The originals you send to the NVC (birth cert etc) will be returned at the embassy.

Where the heck do you get your information..? No need to respond just thought I'd put that out there.
The originals are not returned.. matter of fact .. sure DHL will give them to you in a sealed envelope only to be taken and turned over to the immigration officials upon entering the USA. - still will not get them back.. Jamaica will not give it back to them to have - to keep.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo you get the important documents back?

When pictures, and certificates, and other important documents are sent in is it possible to get them back?

The originals / submitted documents are not returned. You can send a request to USCIS AFTER the person enters the USA and request for the originals which they may take about 4-6 months to be processed - that you still may nor get back. you will use form G- 884.

IR-1 / CR-1 Spouse Visa Process & ProceduresCopies??

When filing the initial packet am I supposed to put a copy of the certified marriage certificate or just make a copy of that. I was under the impression we would send the original at a later date but just want to make sure as I'm putting the finishing touches on this today....hopefully tomorrow I will be actually sending it.

A copy will be accepted. Matter of fact many of the documents that are submitted initially are copies.

there is no online portal provided by the NVC that gives a case status such as th NVC. Your husband can email them .. but it is not effective. A phone call is quick and he'll receive a faster reply.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan I keep my Green Card on hold?

Thanks.

So once I get my re-entry permit I can stay outside Usa as long as I need, and once I am able to return I can start working in America right away?

Yes if you apply for a re-entry permit then you can stay outside the country for up to 2 years without visiting and yo must be in the country when you apply. The permit can be sent to your US Consulate.

How long does it take to become citizens, after I get a 10 years green card?

It takes 5 years to become a US Citizen typically however if you are missing for 6+ months then you will need to add that to the back end of the residency requirement.

If I have to leave Usa, with a re-entry permit in my passport, is the count of the required time to apply for the Us citizen put on hold?

the hold starts basically if your visit goes over 6 months.

IR-1 / CR-1 Spouse Visa Process & ProceduresShould I make one more trip or not? Help!

Consider the amount of time you have until you actually interview at the embassy - you can file with what you have now, and make another trip when you are waiting for approval - then at the interview you will have more pictures and further proof.

IR-1 / CR-1 Spouse Visa Process & ProceduresBig problem, please help

Checking YES may cause a delay in your being together , checking NO may keep her out of the US forever. They will know about the charge and if you lie then she will never be able to come. If you check yes they will check at medical if it is a thing of the past.

IR-1 / CR-1 Spouse Visa Process & ProceduresApplying for CR-1 while abroad

Have you filed for a K1 yet? If you were to withdraw it and file a CR-1, you go back to the start. Any time you have spent waiting will have been for nothing.

You can send the paperwork from abroad, although you must maintain your US domicile. If you are a legal resident of your spouse's country for 6 or more months, then you could be eligible for DCF (Direct Consular Filing).

Ok I have a question.

My friend filed for her stepson in Jordan. He went in for an interview, not sure of what was said. However it was later revealed that the case was sent back to the National Visa Center, and that a letter would be sent. We have not received anything. I am thinking that I need to contact the DOS and National Visa Center. Or what should we do.
What is the contact info for both places.

Thanks my VJERS

IR-1 / CR-1 Spouse Visa Process & ProceduresFiling tax return as single this year is spouse live outside USA
If, at the end of your tax year, you are married and one spouse is a U.S. citizen or a resident alien and the other is a nonresident alien, you can choose to treat the nonresident as a U.S. resident. This includes situations in which one of you is a nonresident alien at the beginning of the tax year, but a resident alien at the end of the year, and the other is a nonresident alien at the end of the year.

If you make this choice, the following rules apply:

 • You and your spouse are treated, for income tax purposes, as residents for all tax years that the choice is in effect
 • You must file a joint income tax return for the year you make the choice
 • Each spouse must report his or her entire worldwide income on the joint income tax return

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved. Now what?

Right. That's where everything is now. Back when we applied for the visa, we were advised by USCIS not to apply for the fiance visa because they said it could delay the process of the visa. So, as a result, we didn't submit it. Now, 8 months later, we are still waiting. I guess I just want to know how much longer we should expect it to take now that the case has been forwarded to the NVC. Of course, I wish we had done things differently, but it seems there isn't anything we can do about that now. Any information would be so much appreciated.

below is the flow that you should expect and the form etc that will be requested.

No. He is in Mexico. We were married in the US, but we both lived in Mexico for the first 8 years of our marriage. I moved back to the US to set everything up last year. He is waiting in Mexico in the meantime.

well when the review period has passed the case will be forwarded to the National Visa Center where the second phase of the process will continue.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 approved. Now what?

After 8 months of waiting, I finally got news that the application for my husband has been approved by USCIS and that the case is being passed on to an appellate body for further review. Apparently this is the point at which a background check is done. We have been married for 8 years, and neither of us has a criminal record. How long does this kind of thing usually take? Also, I have an appointment at the local Infopass office tomorrow, but now that the I-130 has been approved, I wonder if they will be able to help me there? Any ideas? Thanks so much for any information you can give.

is this for an Adjustment is Status ?

Hello,

A simple question please:

In the form DS-230 Part 2, for Question 39, It says to enter Petitioner's Name and Address.

However, it does not say in the next set of columns: for Telephone number and Email, it's meant for whom?

Petitioner or Applicant?

Thanks a lot,

Hi every1... im tryn 2 see if any1 fr jamaica .. Knws the time frame 2 get a interview fr the time case complete. Which was ( april 7) b/c im due the end of may n would love 4 my hubby 2 be there.. It will mean so much 2 mi... Our 1st son was born 2009 .. N i wanted him there as well .. But we all knw how life is at times ...:( ... if any1 can give mi something... Thank u sis&sull ......

Your interview is going to be sometime between May 2nd - 15th... very likely.. The consulate isnt back up so that's good. You are likely told by the officer when you would be able to travel. Your husband will have to be in Jamaica if the child is born after your interview so sign certain documents that would given him certain citizenship.

IR-1 / CR-1 Spouse Visa Process & ProceduresSisters Visa denied

So my sister dated this guy 4 years ago and they have been on again off again until about a year and a half ago. They got married April of last year and they filed late 2010. she got her work permit and applied for her social but her interview was yesterday and they fail the interview. The thing is he lives in FL and she lives in NY, in December right before she was about to visit he told her it wasn't working anymore and she found out he has been living with a woman. My hubby did the affidavit of support and even though they are legitimately married they seem not to believe because her husband was able to answer a lot of stuff they asked him so I'm a little worried. Now she said they called his job and wants to talk to him and the woman he was living with because they found out about her. What can she do?

didnt seem like a case that should have been filed. They were married but never lived together, The 4 years of dating does not carry much weight. The husband was able to? or not? she can get a lawyer as sus said but might be a waste of money if they had no minglings of life after the marriage.

IR-1 / CR-1 Spouse Visa Process & ProceduresWTH... Info needed

Ricardo, I did file a separate I-130 for the baby. I followed your directions. It was approved!!!! on 4/6/11.I was saying that now they have sent my husbands petition back to USCIS after it was approved.. which is real funny.

Lol I know hehehe I'm happy. I was quoting the person above my reply.
RICARDO4EVA2MaleJamaica2011-04-15 00:58:00
IR-1 / CR-1 Spouse Visa Process & ProceduresWTH... Info needed

This is really similar to our situation. In our case a professional prepared our CR1 I-130 as if it was K3 and included our son as a derivative K4. Of course USCIS approved my wife's and just ignored that my son was included in the petition as an intended derivative.

you needed to have filed a separate petition for the CHILD .. as stated in the instructions. listing the child on the application does nothing than letting USCIS know they "hey i HAVE A CHILD." That does help the immigrant would would later petition for the child .. so no surprises.

Exactly, Darnell.. and mind you know one can give me any info. NVC sent my husbands back to USCIS. I would like to think that USCIS is also holding my step-son's there to. As I stated I never recvd a ref while my husbands petition was pending.I paid the NVC $88.00 AOS fee. I know it has nothing to do with the embassy, because it never maid it there. I was waiting til my step -son's petition was approved, so I could pay both IV bills and send the proper paperwork in at one time. Am just sooo frustrated with this process, I had to come home early today.
