Look at the processing times. Its taking around 104 days now (average) but anyone can be ahead of or behind that window. 104 days is actually quicker than it has been in the last few weeks.

Just be careful with what information is given to you. Everyone (not on this site...but in my world...lol) told me all kinds of things. I'm a researcher and gathered enough information to be able to do it the right way and not make any mistakes. (I found VJ after I sent in my petition...:( ) Just we very careful and take your friend's information with a grain of salt and do your own research. Maybe they DO know someone that can get you moved up on the interview docket or something. I don't know. Just make sure you know what you're doing before you do it. And if you do find out a secret formula.....bring in to us!!!! PLEASE!!!!!!!!!!!!!!! Good luck!

Best advice, never listen to hearsay. no ones case is the same, and no ones case will be determined to a deffinate time of approval and arrival. dont get your hopes up on what her friends say, they are not going thru the process, you and your fiance are. if you listen to other ppl, you will get hopes up and when they dont meet your expectations, you will be disappointed.

There must have either been extenuating circumstances in that case, or it was a completely different visa type. And it may have also been pre 9/11.

There are very few ways to expedite a K1 case (for example, a military person who is about to deploy).

We'd all like this to be a speedy process and be with our loved ones ASAP. If this could be done in a month and a half, we'd know about it by now. Afraid to say you're grasping at straws here.

Ok starting on the 17th, my case has been touched every day except for Saturday. I looked this morning and I see it was updated on the 22nd....I really dont see them working on a Sunday....do they??? How long does it take to say...ok your approved now you can go on to the hell known as Casa!!! Sorry had to vent...reassurance needed!!!!

You can't call your service center - the only number available to us is the customer (mis)information line, which chasnik has called several times, as well as a rep from the congressperson's office.

I believe the last 'information' from the (mis)information line was that the case was with an officer - must be true from all the touches! - and they should hear something soon.

And yes, people here have gotten touches on weekends before.

I'm not saying what he said was wrong, but I'd seek another opinion. I'd want a clear answer on the status of my current case before deciding how to proceed.

I don't understand this sentence in your original post: "Now it's going into August and said that our case cannot be refuted and was recommended to refile." Who told you this? The CSC? Did you receive a NOID (notice of intent to deny)?

I'm not sure if you'll get to talk to the senator directly. Even our representatives' hands are tied to a certain extent when it comes to USCIS.

I've no idea what 'your case cannot be refuted' means. Sounds like a misnomer of some sort. If I were in your position, I would hire myself a qualified immigration attorney and find out what your next steps should be.

Thanks so much for your advice.

I understand what you are saying about convincing immigration I did not intend to immigrate. However would I be able to convince them that when I entered the US we were intending to continue the K1 route. However once we realized it would be very slow process and that I wanted to work as quickly as possible, we decided to get married. Could this be sufficient reason to show the immigration officials we did not intent to get married?

Would the fact I entered on a B2 tourist visa rather than under the VWP have any impact?

fwaguy is right. Also, the fact that a K1er can't work right away wouldn't be improved by marrying on VWP and doing AOS. You'd still have about the same amount of time in the states before you could work.

We all want to be with our loved ones sooner rather than later, but this is how it is. And actually - the process is now MUCH faster than it used to be, and in fact, the fiance/e visa wasn't always an option. Hard to believe that we should count our blessings, but truly, we should.

Esp. those of us with our loved ones from VWP countries.

Hi all,

Please can anyone advise me on the current expected waiting time for I-129F petitions. Our petition was received by the California Service Center June 21. 2007. According to the USCIS website the CSC on July 16 was processing 1-129F's from Jan 13, 2007. This would imply that we won't even bee looked at for another 6 months. Is this correct?

I assume it would then take from NOA2 at least 3-4 months before my interview in London. Am I correct in thinking this?

What would happen if we just got married in the US (I am currently visiting my fiance) and applying for an AOS?

You entered the US on the VWP with a K1 petition already filed. If you married now and then filed for AOS, you would have to prove that you did not have immigrant intent when you entered on the VWP. Hard to do seeing as you had a fiance visa petition in the works when you entered.

The date on the USCIS site is the date on the OLDEST petitions that they are working. That doesn't mean they're the only ones they're working on.

What fwaguy said about the timeline is correct. Also - our journey took 7 months from beginning to end; yours may be exactly the same, or a little longer, or a little shorter. Depends on a LOT of factors. The timelines here are probably your best ballpark idea for a timeframe. Have a look around the site at other folks' timelines, and remember that your mileage may vary.

Go by the date on the hardcopy NOA2. There have been several people who have reported getting an approval email a while after the actual approval. Seems to be some kind of 'glitch' in their system.

I suspect that the touches after the approval was them preparing your case to send it to the NVC.

Unfortunately, it IS taking longer lately to get from CSC to NVC. Not much you can do but wait.

No one can predict who may/may not get an RFE. You can get one even if your petition packet was complete - but USCIS loses a document.

There is also no straight answer for 'touches'. Some people have several while they wait - others have none until the day the petition is approved (like me).

Enclose a cover letter detailing what fees were enclosed and what date the case was postmarked and/or received.

I personally cannot say for sure yet. Our AOS is in its infancy (relatively). But the examples meow mix gave above are just a few indicators that there are still issues and complexities once the couple is together.

My fiance (now hubby) and I were apart for quite a while too, thank you, as were many others here. I don't recall saying that you should want to be apart from your fiancee. *shrug*

I was trying to understand how you could have come to that conclusion. A brief read through of the AOS forum should be at least some indication that immigration issues don't 'fall off' after the foreign fiance/spouse arrives on US soil. Sorry if I assumed you had at least read a thread or two there. I was simply pointing out that being together doesn't 100% of the time equate to immigration roses and clovers.

But I'll go away now and let you all fight over who is suffering more in this process.

I think the often used phrase 'Sheesh, VJ' is somehow very apt.

Meh. The visa journey timeline date is just a guesstimate based on recent timeline data. It really shouldn't be used as more than that. Unfortunately, the USCIS person is right - they cannot give you an estimate when you'll be adjudicated, so the best you can go on are the rough estimates here and how current timelines are shaking out.
