I am new to this site so forgive me if I am posting in the wrong forum. My elderly Aunt, from the Philippines, married an American citizen two years ago and they were both living here in the States. He unfortunately passed away 2 months ago. They had completed the Green Card process but she has not received it yet. She is being told that she cannot receive his benefits until she receives the Green Card. Is this true?

Thanks to everyone for sharing concern.

Both my children have US passport. However he kept them all. With the 1st child, we both went to the consulate to pick up ROBA and passport, he just showed them to me at the consulate and kept them ever since. He told me that he needs to have my child passport to apply for her SSN, insurance and so on. No passport, nothing he can do. I live in VN, I do not know how things work in USA and I let him have the passport. As for the 2nd child, we could get the passport when we came back to the consulate due to some AP. In fact, I was waiting for him outside when he came inside to pick up the passport, I did not know that he already planned to have the consulate send him the passport to US by mail. He lied to me that we would have to wait for a few more days, he has to leave for US the next day, therefore we would have to pick it up when he return to VN next time. In sum, he has passports of my children as well as ROBA. For my up coming interview, he gave me copies of those. I have asked him to give me an original one of one of my children coz I am a mother, I have the same right. He said he would not send me any.

He's kind of controlling and self-important. Every time he's upset with me, he asked me to give him back whatever he bought me such as clothes, shoes and hide soap or toothpaste so that I have nothing to use. Much worse he won't let me put on clothes for the kids that he bought them, empty the kids' shampoo or body wash and so on. The last time he was angry, he took everything that are for the kids, such as clothes, shoes, dvd, toys, dvd player... I mean everything, dump them all outside of street and have people pick them up. The kids were crying like crazy, specially the older one, she said dada is bad. When he's calm down, he said he was wrong to do so, yet he was so angry. I can understand he's upset with me and he wants to get me back, the kids are innocent, a father should never done such thing. I am not saying that he has done nothing for us, when he's in a good mood, he goes shop for us, anything that we need like medicine, new clothes for the kids, milk and so on...

He hates so much the white. Awhile ago, he said his father was Persian (Now is Iran), for my interview he was trying to explain about his background, then he said his father was Canadian, mother was USC. He has many different citizenship because when he was young, his parents lived in many different countries. Overall, it sounds to me that he's ashamed of his background and where he came from. He has been talked big about himself, he's better than thousand people out there, he has knowledge more than any white people, most of them live in US, yet know nothing about the country and so on. He said to me that he intend to become a lawyer, he already studied for 2 years. He's very controlling, I am afraid that he will take the kids away from me once I'm in the US because I am not a citizen, has no money, I am not in a potition to provide them things as he does, therefore he will be in charge of the kids. I can't afford to lose my children, they are reason I am here now today.

There's many time he threaten me, he will prevent me from going to different country. I already told him that I've changed my mind, I will not go to interview. I will stay here in VN. It's my own decision. He said he was not upset ... From deep down I know he piss off, he said I am stupid, I do not care about the future of the kids, I prevent them to have a better future, live in a safe and healthy environment. It's not true, he is the one that made decision to have the kids to be born here and grow up without him until now. At the same time he speak scornfully of VN and specially his own children, because they are also Vietnamese.

Since he already refused to send me passport of the kids as well as have plan to destroy me. I will not allow him to talk to the kids anymore. I don't think he deserves. My kids have been growing without him, they speak more Vietnamese and little English, it would make no difference if they do not talk to him. I'm FREE

I have read your post and man.. this is not good. I also think that the right choice was made. To have someone also speak scornfully of the kids - can he get any lower... he is curing his own blood, is he stable in the mind? Perhaps at ths point the questions maybe best left unanswered since a decision was made.

My sis the petitioner for our mom the applicant . my sis call the 1 888 to set up an follow up interview for our mom she buy the pin over the phone an then set u the inteview they give her a number an tell her to give my mom an when my mom coming to the interview she present that # in order to be interview, when my mom get at the embassy today the security didnt let in side tell her that her name is not on the interview list.. what should we do now that she miss her follow up interview??

i know,i personally ( i have to throw this in there,cause im not speaking for everyone or even intending to ) wouldnt mind one bit if AT LEAST 130s would go through,anyone that is dealing with CSC at the moment,for whatever reason understands,and people who got their packages through within the five months frame commenting about how we should just wait and our complains are pointless are the ones who annoy me to the root.


DONT LET small things "annoy" you there are other things out there of greater importance.. I WISH for alllll of you people and the others to get their petitions Approved... have to start another I-130 process for lil brothr so the more USCIS gets approved.. the quicker our case file would be approved.... it is just that simple.

Hi Ricardo, I don't agree with your position. There is no way a 5 month or 7 year wait can be acceptable. We all pay a good portion of our incomes in taxes for our government to serve us. The service we are getting is not commensurate with the taxes we pay. I just isn't right and I don't see the problem ever being fixed. The obnoxious behavior of the USCIS and embassies is unacceptable, but nothing can be done. Only our government can get away with what they are doing because they have all the power in this situation. The government is supposed to be for the people. Now that we are in the electronic age the process shouldn't take more than one month for a properly prepared petition without any red flags.



1 or 2 months would be nice.. but never possible (just sayin') there are many checks to do and I'd like this done..so that as a means to help keep the country safe. FBI name checks/other doesnt go through that quickly. You joined back in June 2010... you probbely have seen the one posted (female) who said her boyfriend's familyis sending him to his home country to marry his sister.. She would be using a dead person's name as to gain immigrant status to the USA.. See because we have people like this in the world.. it makes the process a lil lengthy... hope you can see that. So that's why the USCIS/Consulate require all these evidence and endless interview questions... poppiing up with Stokes.. many hoops to jump thru.

For me a 5 months wait is kool... still faster that MOST countries a 7 year wait definately isnt.

im a july filer,only two people from july have been approved so far,so please,explain to me,WHY there are nearly 120 people ONLY on VJ ( you need to realize it represents a small sum of the petitioners ) waiting for their second notice of action?
no one is doubting CSC workers,people are doubting how effective this whole process of changing focus is.
and yes,i dont give ####### about any other visa and processing time either than k-1,and i can assure you if my package and my processing time go over 5 months i am personally going to raise hell,the amount of stress and pressure put on the petitioners is insane.



"Ummmmmmmm, No" Your assumption because No Where in my text was it mentioned that the system was flawless. BUT people who have always dealt with any process of immigration know that it's a rather costly, and time-comsuming project that's not to be rushed. What I said Specifically was if USCIS gives a clear processing time frame of 5 months why not wait and only when the time is going to pass of has passed should the concern be risen. Ofcourse I understand the need to be unified, no questions there - but there are processes to follow.


I grandmother petitioned for her daughter back in 2003... well uscis NOA1 said the proess would be completed in 999 days .. that's 2 years and 291 days.. that was back in 2006.. NOTHING was approved and we submitted inquiry after inquiry. hmmm still nothing. Have not thought about getting a congressional pull perhaps they would have been here back in 2007/8. The petition was Approved in August 30, 2010.. so 4 years longer. So the system not beiing flawless.. this I know so that's why in Feburary a USC -son.. petitioned for a parent and now they are awaiting interview on 11.1.10 while the Case is at the NVC for another 1.5-2 years... even through all this one must be humble. Many people as your self per your signature just met and got your green cards last/this year NOT knowing the true test for those who may have placed a case file with immiration and still after 7 years nothing has happed. Even so - though we have been tested.. no need to blast the INS/UCSIS that has in some way help family and friends of mine.

On what are you basing this? The employees at the CSC work 10 hour days, 4 days per week. They have not reduced their staff and they have not reduced their hours. Do you think they are all watching TV? They are producing the same that they always do. It is not unusual for the centers to shift focus from one type of petition or application to another as demand dictates but that is hardly a "slowdown" Trying to trend the processing of K-1s based on the most recent information is silly. That is only bound to change. It is like saying "Gee it has been real warm the last 3 months, so why is it getting cool now?" Better to average it over several years to take in all cycles.


Goood job... I dont see a slow down. my cases were approved within the 5 months that is listed on the website for csc. Even though my application was approved in 3 months and 27 days.. At 3 1/2 months I cant recall tryin to make the sysem go ANY faster when A time is already given (5months)... people Should become worry IF the came gets outside the processing times.. but many are too quick to jump the gun. :bonk:

No one can rush the 5 month GIVEN time frame*.... USCIS website does not say petitions will be approved/denied in a certain time of 2 weeks etc... but does say petitioners can expect the cases be processed in 5 months. So if an applicant get an approvaed case in 3 months.. DONT get MAD.. not all applications can be approved in 3 month.. ESPECIALLY when you know the other person lives or comes from a country that does not KEEP good records etc and the us comes up with info that are conflicting... their background record - when check is all screwed up because of all the wrongs he/she have done and all the other works..

People can HELP to make their cases go sooomuch smoother if only they SUBMIT as much INFORMATION about their cases as possible.. one of the form that allow for this to be possible is the Form G-325/A though it was not requested I submitted it anyway... and the person reviewing the case can crocess reference in their search engine if they need to mame a conclusion... do dont get mad when others get a rather fast approval and you're stuck on 6 months... Many people are Quick to submit their I-129F/30s without doing the necessary research.. not reading enough. :bonk:

There isn't a separate box for "clear as snow" petitions. USCIS is receiving close to 500,000 petitions a month so which one of the "clear as snow" petitioners gets to go first? If you want to a more accurate target for your frustration, it would be all of the rest of us petitioning for visa benefits. Personally, I think a 5 month wait when there are 1.5 million pending petitions is acceptable. Good luck with your NOA2. Maybe it will be in one of the more productive adjudicator's queue.

Kinda old stuff but ive long said that 5 months =acceptable. Most applications are approved within 5 months. Those that must wait Will wait no lawyer etc cant speed things up.

I don't know why one would think it's unfair. They have an estimate of up to 5 months. Whether they do it on day one or the day before the 5 months are up, their projection is still accurate. :thumbs:


I think that as LONG as they are within the 5 month processing times... we outta just hang up and let THEM do their thing. Now should the processing be outside the 5 months quoted then concerns should be brought up.

I think for the most part, CSC is within their 5 month processing times. I know there's quite a few people outside of 5 months, but there's a LOT more that are within the 5 months.
I think the reason a lot of us are impatient is because the stats from VJ say that historically, the overall average for 129-F petitions are however many number of days... 70-something is it?
But, most of are still within the 5 month processing times.

The processing times USCIS gives as "5 months" is just for the I129-F petition. That doesn't include the time it takes at NVC and your country's consulate, to actually issue the visa . The USCIS has no bearing over how long individual consulates take to schedule an interview for the visa issuance.

That being said... I hope we all get approvals soon!

and for the added comfort ... I submitted 2 I-130s back in march for my parents and conpleted the USCIS and the NVC stages and the CONSULATE stage and did not get a RFE... that was made possible by reviewing what I'm submitting as requested.. it's simple.
