Nothing you can do now... they might not even look at the payable and just endorse and cash it... My check too about 10 days to clear....


And worst case scenario is they'll send you back your entire package. You write out a new check, remail it and you're on your way again.

Out of curiousity, who did you make the check out to? I made mine out to California Service Center, is that alright?!?!?!?! :help:


I made mine to the "Department of Homeland Security", I think thats what the I129 mentions....now you got me worried. I should've avoided this and just put CASH on the check.


The instructions on the I 129f say to make it out to 'USCIS' (written out) or Department of Homeland Security.

Why in the world would 'CASH' be an acceptable alternative? :unsure: That would have achieved nothing except them likely sending you the entire package back to you.

The link you provided is for IMMIGRANT VISAS, keep in mind that K-1 is non-immigrant, so while the info. might be similar there could be differences in the process smile.gif


Many consulates treat K visas as immigrant visas. London, for one, sends all K visas to the immigrant visa (IV) unit.

No, we are NOT happy about it, because I will miss out almost everything we looked forward to!

Well, here's our update:

Called the State Dept., Yesterday I spoke with a lady who asked for our case number. When I gave the first 3 letters of our 'receipt number' she told me that was not the number they wanted. After apologizing for 'mistakenly' calling the wrong number, she agreed to check the NVC to see if they had indeed received our case. When I told her the approval date (3/29) she said that it usually takes 2 to 4 weeks.

This morning, I contact the NVC again and speak to an actual breathing person. She reconfirmed that they had not yet received our case from USCIS and stated that it usually takes 2 - 4 weeks, but can be up to 90 days.

At this point, I'm beginning to think our case is still sitting on our adjucators desk at CSC. I'm also beginning to think the person handling our case at CSC is either a) Heartless, B) Slow, c) Mean or d) All of the Above.

Well, at least we had a few seconds of happiness when we received the NOA2.

I don't know what to think - I mean, we know that VJers experiences with service center waiting times are NOT all the same -- perhaps its the same with the wait time between the service center and NVC?

There is no online way to track your case when it is at NVC - you can call them to get your case number - they do have an email you can inquire, but from what I've learned, it's pretty slow - much faster to call. The good news is they don't really hold on to your case for very long at all before sending it out to your embassy.

After your NOA2 - wait a few days before calling the number on your NOA2.. (it seems to take a few days - maybe a week depending on when it was approved to get to NVC) - if it is there, they will tell you - otherwise give a day or so longer..

Once it is sent to the embassy, there is a kind of way to track the DHL packages to the embassy, but it's not a whole lot of help. - only takes a few days to get there anyway.

Once it is at the Embassy - you can call the embassy to check status - but I wouldn't call too often..

You CAN call the State Department here in the states after the embassy has received your case to see if you're on their system yet. Its a way to get the same information w/out hassling the embassy. I'd suggest trying a few days after the petition has arrived there.

I don't know the exact process in China, but the consulate will have to get your petition first, won't they? Meaning it will have to go to the NVC first, then to the consulate.

Or will they issue the packets based on electronic receipt of your petition? (Even if so, NVC will still have to process it and give it the new case number.)

That is so weird. So if the State Dept doesn't have it, and NVC doesn't have it - where do they suggest it is? Did he ask what he should do?

I'd call the State Dept at this point (see above) - surely you've flown out of NVC by now, so I bet the embassy has you on their system already. I wouldn't even mess w/ NVC, unless State Dept doesn't see your case yet.

Oh ! Well the automated phone system at NVC does not have information on K1s. They're not at NVC long enough.

Call back either early in the morning or late at night (midnight EST) and get a human on the phone. You've probably already been sent to the consulate.

In fact, you could try calling the State Dept and see if the embassy has you on the system yet. I did this on Thursday.
Call 202 663 1225 (then press 1,0,0 to talk to someone).

My fiance had just under 3 hours to connect to his flight after immigration/customs, and he got there with nearly an hour and a half to spare.

At O'hare, it REALLY depends on the time of day that you are going through. Because 2 1/2 hour layover is otherwise very do-able.

If she admitted to drug use in 2006, then obviously that has taken place within the last 3 years - which makes her inadmissable (see below), but it does appear you can have another interview after 3 years have passed. It may be a good idea to have her undergo some kind of rehab or see a counselor about it to help with the interview at that time.

I'm sort of surprised that the lawyer you spoke to didn't seem to know what was quoted below.

I'm sorry this happened to you, but it sounds like this is a serious drug (the equivalent to meth?) and not something to mess around with - whether she's 'only' taken it two times or is a full blown addict.

If you disagree with the finding, ask the consular officer to file an Advisory Opinion request with CDC. Other than that, there’s nothing the Department of State can do for you, and you do not have the option to file the Advisory Opinion request directly with CDC yourself.

Thanks for the replies. I believe I'll just bypass the gentleman congressman and go to my senator. I'll provide some of the nformation you've suggested from here but as much as I appreciate it, I don't want to take anyones personal information and their case numbers. I should not have to provide that to get assistance in this. I don't see how they expect that when they wanted a signed privacy act form from me to get my information.

I believe they meant by more cases needed that they could inquiere to the UScis center that those who are waiting for long time have to call the congressman, they make a package with which they have more power to request answers...Not those of you guys who already have been approved...(NOA2)...One consumer like you can not do their job...the only thing possible is that petitioners call one by one to make a group...Good luck, we are in the same boat with a few others with the Cr-1...!!


I sincerely doubt they would make inquiries 'in bulk'. As Jim pointed out, they have to get privacy releases from each person to do the inquiries. It'd be a logistical nightmare for the congressman's staffer to get all of those in and compiled, then send one request with 20 cases. Let alone how the CSC would then sort through that.
