who is in them and when they were taken. I mention that only because I know some people thought it'd be a good idea to send in a CD with photos on it. Erm, not so much! LOL

Dunno if you are the alien or the USC. At any rate, what they are mainly looking for at this stage is co-mingling of assets - and essentially proving your lives together. You'll note there is no affidavit of support for this filing (as there was for AOS). Tax returns (or better yet, tax transcripts from the IRS) are merely used to show that you've filed together (or filed as married, filing separately), and as such, are just further proof of your lives together.

Focus on proving that and you should be fine.

Besides, in this economy, I hardly think you'll be the only unemployed person filing...!

If you read the instructions on the I 751, it says to submit 2 passport photos with your application. If I recall correctly from our AOS experience, the picture they used on his green card is one of the ones my hubby submitted with the application.

I can't remember what happened at his bio appt for sure (and he's not around for me to ask him), but if they did take his picture there, it was simply to verify his identity at the time of the appearance.

No, I don't think the marriage certificate is a requirement either. I was just being #######. smile.gif May not end up sending it at all.

They do say friends and family for the affidavits. I just thought it was prudent to have a 'mix' instead of all family. A friend of mine asked an attorney about it, and he had said it is best to have more than family members give the affidavits since an outside source of a co worker, friend, or someone that you do business with would be better than immediate family members. Essentially because family will stick together and say things for benefits whereas someone that you associate with outside of the family could testify that you are a couple that does things together - and would not be looking to gain any benefit.

But again, it's a preference thing. I'm sure applications are approved where only family affidavits are submitted.

I did just realize you didn't list passport photos - you have those too, correct? Also, I plan to include our marriage certificate again (even though they've already seen it for AOS).

Personally, I'd get an affidavit from someone not related to you. They do not need to be notarized.

'Joint' petition means you and your wife - you are petitioning to remove conditions on her residency based on her marriage to you and your life together.

I don't know a lot about K2s, but the link I provided says, " IF you have K-2 children who will also be filing for removal of conditions at the same time, you may include them and use only one form and only one fee for the form." Also, download I 751 form and the instructions; the instructions have a section about conditional resident children. The form itself has a space to list children applying 'with' the parent.

ETA I often find the forms and instructions make things clearer for me than just about anything I can find on a message board. But that's just me. smile.gif

A lawyer can't help you rustle up proof of a life together. Have a look again at the list provided on the guide here. No utility or cell bills in either of your names? Car insurance? Car titles or car loans? No credit cards, but what about regular bank accounts (checking and savings)? What about photos of family gatherings and vacations?

Also, be creative if you have to. Maybe have your dad do a lease agreement; also, we are including an account statement for our hockey season tickets. Try to think of things that may not be 'normal', but do indeed prove a life together.

And be sure to get the affidavit letters as well, including some that are not just family members. I'd have them notarized too as extra 'insurance'.

And also, a USC would not have an A#. So all that was really missing is his SSN and DOB (though generally, I'd write 'none' in the box for A#). The worst thing that will happen is an RFE for the incomplete form.

That list seems a little short. Have a browse through the guide here again and see what other documents from that list you can include. The main thing that pops to mind for me is mortgage or lease agreement.

If you have a NOA1 letter from USCIS, then you have a valid case that is pending. The fact that the knob at the 800# couldn't pull it up doesn't mean anything other than they probably didn't type it in correctly. Heck, you could call back and get a different person only to find you're suddenly in the system.

There isn't much they can tell you anyway, other than your case is pending.

Not every case becomes available online -even ones that were never lost to begin with. It's not outside the norm.

Did you get the new case number from a NOA1 or a cancelled check? Maybe it's missing a digit somehow (if the 800# can't pull it up).

You still need to renew your passport, but I am not sure I'd risk doing it now - you may not have it back in time for the interview. In which case, what milimelo suggests is spot on.

Why is it bad news that it got transferred to your local office? Sounds like good news to me - that your inquiry 'shook it loose' and sent it to the proper place. I'd say an interview is in your future - how long it will take to get one depends on how busy Newark is.

A touch can mean anything - either that they moved your file from room to room, or that they actually worked on it. Sounds to me like they did indeed work on it, hence your transfer to Newark.

Question 3 referenced the receipt number and application number that I was confused by. Still sort of am, LOL. Not having had a bio notice in my hands for a while, I still can't be sure what you mean. Your 'receipt notice' number (from the I 797 C) --do you mean your CASE number? Not following you at all - maybe I should let someone else answer that!

I wouldn't worry about the misspelling (as in lose sleep over it), but I would mention it at your bio appt anyway and see if they can correct it.

CR189 is the correct denotation for an I 751 in USCIS' system. You're fine, and they have not made an error.

I'm fuzzy on question 3 - what do you mean by 'application number'??

If you want, go to your local office for a walk up biometrics appointment (most people are having success with that). FYI biometrics are wholly unrelated to working - not sure what that statement even means.

If you notice a misspelling on any forms, I'd mention it at your bio appt and see if they can fix it there.

Exactly. There was no verbiage on the screen to indicate my husband had his bio appointment. All that changed was the 'last date updated' changed to be the day he had the appointment.

It happened to me during AOS - I don't think it EVER shows online that you've had bio. All that showed online when hubby had biometrics was a 'touch' on that day, and one the next day (this was for AOS).

What exactly does the letter say? Normally they do not send a request for evidence w/out telling you exactly what is needed.

I've never heard of the service centers sending out letters to buy themselves more time. They're in a position to take as long as they want, I'm afraid!
