Patience is a virtue with immigration. Besides, by the time you reach the POE stage, you WILL be together - so I don't exactly get the need to try and marry before he even touches US soil. Saving $ on flights does make sense, but that's not how it works unfortunately! Maybe the K1 wasn't the way to go if that was a consideration.

A civil surgeon here in the US can denote that you are in the midst of your course of vaccinations and thus are complying with what is required in order to adjust status once you arrive. I've never heard of such a thing at an interview, though I suppose it is possible at a consulate in a country that is considered high fraud - I don't think Romania qualifies there. They'll only know if you tell them about it which I wouldn't do unless they specifically ask you - and I'd be surprised if they do.

Israel is still related to his brother, regardless of what his immigration status is here in the US. They ask this question because having relatives in the US could suggest that the visitor visa applicant may have immigrant intent. Above all, be sure that he is truthful. It will be way worse if they find out he does indeed have a brother but did not state such on the application.

For the sister in law, she does not have to list him as a relative (as they are not yet related), but she will have to state her reasons for the visit - and again needs to be truthful.

Edited to add: you might want to breeze around the Africa regional forum here and see what the chances are of a tourist visa being issued. Sometimes they're hard to come by, depending on the country of origin.

Thank You Thank You...Love the replies. Yes i have realized that the process is not easy at all. Im in Jamaica. As i get deeper into things i realize that the best thing for us is to get married then do the CR-1, but we arnt living together so that might be a big problem as i read that if we are merely living together we arnt qualified.

Where did you read that? Regardless, don't always believe everything you read.

A read of the guide and flowchart for the CR1 would be prudent. It doesn't matter what type of wedding you have, so long as it is recognized in the US as a legal union. You can file the I 130 the day after you marry in theory - though you may not have the marriage certificate in hand at that time, which obviously you'd need to prove the marriage.

And no, your wife doesn't have to be there for the consular interview - though some countries are pickier about that than others. You'll want to see what those going through Kingston on CR1s recommend.

^^ Agreed. The process itself is not cheap, so if money is a concern, its not going to get easier once you start this process. In fact, it will be harder - esp. as you'll have to prove that the alien will not become a public charge upon arriving in the US - both at the time of the consular interview AND adjusting status (if you go the K1 route).

If she's already going to be here on a student visa, then a K1 or CR1 is likely not the best course of action.

She'll need to find out the rules around her visa type for sure, but you should be able to marry and then adjust her status to that of a US permanent resident. But again, does depend on the type of visa she'll be here on so research it further - or have a one time consultation with an immigration attorney - most will do those for little to no money.

I suppose I would resubmit the I 129f with the supplemental piece of paper as the cust service rep suggested. I'd be hard pressed not to point out on a cover letter, though, that I didn't check anything initially because those did not apply to me, and that you hope the supplemental sheet is sufficient. (Then again, I tend to be a s*** stirrer so...! LOL)

1) Yes, you will need the Affidavit of the Court showing Guardian's consent unless the legal age of marriage in your state is 17 or lower. The requirement for the USCIS is to make sure you both are eligible to marry so what you need to demonstrate is you are either of age to marry in your state or have consent of parent or guardian.

Yea, I'm aware of all the expenses it will take to process the Visa. Also wanted to mention in the working is my own business outside the Ministry is developing Christian adventure and action games base on the Word of God for XBox, Wii, Sony, etc... Hoping to have my first game completed by Dec for Christmass. Before working witht he Post Office I worked as a Software Engineer for 16+ years. If push comes to shove then I would have no choice to find another job while doing the ministry.

I'll let those who have gone through Manila speak to this specifically, but you will have to prove you can support her. It doesn't sound like your current venture helps you in that sense at all.

And her job experience means little to them. That doesn't necessarily mean she will get a job here easily, not to mention the fact that there will be a period of time after she arrives where she cannot legally work. Thus, your support of her will be vital during that time.

Copies of calling cards - I don't see how that helps. They could be brand new calling cards that were never used - how would they know?

You can ask for a fee waiver, but just know they are EXTREMELY rare to get. The situation you describe doesn't really sound like a reason for which they would grant it - sounds like every day life stuff to me.

I agree with Bernie C.

Your original post confuses me a bit. If your case is already at the consulate, then it's not USCIS who issued an RFE - the case no longer resides with USCIS, but the Dept. of State. I've also never heard of consulates issuing RFE's - it sounds more like they're wanting you to explain the overstay, but I'm surprised they have done that now instead of asking for the explanation at the consular interview. Definitely not the norm, so I think it's hard for us to guess what the outcome could be.

Sorry to be the bearer of bad news, but your employer doesn't dictate the terms of a visa - they don't have the authority to do that. If your visa was for 12 months, it was for 12 months - regardless of what the employer wanted you to do.

Also, I thought some J1 visas had a 2 year home residency requirement before you could apply for a non immigrant visa. Dunno if that would apply to you or not.

:yes: If you'll read the I 129f form itself, there is a place where you're asked if the non USC fiance is currently in the US.

The I 129f petition fee is $455. You'll also have a visa fee to pay at the consulate and a fee for the visa medical - click on 'Embassy Info' link above to find out the details for your consulate (your profile doesn't indicate which consulate).

Also, I don't think you've filed for naturalization as your profile indicates either.

It's fine to include photos of them on the trip, but it's not necessary to document their travels as well.

Passport stamps are fine for proof of the visit, along with the other things you listed. You don't HAVE to have the boarding passes, esp. as long as you are heavy on other proof as you seem to be.

If your petition is already approved, were you thinking of having these photos/proof of your visits for the consular interview or?

I can't speak to how to 'transfer' Canadian disability - I somehow doubt it can even be done. But I'll let other Canadians speak to that more intelligently. :) Also he is free to visit here while the K1 is in process, so long as he doesn't stay longer than he is allowed to (isn't that 6 months as a Canadian?), and that it doesn't look to CBP like he is actually residing here. Unfortunately, you'll probably have to suffer SOME separation while awaiting the process (we all do).

There's nothing you need from your ex. You just have to prove you are both free to marry which can be accomplished by providing a copy of your divorce decree.

It's best to start by reading the guide so you understand exactly what the process entails.

No, there is only one form at the consular interview - the I 134. The I 864 is used at the time of adjustment of status.
