You can, but if the reason your I 129f was denied is not overcome, success of the CR1 is certainly not guaranteed.

Agreed - this could likely be the culprit. In which case, marrying and starting the I 130 process would likely be easier than trying to challenge the I 129f denial.

Anyone can request it, but USCIS generally grants it only in cases of impending military deployments or severe medical issues concerning one of the parties (for example, if the USC is very ill and needs the alien for a caregiver).

But you raise a good point, in general, I don't get why people go to such extreme lengths to find a wife/husband abroad and do not first make a good hard attempt at finding a partner that is already legally here, first... so you can spend a lot of time with them before getting married, get to know their friends and family if possible, see how they live, I can carry on because there are just soo many advantages of knowing your partner well before marriage... I have been married and divorced (to another USC) previously -and I can tell you that the amount of time I spent with him before we got married wasn't enough to clue me in to the trouble down the road. So that's not always the best measuring stick of success. LOL. But in general, I get your point otherwise.

It depends greatly what stage they're at in the process. 'Approved for a visa interview' makes no sense to me - does that mean an interview was scheduled but has not yet taken place? If so, contact the consulate immediately and tell them of the intention to withdraw support of the petition. If the visa has already been issued, that's another matter.

It also wouldn't hurt to email or write USCIS with the original case number (on his NOA1) with his intention to withdraw. Keep copies of all this documentation for his next K1 process - boy, he sure does get around...!

BTW he will need an IMBRA waiver since he will have sponsored two K1s in such a short time frame. See item 9 on the I 129f instructions.

No. The 125 percent minimum income requirement, the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.


This is correct. The main difference between the I 864 and the I 134 is that the I 864 is 'legally binding', meaning you could be sued in court to provide this support if you and your future spouse were ever to divorce. (How often that is done and how successful that is would be another matter, though...!)

However, my impression has been that most consulates apply the 125% guideline to the I 134, although that pretty much contradicts what is said above. So it is best to be able to document that at interview time. I wouldn't risk going with 100% only to get there and find out they would deny you on that basis. Plus, as you'll have to file the I 864 at AOS time, it's better to get that sorted out now with a joint sponsor. Just be sure your sponsor knows exactly what this entails.

The practicalities of 3 people surviving on less than $22k a year would concern me as well, but I'm sure you must have a plan in place to mitigate that.

You may be able to finish the whole process, interview, etc., then contact the embassy or DOS to explain you are serving and need an extension on entry date/ validity date. I wouldn't think it would be a problem. Then you'll know it's all done, all approved, and just waiting on your arrival back in the states. Your fiance would be able to fly immediately when you're done with your service tour.


Consulates can be funny about extensions. If you're going to go that route, I'd get them to confirm that in writing (likely email) so you have a leg to stand on after the fact.

I still think delaying the interview process is the easier way to go.

More to the point, your K1 PETITION was approved - not the visa. Only consulates can issue visas, which are good for 6 months.

I don't know of a way to delay things at the NVC (Dept of State) so you may want to delay the return of your documents to the consulate to better accommodate your timeline needs. It may not hurt, though to reach out and tell the consulate why you're doing that and make sure you don't need to do anything else to keep your application 'active'. Wait until they receive your file and then contact them.

According to time lines that I have read I am not really all that sure myself, just been crying and lost for the most part. I think that we maybe are in the NOA2 by now, for the received and now are going through the information that my lawyer provided, so confused and just lost. I feel so stupid sometimes with some of the questions that I ask here but hey, stupid is, is what stupid gets! I could care less if anyone here thinks that way of me. I have been just so overwhelmed and a lot of the short form terms that are being used here are confusing as all get out, if you know what I mean,lol!


Its always good to know where you are in your own process so you can manage your expectations. You can't be 'in' NOA2 - the NOA2 is simply the approval of your petition, but yet, an important step. Lawyers can be great but they can also put you in the position where you don't have your hands on your own case. They don't have a stake in your future like you do.

If you don't want to feel stupid, read the guides and flowcharts here, and ask any questions about the parts of those that you don't understand. Knowledge truly is power.

London routinely extends the date on NOA2s - generally, they have expired by the time most people get an interview anyway. All you need to do is both submit another 'intent to marry' letter at the time of the interview.

I'd call DOS and figure out what is going on. You will have a new case number now (starting with LDN). If you are stalled at NVC, fine - but it'd be nice to know that!
