You will have to wait

They are processing the petition - The request for evidence means they looked it over and you forgot to include something in your packet - When you get the letter, comply with what they ask for and send it back ASAP following the instructions in the letter - then your petition will continue to process.

This is not a helpful answer because Ciudad Juarez is only one place in a very large country, just because she is from Mexico does not mean she "knows the ropes" in that city... I know that my fiance and I are very worried to go there, he is from Mexico, his whole family is from Mexico, his friends are from Mexico and NONE of them would ever feel safe going there considering the problems it's facing with the drug war.. Just because they are from Mexico doesn't mean they know the ropes..

Anyway to answer the OP's question, she'll probably be fine. I've been reading a lot of reviews from people who have gone and it seems like the area around the consulate is relatively safe. She should take precautions, only go out during day light, stay in the consulate area, don't go wondering around the city.. that type of thing and she should be fine. She only has to be there for a couple of days.


She is still living in Mexico ... she's not dead.. so going somewhere she should be familiar with their way of life .. it's mexico .. all the same. have some street smarts i'm sure she'd be find.. i many others have done it.. so that alone says a lot... and the office seemed to be in the same pace so this is not a different case.. nothing to even talk about.

no i submitted the ds260. no ds230. but what if the case has been forwarded to the consulate?? the ds260 is at the consulate


then I would first email the consulate and ask them how to correct it. OR you can just bring the UPDATED DS-260 to the interview if you are able to print it. IF not i would take a completed DS-230.. The DS-230/60 are no different. One is done electronically the other my paper.

you're doing the K1 visa with the DS-230? To update the information call the NVC and let them know the information on the form is incorrect and they might ask the updated from be emailed or give another option.

Yes, London will use the NVC case number (hence the first three letters - LDN). The NVC is under the Dept of State, as is the consulate - which is why you get a new case number once you move from the Dept of Homeland Security to Dept of State (via the NVC).

I doubt anyone here would want to chat to dispense immigration information - it's best to do such things out on the open forum. I don't even like doing it on private message. You may not get the best answer possible one on one with someone. While many of us have a fair amount of knowledge on the subject, it's rare to find one person who knows EVERYthing, and with something as complicated and important as immigration, it's wise to seek a consensus answer instead of relying on one person.

have just made a big decision to marry and now we find ourselves in Limbo. I am from Dallas Texas and he Is from Ireland. We met 4 years ago in Spain/Valladolid during international studies. While he finished his final year of studies I visited twice and he flew over to me. In total i think i was in Ireland for a few months. After he finished his studies, we decided to travel and volunteer for a year. We traveled together to Panama Peru where we voluntered and taught English for 1 year. We've had our ups and downs and after a year travelling we were not ready to make a commitment. So he went back to Ireland and I returned to Texas.

Before making a decision we wanted to live together to be really sure. I didn't want to live in Ireland( the rain!) and he couldn't live in the states so we decided to live in Spain We have figured everything out are madly in love. Now we are ready to move to the states were I can pursue my career and he will work and go back to college.

Not sure how much of that is necessary but its our story:)

I will post some of my questions here as I feel overwhelmed by questions and doubts about this visa process.

Here are my question, any help will be much appreciated.


1. I have heard that the average time for the K1 visa to be issued is 7 months. Is that true? Not exactly. You first must get the I 129f petition approved stateside, which can take a few months on it's own. Then you go through the consulate which has it's own timelines (that tend to vary). Read the K1 flowchart on this site to get a better understanding of the process.

2. He was issued with a drink driving ban in September 2009 in Ireland (basically like a DWI, meaning he's banned from driving in Ireland for 2 years) -->How does this affect the greencard process? Will he be able to get a driver's license in Texas? The green card process? If he gets to that point, it shouldn't. I'll have to defer to other posters about how DWIs by the alien may effect the visa process itself, though. I'm not quite as up to speed on that as I should be.

And each state has different driver's license laws - Google it.


3. Right now in Spain we are both self-employed, off the record (private English lessons). When he goes back to Ireland, he won't have a job. I will probably have a part-time job in Texas (not making much). Will his unemployment history, and/or his unemployment in Ireland when he returns affect the application process? We do have a sponsor for K1 visa. His employment history is of little consequence, though there are a few forms along the way which ask him to list current and former employers.

My posting was to assist the OP with their question. The K-1 is a technically a "non-immigrant" type of visa and technically the I-134 is used. That was my only point.

And, I am aware that various consulates look for a higher % level than just the 100%. But, how did Costa Rica enter this discussion? The question was the OP's, not mine.

Since you brought up London, are you telling the group that the consulate there will deny the K-1 to a beneficiary if the petitioner earns over the poverty level plateau but not quite 125% at that moment? Which form do they ask for at the interview...I'm curious? Do they not give consideration to the fact that the petitioner or sponsor may receive a raise in pay/income, take a second job after their loved one arrives and they marry...or whatever?

Sorry - I somehow got you confused w/ the OP. I should have said 'your consulate' instead of Costa Rica.

London asks for the I 134 for K visas. As far as will they deny someone a visa if they don't hit the 125% - I can't say what a particular conoff will/won't do on any given day...not sure anyone can. I do know that, from anecdotal experience, folks have been sent away when they don't meet that criteria and asked to come back with a joint sponsor. Do I have links lined up in which to prove that - no. But it has been the general rule of thumb for London applicants as long as I can remember, and folks prepare their I 134s accordingly.

To my knowledge, London (and other consulates) prefer to take current situations into consideration over possible future employment. If they didn't, then they'd just be taking people at their words, and if circumstances were to change or not come to pass, then the alien could conceivably become a public charge. Probably not a chance they're willing to take.

I suppose the only case in which they might is DCFs, where the US petitioner is in the process of creating a domicile again in the US, and has a new job waiting for them. (Should mention, though, that in the case of DCFs, the I 864 is used - not the I 134).

Yes, but consulates take it upon themselves often times to apply 125% (London does this). I'm not sure what Costa Rica does. But also, as you must have 125% for the affidavit of support that accompanies the adjustment of status application (once he arrives in the US), it's best to get that in line now anyway.

Correction. 125% above the poverty guideline is equal to 225% "of" the poverty guideline. The requirement is 125% "of" the poverty guideline.

Further, the US Citizen petitioner is NOT COUNTED in the cosponsor's household size.

1) Your friend can be a joint sponsor if they are a US citizen or LPR (resident). It is OK if they live in another state. She needs to earn 125% of the total number of her dependents plus two (you and your fiance(e) plus your additional dependents like a child from a previous marriage of either of you.) She has to cover 125% of the total number of dependents involved.

2) I don't believe they will consider the job offer for your fiancee. There is no guarantee she will be hired and so on. You could send your current letter of employment, about six months of pay stubs (maybe less) and three years of tax records or transcripts. They might accept that. It depends on the Consulate.
Additionally if you have assets such as cash in a bank account or stocks and bonds you can use evidence of the assets to cover a short fall in income.

My guess is since she started - but did not finish - the process of applying for a green card, they denied her application and 'deported' her. Like perhaps they scheduled an interview date but she did not go (as she was back home by then). But there could be more at play - or not! - which is something I figure an attorney would have a better chance at unraveling.

How can a bona fide relationship exist? Well, through the course of emails, chatting online with and without video and telephone calls, emailing pictures of where we live and our daily routines...you get the idea.


Maybe you stated this above and I didn't catch it - but have you and your fiancee not met in person?

If not, that's a WHOLE other can of worms that could be coming into play in your case.

My fiancee currently resides in Iraq. The RFE was about explaining why we have not had a face to face meeting. As far as the background checks go, I think they have more to do with me than with her.


If your fiancee lives in Iraq, I sincerely doubt the checks have much to do with you. It may not be fair, but given where she resides, they're going to be extra cautious and make sure all of their checks clear before proceeding with the processing of your petition.

It cannot hurt to get your elected official involved but I bet they'll get the same stone wall of an answer. This is one I think you'll just have to wait out.

Patience is a virtue with immigration. Besides, by the time you reach the POE stage, you WILL be together - so I don't exactly get the need to try and marry before he even touches US soil. Saving $ on flights does make sense, but that's not how it works unfortunately! Maybe the K1 wasn't the way to go if that was a consideration.
